Members answering Rollcall were Dickson, Xohler and Bredesen. arrived immediately after Rollcall. Trustee Tupa Minutes of the Regular Meeting of January 13, 1958 were approved as submitted, by motion Dickson, seconded by Kohler and carried. PUBLIC HEARING ON PETITION FOR PERMIT TO CONSTRUCT SIX-FAMILY DWELLING ON LOTS 10. 11 AND 12, BLOCK 9, BROOKSIDE HEIGHTS (5136-40-44 HANKERSON AVENUE). Af f idavits of Publication and of Mailing of "Notice of Hearing" were presented by Clerk, approved as to form and ordered placed on file. favorable recommendation of January 15th was reviewed. Petition, signed by owners of some 53 lots in the neighborhood (although all petitioners were not in the 500-foot radius of the lots affected) was presented, in objection to the proposed construction. Petition was supported by Messrs. John E. Shafer, 5133 William Ave., and Mark J. Dougall, 5116 William Ave., who stated that the Motel and the double bungalows behind it have increased traffic problems in the area, whereas traffic should be kept to a minimum on William because of the number of children in the block; that the proposed two-story dwelling would detract from the value of adjacent one-story, one-family dwellings; that property owners feel that the three lots affected comprise too small an area for six families and that they object to having any more multiple dwellings in the vicinity. Manager Hyde pointed out that this is problem land; that it is unlikely that one-family dwellings will be built, here; that it was the Planning Commission's thought that the multiple dwelling would be a buffer against a commercial enterprise. Petitioner V.H. Mathieu, after stating he feels that his proposition would prove to increase, rather than decrease the valuation of surrounding properties, and that he intends to live in the dwelling himself; that he feels the proposed dwelling would eliminate the possibility of more small children moving onto this property (in contrast to building of small one-family dwellings, here) and that it would bring additional taxes into the Village, offered to compromise on a four-family dwelling to be built on two lots, but delegation was adamant in its opposition to any further multiple dwellings. Trustee Dickson moved for rejection of petition. Motion seconded Planning Commission's by Kohler and carried. PUBLIC HEARING ON PROPOSED WATERMAIN IN BERNARD PLACE FROM GROVE STREET TO BENTON AVENUE: BENTON AVENUE FROM BERNARD PLACE TO 350 FT., MORE OR LESS. EAST THEREOF: CODE AVENUE FROM W.58TH STREET TO BENTON AVENUE. Affidavit of Publication of "Notice of Hearing" January 16 and 23, 1958, was presented, approved as to form, and ordered placed on file. the area to be assessed; Work at $10.00 per Assessable Foot, for Summer Work at $5.00 per Assessable Foot. that the main is being constructed in the other two streets to form a "loop'* and that property abutting these streets will not be assessed for the main unless they have not heretofore been assessed for lateral watermain; that the Waterworks Fund of the Village will bear this expense. a petition dated January 23, objecting to the published estimated cost but agreeing to an assessment of $4.00 per front foot. were reviewed and, upon some rapid calculation by the Engineer, it was determined that assessment based on today's bid should come to about $4.03 per front foot. Delegation was agreeable to this, but inquired as to the division of costs between the assessed portion of the project and the "waterworks"portion. Manager Hyde explained that the "loop*t mains will have no house connections, whereas the Bernard Place main will have a connection per lot from the main to two feet back of the curb line, necessitating copper piping, corpmation cocks, etc., which adds to the cost of this installation. Mr. Tom Lee inquired as to whether money could not have been saved by an installation last year, and Mr. Hyde replied that he could not be sure but that, in view of our receiving nine bids on the project today, he feels that a very good bid has been received. As a part of the Public Hearings on Sanitary Sewer and Watermain for streets in Edgegoor, Mr. Hosmer Brown, representing developer Stow, asked that financing agreement be eased to allow for pre-payment of special assessments at such time as the house is sold. (Agreement now stipulates that pre-payment be made when the I& is sold). Mr. Brown told the Council that contractors simply do not have the money to buy large blocks of lots and special assessments also. He also stated that the mortgage companies will not finance homes which are subject to three-year assessments and that, therefore, assessments would auto- matically have to be paid before purchaser could secure a loan. asked that the agreement be revised to make some reference to the nestimated cost" based on today's bids. developer be required to post performance bond for some part of cost of utilities, to guarantee that pre-payment be made at sale of house. his feeling that agreement should stand as originally made. that the agreement as proposed by him be recorded as a part of the land covenants, thus placing the purchaser on formal notice of required pre-payment of special assessments before transfer of title; and Village Attorney Hasselquist stated that if the agreement is recordable the Village would be protected. Ordinance was read, as follows: t ORDINANCE NO. 261-26 t 'i AN ORDINANCE AMENDING THE ZONING ORDINANCE OF EDINA BY PROVIDING FOR SPECIAL PERMITS FOR CERTAIN USES THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS: Section 1. ordinances of the Village of Edina is hereby renumbered Section 10, and Section 10, Administration, is hereby renumbered Section 11. Manager Hyde reported that the proposed assessment for filling lots 4 and 5, Block 4, Brookside Heights is in error; that three lots were filled, rather than the two proposed to be assessed. He recommended that a new assessment hearing, for the re-computed assessment roll, be scheduled at an early date. Tupa offered the following Resolution and moved its adoption: 1/27/58 RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED MENDED SPECIAL ASSESSMENT FOR IMPROVEMENT NO. FILLING OF LOTS TO ABATE DANGEROUS CONDITION. 454- BE IT RESOLVED by the council of the Village of .Edina as follows: The amounts proposed to be assessed for Lots 4 and 5, Block 4, Brookside Heights Addition, as previously calculated for IMPROVEMENT NO. 454 are erroneous. The Clerk and Engineer now having calculated the proper amounts to be assessed for said IMPROVEhqENT NO. 454, against Lots 3, 4 and 5, Block 4, Brookside Heights Addition, and said proposed amended assessment having been filed with the Clerk, the same are hereby approved; and the Clerk shall keep the same on file in her office and open to public inspection pending hearing thereon as herein provided . 3. Manager Hyde reported that investigation has been made on the question raised by,ks. Waste at the last regular meeting of the Village's filling a lot at Interlachen and Hollywood Road for Mr. Gunnar Johnson; that it has been determined that the lot was filled by Phelps-Drake Company, sewer contractor, under private arrangement with Mr. Johnson and that the Village had no interest in the matter. LYLE OTTO'S ADDITION (FIRST SIX LOTS) APPROVED AS PRELIMINARY. hlr. Lyle Otto vias present to request approval of Preliminary Plat of six lots in Lyle-Otto's Addition, adjacent to LaBuena Vista. stated that he will finance sanitary sewer and watermain installation for this plat. Kohler's motion for approval of preliminary plat for first six lots was seconded by Tupa and carried, COOPERATIVE AUDIT BY STATE PUBLIC EXAMINER REQUESTED BY COUNCIL. Mayor Bredesen told the audience that the Council fespects the honesty of the remarks and state- ments made by petitioners at the meeting of January 18, in that petitioners felt that there was no particular wrongdoing or impropriety by Village officials or employees; that it is the sense of the Council that they would like to cooperate with the petitioners or with anyone else who wants information, either through the use of the Public Examiner or the use of Ernst and Ernst, but that Council is opposed to spending money for a complete audit of the record for the years indicated by the petition as this means a duplication of both effort and money; that if petitioners have specific questions for the State Examiner the Council will cooperate in having these specific matters investigated. Hyde estimated that $100,000 to $150,000 would cover 1/3 financing of special assessments for sanitary sewer and watermain laterals for those of the above plats for which the services can be made available, to request financing for his plat in line with that considered at the last meeting. following stipulations: Beginning as of this date, approval of final plats only after compliance with the following requirements - Installation at developer's expense and under supervision of Village Engineer (a) Lateral watermains (b) Lateral sanitary sewers and (c) Storm drainage facilitiesj'or filing by the developer of a performance bond in sufficient amount to cover cost of installing such utilities. - Installation of Storm drainage facilities, or filing of performance bond to cover same, in those subdivisions where sanitary sewer and watermains have not been programmed. - Construction of all-wather surf aced roadways by developer, or filing of performance bond to cover cost of same. Waiver of above requirements by unanimous vote of Council in plats which do not have as a part thereof a new public street and which do not increase the original number of platted lots. Mr. Roy Peterson spoke in objection to two portions of the proposed Resolution, He asked that developer not be required to provide drainage facilities for an entire drainage basin, which sometimes encompasses an &ea much larger than the subdivision to be platted; also, that the provision.for all-weiikher surfacing be stricken for the reason that such surfacing should not be done until at least a year after the underground utilities are in and that, unless building is entirely completed at time of installation the Village would simply be assuming a maintenance problem. Planning Director Swanson was asked, "Is there any question that every developer' filing a plat after September 1, 1957, knows that sewer and water will be required of them?''
