Members answering Rollcall were Bank, Kohler, Tupa and Bredesen. Minutes of the Regular Meeting of March 24, and of the Special Meeting of April 3, were approved as submitted, by Motion Xupa, seconded by Kohler and carried. BIDS TAKEN APRIL 11 AND APRIL 14. taken, and his recommendations, and Council took action as follows: presented for Construction Vdork, and a total of six bids on Baseball Backstops. Park Department's recommendation was for award to Low Bidder, Swanson Excavating Company for Finish Grading-Seedbed; Seeding; Sodding; and Tree Removal, the total contract cost to be based on bidder's unit prices, with recommended contract ward being $16,422.80; for rejection of all bids received on Bituminous Parking, Planting, and PathConstruction, and rejection of all bids received on Baseball Backstops. Cornelia Park improvements; that baseball backstops are being re-designed. Bank's motion that contract be awarded, and that balance of bids be rejected, all in accordance with recommendation of Park Department, was seconded by Tupa and carried. TRACTOR-!LOVER (Bids Taken April 14). Tabulation of Bids showed a total of five bids received, Astleford Equipment Co., Inc., bidding on an International , Model 1-330, at $2,760.00, being low bidder. Mr. Hyde explained that he would like to delay award pending letter from manufacturer as to performance. action taken. Manager Hyde presented Tabulations of Bids PAMELA PARK IMPROVEhlENTS (Bids Taken April 11). A total of five bids I It was explained that parking lot surfacing can be re-bidewith No ARDEN PARK IMPROVEMENTS- Petition in favor of development of Arden Park, signed by owners of some 234 residences in the area proposed to be served by this park, was filed. Mayor Bredesen told the audience he doesn't believe the people immediately surrounding the park are being unselfish in prohibiting expansion of the play area, but that he does agree with the opposition that the plan for development is over- ambitious. Manager Hyde reported receiving a call from one of the leaders of the opposition, requesting that a meeting of opponents and proponents be scheduled, in order that neighbors might work out a plan satisfactory to all. Hopkins, 53rd and Wooddale, a sponsor of the petition for development, stated that petitioners want the allocated $25,000 spent for this park, but %hat he, for one, feels that the present plan is ambitious; that proponents do want a bridge across the creek, a meadow play area, the channel defined so that potholes will not be dangerous; that he believes the vigorous opposition is to the entire plan and certainly not to a limited plan coming within the allocated budget. Bredesen told sponsors of petition that a meeting of the neighbors would be scheduled at the earliest convenient time, and that proponents would be notified of its time. Mr. John Mayor BUILDINGS ON McNELLIS "PUMPKIN FARM" ORDERED REMOVED. Petition, signed by some 40 residents in the neighborhood of the McNellis Pumpkin Farm at Highway No.169 and W.49th Street, asked for removal of house and outbuildings on the premises, claiming that these buildings constitute a safety hazard. that, back in December of 1957, the buildings had been ordered removed; that, because it is apparent that the Highway Department will eventually take some or all of this property, the removal order was stayed for six months with the thought that by that time the owner would know the status of the property. Nevin, present owner, objected to the expense of removal in view of a probable condemnation. 30 days; that if there is non-compliance with order, Village proceed to remove and assess cost of removal against property. Some discussion was has as to the procedure to be followed for assessment of costs, and further conversation with regard to method of removal (as a possible fire drill or civil defense exercise), and cost of filling excavation. Tupa moved that Council order removal of house and outbuildings within 30 days; and that, subject to the Village Attorney's advice on legality of procedure for assessment of costs of removal and subject to Manager's negotiations with owner as to costs of filling of excavation, the Village proceed to remove the buildings and otherwise abate this safety hazard upon pon-compliance with removal order. SANITARY SE'JER IMPROVEEIIENT NO. 53 ASSESSMENTS CANCELLED FOR LOTS 14 AND 41, NORMANDALE THIRD ADDITION. for cancellation of assessment levied in 1953 for Sanitary sewer Improvement No.53, on Lots 14 and 41, Normandale Third Addition-which lots lie beneath Northern States Power Company" s highline and are, therefore, unfit for dwellings. Manager Hyde recommended cancellation of levy on the basis of "no benefit", and Bank offered the following Resolution and moved its adoption: Manager Hyde reported owner Frank Natole's request 4/14/58 RESOLUTION CANCELLING SPECIAL ASSESSMENTS FOR SANITARY SEWER IMPROVEMENT NO. 53 ON LOTS 14 AND 41, NORMANDALE THIRD ADDITION WHEREAS, it has been determined that the Special Assessments levied for Sanitary Sewer Improvement No, 53 against Lots 14 and;41, Normandale Third Addition, are incorrect; and against said properties should be cancelled: Edina, Hennepin County, Minnesota, that the assessments levied against the above named parcels of property be, and hereby are, cancelled from the assess- ment roll for said Sanitary Sewer Improvement No. 53. advised of said cancellation and requested to correct their records accordingly, - of said properties for the amounts paid on said special assessments for the years payable 1954 to 1957 inclusive. OILING PETITIONS ACCEPTED. were accepted for work by Motion Bank, seconded by Tupa and carried: Motion seconded by Tupa and carried, The following Oiling petitions were submitted, and Halifax Lane, Woodland Circle to W.54th St. Brookview Ave.,W058th to ~~59th St. Bolf he., Valley View Rd. to Roberts Place. Danens Drive from Duggan Plaza to Ridgeview Drive. The last petition requested "Oil or Lignite Liquor". Manager Hyde reported that Lignite Liquor is a paper residue which is coming into use for street surfacing; and Mr. Zikan added that he has been approached by a salesman for the product who states that its price is between four and six cents per gallon as compared with the approximately 134 paid for road oil. this product, Engineer asked to investigate STORM SEWER HEARING SCHEDULED FOR ENLARGEMENT OF TEMPORARY SEWER BETWEEN 6925 AND 6929 SOUTHDALE FIRST ADDITION. Petition was filed, signed by owners of about 25 residences in Southdale First Addition, asking for enlargement of present storm sewer located between 6925 and 6929 Southdale Road. Mr. Crouch, sponsor of the petition, stated that the drain worked well for awhile, but that as the property builds up, it is noticeable that the drain becomes less and less adequate; that neighboring owners are much afraid their basements will be flooded unless some- thing further is done. Manager Hyde explained that the original storm sewer had been constructed with General Fund moneys as an emergency measure, inasmuch as it is planned that this area will be a part of the large storm sewer project now under consideration; that it is questionable that an additional $1,500 will be well spent for enlargement. properties, with a credit to be issued when permanent storm sewer is installed. Petition requested assessment against benefited APPLICATION FOR INCREASE IN BUS RATES TO BE FOUGHT. Commission's notice of a public hearing to be held April 29, on Minneapolis Street Railway Company's application for an increase in bus fares brought on a discussion as to possible action against an increase. Bank moved that Village Manager be authorized to investigate proposed action to be taken by other municipalities, including Minneapolis, on this application, and to join with other communities in attempting to prevent any increase. TAX DELINQUENT LANDS TO BE ACQUIRED FOR ROAD PURPOSES. Hennepin County Auditor's Non-Conservation List No. 444-C, dated February 25, 1958, showing three parcels of tax delinquent land, was reviewed. Village Attorney Hasselquist He Council requested report at first regular meeting in May. HOPKINS-EDINA BORDER ROAD MEETING SCHEDULED, Heights residents, headed by Mr. G. R. Thurber, 301 Adams Avenue, asked that Edina do something to make possible the planking of a tree and shrubbery screen by Superior Separator Company at the north boundary line of Third Street. reminded the Council that Hopkins has requested a joint meeting on the opening of Third Street between Blake Road and Washington Avenue; that their Estimate of Cost for acquisition of property is $20,000; and that the Estimate of Cost for improving the road to a thirty-foot width is $39,000; to a 44-foot rvid€h, $60,360. Neighbor- ing residents evinced no desire for the road, stating that all they want is a screen against the commercial property to the North; that the Company is willing, ready and able to install the screen providing they are given permit to do so. In order to.have full information on the matter of Hopkins‘ request for the border road and any possible tie it may have with the planting of a screen, Manager Hyde was directed to schedule a joint meeting with the Hopkins and Edina Councils for 4:OO P.M., Friday, April 18. results of the meeting. Preliminary presented, together with Planning Commission's recommend--2, ation for approval subject to establishment of street right-of-way for Wooddale Avenue, and adjustment of frontages of Lots 1 through 6, Block 5 to 80 feet (which would accomplish the closing of West Shore Drive across the South lots, and the opening of Wooddale Avenue). relation of this plat to the property to the West; and the following plat was presented : Council asked that members be informed as to the "FINAL PLAT"-NORMANDALE LAKES ADDITION - REFERRED BACK TO PLANNING COMMISSION: NO ACTION TAKEN ON FINANCING OF SANITARY SEWER AND WATERMAINS. This so-called Final Plat was presented to the council, with the report that it was not previously presented to the Planning Commission because this office had not received it until April 10--the .deadline for sewer and water financing consideration. Attorney Thompson, representing the platting interests, stated that owners did not know of the Council's decision on financing of sewer and water for new plats until approximately a week before the filing deadline; that Mr. Chapma,n, to whom the Village had sent the notice, had failed to notify the present owners. It was pointed out in discussion that Mr. Tom Chapman has consistently acted as the agent for the owners of this development; that the village had no knowledge of any change in either ownership or agency, and had acted in good faith in sending its notice to Mr. Chapman. plat the consideration of 1/3 utilities financing, pressing his point with a plea that developers be advised tonight of Council's decision. Manager Hyde pointed out that the Village has installed a Sanitary Trunk Sewer along the line of the Northernmost street in this plat; that the "Lake" shown on the plat is under consideration as a possible ponding area for the proposed "Lake Cornelia" storm sewer project. Bank moved that this plat be accepted only for referral to the Planning Commission, so 'that it can be coordinated with regular platting procedure, and that it not be considered as having been filed on time for financing of utilities on a 1/3 basis. Motion lost for want of a second. Mr. Thompson asked that Council act to allow this Mr. E. C. Stow pointed out that arrangements should be made for a connecting street between the Morton Arneson property ttb the East and the Normahdale Lakes and Lake Edina plats--that this would be one way of obtaining gas for the two latter plats. He was assured by Mr. Swanson that the Planning Commission is just as anxious to make these arrangements as is Mr. Stow. Kohler moved that PRELIMINARY PLAT OF SOUTH GARDEN ESTATES 4TH ADDITION AND "FINAL PLAT" OF NORMANDALE LAKES ADDITION both be referred back to the Planning Commission, for integration. Motion seconded by Bank and carried. Mr. Thompson asked if it is the Council's decision that the Normandale Lakes plat is in no event eligible for ten-year special assessments for utilities, and was informed that this is definitely the Council's decision; but that the Council has taken no action concerning its policy on 3W? 3-year financing for this plat. FINAL PLAT--BROST ADDITION. This plat, carrying Planning Commission's recommend- ation for approval, is a rg-subdivision of Lots 4 and 5, Normandale Terrace, into three 85b300' lots. Road. Manager Hyde reported that because of the extent of the damages sustained by the new 1958 4-Door Plymouth, as the result of a successful attempt to apprehend some juveniles, (damages between $450 and $650) it may be possible to secure a new vehicle for very little more than it will cost to repair the damaged car; that, because the amounts involved aremore than $500 it will be necessary to take bids on the new car-with trade-in on damaged car to be a part of the bid. Bank's motion, that the Village take bids on a new police car in accordance with Manager's recommendation, was seconded by Tupa and carried. FLOORING AUTHORIZED FOR VILLAGE HALL BASEMENT. finishing offices in the Village Hall basement was presented, showing that to date the work has cost $2,781.63, as against a total bid of $4,890 by H.N. Planning Commission's April 2nd approving recommendation was noted, it being subject to submission of easement, filing of bond of $2,000 for street improvements, park acquisition dedication of $1,450, utilities easement between Lots 5 and 9 and 6 and 7, Block 1, change of street name from "Drive" to "Lane" and agreement as to financing of sewer and water. Mr. Swanson reported that an .. REQUEST FOR 1/3 FINANCING OF SANITARY SEWER AND WATERMAIN IN "BROOKVIEW HEIGHTS 4TH AND 5TH ADDIT1ONS"DENIED. Developer E.C. Stow was present to support his written request dated April 9, asking that Council consider "Brookview Heights 4th and 5th Additions" as being eligible for 1/3 3-year financing on sanitary sewer and watermain construction. Mr. Zikan reported having received a proposal from the Richfield Engineer, for Richfield's oiling of Xerxes Avenue between approximately 73rd and 78th Streets at a cost of approximately 67$ per foot, with Edina to pay half the cost. Because no petition for this service has been received, and because it is felt that Edina can oil its half of the street at a cheaper cost, this proposal was rejected by common consent of Council. REPAIR OF ORNAMENTAL STREET LIGHTS ON BROWNDALE AVENUE AUTHORIZED. told Council that the ornamental light at Sunnyside and Browndale has been broken off for some time; that it has been impossible to ascertain who was reFponsible for the damage; that it will cost between $700 and $800 to have it fixed. that the light at 4507 Browndale (which is connected to the main line by under- ground cable through private property) has dimmed because of some damage to the cable; that it should be tied to the one at the corner--which will mean an additional expenditure of some $800. and Kohler moved, authorizing Village Engineer to have both lights repaired at once. Engineer Zikan reported that the consulting engineer retained to survey the area affected by the petition for Storm Sewer in West Woodland Road and Concord Terrace, filed with Council September 10, 1956, has stated that a storm sewer will not solve the drainage problem; that the yards have been graded so as to trap drainage water near the basements. he be authorized to inform petitioners of the situation by letter; that owners be advised to tpegrade. to property owners in accordance with his recommendation was seconded by Kohler and carried. Mr. Zikan suggested that the petition be voided and that Bank's motion authorizing Engineer to proceed with advice 4/14/58 DRAINAGE PROBLEA!S--BLOCK 21, MENDELSSOHN. Developer Folke Victorsen asked Council decision concerning his drainage problem in connection with development of Block 21, Mendelssohn. He owns the entire East half of this block, and some of the West half of the block. of Block 21. These two blocks, situated between Waterman and Maloney Avenues, are high at both streets, and low in the middle. At present the drainage flows from . Lot 21, Northeasterly, across Blocks 22 and 23, to a pond bordering Interlachen Golf Course. Block line of Blocks 21 and 22. Mr. Zikan explained that it is Mr. Victorsen's wish to fill in the middle of the block; that a fill of at least ten feet would be necessary; that, with this amount of fill a right-of-way of at least fifty feet is necessary; sixty feet being preferred. Also, that construction of the road would divert the drainage from its present ponding area to Maloney Avenue, thence Northeasterly to a small pond in Blocks 10 and 9, Mendelssohn. solution to Mr. Victorsen's problem, Mr. Zikan explained that a Storm Sewer for the entire area is the only real solution to the problem. who had previously been consulted by Mr. Zikan on this matter, stated he feels the village should require the developer to secure drainage easements and ponding rights to whichever'pond the water will eventually drain, or sign an agreement with the Village, holding the Village harmless €or whatever damage might result from diversion of waters. Mr. Victorsen pleaded inability to secure drainage easements for the reason that the owner of part of Block 22 is unwilling to have the street constructed and therefore will not be cooperative. He also seemed unwilling to consider a hold harmless agreement; and, after some considerable discussion, stated he will present the best plat he can of this property for Planning Commission and Council consideration. Mr. French told the Council that, in order to facilitate sale of season's tickets, the price of single admission tickets should be set, He reported the recommendation of the Park Board (made after considerable thought and discussion on the part of the Board and a meeting with representatives of a dozen local organizations), that single admissions be 50g per person, regardless of age or place of residence. He stated that, because the children of EAorningside are so closely integrated with Edina's educational and recreational pattern, it is the Board's opinion that season's tickets be offered Morningside children, 18 and younger, for $5.00 per child; no family nor adult season's tickets to be offered to Morningside residents. 1.b.
