Gebo and Anderson, explained that a window shade display room had been planned
but that the Company planning to erect the building had changed its plans. It
was brought out in discussion that Cities Service Oil company had informally
applied for a permit in 1956, but that they had been requested to consult with
the State Highway Department concerning its plans for relocation of Highway #169;
that present "tentative" plans show that the highway will be located South of
this property.

seconded by Dickson; and, on a Rollcall vote, there were four ayes and no nays,
as follows: Bank, aye; Dickson, aye; Tupa, aye; and Fronk, aye; and the motion
was unanimously carried. Uic. Bank explained his motion by stating that the
property has already been zoned commercial; that the Council is not changing the
zoning because it is felt that no one would build a home on either of the two lots,
and also that the village-owned park will provide a very adequate buffer South of
this location, for the residential section.

Objections to the proposed assessment were registered as hereinafter recorded:

an "Oiling Improvement"; that the only purpose of this project is to allay the dust.
2. Mr. I"J.G. Fredel, 5044 W.60th St., objected to the assessment for W.6Oth St.,
Code Avenue to Highway No. loo., stating that because of the wash from Tingdale
only about 20 feet of his property benefited from the improvement.
Oiling of Beard Ave. between N.6Oth and W.6lst Sts., on the grounds that Curb and
Gutter construction was started within ten days from the Oil Coat. They were
informed that requests for the Oil had been received by some of the residents; that,
at the time the oil was applied the curb and gutter contract had not yet been
awarded.

street been repaired after server construction, Oiling would not have been necessary.

Messrs. McCauley, Fredel and MacMillan were informed that their complaints would
be investigated; that if the Oil Coat applied on their streets was not up to -
standard adjustments would be made. Tt was, however, reiterated that a 15$ Oil
Coat job means simply the laying of a Dust Coat; that it involves no construction
work whatsoever because of a limitation in the law; that storm sewer problems
cannot be considered in the analysis of the standard dust coat. Bank offered

ASSESSMENTS FOR 1957 OILING IMPROVEMENT
BE IT RISOLVED by the Village Council of the Village of Edina, Minnesota, as

in accordance with the provision of Minnesota Statutes Section 412.441; that notice
has been duly published, as required by law, that this Council would meet to hear
and pass upon all objections, if any, to amend said proposed assessments as might
be necessary, and to adopt the same by resolution; that said proposed assessments
have at all times since their filing been open for public inspection; and oppor-
tunity has been given to all interested persons to present their objections; and
that each of the lots, pieces and parcel s of land enumerated in the respective
assessments was and is specially benefited by the construction of the improvement
for which such assessment is levied in the amount set opposite the description of
each such lot, piece and parcel of land, respectively.

Auditor, and the assessment or installment so prepaid shall be cancelled on the
books of the County Auditor.
The Clerk shall, as soon as may be, prepare and transmit to the county
Auditor a certified duplicate of said assessments, with each then unpaid install-
ment and interest set forth separately, to be extended upon the proper tax lists
of the County, and the County Auditor shall thereafter cause said assessments to be
collected in the manner provided by law. Said duplicate shall be designated as
the "Assessment Roll for 1957 OILING IMPROVEMENT, and all amounts collect in
respect of the assessments therein contained shall be similarly designated by the
County Treasurer and remitted to the Village Treasurer and by him credited to the
Sinking Fund Account of the Permanent Improvement Revolving Fund.

that the higher bid is for a newer model plant, which has been in operation
only a month, is in very good condition, with both frame and belt in better
condition than that of the equipment represented by the low bidder, although
the Dunn can do the job, with some repairs to the belt.

REQUEST FOR VILLAGE PAYMENT OF SANITARY SEWER AND WATER CONNECTIONS FOR LOT 1, - BLOCK 1, PAYTON'S ADDITION, was discussed. It was reported that this property
was unplatted at the time it was assessed; that Mr. Payton needed additional
property (which he subsequently purchased from the Village) to plat his property
into two lots; and, for that reason only one watermain and one service connection
were installed for the tract--these connections now being available for Lot 2,
Block 1; that, had additional connections been installed, the cost per foot
would have been higher for the entire area. Motion by Bank, seconded by
Dickson, and carried, for denial of request for Village payment of extra
connections.

TELEPHONE RATES HEARING BEFORE RAILROAD AND WAREHOUSE COMMISSION, to be
December 10, 1957, was reported as a matter of information.
PUBLIC HEALTH NURSING REPORT FOR SEPTEMBER, 1957 was received, reviewed, and
ordered placed on file.
SCHOOL BOARD'S REQUEST FOR R-ELIEF OF DRAINAGE PROBLEMS AT JUNIOR HIGH AND CONCORD
SCHOOLS was discussed. Engineer Zikan reported that, because the School has
blacktopped its parking lots, thus increasing the rate of flow, and because a
large drainage ditch has been filled by the school, a rather serious problem
now exists; with only one catch basin available to take a very large run-off.
He recommended that the line be extended in two directions from the present
catch basin, with additional catch basins to take the water; stated that the
School Board property will bear most of the assessment because there is very
little (if any) other property which will be benefited by the line. Manager
Hyde was instructed to write the School Board, with an Estimate of Cost of the
storm sewer recommended by Engineer Zikan, to ascertain the Board's view on
this construction.
PETITION FOR BLAChTOPPING-Knoll Drive and South Knoll Drive from South Blake
Road to Schaefer Road, was received; and, by motion Dickson, seconded by Tupa
and carried, was accepted and referred to Village Engineer for scheduling for
next year's work.
PETITION FOR DEMOLITION OF "THE VJHITING PLACE" AT 63RD AND VALLEY VIEW ROAD was
read. It is signed by some thirteen neighbors, and states that the building is
dilapidated and deserted; that there are an open well and an outside toilet,
