Morningside courier May 15 and 22, 1958, of "Notice of Assessment Hearings on
Sanitary Sewer Nos. 129, 130, 131, 132, 134, 135, 136 and 137," which Notice was
approved as to form and ordered placed on file. Pursuant to said Notice, the
following Special Assessment Hearings were conducted and action taken as recorded:

Resolution, Mr. F. Harry Andrews, No. 3 Orchard Lane, inquired concerning
resurfacing of Orchard Lane. He was informed that he must be patient--that
this work will not be done until after construction of watermain, although the
hole about which he spoke will be filled; that it is advocated that streets
settle for a year after underground construction before resurfacing is attempted.
He raised no objection to Council's action levying assessment.

RESOLUTION ACOPTING AND CONFIRNIING ASSESSMENTS
SANITARY SEWER IMPROVEMENTS NOS. 129, 130, 131,
132, 134, 135, 136 AND 137
BE IT RESOLVED by the Villaqe council of the Villaqe of Edina, Minnesota as follows:
1.
for SANITARY SEWER IMPROVEMENTS NOS. 129, 130, 131, 132, 134, 135, 136 AND 137, and
each of them, have been properly calculated in accordance with the provisions of
blinnesota Statutes Section 412.441; that notice has been duly published, as required
by law, that this council would meet to hear and pass upon all objections, if any,
to amend said proposed assessments as might be necessary, and to adopt the same by
resolution; that said proposed assessments have at all times since their filing been
open for public inspection, and opportunity has been given to all interested persons
to present their objections; and that each of the lots, pieces and parcels of land
enumerated in the respective assessments was and is specially benefited by the
construction of the improvements for which such assessment is levied in the amount
set opposite the description of each such lot, piece and parcel of land, respectively.

said improvements, respectively. The assessment against each lot, tract or parcel,
together with the interest accruing on the full amount thereof from time to time
unpaid, at the rate of five percent per annum from the date of this resolution,
shall be a lien concurrent with general taxes upon the property described therein
and all thereof. The total amount of each such assessment shall be payable in
equal annual installments extending over a period of ten years, the first of said
installments, together with interest on the entire assessment from the date hereof
to December 31, 1959, to be payable with general taxes for the year 1958, and one
of the remaining installments, with one year's interest on that and all subsequent
installments, to be payable with general taxes for the years 1959 through 1959
through 1967, collectible in the respective ensuing years.

assessment or any installment thereof without interest to the Village Treasurer
and thereafter such payment may be made with accrued interest to the County
Treasurer; provided that if any assessments or installments thereof be prepaid
to the Village Treasurer, he shall promptly notify the village Clerk and County
Auditor, and the assessment or installment so prepaid shall be cancelled on the
books of the County Auditor.
The Clerk shall, as soon as may be, prepare and transmit to the County
Auditor a certified duplicate of said assessments, with each then unpaid install-
ment and interest set forth separately, to be extended upon the proper tax lists of
the County, and the County Auditor shall thereafter cause said assessments to be
collected in the manner provided by law.

He reported that these three streets are heavily traveled, area-used; that it is
impossible to secure petitions by owners of abutting properties for improvements,
and that .in order to maintain satisfactorily an oil coat should be applied this
year. Suggestion was made that Lignite be tested in these t$F;x?ctat;fas; and Mr.
Hyde asked permission to purchase up to $1,000 of Lignite/for use in surfacing,
with the cost of the surfacing to be appropriated from Municipal State Aid Funds
(Maintenance) . Bank's motion, granting authority for purchase, and approving
charge to Municipal State Aid, was seconded by Dickson and carried.
