HomeMy WebLinkAbout19570708_regular7/8/57 MINUTES OF THE REGULAR MEETING OF THE EDINA VILLAGE COUNCIL, HELD MONDAY, JULY 8, 1957, AT 7:30 P.M., AT THE EDINA VILLAGE HALL Members answering Rollcall were Bank, Dickson, Fronk, Tupa and Bredesen. Minutes of Meetings of June 5 and 24, and July 1, 1957, were approved as submitted, by motion Bank, seconded by Dickson and carried. PUBLIC HEARINGS ON PROPOSED IMPROVEMENTS, Clerk presented Affidavit of Publi- cation in Edina-Morningside Courier June 27 and July 4, 1957, of "Notice of Public Hearings-Proposed Bituminous Surface Treatment and Curb 8 Gutter", which affidavit was approved as to form and ordered placed on file. Pursuant to said Notice, the following Public Hearings were conducted and action taken: 1. PUBLIC HEARING ON PROPOSED BITUMINOUS SURFACE TREATMENT OF WINDSOR AVENUE ' FROM HANSEN ROAD TO RAILROAD TRACKS.- AND I 2. PUBLIC HEARING ON PROPOSED CONSTRUCTION OF CONCRETE CURB AND GUTTER IN- WINDSOR AVENUE FROM HANSEN ROAD TO E. LOT LINES OF LOT 8, BLOCK 6, AND LOT 9, BLOCK 7, WESTCHESTER KNOLLS ADDITION. Manager Hyde read the Engineer's Estimates of $3.17 per Assessable Foot for the Blacktopping; $3.06 for the Curb and Gutter. Messrs. Hyde and Zikan explained that the Curb and Gutter down the slope is a necessity for the drainage; and the owners of the two lots to be assessed for curb and gutter protested paying the full cost, claiming that part of this cost should be assessed azs an integral part of the blacktopping project inasmuch as the curb and gutter will abut the only entrance to the street and is consequently of benefit to all owners on the street. Mr. V. H. Mathieu objected to such an arrangement, claiming that curb and gutter will soon go in on the balance of the street, and, if such plans are made, the two corner lots should be assessed for this construction. Some discussion was had as to a change in the present grade, taking some of the water to the railroad tracks. that.this would mean a change in plans. that inasmuch as the Village Engineer has reported that the curb and gutter is necessary for good blacktop construction all abutting properties benefit by the curb and gutter, moved for the scheduling of a new public hearing on Blacktopping, Curb and Gutter, with the understanding that the extent of the curb and gutter will not change but that all properties along Windsor Avenue between Hansen Road and the Railroad Tracks will be assessed therefor, said hearing to be hePd Monday, July 22, at 7:30 P.M. unanimously carried. Mr. Zikan reported he believes this can be done but Trustee Bank, explaining that he feels i Motion seconded by Tupa and I AWARD OF WINDSOR AVENUE CURB & GUTTER BID DELAYED. pursuant to "Advertisement for Bids-Curb and Gutter Improvement," publishl?d in Edina-Morningside Courier and Construction Bulletin June 27 and July 4, 1957, for Construction of Concrete Curb and Gutter in Windsor Avenue from Hansen Road to E. Lot Lines of Lot 8, Block 6 and Lot 9, Block 7, Westchester Knolls Addn., bids had been taken this morning; that only one bid had been received--that of Victor Carlson & Sons, Inc., at $1,564.50. Tupa moved that award of contract be delayed pending the outcome of the July 22nd Public Hearing on the proposed improvement. Manager Hyde reported that, PUBLIC HEARING ON PETITION FOR PERMIT TO CONSTRUCT MULTIPLE DWELLINGS ON LOTS 3, 4, 5,. 6, 9, 10, 11 AND 12, BLOCK 4, TINGDALE BROS. BROOKSIDE (5109,5113,5117 and 5121 1.49th St. and 5120,5116,5112 and 5108 Highway No. 169.) Clerk presented Affidavits of Publication (June 27 and July 4, 1957 in Edina-Morningside courier), Posting (June 24, on three official bulletin boards) and Mailing (to owners of property within 500 feet of proposed construction) June 24, of "Notice of Public Hearing on Petition for Permit to Construct Multiple Dwellings". were approved as to form and ordered placed on file. presented a sketch showing the placement of the buildings on this plat, stating he wishes to construct two four-family dwellings, and garages. A delegation of some fifteen neighbors was present to discuss the project, and seemed to be in accord with the plan, except that they requested that garages be constructed parallel with Highway No. 169--to wh'ieh2mequest Mr, Jarnberg was agreeable. Fronk moved that petition for permit to construct two multiple dwellings be granted, with the understanding that garages will be moved as requested, was seconded by Dickson and carried. Clerk presented Affidavit of Publication in Edina-Morningside Courier June 20 and 27, 1957, of "Notice of Assessment Hearings on Blacktop Nos. A-76, A-80, A-81, A-85,and A-86; Street Lights No. L-2, and Curb and Gutter B-34. placed on file; and, pursuant to said notice the following public hearings were conducted and action taken as recorded:. Affidavit was approved as to form and ordered 7/8/57 1, of Concord Avenue from 't'J.60th Street to Southview Lane. Tabulation of Assessment at $6,035.56 as against 3,702.8 Assessable Feet, for an Assessable Cost of $1.63 per Assessable Foot, compared with Improvement Hearing Estimate of $2.12+ Mr. X. Forder, 5932 Concord Avenue, was present to support his letter of objection to assessment for reason that he does not have proper drainage. Engineer Zikan presented 1953 street profile, showing that hk. Forder's lot was below street grade at that time, but made a proposal to raise the burm at the lot's edge, to prevent wash. be levied as read, with understanding that burm at 5932 Concord will be built up. Motion seconded by Bank and carried. (See Resolution of later in meeting, formally levying assessment). 2. PUBLIC HEARING ON ASSESSMENT FOR STREET IMPROVEMENT NO. A-80--Blacktopping of 1.52nd Street from Highway No. 169 to Bedford Avenue. was read at $4,510.31, as against 1,097.4 Assessable Foot, for $4.11 per Assessable Foot, compared with Improvement Hearing Estimate of $3.81. the increase in cost was due to about a 5% overage in excavation. No oral objections were filed, and no written objections had been received prior to the HeaSng. 3. W.58th Street from France Avenue to Brookview Avenue. was read at $4,703.01, as against 3,053.9 Assessable Feet, for $1.54 per Assessable Foot, compared with Improvement Hearing Estimate of $2.48. were registered at the Hearing, and no written objections had been received prior thereto. 4. PUBLIC HEARING ON ASSESSMENT FOR STREET IMPROVEMENT NO. A-85--Blacktopping of Ashcroft Avenue from W.59th St. to W.6Oth St. Tabulation of Assessment was read at $1,796.70, as against 1,197.8 Assessable Feet, for $1.50 per Assessable Foot, compared with Improvement Hearing Estimate of $2.74. No written objections were reported by the Clerk, and no oral objections were registered at the Hearing. (See Resolution of latex in meeting levying assessment). 5. Lake Ridge Road. Tabulation of Assessment was read at $1.482.37; assessment to be levied on a "percentage of total" basis as per agreement by owners of benefited properties. PUBLIC HEARING ON ASSESSMENT FOR STREET IMPROVEMENT NO. B-34--Curb and Gutter in Ridgeview Drive from Danens Drive to Meadow Ridge. Tabulation of Assessment was read at $2,432.00, as against 800 Assessable Feet, for $3.04 per Assessable Foot, compared with Improvement Hearing Estimate of $3.46. 5245 Danens Drive and JOE. IVithrow,5248 Meadow Ridge, and developer E.C. Stow, objected to the assessment on the grounds that - 1. Curb and Gutter has washed out, been replaced once, and is washing out again and will not be satisfactory until a new base is put under it. 2. This is in effect a storm sewer and should be assessed against the drainage area rather than to abutting properties only. Council informed audience that it does not have the power, now, to assessL,against the drainage area; that assessment can be levied against only those properties included in the notice for the improvement hearing. Cleland, Because it was apparent that no agreement on the assess- Fronk then offered the following Resolution and moved its adoption: RESOLUTION ADOPTING AND CONFIRMING ASSESShENTS FOR STREET IMPROVEMENTS NOS. A-76, A-80, A-81, A-85, A-86 AND L-2 BE IT RESOLVED by the Village Council of the Village of Edina, as follows: for STREET IMPROVEMENTS A-76, A-80, A-81, A-85, A-86 AND L-2, and each of them, have been properly calculated in accordance with the provisions of Minnesota Statujxs Section 412.441; that notice has been duly published as required by law, that this Council would meet to hear and pass upon all objections, if any, to amend said proposed assessments as might be necessary, and to adopt the same by resolution; 1. It is hereby found, determined and declared that the proposed assessments 7/8/57 ? 19.1 that said proposed assessments have at all times since their filing been open for public inspection, and opportunity has been given to all interested persons to present their objectiob/ns; and that each of the lots, pieces and parcels of land enumerated in the respective assessments was and is specially benefited by the construction of the improvement for which said assessment is levied in the amount set opposite the description of each lot, piece and parcel of land respectively. 2. The amount so set out are hereby levied against the respective lots, pieces and parcels of land described in said respective assessments, and said proposed assessments are hereby adopted and confirmed as the proper special assessments for said improvements respectively. The assessment against each lot, tract or parcel, together with the interest accruing on the full amount thereof from time to time'unpaid, at the rate of five percent per annum from the date of this resolution, shall be a lien concurrent with general taxes upon the property described therein and all thereof. The total amount of the assessment for Street Improvement No. 1-2 shall be payable in equal consecutive annual installments extending over a period of ten years, the first of said installments, together with interest on the entire assessment from the date hereof to December 31, 1958, to be payable with the general taxes for the year 1957, and one of the remaining installments, with one year's interest on that and all subsequent installments, to be payable with general taxes for the year 1958 through 1966, collectible in the respective ensuing years. The Clerk shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of said assessments, with each then unpaid install- ment and interest set forth separately, to be extended upon the proper tax lists of the county, and the County Auditor shall thereafter cause said assessments to be designated as ASSESSMENT ROLL FOR STREET IMPROVEMENTS NOS. A-76, A-80, A-81, A-85 A-86 AND L-2; and the amounts collect in respect of the assessments therein contained shall be similarly designated by the County Treasurer and remitted to the Village Treasurer, and by him credited to the following Funds: The total amount of each of the assessments for Street Improvements Nos. 3. Xttorney ReForest Spencer.: stated that the Village does not have the legal right to prohibit construction of a sidewalk on private property. No action taken because of lack of jurisdiction. PUBLIC HEARINGS SCHEDULED FOR PETITIONS FOR MULTIPLE DlVELLINGS. Clerk asked that Council now confirm the dates for Public Hearings on petitions for Multiple Dwellings; and Bank moved that Council confirm as the date of Public Hearings on petitions of Southdale Realty Company and E. UNIVERSITY INSTITUTE ON CHEMICAL TESTS FOR INTOXICATION, which will enable one of our own officers to become expert in drunkometer readings, was approved, and authorization for issuance of $40.00 check for registration fee was given, by Motion Bank, seconded by Tupa and carried. DOG ORDINANCE NO. 33-A was reviewed and discussed at some length; the Council determining that good enforcement of the year-round leashing ordinance would be very expensive (Manager Hyde reported that a contract with the Animal Rescue League for dog pound service and a 40-hour per week patrol with one truck would mean an appropriation of at least $10,000 and that one truck would not be sufficient for really good enforcement); that the nominal licenses which would be charged would defray very little of this expense. that multiple violations should be penalized and, on common consent it was written into the Ordinance that the impounding fee be $5.00 for first violation, and doubled for each subsequent violation; with $1.00 per day board charged for each day dog is impounded; also that license fee be raised fo $5.00 for dogs weighing over 30 pounds (American Kennel Club standards) and remain $3.00 for those under 30 pounds and that leashing be only for the six months between April 1 and October 1, except that the animals be prohibited from school grounds and other public places at all times. "ADOLPH MEYER" STORM SEVER REPORT--HEARING POSTPONED. the plans for this Storm Sewer, which will drain to Nine-l~1il.e Creek, have been delayed pending the decision of Normandale Development Corporation concerning an easement for the line--this decision depending on future plans for Nine-Mile Creek, inasmuch as developer is apprehensive that storm sewer drainage will cause creek to flood. Mr. Hyde told the Council he would suggest that the Assessment for the project be on a trunk-lateral basis; with the Northern boundary of the large assessmant district being assessed for a trunk sewer only, and the Southeasterly ' section, which is more immediately concerned, on a trunk and lateral basis. Mr. Hyde told the Council that the sewer could be laid over a route to Highway #lo0 and enter Minnehaha Crekk at approximately that point; but, at the last Estimate, this would mean approximately $60,000 additional cost. Assessor Creighton reported that his books of valuation were not yet complete, and suggested continuance of meeting to liiIonday, July 29, at 5:OO P.M. No one appeared before the Board, to complain that the property of another is assessed too low, or who considered himself aggrieved by his assessment. Because books of valuation could not be examined at this time, it was moved, seconded and carried that meeting be adjourned Clerk
