Affidavit of Publication in Edina- Morningside Courier September 11 and 18, 1958, of "Notice of Public Hearings" was submitted, approved as to form and ordered placed on file. Pursuant to said Notice, the following Public Hearings were held, and action was taken as hyreinafter recorded: ,d .1. and: 2. .. :PUBLIC I-kARxNGS ON 'PROPOSED LATERAL SANITARY SEWER AND WATERMAIN FOR STREETS IN SOUTH GARDENS ESTATES 4TH ADDITION; said streets being West Shore Drive from Dunham Drive to Gilford Drive; Fondell Drive from wooddale AVe, to Oaklawn Ave,; wooddale Ave, from Ellsworth Drive to Gilford Drive; Gilford Drive fromwest shore Drive to Kellogg Avenue, for the SANITARY SEWER - and west Shore Drive from Dunham Drive to Gilford Drive; Wooddale Ave. from Ellsworth Drive to Gilford Drive; Fondell Drive from Wooddale Ave, to Oaklawn Ave,; Gilford Drive from West shore Drive to Oaklawn Ave,; Oaklawn Ave, from Ellsworth Drive to Gilford Drive for the WATERMAIN,. It was reported that, although the Notice lists improvements proposed for Fondell Drive from Wooddale Avenue to Oaklawn Avenue, this street is not in condition for excavation; that the Estimates of Cost doe not include this street, and it is not to be considered for improvement. Estimate of Cost for the proposed Sanitary Sewer was $36,179.70; for the proposed Watermain was $45,022.94, for $574.28 and $523.32 per Lot, respectively; estimates haveing been made by John Balich and Asstso, consulting engineers, There were no objections registered at the Hearing, and none had been received prior thereto, At a question from Trustee Tupa as to what basis of assessment these improvements will have, Manager Hyde reported that a 30-year term assessment for this plat was part of the consideration of the combination dedication-purchase of lands for ,sanitary sewer lift station and park,zBank offered the following Resolution and moved its adoption: cr4 03 ib a d 33 RESOLUTION ORDERING IMPROVEMENTS - SANITARY SEWER IMPROVEMENT NO, 154; WATERMAIN IMPROVEMENT NO. 134 BE IT RESOLVED by the Council of the Village of Edina, Minnesota, that this Council heretofore caused notices of hearings 20 be duly published on the following pro- posed improvements: A. ATFT : Village Clerk P.!ayor 30 PUBLIC HEARING ON PROPOSED OPENING. GRADING. GRAVELLING. BLACKTOPPING. AND CURB AND GUTTER-WEST 66TH STREET FROM NAOMI DRIVE TO TINGDALE AVENUE. Estimate of Cost was given as $16,555.16, to be assessed over 1,110 assessable feet, for $14.91 per assessable foot. high cost of this improvement, stated he can see no reason for improving this street, when "66th Street between Tingdale and Wilryan Avenue is impassable most of the time. Mr. Hansen stated he feels it would be proper to open the street,so that hk. Kenney has access to his property, but that he objects to-the curb and gutter and blacktopping proposed. steep grade, it would be completely impossible to maintain the street without the additional two improvements. One other gentleman stated that the intersecting streets would need some care, also, if 66th Street is opened; and Mr. Stow talked about advisability of insitalling catch basins to take run-off. It was noted that petition for improvement comes, not from owners of property abutting the street, but from owners in Normandale Second Addition, who are being bothered by those persons seeking directions to Brookview Heights.. At a question from Mr. Kohler as to the amount of traffic which 66th Street, West of Normandale Road, will carry, Engineer Zikan replied that it is difficult to tell, inasmuch as the'property to the North and Vest is not yet platted; but that it is surmised that this street' will carry considerable traffic as the area grows and after the crosstown highway is built. Manager Hyde asked those present if they would consider a 38-foot wide traveled roadway, with parking on only one side, should Council be able to include street improvement in the gas tax allocation for part of the cost. There was some further discussion along this line; and Bank moved that this proposed project be abandoned, and that Village Engineer be requested to study the possibility of improving the street with part of the cost to be borne from gas tax moneys, with Hearing to be next spring.. Mr. E. C. StovPs request, dated September 18, was read. It asked *' that council reconsider its stand on the assessing of lateral sewer and water improvements, and accept this letter as the Stow Company's petition for installation of these .improvements in the balance of Edgemoor. as soon as possible. Mr. Stovr was present, and stated that the Council's policy is working a hardship on all developers; that he is not trying to welsh on an agreement-that he is simply hoping that Council, after some consideration of the problem and some experience with the difficulties encountered, is ready to recons'ider its policy of developer-financed utili.ties. Council told Mro Stow that several of the local developers have already signed the developer-financing agreement; that, while some consideration is being given to a change in policy, the council is not yet ready to offer any alternative to its present policy. Bank moved that petition be denied. Motion seconded by Dickson and carried. J 9/22/58 ". 285 VACATION OF Wo59TH STREET BETWEEN OAKLAWN AND BROOKVIEW AVENUES HEARING SCHEDULTD. - Petition was presented for the Vacation of "the first one hundred feet of W.59th Street i measuring East from the center of Oaklawn Avenue, block between Oaklawn and Brookview Avenues was discussed; and Bank's motion, that Public Hearing on proposed Vacation of W,59th Street between Oaklawn and Brookview Avenues be scheduled for October 27. CONTINUATION OF ASSESSMENT HEARINGS FOR SANITARY SEWER IMPROVEMENT NO.139 AND WATEMIN IMPROVEMENT NO. 126 - STOW'S EDGEMOOR. Written report was presented by Clerk, pursuant to Mr, Eoc, Stow's request of September 15, for amendments in the tabulated assessments, to change the front-foot assessments for Lot 1, Block 5 and * Lot 6, Block 4, from 125 feet to 96 feet each; and for inclusion of Block 9, at 372 feet, in the Watermain assessment. Nr, Stow's letter of September 22, presented shortly before Council Meeting, was then read. It asked that other amendments be made in the watermain Assessment; and, because it was impossible to calculate the results of these additional amendments, Bank moved that Hearings be continued for one week, to September 29, in order that further report might be made. seconded by Dickson and carried. PUBLIC HEARING SCHEDULED ON PROPOSED "GASOLINE SERVICE STATION SPECIAL PERMIT SECTION OF ZONING ORDINANCE", Council studied Planning Director Swanson's recommendations for this Special Permit Section, as approved by the Planning Commission on September 18. Dickson's motion, scheduling Public Hearing for Monday, October 27,- on this Zoning Ordinance Amendment, was seconded by Tupa and carried. PUBLIC HEARING SCHEDULED ON PROPOSED VACATION OF CUL-DE-SAC AT WEST END OF WATERMAN AVENUE. Planning Director Swanson asked that Council vacate the Cul-De-Sac dedicated by legal description some time ago, in favor of plat dedication. Tupa's motion, scheduling Public Hearing on proposed Vacation for Monday, October 27, was seconded by Bank and carried. PINAL PLAT OF "CODE AVENUE ADDITION" APPROVED. Final Plat of Code Avenue Addition (Resubdivision of Lots 1 and 2, Block 1, Code's Highview Park) , together with Planning Commission's recommendation that plat be approved, subject to - 1. Letter of agreement that building permit will not be sought on Lot 3 until such time as Code Avenue is widened to its full width; and 2. Homes on Lots 1 and 4 be allowed to face nortfi, provided all required setbacks are complied with, immediately hereafter, and Kohler moved for approval of plat, subject to compliance with requirements set forth by Planning Commission. carried, Planning Director Swanson presented Some discussion was had with regard to this plat, as recorded Motion seconded by Tupa and ,CHANGE IN NAME OF "WEST" CODE AVENUE TO "PORTER LANE" RECOMMENbED. Swanson showed the Council the confusion which will result when the South extension of llWest*l Code Avenue'is opened. He recommended that "Westt1 Code Avenue be changed to "Porter Lane", decided to wait until llWest*l Code is extended South before taking any action, Planning Director Council agreed that this would be in the public interest, but OPENING OF llWEST1l CODE AVENUE OF CONCERN TO OWNERS OF ABUTTING PROPERTIES. Mr, Glen Carlson, 5908 Code Avenue, expressed his concern at the possible opening of "West" Code Avenue. He reported that, pursuant to instructions from the Village, he had set his house back 90 feet from'Code Avenue; that if llWestllCode Avenue is opened he would be forced to dedicate 30 feet for the street, and, because of-assessments for utilities, etc., he would be forced to divide his property into two lots with one facing I1Westt1 Code; leaving his own site with a back yard of only some fifteen feet. 9/22/58 ?.kc. Carlson was informed that, where there is sewer and water in the area, lots 286 are required to have depths of only 120 feet. JACKSON AVENUE PROTEST RE-HEARD, their driveways, newly constructed, had been ,left "high and dryq1 at the grading of Jackson Avenue by the Village--and the Council's action asking for a report from Engineer Zikan-five residents of the 400 Block on Jackson Avenue were present to hear hlr. Zikan's report. Mr. Zikan presented Vu-Graph Slide, showing that the traveled roadway had been widened two feet on either side; and a written report, showing the very small differences in elevation llbefotre and. aftert1 the improvement. Mr. zikan's report stated "The cuts at the gutter lines indicate the difference i-n elevation between the blacktop and the lawn, however, if a concrete curb is con- structed on this street the toptof the curb.would be 0.5 above the wtter elevation. The west side of the street would require no adjustment of the lavm. The east side would require a small adjustment of the larvns. The surveying crew indicated that the ovrners had carried their lavm and driveways into what is now the standard 30 foot traveled roadway, and that the traveled street was about 26 feet wideg1. Alessrs. Harvey L. Olson, Paul Hedblom, John H. After some further discussion, Manager Hideistakes suggested that laws could be sloped at very little expense to the Village, but it (had not seemed to be the concensus of the delegation that they would prefer to repair the lawns themselves, but that they wanted the driveways repaired by the Villase- sloped, and then blacktopped. They stated that the only .driveways affected are those of the five persons present, and possibly one other. Manager suggested that a survey be taken, to ascertain the cost to property owners to have the Village repair driveways; and matter was left, without formal action by the Council. (been (requested. ASSESSAWS FOR SANITARY SEVER IAIPROVEMENT NO, 125, AND WATERMAIN IMPROVEMENT NO, 120 AAlENDED. Written report was presented, concerning the requests made by Mrs. G.E. Hardy, 5425 France Avenue south, €or adjustment in her assessments for each of these improvements, SANITARY SEVER IMPROVELENT NO. 125 for ks. Hardy's property, from the $561.75 proposed to be assessed, to $399.00; the General Fund to assume the $162.75 difference-the reason being that the Hardy property should bear an assessment for its full front footage on Vi. Fuller Street (240 feet) rather than the 135-foot frontage for which it was originally assessed for Sanitary Server Improvement No. 12; and that this $399.00 will bring Sanitary server Assessment to this amount. Report also recommended cancellation of assessment for one Watermain Connection for Watermain Improvement No. 128 ($72.00) , and that Waterworks Fund assume this amount. Tupa' s motion, that Sanitary Sewer Improvement No. 125 and Watermain Improvement No. 120 Assessments be amended as recommended by Clerk's report dated September 22, 1958, was seconded by Bank. Mayor Bredesen called for Rollcall' Vote on motion, which was as follows: aye; and Bredesen, aye; and the motion was unanimously adopted. Report recommended that an adjustment be made in the assessment for I Bank, aye; Dickson, aye; Kohler, aye;.Tupa, REQUEST FOR RELIEF FROM ASSESSMENTS DENIED - LOT 6, MELODY KNOLLS FIRST ADDITION. Mr. George Kell, owner of Lot 6, Melody Knolls First Addition, asked for relief from a total of $2,974.70 in special assessments for Sanitary and Storm Sewer and lvatermain. It was noted that the assessments under consideration were levied some time ago, the last being in 1957. Mr. Kell stated he teels that the method of levying the assess- ment was rkong; that he is the same benefit. Bank's motion for approval of Preliminary Plat, subject to compliance vsith Planning Commission's stipulatiops of September 10, was seconded by Tupa and carried. PRELIMINARY PLAT OF "LORRAINE COURT" APPROVED, Planning Commission' s September 18dh recommendation €or approval of this preliminary, providing all three lots contain at least 9,000 square feet, were reviewed. approved subject to compliance with Planning Commission's recommendations, was seconded by Tupa and carried. PUBLIC HEARING SCHEDULED FOR SEPTEMBER 29, ON PETITION FOR PERMIT TO CONSTRUCT ATTACHED GARAGE WITHIN THREE FEET OF LOT LINE. - LOT 7, BLOCK 5, MENDELSSOHN (314 John Street). Planning Commission's September 10th favorable recommendation on this request was reviewed, and Tupa's motion, scheduling Public Hearing for Monday, September 29, was seconded by Bank and carried. GAS ALLIANCE MEETING REPORT. Manager Hyde reported he had attended the recent meeting at Robbinsdale; that the group has decided to allow all municipalities to participate until such time as the matter of the rating structure comes before the group; that the Gas Company has made no commitments; and that, at this time, he (Mr. Hyde) has no recommendations as to joining the group. COUNCIL TO TAKE BIDS ON "REMITTANCE CONTROL MACHINE1'. TupaCs motion, confirming Advertisement for Bids for "Remittance Control Machine", published in Courier and Construction Bulletin September 18 and 25, was seconded by Bank and carried. Council action pursuant to recommendation by Ernst and Ernst and State Public Examiner in recent audit. AUTHORITY GIVEN TO PURCHASE SALT WITHOUT BIDS. Finance Director Dalen's request for authority to purchase 40 tons of Salt from Morton Salt Company, as needed, at $21.60 per ton; next low informal bid received being $22.40. Dickson's motion for authority to purchase without formal bids was seconded by Tupa and carried. , HENNEPIN COUNTY-HOPKINS-EDINA STORM SEWER PRELIMINARY PLANS PRESENTED, Manager Hyde presented map showing Preliminary Plans for a joint storm sewer, in connection with County Road No. 18 development. He reported that it is Edina's idea at present, to make an estimate of cost on Edina's portion of this proposed improvement, together with Lateral Storm Sewers needed in the area (West Minneapolis Heights and that immediate area) and to call a Public Hearing on the matter some time in November. HOPKINS-EDINA STORM SEWER PRELIMINARY PLANS PRESENTED. Hopkins' proposal to design its "Ashley Road" Storm Sewer in such way as to permit Edina to discharge 10 cubic feet per second into it; and to charge Edina for its proportionate share of the cost. up; that there are some local storm sewer problems, there., and Mr..Hyde suggested that a joint meeting with Hopkins be held; that study be made of this proposal and additional-cost of laterals, and that Public Hearing be called for November. STANDARDIZING ON "OUTSIDEtt WATER METERS RECOMMENDED.
