feet below the top of his abutting hill. hlr. Zikan told 1A.r. cooper that the level
of this street will be raised about a foot at Tracy Avenuey and Trustee kohler
inquired as to the safety of the intersection, asking that the Efigifieer make
sure that the grade is such that Tracy may be easily entered. Mr. Otto's rep-
resentative told Council that the developer will have excess material coming
out of excavations, which can be used by the Village on the Hawke's Lake streets
if the Village wishes it, and Engineer Zikan was authorized to consult with Mr.
Otto concerning this offer.

POLICE DEPT. STATION WAGON AND PATROL CAR BIDS AWARDED. Manager Hyde presented
Tabulation of Bids taken today on a Station Wagon and Patrol Car for the Police
Department.
Hopkins Motor Sales Company bidding on Plymouths; Woodhead Company bidding on Fords,
and Grossman Chevrolet Company, Inc., bidding on Chevrolets. He recommended award
of bid on the Patrol Car to Woodhead company, low bidder, at $2,283.00 for a 1959
Ford Custom 300, less Trade-In on 1958 Chevrolet of $1,420.00--Net Bid, $863.00;
and award on the Station Wagon .to Grossman Chevrolet Company for a 1959 Chevrolet
2-Dr. Brookwood #1215 at $2,450.32, Less Trade-In on 1958 Plymouth Stn. Wagon,
$1,500.32, for Net Bid of $950.00. Beim so moved. Motion seconded by Kohler and
carried.

ADJUSTMENT OF BOUNDARY LINES BETWEEN EDINA AND HOPKINS ASKED IPI E.F. GARRISON. Mr.
Garrison was present to support his written petition for adjustment in the munici-
pality boundary lines between Hopkins and Edina so as to place the old Street Car
Right of Way from Harrison Avenue to Monroe Avenue entirely within the Hopkins City
Limits.
reporting that Edina's disposition of it depends somewhat on Hopkins' disposition
of €raffic on their 2nd and 3rd Streets; and Mr. Zikan explaining that there are
problems of drainage €or Edina in this locale, which should be settled before
allowing any change in boundary lines. Stating that Mr. Garrison is petitioning
for this change, principally in order to obtain sewer and water from Hopkins for
his plat, Mr. Hyde reported that he believes the Village would prefer to keep the
land in Edina, petitioning Hopkins for utilities service for it.

have been a natural drainage basin for the storm waters of the area. Mr. Hite
reported that the Final Plat of Balthrop's Addition includes the changes from
the Preliminary previbusly required by the Commission; that the Commission has
approved Final subject to dedecation for park and dedication of additional 7
feet of right of way along W.70th St.

SOUTHDALE PLAZA FINAL, PLAT APPROVED': BUILDING BEFORE APPROVAL PROTESTED BY COUNCIL.
The Planning Commission's July 8th recommendation for approval of this plat--on
which the Southdale Bowling Alley is now being constructed--was reported.
Kohler protested the Village's allowing construction of Bowling Alley on this tract
before platting, inasmuch as one building had already been constructed thereon.
Braddock explained that former Planning Director Swanson had been about to present
an ordinance for adoption, making it unnecessary to plat where ownership of
commercial property is in one name; that Southdale had been advised against
platting in view of this proposed ordinance; that subsequent delay in presentation
of 'ordinance was the cause of this violation of present ordinance. Tupa.moved for
approval of Final Plat, and motion was seconded by Beim and carried.

motor vehicle upon, or standing, stopping or parking such vehicle in the parking
space adjoining any such drive-in restaurant shall 'race the motor of any such
motor vehicle, cause any horn to be blown except as a traffic warning, or make or
cause to be made any loud or unseeming noise or disturbance upon said premises.

(h) At all times when the licensed premises are open to the public the licensee
shall provide an adequate number of attendants on duty at all times, who shall patrol
the exits, entrances and parking spaces in connection with the licensed premises to
see that order is maintained, disorderly or immoral conduct is prevented, that the
entrances and exits are kept free from congestion and that this ordinance and a11
governing ordinances pertaining to drive-in restaurants are observed.
No loudspeaker shall be made use of upon the premises for communication with customers or employees and no juke box, radio, or other musical device shall be
used or permitted on the premises, provided that this provision shall not be con-
strued to prohibit the use of radios installed in automobiles of customers on the
premises; no person, however, shall use or permit such a car radio upon the licensed
premises or parking areas in connection therewith if the volume of sound from such
radio is audible more than ten feet from the vehicle in which the radio is installed.
The licensee shall maintain quiet and good order upon the premises licensed and all parking areas in connection therewith, and loitering shall not be permitted
in or about said premises by persons not actually engaged in consumption of food
products served by the licensee.

MUNICIPAL COURT PROCEDURES DISCUSSED.
Moss, and Prosecuting Atgtorneys. Hennessy and Gustafson were present to report to
the Council the recent legislative changes pertaining to the Court; namely, a change
in salary from $400 to $525 per month for Judge, and from $40 (Edina) to $25 per
diem for special judges. Reviewing for the Council the statute which states that
Municipal Courts shall convene daily, Mr. Burris stated that it is the present plan
to have the Edina Court convene at 8:30 each morning, Monday through Friday; thus
giving the special judges less time at their respective sessions and, too, complying
with the law and more expeditiously disposing of the cases before the Court.
Stressing the changes in the character of the court over the past few years, Ab.
Burris reported that while there is an ever-increasing number of traffic cases to
be heard, there are now many and more complex criminal complaints to be settled,
involving more time on the part of both the prosecuking attorney and the judge,
Mi. Burris summarized his recent memorandum to the Council, asking for additional
salary for the Prosecuting Attorneys and again outlining the plan for daily court.
The others supported his arguments, outlining for Council the increase in time
spent in Court duties, Matter tabled pending Mayor Bredesenls return and meeting
next Monday evening.
