Minutes of the Regular Meeting of August 12, 1957, were approved as submitted, by

PUBLIC HEARING OX PROPOSED §TORFA SEWER INTO NINE-I?IILE CREEK. Clerk presented
Affidavit of Publication of "Notice of Public Hearing on Proposed Storm S&er
Improvement" in Edina-Korningside Courier August 15 and 22, 1957, which notice
outlined in detail both the route and the assessable district; and also reported
on the explanatory notice mailed to property owners. A large map of the route
and district proposed to be assessed was shown to an audience of about 150
persons; and Ki. Adolph ]?eyer, Consulting Engineer for the proposed project,
explained the proposed project in detail. He stated that the purpose of the
proposed storm sewer is to provide an outlet for the '*excess runoff" which is
caused by the construction of streets and structures in farmland; that the
proposed project ail1 drain some 700 aqA%fi or more; that it will provide
ten to twelve percent more protection/is customarily provided in Ninneapolis;
that _the project is ,pl.apned to utilize Lake Cornelia as -a temporary storage 'basin,
which will act as a buffer -I and decrease the cost of the project. 13. LIeyer
reported that the "natural high water mark" of Lake Cornelia is 863$, although
the lake has not been that high for a number of years; that his recormendation

at the Lake's outlet so that as soon as the lake reached the cdntrd, .

Morningside Courier August 15 and 22 on Sanitary Sewers; August 1 and 8 on Fire Truck.

Later in the evening, Engineer Zikan explained that the Village has not received
State Board of Health approval on this group of projects, and that the State Highway
Department has n& given its approval to laying a main in Highway #lo0 (Improvement
No. 133) because they expect 'to take part of the property for an intersection. Mr.
E.C. Stow objected strenuously to delaying Improvement No. 1 3rpending Highway
Department approval, stating he has been waiting five years/ 9 fie Department to make
up its mind; has lost some $35,000 because of the Department's indkcision; and that
the Department has the power to refuse this main nowsand then change its mind again
and take right-of-way in some other area.
Bank moved that contract be awarded subject to approval by the State Board of Health
and Minnesota Highway Department. Motion seconded by Dickson and carried.

4.7 feet from the East property line of Lot 2, Enoch Sward Addition (3932-34 W.49th
Street). They stated that, through an error made by either the surveyor or the
basement contractor the house had been set .3 foot over the setback required by the
Village Zoning Ordinance; that said error had not been discovered until a title searc~ by a prospective purchaser. It was also noted that the building to the East
of this property is set back from its West lot line considerably more than five
feet, and that, therefore, there is actually more than ten feet between the two
buildings.

Tupa offered the following Resolution and moved its adoption:
RESOLUTION APPROVING SIDEYARD SETBACK
WHEREAS, violation of sideyard setback provision of the Village Zoning Ordinance
has been made by error of the building contractor, and unbeknown to the property
owner and to the Village, in setting the dwelling on Lot 2, Enoch Sward Addition
(3932-34 W.49th St.) .3 foot over the required five-foot setback for side yards;
said error having occurred in the setback from the East lot line of said Lot 2;
and,
WHEREAS it would cause undue hardship on the owner of said property to have
said 4.7 foot sideyard setback corrected;
BE IT RESOLVED by the Village Council that a setback of 4.7 feet from the
East lot line of Lot 2, Enoch Sward Addition shall be, and hereby is, approved.

group, stated that the merchants feel that this restriction has hurt them, that
the area looks like a ghost town during these hours, that they would like to
encourage shopping in the district. It was brought out in discussion that the
Barton Traffic Report recommended the restrictions, that they were imposed on
a trial basis.

EDINA HIGHLANDS SCHOOL ACCESS ROAD. Hanager Hyde reported that the State Highway
DeDartment has disapproved the School Board's request for the Doncaster Way
ap'proach; that &s,'Johnson is now willing to sell only the rear two lots, if
this will make possible the approach considered by the Council; that the School
Board has appointed a committee to consult with the Highway Department concerning
the approach, hlr, Folke Victorsen stated that the Board is unwilling to have
the residents represented on the Committee and that, consequently, they are
dissatisfied about the Board's action,
Hyde informally asked to advise the Highway Department of the Council's proposal
concerning access.

DIRECTIONAL FLOW INTERSECTION AT 63RD AND NORMANDALE was discussed at quite some
length, after Manager Hyde had presented the Highway Department's newest plan for
this intersection, Mr. Xyde explained that the present plan involves the taking
of considerably more property than the "cloverleaftr plan heretofore presented;
that some 38 homes must be moved for acquisition of right of way. A number of
questions were asked by the Council, concerning both the need for this type
of intersection and its cost compared with that of the formerly proposed
cloverleaf. Mr. Hyde suggested that the proposed plan be publicized in order
that residents might become informed of it, and that the State Highway Department
be asked to have one of its officials present at the Council Meeting of September
9th, to explain the plan in detail. Council in agreement with Mr, Hyde's
suggestion.

with a liquor store planner who suggests that the present refrigerator door be used;
that the present shelving be used in the back room, with new five-tier shelves in
the new store; that new cooler be purchased for better use in a serve-yourself
store. Manager Hyde reported he would like to take bids in accordance with this
planner's recommendations, in order that the move might be made soon, Council

POLTCY OF DEVELOPERS FINANCING THEIR OWN IMPROVEMENTS was once discussed,
pursuant to a comment by Trustee Fronk, who explained that in the last week he
has had calls from developers who state they have filed plats but have had no
information that they will have to pay for sewer and water. Mr. Hyde reported
that he written to all developers who had filed preliminary plats; that he
expects to have a report to the Council very shortly on estimated costs of
these utilities in large plats.

DIRECTIONAL FLON INTERSECTION AT W.63RD STREET AND HIGHWAY NO. 100. Mayor
Fro Tem Fronk introduced Mr. E. J. McCubrey, District Engineer, Minnesota
Highway Department, who explained the proposed plan in some detail. Mr.
McCubrey told the large audience that the plan now being presented to the
Council is a "Preliminary or General Plan of Proposed Directional Flow
Intersection'"; that it is customary for the Highway Department to present
such a preliminary plan to municipalities for their consideration before
going ahead with expenditures for detailed construction plans. He stated
that the plan has been designed to accommodate traffic estimated for 1975;
that highway construction is aimed at this goal so that it will be unnedessary
to enlarge highways between now and then.

wishing to turn left actually does turn left in the "directional flow",
whereas on a "cloverleaf" traffic must go to the right in order to turn left.
He stated that the directional flow is the modern type of intersection; that
there are a number throughout the country, now, although he cannot think of
one in Minnesota; that this type of intersection is much easier for traffic
to negotiate than the cloverleaf; that the Highway Department staff feels
this is the type of intersection which the State must have at this location
within the next fifteen years. Mr. McCubrey stated that the area necessary
for a directional flow intersection is about the same as that required for
a cloverleaf.
