Minutes of Meetings of July 22 and 29 were approved as submitted, by motion Fponk seconded by Dickson and carried. PUBLIC HEARING ON PROPOSED REZONING TO COMMUNITY STORE DISTRICI' OF LOTS 3 AND 4, BLOCK 2, ELMWOOD TERRACE (5512 S, 5516 FRANCE AVE. SO,), FOR PRAYER TOVER, was the first matter on the agenda, published in Edina-Morningside Courier August 1 and 8, 1957, posted on official bulletin boards, and mailed to owners of properties within $00 feet of the land proposed to be rezoned. were presented by Clerk, approved as to form and ordered placed on file. Hyde reviewed for Council and audience the Planning Commission's favorable recommendation, and explained that the Prayer Tower cannot be considered a church (and thus permissible under the "Open Development't section of the Village Zoning Ordinance) because it has neither a minister nor a congregation. He explained that the primary function of the United Prayer Tower organization is the distributi6n of prayer tracts; that there would be a small chapel in the building for prayer groups, but that there would not be Sunday services. The Director of the Prayer Tower spoke briefly, stating that a free lending library would also be housed in the building. Mrs. Link, 3705 W.55th Street, spoke in favor of the project, explaining that she knew of the group's work and feels that it would be of distinct benefit to the community. Beard, owner of the property proposed to be rezoned, supported her August 5th letter protesting rezoning--stating she feels that the Prayer Tower should be allowed in the Open Development District. audience as to the type of construction, the Prayer Tower's architect explained that a one-storey residential-type structure is planned, which will blend well with the present character of the neighborhood. Trustee Fronk inquired as to provision for off-street parking and was informed that plans had not yet been made, because the organization wishes to know, first, whether they can obtain a permit, but that they will provide parking. Attorney Ira Peterson, speaking for the objectors, explained that while the residents do not object to this religious group it is felt that there are three protestant churches within a block of this property for service to the neighborhood; that this is, strictly speaking, not a neighborhood congregation. He presented a petition, signed by owners of some fifty lots in the area, protesting both the proposed rezoning and the construction, and asking that the property be kept residential. Hyde explained that because of Attorney's opinion to'the effect that the Prayer House could not be allowed in the Open Development District the Council cannot issue a permit for it without either rezoning to Community Store or amending the Zoning Ordinance to include the function in the @en Development District; and Mr. Peterson replied that it is not only the rezoning the residents are objecting to--it is also the construction. Niles Roaderick, Erick Bentzen and C.H. Jensen added their objections, stating they feel that this land useage will devaluate their properties, cause parking problems. Asked whether they would object to double bungalow on the property, neighbors agreed that this land useage would be satisfactory. in view of the preponderance of objections the application for permit be denied. Clerk presented Affidavit of Publication in Edina-Morningside Courier August 1 and 8, 1957 of the Notice of Hearing on Proposed Curb and Gutter, which was approved as to form and ordered placed on file. She explained that this Public Hearing had been called after a petition for concrete curb and gutter was received; this petition having been filed as the result of the July 22nd Hearing on Blacktopping at which several residents evinced interest in concrete rather than blacktop curb; that, after notice of hearing had been issued one of the petftioners had withdrawn his name, leaving a petition of less than 51% of the properties signed for concrete curb and gutter. Mr. W. H. Brewbacker, 6100 Ewing, explained that owners of three properties directly south of the present termination of concrete curb and gutter want permission to install concrete curb and gutter at their own expense. C.J. Annas, 6109 Ewing, reminded Council of the original petition for blacktopping, which also asked for blacktop curb. The owner of 6116 stated that he and Mr. IdcCauley, 6112, also want ,permission to install concrete curb and gutter. It was noted that there would be two lots in the middle of the block on the \Vest side of the street, with blacktop curb. street objected to concrete curb but wanted blacktop curb. There seemed to be some difference of opinion as to Mr, McCauley's wishes; and Fronk moved, granting permission to the owners of Lots 2, 3 a& $4tBlock 1, Edina Bel-Air 6th Division (6024,6028 and 6100 Ewing) to install/curg an8 gutter at their own expense under Village supervision. Motion seconded by Tupa and carried. Discussion was then had on Blacktopping with Blacktop Curb and Gutter, an Estimate of Cost of $2.77 being given for this work, compared with Estimate of $2.09 for Blacktopping in conjunction with Concrete Curb and Gutter. previous discussion Engineer Zikan had recommended concrete curb foq the reason that blacktop curb disintegrates. He stated that the blacktop curb is actually a "blacktop burm"; that it will not be done by machine because only a very few contractors have the equipment for this work. Mr. Annas once again referred to the original petition for "blacktopping and blacktop curb'', asking that it be honored; and, after explaining that the Council feels that while continuation of present concrete curb and gutter is satisfactory,buC that construction of it at the South end of the block, with two non-curbed lots between, would fmprove neither the drainage nor the appearance of the street, Fronk offered the following Resolution and moved its adoption: RESOLUTION ORDERING STREET IMPROVEMENT Mr. All owners on the East side of the In the NO. Manager Hyde explained that the Council had called these Hearings on its own motion, without a petition but at the request of the school for Southview Lane improvement; that it is almost necessary to install concrete curb and gutter to hold the grade, if the Village is to contemplate blacktopping. of Cost in the amount of $5,496.40, as against 1,848 assessable feet, for $2.97 per assessable foot was given for the Curb and Gutter; and Estimate of $8,220.80, as against 2,550 assessable feet, for $3.22 was given for the Blacktopping--with the proposal that the Village pay 1/4 of the cost of the Blacktopping, the School pay 1/2 the cost, and the abutting properties bear the other 1/4 of the cost, for $1.71 per foot. 1.k. Hyde recommended that this basis of assessment be considered only on condition that curb and gutter is installed. Messrs. D.R. Anderson, 5616 Sherwood Avenue; G.O. Norman, 5617 Shewood Avenue; J.E. Rohne, 5616 Dalrymple; E. 1% Blanche, 5615 Dalrymple; H. L. Knearl, 5617 St.Andrews, and one other, objected to paying the assessments for the improvements, although they stated they believe some improvement is needed. They stated they are now paying for these same improvements at the front of their homes, and feel that these additional assessments on their side footages are just too much. It was noted that Southview Lane has been designated by the Village as a part of its "hnicipal State Aid Street System" and that it will in the future benefit from gas tax funds; however, Ak. Hyde stated he feels it will be some time before this street can benefit, hasmuch as several other streets in this system carry more traffic and are thus eligible for more immediate improvement. Peterson, 4809 VJ.7Oth St., stated it is all right with him, too, although a great deal of his property is low. Mr. E. C. Stow, developer of Lake Edina Addition, objected heatedly to "paying for someone else's sewer"; asking why the utility costs so much after it leaves Lake Edina. It was explained that an assessment cannot be levied against the Larkspur Lane or Highway No. 100 sides of the Gavin tract because of the terms of a utilities easement granted to the Village at the time of watermain construction. Upon further investigation it was found that Estimate had been based upon assessing both sides of'the Larkspur Lane sewer; that eliminating the Gavin property from the assessable footage would raise the cost to about $10.80 per front foot. served from the present W.7Oth Street sewer because of the topography. Stow's letter of August 2nd was reviewed while Mr. Stow and Mr, Hosmer Brown were present. Smith the work of preparing plans for sanitary sewer in the Addition. Hyde read for the Council an Estimate of Cost for Watermain in the amount of some $62,000; then stated that he has been under the assumption that, because the plat of Edgemoor was filed after July I, 1955, the financing of the sewer and water projects was to be done by the developer, in accordance with 1955 action by both Planning Commission and Council putting developers on notice that such financing would be required of them. 1955, and 1957, action of the Council was reviewed* action by the Council, although he was aware that this policy had been talked about. He stated that, had he thought he would be required to finarice under- ground improvements, he would never have undertaken the development of the property. fact that no official action was taken; that, as late of May of this year, the matter was still being considered by the Council. would agree to pay off the total sewer and water assessment on each lot at the time he sold the lot. Mr. Brown stated he felt this was a reasonable re'quest; and Mr. Stow stated he would be willing to agree to it; that he could draw up a sales contract providing for payment of sewer and water on an estimate of cost basis but that adjustments (if actual construction costs were either over or under the Estimates by the Village Engineer) would have to be up to the Village. Mr. Hyde demurred at this arrangement, stating that even short-term financing will put the Village in the bond market again and-jeopardize its credit rating; that he feels developers should be required to finance directly. feels PAr.
