Morningside courier May 15 and 22, 1958, of "Notice of Assessment Hearings on Sanitary Sewer Nos. 129, 130, 131, 132, 134, 135, 136 and 137," which Notice was approved as to form and ordered placed on file. Pursuant to said Notice, the following Special Assessment Hearings were conducted and action taken as recorded: Construction of Sanitary Lateral Sewer and Appurtenances in South Drive from Dundee Road to Mirror Lakes Drive. Total Assessable Cost of $4,543.20, to be assessed against 805 assessable feet, for $5.56 per Assessable Foot, Plus $.08 per Assessable Foot connection to Sanitary Sewer Improvement No. 65, for a Total of $5.64 per Assessable Foot, as compared with Estimate of Cost of $6.80 per Assessable Foot. assessment were registered at the Hearing, and none had been received prior thereto. (See Resolution of later in meeting, Adopting Assessment). Construction of Sanitary Lateral Sewer and Appurtenances in 'Sdashington Avenue from Maloney Avenue to North Village Limits. showing a Total Assessable Cost of $10,741.70 to be assessed against 1,194.9 Assessable Feet, for $8.90 per Assessable Foot, plus $.08 per Assessable Foot connection to Sanitary Sewer Improvement No. 65, for a Total of $8.98 per Assessable Foot, compared with Estimate of Cost of $9.22 per Assessable Foot. Mr. G. J. Ostlund complained that the excess gravel had not been removed from the street, and was informed that this matter would be taken care of in the near future (See Resolution of later in meeting, Adopting Assessment). completion of Hearing and Resolution, Llr. SPECIAL ASSESSMENT HEARING ON SANITARY SEWER IMPROVEMENT NO. i37 - Construction of Sanitary Lateral Sewer in Interlachen Blvd. from Mirror Lakes Drive to 125 feet East of Cooper Avenue; Cooper Avenue from Interlachen Blvd. to Orchard'" Lane; Orchard Lane. Tabulation of Assessment was submitted, showing Total Assess- able Cost as $32,146.67, to be assessed against 3,849.9 Assessable Feet, for $8.35 per Assessable Foot, plus $.08 per Asxessable Foot connection to Sanitary Sewer Improvement No. 65, for a Total of $8.43 per Assessable Foot, as compared with Estimate of Cost of $9.59. registered at the Hearing, and none had been received prior thereto. (See follow- ing Resolution, Adopting Assessment) H* After conclusion of Hearing, and Resolution, Mr. F. Harry Andrews, No. 3 Orchard Lane, inquired concerning resurfacing of Orchard Lane. He was informed that he must be patient--that this work will not be done until after construction of watermain, although the hole about which he spoke will be filled; that it is advocated that streets settle for a year after underground construction before resurfacing is attempted. He raised no objection to Council's action levying assessment. i No objections to the proposed assessment were Bank offered the following Resolution and moved its adoption: RESOLUTION ACOPTING AND CONFIRNIING ASSESSMENTS SANITARY SEWER IMPROVEMENTS NOS. 129, 130, 131, 132, 134, 135, 136 AND 137 BE IT RESOLVED by the Villaqe council of the Villaqe of Edina, Minnesota as follows: 1. for SANITARY SEWER IMPROVEMENTS NOS. 129, 130, 131, 132, 134, 135, 136 AND 137, and each of them, have been properly calculated in accordance with the provisions of blinnesota Statutes Section 412.441; that notice has been duly published, as required by law, that this council would meet to hear and pass upon all objections, if any, to amend said proposed assessments as might be necessary, and to adopt the same by resolution; that said proposed assessments have at all times since their filing been open for public inspection, and opportunity has been given to all interested persons to present their objections; and that each of the lots, pieces and parcels of land enumerated in the respective assessments was and is specially benefited by the construction of the improvements for which such assessment is levied in the amount set opposite the description of each such lot, piece and parcel of land, respectively. and parcels of land described in satd respective assessments, and said proposed assessments are hereby adopted and confirmed as the proper special assessments for said improvements, respectively. The assessment against each lot, tract or parcel, together with the interest accruing on the full amount thereof from time to time unpaid, at the rate of five percent per annum from the date of this resolution, shall be a lien concurrent with general taxes upon the property described therein and all thereof. The total amount of each such assessment shall be payable in equal annual installments extending over a period of ten years, the first of said installments, together with interest on the entire assessment from the date hereof to December 31, 1959, to be payable with general taxes for the year 1958, and one of the remaining installments, with one year's interest on that and all subsequent installments, to be payable with general taxes for the years 1959 through 1959 through 1967, collectible in the respective ensuing years. 3. of any lot, piece or parcel of land assessed hereby may pay the whole of such assessment or any installment thereof without interest to the Village Treasurer and thereafter such payment may be made with accrued interest to the County Treasurer; provided that if any assessments or installments thereof be prepaid to the Village Treasurer, he shall promptly notify the village Clerk and County Auditor, and the assessment or installment so prepaid shall be cancelled on the books of the County Auditor. The Clerk shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of said assessments, with each then unpaid install- ment and interest set forth separately, to be extended upon the proper tax lists of the County, and the County Auditor shall thereafter cause said assessments to be collected in the manner provided by law. Manager Hyde asked authority to use part of the $20,000 allotted to the Village under the Wunicipal State Aid Maintenance Program" for the Oiling of Gleason Road from Valley View Road, North to intersection with Indian Hills; T;?.70th street from France to Normandale; and possibly Tracy Avenue from Grove Street to Highway 169. He reported that these three streets are heavily traveled, area-used; that it is impossible to secure petitions by owners of abutting properties for improvements, and that .in order to maintain satisfactorily an oil coat should be applied this year. Suggestion was made that Lignite be tested in these t$F;x?ctat;fas; and Mr. Hyde asked permission to purchase up to $1,000 of Lignite/for use in surfacing, with the cost of the surfacing to be appropriated from Municipal State Aid Funds (Maintenance) . This Council shall meet at the time and place fixed in the form of notice set forth below for the purpose of opening, receiving and acting upon sealed bids for the purchase of $970,000 Improvement Bonds to be issued to finance various improvements instituted pursuant to Minnesota Statutes, Chapter 429, during the current year and also in 1957. of the time, place and purpose of said meeting to be published forthwith in the Edina-Morningside Courier, the official newspaper of the Village; and in the Commercial west, a financial newspaper in the City of Minneapolis, Minnesota. 2. Trustee Dickson asked that every possible effort be made to keep property controlled by Park Board--Country Club islands, and other small park areas in the residential districts--well mowed and trim looking. STATEMENT OF POLICY ON RETIREMENT AT 65 YEARS OF AGE TO BE PREPARED FOR COUNCIL CONSIDERATION. Some little discussion was had on the matter of the "Xblic ' Employees Retirement Fund"--cost to employees and municipalities, and benefits derived. at the age of 65. Manager Hyde stated he feels that a rigid 'retirement at 65' policy is not right; that it might be better to formulate a policy of requiring a physical examination each year dfter the age of 65, to determine suitability for continued work. Manager directed to draft retirement policy along these lines, for consideration by the Council.
