MINUTES of the Regular Meeting of January 28, 1957, were approved as submitted, by motion Dickson, seconded by Bank and carried. SERGEANT HENRY WROBLESKI was publicly congratulated by the Council upon his completion of the International City Managers' Municipal Police Administratioti Course. ANARD OF BIDS TAKEN FEBRUARY 11. taken this morning on a PUMPHOUSE FOR CELL NO. 7; WELL NO. 9; and certain INSURANCE requirements. until February 25, in order that more study could be made, and Dickson so moved. until Consultlant Banister's arrival, and it was decided so to do; then, later in the evening, after Mr. Banister's arrival, the following reports were made and action taken: 1. WELL. It was noted that bids had been taken on Four Conditions and their alternates. Mr. Hyde explained lthat conditions specify the following types of wells - No. 1 - The same type of well we now have. No. 2 - Casing off at the Shakopee strata, as is now advocated by the State. 'No. 3 - Deeper well, going down to the Hinckley strata. strata, with provision for casing later if we have to do so1 all cases, are for wells with screens. Mr. Banister recommended that Council award contract on Condition No. 3. will secure water with considerably less iron content and that the water will be only about half as hard as the present supply. Waterworks Supt. Woehler stated he feels that within another two or three years another well must be drilled, and that with two or three of the deeper wells we could supply the normal demand for seven or eight months of the year, thus cutting the expense of water treatment during these months. Manager Hyde recommended award of contract to low bidder, Keys Well Drilling Company, at $29,993.00, without screen. with Ab. Banister reporting that it is usually not necessary; that a test run is made immediately upon completion and that screen can be added at that time if it is found necessary. Bank's motion, accepting Manager's recommendation and awarding contract to Keys Well Drilling Company at $29,993.00, was seconded by Tupa and carried. 2. PUMPHOUSE FOR WELL NO. 7. Manager Hyde recommended award of contract to Adams Construction Co., Inc., in the amount of $9,853.00, for a brick pump- house, his reason being the completion date of April 15 specified by this bidder as against that of July 1, specified by the low bidder Lloyd D. Wick, Minneapolis, who bid $9,739.00 for this work. ].Bids on the frame alternate by theseitwo bidders were Adams, $8,865.00 and Wick, $7,806.00. Mr. Hyde's reason for recommending the brick was the saving in maintenance costs. to fact that present bids are some $2,000 lower than those taken 1astkFall for the same work. Mr. E. C. Bank's motion, accepting Manager Hyde's recommendation and awarding contract to Adams Construction Co, for the brick pumphouse, was seconded by Dickson and carried. PERMANENT BAN ON SPRINKLING. In connection with award of bids on well and pumphouse, Manager Hyde asked that the Council give thought to imposing a permanent ban on water sprinkling during the summer months--either from 4:OO to 7:OO P.M., or on an every-other-day basis. make this recommendation because he feels water consumers are entitled to all the service which the Village can give them, he added that he feels it is no longer practical or economical to make provision for the large load which unregulated sprinkling places upon the system. water consumers use 700,000 to 800,000 Gallons per 24-hour period during the non-sprinkling period, as against some 6,000,000 Galons during the sprinkling period. D-'ARCY LECK PETITION FOR REZONING-STRIP ON \'I. SIDE OF FRANCE AVENUE, FROM W.70TH STREET, SOUTH. petition on grounds that rezoning is unconstitutional because it does not comply with Village Zoning Ordinance, and to deny the plan on its merits as well, was read and discussed. Consideration was had by the council on that part of the Zoning Ordinance which has made this plan "unconstitutional", being, namely, the clause, "No property located within one-half mile of any property thereto- fore zoned as a Regi6nal Shopping District shall be zoned for any use other than Open Development District". would not hold up in court, moved that the Ordinance be amended to exclude the clause. PRELIMINARY PLAT OF IDYLROOD THIRD ADDITION was presented, together with Planning Commission's February 6th recommendation that it be approved subject to correction by Nr. Hyde noted that his plat carries no dedication for Park and Playground and suggested that Council approve plat subject to such dedication. Tupa so mored. Kotion seconded by Bank and carried. PEARSON BROS.' REQUEST TO BUILD DOUBLE BUNGALWS ON LOTS 13,14,15 AND 16, BICHJOND HILLS THIRD ADDITION khas received the Planning Commission's recommendation for denial, hlr. Hyde reported. Bank's motion that the Commission's recommendation be kaccepted was seconded by Tupa and carried. FINK PLAT OF LUCE'S HIGHVOOD ADDITION. carrying Planning Commission's recommendation for approval, and Tupa moved accepting Commission's recommendation and approving plat. Motion seconded by Dickson and carried. PRELIMINARY PLAN FOR LEDICAL CENTER AT 66TH AND FRANCE was presented by Manager Hyde as a matter of information. This final plat was presented, No action taken. INDUSTRIAL PARE PETITION APPROVED BY PLANNING COMdISSION. the Planning Commission's action of February 6th, recommending approval of the Peterson-Hanson petition for rezoning to "Industrial Park" a certain specified area South of tJ.70th Street and between Normandale and Cahill Roads, knom briefly as the B.B. Nelson Fab, Bernard TI. LaBeau Farm and J.A. Danens 8 Son Inc. acreage. Recommendation stipulates a zoning ordinance amendment restrict- useage. Several persons in the audience asked for an opportunity to read the Gardner Report. Manager Hyde reported 211 1/57 Council informed the audience that there are-not sufficient copies of the Gardner Report to give out, but that anyone interested might read the report at the Village Hall, or that an over-night loan could be arranged; that all material available to the Council can be seen at the Village Hall. Some urged that PJr. Gardner be asked to appear at any public hearing to be held, but council demurred, stating that examination of the report should answer any questions as to Mr. Gardner's stand on this matter. Dickson moved that Council take Planning Commission's recommendation under advisement. Motion seconded by Thpa and carried. After some further questions from the audience and discussion by the Council, Bank moved that a Public Hearing on the matter be scheduled for Friday, March 8, 1957, at 7:30 P.W. at the Village Hall. Trustee Motion seconded by Tupa and carried. EXTENSION OF BUS LINE. ;.Twin City Rapid Transit Company's request for permit to extend its bus line on Wooddale Avenue from W.60th St. to W.62nd St.; On W.62nd St. to Concord Ave.; on Concord to liV.6Oth St.; and on VJ.60th St. back to Wooddale, was reviewed. Mr. Hyde explained that the Company has received complaints from persons in the area about the waiting time, and the wyeing of the buses at 60th and Vu'ooddale and that this plan should largely solve both problems. extension. carried . Clerk and Manager presented Assessment Rolls for Storm Sewer Improvements Nos. 29, 31 and 33, asking that Council confirm Clerk's action in publishing Notice of Hearings for February 25. BY ORDER OF THE VILLAGE COUNCIL. GRETCHEN S. ALDEN COMPLAINT ON WATER' - KEITH L. CARLSON. with directions given at the last meeting, the watermain at 6021 Chowen Avenue has been dug up; that connection has been found to be satisfactory, coming from the top of the main; that there is no sag in the main; that the washing machine has been taken apart to see if this was causing the trouble; that the Carlsons do have a permanent water softener and that it is thought that the trouble is caused by this equipment; that it is our opinion that the Carlsons' trouble arises from no fault of the Village. No action taken. PLEA FOR RELIEF FROM ASSESSMENT-LOT 6, BLOCK 2, NORMANDALE COURT. Pursuant to Council's referral of this .plea to Village Attorney for his oplnion (by action taken January 28), Manager Hyde reported he has received attorney's opinion to the effect that action cannot be taken to relieve assessment before the actual public hearing on the individual assessment. recommendation was seconded by Dickson and carried. petitioner . He stated the improvement would cost approximately $80,000, which would mean ll$ per square foot to all properties within the drainage area, or approximately 154 per square foot to the business district if the residential properties were excluded. because of the number of utilities already installed. In accordance with Mr. E. C. Motion seconded by Tupa and carried, PROPOSED LIQUOR ORDINANCE AMENDMENT (NON-INTOXICATING MALT LIQUOR) was discussed. Dickson offered the following Ordinance, moving that the Council waive second reading and adopt Ordinance as read: ORDINANCE NO. 131-3 AN ORDINANCE AhENDING THE LIQUOR ORDINANCE OF THE VILLAGE OF EDINA AS TO THE NUd3ER AND TYPE OR PERSONS WMO MAY BE GRANTED ON-SALE LICENSES FOR THE SALE OF NON-INTOXICATING AWT LIQUOR, THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS: Village is hereby amended to read as follows: Section 1. TREE REPORT-AUTHORIZATION TO ADVERTISE FOR BIDS FOR SPRAYER. detailed report on present condition of trees, which shows a heavy infestation of scurby scale, substantial infestation of lecanium scale, and some cottony maple scale still present. On the basis of this report Mr, Hyde recommended that the Village purchase a tcvo-hose spray (which will enable spraying to the top of the trees) at a cost of some $3,500, and purchase of a carload of spray at about $1,400. Dickson's motion, authorizing advertisement for tvio-hose spray was seconded by Fronk and carried. Ab. Hyde presented HEARINGS ON PROPOSED CURB AND GUTTER IMPROVEMENTS. plans and estimates of cost on several curb and gutter projects, asking permission to advertise for public hearings on February 25. Engineer Zikan reported that Minneapolis has requested permission to enter France Avenue on the Edina side-- at W.50th Street to remove a 48" gate valve, and at W.49th Street to clean the watermain; that operations will take about a month. it will be necessary to re-route traffic while this work is going on. discussion was had as to negotiating with Minnea olis as to other matters; namely, prohibition of parking on France Avlenue at W.492- Street, and possibility of Edina's entering Minneapolis Storm Sewer; and the matter of opening France Avenue was finally left with Ab. Zikan for settlement at his discretion. He reminded Council that Some !? I RESOLUTION OPPOSING BILL PLACING RURAL HENNEPIN COUNTY ON COUNTY RELIEF SYSTEM. Receipt of a resolution adopted by Hennepin County League of Towns and Municipalities, opposing the bill placing Rural Hennepin County on a County system of direct relief, and the League's recommendation that Rural Hennepin County municipalities adopt a like recommending resolution, was reported by IVIanager Hyde. Discussion was had as to the disadvantages to Edina of the County relief system, and Dickson offered the following Resolution and moved its adoption: RESOLUTION OPPOSING COUNTY RELIEF BILL IHEREAS, placing Rural Hennepin County on a County system of direct relief, to be administered under the County Welfare Board, would not be in the best interest of Rural Hennepin County, or of the Village of Edina; County, Minnesota, go on record as opposed to the adoption of County Relief Bill- H.F. 72 and S.F. 60, introduced in the 1957 session of the Minnesota Legislature. Engineer Zikan reported that detailed plans and specifications for this large project will be completed, with possible exception of the l&ft station, in time to take bids March 11. Dickson's motion,that Council schedule the taking of bids for Trunk Sewer Improvement No. C-1 for Monday, March 11, 1957, at 11:OO A.M., was seconded by Fronk and carried. RECOMENDATION ON POOL. on costs of constructing swimming pools within the state, using Vlayzata, Hastings, Redwood Falls and West St. Paul and Idloorhead as examples. Park Board's recommendation that the Council construct a pool to serve a population of not less than 30,000. Recreation Director French presented a detailed report He stated it is the Trustee Bank was excused from the meeting during Mr. French's report. AUTHORIZATION FOR SALE OF PARK SYSTEM AND IMPROVEUENT BONDS. Dalen presented to the Council an analysis of the suggested maturities and other provisions for the Park System Bonds which are proposed to be issued in the amount of $700,000, pursuant to the authorization by the voters at the February 5 election of bonds in the aggregate amount of $850,000, and of the Improvement Bonds in the amount of $1,300,000 which are proposed to be issued to finance Sanitary Server Improvement No. C-1, and recommended that said bonds be sold together, opening bids therefor at the Council's lmeeting on February 25, 1957, at 7:30 P.L Finance Director's proposals were duly considered and discussed, and upon motion duly made by Fronk, seconded by Dickson and carried by the approving vote of all members present, said proposals were approved and the Village Clerk was directed to cause notice of the sale of said bonds, at the Village Hall at 7:30 o'clock P.M. on February 25, 1957, in the amounts and subject to the further terms recommended by the Finance Director, to be published in accordance with law; such bonds to be sold in the amount of $700,000 for the purposes voted by the electors February 5, 1957, and in the amount of $1,300,000 for the purpose of financing Sanitary Sewer Improvement No. C-1.
