CONDEMNATION OF EASEMENTS FOR SANITARY TRUNKSEWER IMPROVJENT NO. C-1 Engineer Zikan explained that it has been impossible to negotiate for certain very necessary sanitary sewer easements; that it is imperative, now, that these easements be acquired, in order that the project can proceed. Trustee Fmnk offered th'e following Resolution and moved its adoption: RESOLUTION FOR CONDEMNATION OF EASEMENTS Fog SANITARY TRUNK SEVER IMPROVEPEPST NO. C-1 . WHEREAS, It is necessary, advisable and in the public interest that the Village of Edina lay out and establish a certain sanitary sewer system; and WHEREAS,- in order to accomplish such purpose, it is necessary to acquire easements -for sanitary sewer purposes in, under and upon certain real property situate in the Village of Edina as shown on the map or plat attached hereto as Exhibit A and made a part hereof; and ments from the above owners of the property shown on said map or survey have been unsuccessful; and WHEREAS, The Village is advised and believes that the most feasible location for said sanitary sewer easement is across the land as shown on said map or survey; and NHEREASj By reason of the failure of the Village to obtain such an easement, it has become necessary to procure title to such land by right of eminent domain. NOW, THEREFPRE, BE IT RESOLVED That the Village of Edina proceed to procure easements in the property shown on said map or survey under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary complaint therefor and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the Village or by the Court; that the Village Attorney, the Wayor and the Clerk do all things necessary to be done in the commencement, prosecution and successful termination of such action. I VIHEREAS, The efforts of the Village of Edina to obtain such ease- Motion for adoption of there were- four ayes Tupa, aye; and PROSECUTING ATTORNEY FOR VILLAGE. to secure Mr. Roy for daytime work; that it will be necessary, soon, to appoint someone for this position; that he has three persons in mind. Discussion was had, but no action taken on appointment. Llr. Hyde'then stated he would like a directive to appoint a "temporary" prosecuring attorney for the prosecution of one case which will come before the Court this week. Authorization €or employment of 'ltemporaryn prosecutor given, and Llr. Hyde asked to present recommendation for full-time prosecutor as soon as possible. Alanager Hyde reported that it is impossible SYX4LIING POOL SITE ACQUISITION. '. Manager Hyde reported on a meeting concerning the possible purchase of a plot on the site of the preliminary plat of "Southdale 4th Addition"; it being the- Park Board's recommendation that the Village offer $50,000 and, if necessary, Q3 to $75,00O;for this area of about 25 acres. Council was of informal opinion that, since $50,000 was established in the bond issue proposal as the cost of the swimming pool site, this should be the limit of the expenditure therefor. Manager Hyde asked to find plan shoeing proposed "park dedication" as set forth in Southdale's original development proposal. lilanager Hyde suggested a meeting with the Park Board at 7:OO P.M. on Lqonday, Nay 13, to which Council was agreeable. There being no further business to come before this meeting it was adjourned at 5:50 P.M., by motion Tupa, seconded Village Clerk
