GRANT OF PERMANENT EASEMENT
Richard B. Recker, III and Karrie L. Recker, husband and wife, hereinafter referred to as
"Grantors", in consideration of One Dollar ($1.00) and other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, do hereby grant unto the CITY OF
EDINA, a municipal corporation organized under the laws of the State of Minnesota, the Grantee,
hereinafter referred to as the "City", its successors and assigns, forever, a permanent easement for
public drainage and utility purposes over, across, on, under, and through land situated within the
County of Hennepin, State of Minnesota, as described on the attached Exhibit "A" and depicted on
the attached Exhibit "B".
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the easement premises at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public drainage and utility systems over, across, on, under, and through the easement
premises, together with the right to grade, level, fill, drain and excavate the easement premises, and
the further right to remove trees, bushes, undergrowth, and other obstructions interfering with the
location, construction, and maintenance of said public drainage and utility easement.

The above named Grantors, for themselves, their successors, heirs and assigns, do covenant
with the City, its successors and assigns, that they are well seized in fee title of the above described
easement premises; that they have the sole right to grant and convey the easement to the City; that
there are no unrecorded interests in the easement premises; and that they will indemnify and hold the
City harmless for any breach of the foregoing covenants.
IN TESTIMONY WHEREOF, the Grantors hereto have signed this agreement this

GRANT OF PERMANENT EASEMENT
That part of the following easement description that lies within Lot 2, Block 1, Morningside Manor,
Hennepin County, Minnesota:
A public drainage and utility easement over the North 5.00 feet of that part
of Glenhurst Avenue being 50 feet in width, as dedicated in the recorded
plat of MORN-NOME MANOR ADDITION, Hennepin County,
Minnesota lying north of a line between the southeast corner of Lot 2,
Block 1, and the southwest corner of Lot 1, Block 2 and south of a line
between the northeast corner of Lot 2, Block 1 and the northwest corner of
Lot 1, Block 2, said MORNINGSIDE MANOR.
AND
That part of the following easement description that lies within Lot 2, Block 1, Morningside Manor,
Hennepin County, Minnesota:
A public drainage and utility easement 20 feet in width over, under and across
unimproved Glenhurst Avenue, the centerline of said easement described as
commencing at the southeast corner of Lot 2, Block 1, MORNINGSIDE
MANOR; thence North 89 degrees 58 minutes 51 seconds East assumed
bearing along the north line of West 42nd Street a distance of 25.00 feet to its
intersection with the southwesterly extension of the centerline of said storm
sewer; thence North 00 degrees 38 minutes 17 seconds East along centerline of
said storm sewer a distance of 150.00 feet and there terminating.

GRANT OF PERMANENT EASEMENT
Richard B. Recker, III and Karrie L. Recker, husband and wife, hereinafter referred to as
"Grantors", in consideration of One Dollar ($1.00) and other good and valuable consideration, the
