MINUTES of the Regular Meeting of June 8, 1959, were approved as eubmitted, by motion Beim, seconded by Bredesen and carried. PUBLIC HEARINGS ON PROPOSED IMPROVEMENTS: Affidavits of Publication in Edina- Morningside Courier, and of mailing to owners of affected properties, of "Notice of Public Hearings" was presented, approved as to form, and ordered placed on file. Pursuant to said Notice, the following public hearings were conducted, and action taken: 2. PUBLIC HEARING ON PROPOSED CURB AND GUTTER IN UPPER TERRACE FROM SOUTH- CREST DRIVE TO ERITTANY ROAD. $3,074.40, for $2.82 per Assessable Foot. Written objection of Mr. L.S.Clark, Estimate of Cost for this project was given as 6720 Southcrest-Drive; was read. There were no other-written objections, and- no objections were had from the floor. Mr. Clark had asked that the project be limited to those lots requesting it, and Council had some discussion about the utility and aesthetic value of the curb and gutter in only part of a block, it being generally decided that this installation is to be avoided wherever possible. Beim offered the following Resolution and moved its adoption: RESOLUTION DETERMINING ADEQUACY OF IMPROVEMENT PETITION FOR, AND ORDERING STREET IMPROVEMENT NO. B-63 WHEREAS, this Council has duly examined the petition for Concrete Curb and Gutter in Upper Terrace from Southcrest Drive to Brittaoy Road, filed with this Council June 8, 1959, and said examination has proven that said petition has been signed by owners of more than 35 percent in frontage of the real property abutting on the street named in the petition as the location of the improvement: Edina that the petition hereinbefore named has been signed by the required percentage of owners of property affected thereby, under Chapter 429 Minnesota Statutes. BE IT FURTHER RESOLVED that this Council heretofore caused notice of hearing to be duly published on the proposed improvement consisting of construction of CONCRETE CURB AND GUTTER IN UPPER TERRACE FROM SOUTHCREST DRIVE TO BRITTANY ROAD, and at the hearing held at the time and place specified in said notice the Council has duly considered the views of all persons interested, and being fully advised of the pertinent facts does hereby determine to proceed with the construction of said improvement; that said improvement is hereby designated and shall be referred to in all subsequent proceedings as STREET IMPROVEMENT NO. B-63, and the area to be specially assessed therefor shall include all lots and tracts of land abutting the street proposed to be improved. CONTINUATION OF MAY 25 PUBLIC HEARING ON PROPOSED SANITARY SEWER FROM PRESENT TRUNK SEWER, TO SERVE NOS. 5128 AND 5129 MIRROR LAKES DRIVE. reported to Council that, as the result of the Hearing on this project, held May 25, the following improvement petitions have now been filed: Manager Hyde 1. PETITION FOR SANITARY SEWER IN MIRROR LAKES DRIVE FROM EXISTING TRUNK SEWER TO AND INCLUDING 5128 AND 5129 MIRROR LAKES DRIVE--SIGNED WITH THE UNDERSTANDING THAT WATERMAIN IMPROVEMENT WILL BE CONSTRUCTED AT SAME TIME SEWER IS INSTALLED, AND SERVICE ASSURED BY END OF 1961. TRUNK SEWER TO AND INCLUdING NOS. 5128 AND 5129 MIRROR LAKES DRIVE-- SIGNED WITH UNDERSTANDING THAT WATERMAIN WILL BE CONSTRUCTED AT SAME TIME SEWER IS INSTALLED, AND SERVICE ASSURED BY END OF 1961. Mr. Hyde told Council that there is a problem, because the Mirror Lakes Area is not served by Trunk Watermain; that, pursuant to a survey conducted very recently (replies having been received from 43% of those queried), the area as a whole does not want water; consequently, there is no way of guaranteeing to the Mirror Lakes petitioners that they will have water service by the end of 1961--unless this is solved on a temporary basis by connecting from the Edina Highlands Park water line. If the temporary basis is used, now, extension of trunk at a future date will be at added expense. have stipulated joint sewer-water construction to the save the cost of re- blacktopping twice; that they are willing to have their watermain constructed, now, but only with the guarantee that they can receive service by the end of 1961. 2. PETITION FOR lrVATERMAIN EXTENSION IN MIRROR LAKES DRIVE FROM EXISTING He explained that petitioners (See action recorded at bottom of page). TRUNK WATERMAIN HEARING TO BE HELD, FOR MIRROR LAKES AREA. Pursuant to the foregoing discussion, Manager Hyde told Council that the most correct way to cons$ruct the Trunk Watermain under consideration would be - In Interlachen Blvd. from Cooper Avenue to Mirror Lakes Drive; In Mirror Lakes Drive from Interlachen Blvd. to W.56th St.; - In W.56th St., East to Highway #169; In Highway #169 from ln1.56th St. to Tracy Ave., to tie into the trunk main now under construction, Council was perturbed at the idea of once more disturbing Interlachen Blvd.; and it was noted that a plan for utilities was presented to residents in the area last year and they refused it. bottom of page) . Subparagraph (a) of paragraph 2 of Section 3 (Open Development District) of Ordinance No. 261 (Zoning Ordinance) of the Village, as amended, is hereby amended to read as follows: 'I( a) Country estates and other single family dwellings; provided, that a special permit may be issued for the erection of a two-family dwelling, as provided in Section 11 (Special Permits for Particular Uses) of this ordinance." Section 2. Paragraph 4 of Section 11 (Special Permits for Particular Uses) . of said Ordinance No. 261, as amended, is hereby further amended by adding thereto the following: 'Id. Use: Two Family Dwelling Minimum Required Conditions: (1) (2) Each two family dwelling shall be constructed on a lot having- a minimum area of 10,000 square feet. Side yards shall be no less than 10 feet on each side, except in those instances where a side yard contains a driveway, in which case the minimum side yard shall be 15 feet on that side. All other lot, yard, driveway and accessory building require- ments shall be the same as those required in the Open Develop- ment District. There shall be provided on the lot for each dwelling unit, at least one (I) completely enclosed parking space of the follow-. ing minimum size: (3) (a) (b) Combined two car unit - 22 x 22 feet. Separate units - 12 x 22 feet each. (4) The minimum floor area of a one (1) bedroom dwelling unit shall be not less than 750 net square feet, that of a two (2) bedroom dwelling unit shall be not less than 900 net square feet, and dwelling units containing three (3) or more bedrooms shall have an additional 150 net square feet of floor area for each bedroom in excess of two (2) bedrooms. For the purposes of measurement, the net floor area of a dwelling unit shall mean that area within a two family dwelling used as a single dwelling unit and shall be measured from the inside of outside walls to the center of partitions bounding the niwell- ing unit being measured, but shall not include stairways and entries used commonly by both dwelling units, unenclosed porches, garages, and areas located in a basement or cellar. The design features of a two family residence shall be of such nature as to provide for each dwelling unit the measure of privacy normally enjoyed by a single family residence. Particu- lar attention must be given to the problem of sound transmission thru floors and common walls, and the designs of these two buildings features shall be of a type approved by the Village building inspector. B-63,64 and 65 to Arnold Beckman was seconded by Tupa and carried. explained that this bid covers street grading and the hauling of the excavated material to the street right-of-way at Valley View Road Extended and W.7Oth Street, where it will be stockpiled for future Village use. at $4,930.00; M.E. Kraft Excavating Co., at $5,950.00. Recommendation was for award of contract to low bidder, and Kohler so moved. carried. 4. GRADING OF W.70TH ST. FROM FRANCE AVENUE TO 1450 FT. EAST. Manager Hyde Two bidders - Terry BrOS., Inc., Motion seconded by Beim and FIRE INSURANCE COVERAGE AWARDED TO BRANDOW INSURANCE, Finance Director Dalen presented tabulation of bids taken June 15 on fire insurance coverage for 16 Village properties, and contents. Six bids received, R.K. Stensrud Agency being low bidder at $7002.79 on a Five-Year Prepaid basis; $7,201.65 on Annual Pay; Brandow Insurance, second low at $7,047.56 on Five-Year Prepaid; $7,241.45 on Annual Pay. that Brandow had bid with one underwriter, whereas the Stensrud bid is for four--it being necessary to negotiate with all four in case of loss. Mr. Brandow told Council that his is the better of the two bids because he is bidding on "replacement cost insurance", which exacts no penalty for depreciation, whereas the other bid is on the "actual value" standard policy. It was noted that this coverage is written on an 80% Co-Insurance basis, and Trustee Kohler inquired as to a No Co-Insurance basis, and Mr. Howard, representative of Commerce and Industry Insurance Company of New York (underwriter listed in Mr. Brandow's bid) stated that, in order to write on this basis the underwriter's valuation, or other recognized appraisal of value must be accepted by the insured. discussion that under Statute, bid can be for no more than 10% of total assets of the Company; that Brandow neglected to list Insurance Company of North America as an underwriter. Kohler then moved that bid be awarded to Brandow Insurance; that coverage for the Village Hall be placed with Insurance Company of North America and €or the balance of properties and contents with Commerce and Industry Insurance Company with the understanding that they will check our valuations figures with the idea of writing on a "No Co-Insurance and Replacement Cost" basis. seconded by Beim and carried. Motion was seconded by Kohler and carried. I PUBLIC HEALTH NURSING REPORT FOR MAY, 1959, was submitted, reviewed, and ordered placed on file. MINNEAPOLIS GAS COWANY FINANCIAL REPORT FOR YEAR 1958, filed in accordance with terms of franchise, was briefly discussed and ordered placed on file. USE OF POOL DENIED TO MORNINGSIDE RESIDENTS BECAUSE OF ALREADY CROWDED CONDITIONS. Park Board's recommendation for denial of petition for use of Edina Pool by Morningside residents was reviewed. season tickets to Edina residents is already way over the sale last year and it is feared that the pool will be overcrowded. .Council directed Manager to transmit to Morningside the recommendation, together with explanation, Recommendation was made because sale of . VILLAGE-OPERATED POOL CONCESSION DOING WELL. Pool concession is doing a considerable volume of business and it is hoped that direct control will mean better service to customers. Manager Hyde reported that the PURCHASE AGREEAENT FOR PARK LAND AUTHORIZED--0. B. ERICKSON ADDITION. Mr. Hyde presented Park Board's recommendation for purchase of Lots 2,3,4 and 5, and Outlot 1, Block 4, O.B. Erickson's Addition, at a cost of $11,250. developer's required dedication of Lot 1, Block 4, and other recently acquired park land, will provide a playground of sufficient size to be developed. told Council that the price, here, is higher than that heretofore paid, but that the developer will not deviate from it; off the property in return for use of the gravel thereon. that execution of purchase agreement be authorized, was seconded by Beim and carried, VILLAGE ACCEPTS LAND AT 7iv.6OTH STREET AND ST.JOHNS AVENUE. This tract, being Lots 1,2,3,4, Block 2, Valley View Terrace 3rd Addition, being in the name of Mickelsen Fronk Construction Company, with understanding that Mr. Emil Fronk will dedicate proceeds of sale" thereof to Village, was discussed. It was noted that Mr, Fronk has been unable to sell because of a drainage problem involving these lots, and Manager Hyde recommended that Village now take title to the tract. Beim so moved, KOHLER REQUESTS DEVELOPMENT OF "HILLSIDE" PARK, Trustee Kohler requested that planning go forward as quickly as possible on Village's newly acquired park at 62nd and Tracy, inasmuch as planning has been delayed so long on the area park because of Highway plans. This tract, together with @. Hyde that he does, however, agree to grade Kohler's motion, Property located at Beard Place and Crosstown Highway. - Motion seconded by Kohler and carried. CROSSTOWN HIGHI'JAY PLAN, FJROM XERXES AVENUE TO VIRGINIA AVENUE, REFERRED TO PLANNING €0HMISSION. Mr. Hyde submitted for Council review plan just received for Crosstown Highway, from Xerxes Avenue to Virginia Avenue, stating that this plan looks good; that it provides for most of Edina's problems, with exception of Nooddale Avenue overpass, which would be at tremendous cost. He cited the service drives provided on both sides of the Highway, thus eliminating cul-de-sacs for our present streets, Plan referred to Planning Commission for consideration and recommendation, FRANCE AVENUE CROSS-OVER BETWEEN MEDICAL CENTER AND COAMODITY CREDITS BUILDING QUESTIONED, between Medical Building and Commodity Credits Building, stating he feels it to be a decided traffic hazard. has promised to put posts up to eliminate the crossing. Trustee Tupa questioned the use of a cross-over on France Avenue, Mr. Braddock, Southdale Realty Co., stated the County WATERMAIN IMPROVEMENT NO. 127 ASSESSMENT HEARING TO BE JULY 20. Manager Hyde asked that this assessment hearing be scheduled earlier thah previously planned, in order that IEM would have time to prepare for certification. He told Council that the main presently goes to the East line of Chapel Hills but that it should be extended on Valley View Road from this point to the West line of the School property--which is the boundary of the assessment district; and that the assessment should contain the cost of a 6" main--with the balance of the cost of a 12" main to be deferred pending the next trunk main. This recommendation was generally agreeable with Council, and Monday, July 20, 1959, was .tentatively set as Hearing date. 6/22/59 LAKE CORNELIA STORM SEWER HEARING SCHEDULED FOR AUGUST 3. agreed that a new Public Hearing on the proposed Lake Cornelia Storm Sewer should be had, on the new assessment basis as set forth by Adolph Meyer and Associates; and Monday, August 3, was tentatively set as the date for this Hearing. ZONING ORDINANCE CODIFICATION was scheduled for July 13, when NIr. DeForest Spencer will be representing Village Attorney Hasselquist at meeting. In discussion on the Zoning Ordinance, New "NO SPRINKLING" ORDINANCE DISCUSSED. Stating that there is no ordinance to compel water users to observe the "no sprinkling ban" established by the Village, Manager Hyde asked Council policy'on adoption of ordinance. an ordinance is not needed, now, and that this ban should continue to be observed by cooperation, rather than be legal enforcement. It was consensus that such WATERSHED DISTRICT MEETING AT BLOOMINGTON ANNOUNCED. June 23, at the Bloomington Village Hall, for the purpose of establishing a Watershed District in Hennepin county, was again announced. This meeting, to be held on BLOOMINGTON'S REQUEST FOR "RECIPROCAL TAXICAB AGREEMENT" DISCUSSED. reported receipt, today, of a request from Bloomington for a reciprocal agreement to allow cabs licensed in one community to work in neighboring communities. told Council that, offhand, he would feel that such an arrangement would mean loss of control, but that he would like an opportunity to study the matter further before making any recommendation.
