Minutes of the Regular Meeting of May 12, 1958, and Planning Commission-Council Fleeting of May 16, were approved as submitted, by motion Dickson, seconded by Tupa and carried, POOL CONCESSION OPERATION DISCUSSED. of four bids for the operation of the Pool Concession Stand; Stewart Infra Red; Canteen Company, Hot Dog Service, and DeLaria; the best being Hot Dog Service's proposal to run concession with return to Village of 12% of Gross, with $50 per week guaranteed minimum. restricted because of the one-year term of operation. stated the Board feels that bids are far too low; that it is the recommendation of the Board that the concelssion be operated with Village labor; that the matter of supervisory help is the Village's problem even if the concession is leased out. Some discussion had, Council still being of the mind that operation of the pool, itself, will present sufficient first-year problems for the Board and park personnel. It was suggested that the Village purchase the necessary equipment and then get bids on operation of concession; and Kohler moved that Park Board present bids on basis of Village's purchasing equipment. and carried. Manager Hyde reported receipt by the Park Board I He reported that the Board feels that bids have been Mr. Stevens of the Park Board h'lotion seconded by Bank ASSISTANT POOL MANAGER'S SALARY ESTABLISHED. be necessary to have an Assistant Pool Manager, inasmuch as the Pool will be open some 84 hours a week. He recommended that the Council establish a salary of $375.00 per month for the Assistant Pool Manager and Head Swimming Instructer. Bank's motion that position of Assistant Pool Manager be established, with salary of $375.00 per month, was seconded by Dickson and unanimously carried. Manager Hyde reported that it will PUBLIC HEARINGS ON PROPOSED IMPROVEMENTS. in Edina-Morningside courier May 15 and 22, 1958, of "Notice of Public Hearing on Proposed Sanitary Sewer and gatermain Improvements"; and, pursuant to said Notice the following public hearings were conducted and action taken: VANDERVORK AVE. TO OXFORD AVE.: OXFORD AVE. FROM DIVISION ST. TO 290' S. OF W.51ST ST.: INTERLACHEN BLVD. FROM BEDFORD AVE. TO 125' VI. OF UXIEORD AVE. Vu-Graph Slide was shown, and Estimate of Cost was given as $62,295.60, for $15.32 per Assessable Front Foot (or, under new method of assessment, $1,117.40 per lot), 4528 Oxford Avenue, objected on grounds of "no need" and "excessive expense". Engineer Zikan reported that petitions have been received from Oxford Avenue, South of Interlachen Blvd. and that this area can be served only by,running the line to the North, to Division Street; that, at the time the Hollywood Road Sewer was planned, in 1956, it was purposely kept high as an economic measure for the people then requesting sewer; and kthat the only alternative for serving Oxford Avenue South of Interlachen is now to run to Division Street. Question was raised as to whether South Oxford could be served by a line in Interlachen to the west of Oxford, to connect with the "Skyline" portion of the main, but I&. Zikan explained that the intersection of Oxford and Interlachen is the low point and that this cannot be done by gravity. construction of a lift station at Oxford and Interlachen. such a study had not been made but that it is known that costs would be very high. Mr. Score, owner of 145 feet on Division Street, protested that he neither wants nor needs the utility. It was pointed out that Oxford Avenue North of Interlachen has just been resurfaced; that owners do not want it dug up again. Di6UUSSiOn was had by Council on matter of continuing hearing for further study as to a lift station, after presentation of petition by owners of a majority of the properties on Oxford Avenue between Interlachen Blvd, and Division Street, objecting to the project; then, Aka Cooney, 4805 Oxford, asked that if possible Lots 5, 6 and 7, Block 4, Beverley Hills, be included in kthe study for sewer, bring in a petition if this property is to be included in the study. motion that Public Hearing be continued to June 23, for further study by Engineers, was seconded by Bank and carried. SKYLINE DRIVE TO 400 FT. EAST. Vu-Graph Slide was shown, and Estimate of Cost was read at $1,171.84 per lot. Mr. Hansen, owner of 206 feet at the corner of Skyline Drive and Interlachen Blvd,, objected to the sewer's being routed East of Skyline. Mr. Zikan explained that, because this is "hill" property, the sewer can go either East or Vlestd Hansen's, &&&$that unless there is a great difference in cost he doesn't care which way the Sewer is run. Bank's motion, that Hearing be continued to June 23, €or further study by Engineers, was seconded by Tupa and carried. Clerk presented "Affidavit of Publication" 1. PUBLIC HEARING ON PROPOSED SANITARY SEWER IN W.59TH STREET FROM TINGDALE AVENUE TO CODE AVENUE. as $5,701.20, or $475.10 per lot. Mr. Patton, 5120 w.59th St., expressed himself as being definitely in favor of the project, as did Mr, Thos. Byrnes, 5116 W.59th St. There were no objections registered at the Hearing, and no written objections had been received prior thereto. Xupa offered the following Resolution and moved its adoption: 3. PUBLIC HEARING ON PROPOSED WATERMAIN IMPROVEMENT IN OXFORD AVENUE FROM Vu-Graph Slide was shown, and Estimate of Cost was given RESOLUTION ORDERING IMPROVEMENT SANITARY SEWER IMPROVEMENT NO. 144 BE IT RESOLVED by the Council of the Village of Edina, Minnesota, that this Council heretofore caused notice of hearing to be duly published on the proposed improvement of W.59TH STREET BETWEEN TINGDALE AVENUE AND CODE AVENUE BY CONSTRUCTION OF SANITARY LATERAL SEWER AND APPURTENANCES THEREIN, and at the hearing held at the time and place specified in said notice the Council has duly considered the views of all persons interested, and being fully advised of the pertinent facts does hereby determine to proceed with the construction of said improvement; that said improve- ment is hereby designated and shall be referred to in all subsequent proceedings as SANITARY SEWER IMPROVEMENT NO. 144, and the area to be specially assessed therefor shall include all lots and tracts of land abutting the street proposed to be improved;; BE IT FURTHER RESOLVED that, in the opinion of this Council, it is to the general interest that the special assessment to be levied for said proposed improvement be on a "per lot" basis. Vu-Graph Slide was shown, and Estimate of Cost of the line, through an easement between Lots 4 and 5, Block 2, Richmond Hills 2nd Addn., was given as $41,260.80, or $937.75 per lot. Mr. Zikan explained that it is possible to construct the sewer from Richmond Drive through the stub street, but that it is completely impractical to do so because of the very considerable extra expense involved. lk. L. M. Gebo, owner of Lot 3, Block 1, Edenmoor, stated that he dl1 go along with the project although he did not petition for it. Mr. R. K. Frank, 5244 Edenmoor Street, objected to the proposed assessment on a "per lot" basis, wanting it on a "per front foot" basis because that is the way he purchased his lot. Mr. Dobbelman, stating he is especially interested in the proposal for the easement through Lots 4 and 5 because he ovms one of the lots, suggested that this easement could not be condemned because the sewer can, physically, be routed another way. Clerk presented Affidavit of Publication in Edina-Morningside Courier May 15-and 22, 1958, of "Notice of Hearing on Proposed Storm Sewer Improvement", which affidavit was approved as to form and ordered placed on file. Hearing vias held on proposed construction of Village Storm Sewer and Appurtenances "Commencing at a point 33 feet, more or less Nest and 10 feet, more or less, south of the intersection of the centerline of ~~~60th St. and h'Jooddale AVe.; tho Easterly along a line parallel to and 10 feet South of the centerline of VJ.60th Street to a point 35 feet, more or less, East of the centerline of Oaklawn Avenue; thence NEly to a point 160 feet, more or less, East of the centerline of VJ.59th St.; th. NEly to a point 10 feet South and 10 feet East, more or less, of the intersection of the centerline ofM.59th St. and Brookview Ave:; th. Nly on a line parallel to and 13 feet, more or less, West of the centerline of Brookview Avenue, to a point 128 feet, more or less, South of the centereline of 'SJ.58th Street; thence Easterly, parallel to the centerline of I'J,58th Street, 150 feet, more or less, to the Outlet". Vu-Graph Slide was shown, of the proposed route of construction, and the outline of the district proposed to be assessed for cost. lik. Brauer explained that the storm sewer is being planned to correct the erosion on W.6Oth Street, and the ponding on !?*58th Street and Brookview Avenue, and to transport the water from these two areas in the most satisfactory manner. Estimate of Cost was read as $36,987.00; it being proposed that the village pay some $2,000 for Village-owned property benefiting, and the balance to be assessed at the rate of $.0295 per square Foot. During the Hearing petitions against the project were presented 5900 Block on Vooddale, 5800 Block on Brookview, 5800 and 5900 Blocks on Kellogg and Oaklavm Avenues. In answer to questions from the audience--Mrs. Bing and others,--as to why a spillway cannot be put in directly East of rl~.60th Street, instead of carrying the sewer North to 58th Street, Tk. Brauer explained that because of the mucky soil condition, carrying the water directly East of U.60th Street will be considerably more expensive than present plan. The gentleman living at 5912 Kellogg, stating that "If 60th Street had been put in two or three years ago it would have been drained to the park", asked that the area be assessed for repairing W.6Oth street and that the General Fund of the Village pay the balance of the cost'. again, that the W.6Oth Street problem is not the only problem; that there is also the ponding at 58th and Brookview. Mr. Engquist, 5809 Brookview, stated that his area gets considerable water and that he, for one, would like to get rid of it. There was some discussion by the owners of property on the boundary lines of the district proposed to be assessed, that their particular lots drained into another storm sewer; and Mr. Brauer brought out the fact that, in many cases drainage is divided, the rear of the lots draining one way, the front of the lots the other way; and that in most cases this has been taken into consideration and, if a lot is already assessed, chances are it is only a portion of that particular lot. Manager Hyde stated that the average cost of storm sewer is about $.02 per square foot, and suggested that the Village might bear sufficient of the cost to reduce this proposed assessment to $.02 (which would mean a Village contribution of some $10,000 to $12,000, rather than the $2,000 originally proposed) because the proposed project would reduce or eliminate present general fund costs on maintenance of N.60th Street. construction of Curb and Gutter and Blacktopping between Wooddale and Oaklawn Avenues was discussed, and Mayor Bredesen told the Council that if any portion of such an improvement is to be assessed there must be a public hearing thereon. Mr. Hyde reported that, :i -%' pursuant to conversation with the Council at the last meeting, relative to using Gas Tax Funds (for Municipal State Aid Streets) in Benton Avenue from Highway No. to Tingdale Avenue, he would recommend that dhe presently proposed project be abanborigf Letter of protest, signed by Messrs. Tom Hastings, Jr.? 5901 Josephine Avenue, E.J. Haskin, 5900 Josephine, was submitted and ordered placed on file. This lette asked that project be delayed a year "until there is sufficient in the state aid fund to handle the complete project". Bank's motion, abandoning project as set forth for public hearing of April 28th, and calling public hearing on the Counc own motion at the earliest convenience of the Village Engineer for Curb and Gut and Blacktopping of Benton Avenue from Highway No. 100 to Tingdale Avenue, was seconded by Dickson; and on Rollcall vote there were five ayes and no nays, and motion was carried. PUBLIC HEARING ON "PUMPKIN FARM" BUILDINGS CONSTITUTING A NUISANCE. This Public conducted pursuant to Notice served on Mr. John Nevin, 4615 Moorland Avenue, o and posted on premises at 4832 Vernon Avenue, that Council would meet on this "to determine whether buildings on these premises should be ordered repaired, vacated and repaired, removed or demolished, in accordance with the provisions Ordinance No. 148". Tabulation showed receipt of two bids, that of Astleford Equipment Co. at $100, and that of W.N. Gramer at $125, Manager recommended sale to highest bidder, and Kohler so moved. Motion seconded bv Dickson and carried. He recommended award of-contract to low bidder, 4. SkE OF 1946 FORD 1/2 TON PICKUP TRUCK. Five bids received, Hanson- Erickson Auto Parts Co. being high, at $65.00. Dickson's motion, for sale of truck to high bidder, was seconded-by Bank and carried. REROUTING OF BUS FROM H.60TH STREET TO VALLEY VIW ROAD PETITIONED. lilr. C. E. I Medcalf and Ab. c. R. Moser were present to support petition filed with the Clerk for removal of bus from N.60th St. between wooddale and Concord, and rerouting of bus for round trip on Valley View Road; the reason for their request being that Valley View Road is blacktopped, whereas the heavy buses damage oiled 60th St., making it impossible to keep the street in condition. audience requested that the bus be rerouted to Brookview Avenue and thence to W.60th St. Kohler moved that the Council attempt to secure some disposition . from the Bus Company as to re-routing of bus. Messrs Medcalf and Moser presented petition for Oiling, stating they had intended to have this matter delayed until some disposition could be made of bus re-routing; but that dust had become so bad they can wait no longer.
