Mayor Pro Tem Dickson presided in Mayor Bredesen's absence. MINUTES of the Regular Meeting of March 14, 1960, were approved as submitted, by motion Kohler, seconded by Beim and carried. PUBLIC HEALTH NURSING REPORT for February, 1960, was submitted, reviewed and ordered placed on file. HENNEPZN COUNTY HIGHWAY DEPARTMENT'S REQUEST FOR ABATEMENT OF TAXES was referred to the Village Attorney for investigation, at the request of Trustee Kohler and after some discussion as to the amount involved. Tract under consideration was Parcel 227, Plat 73830. County has asked for tax abatement pursuant to easement for road purposes acquired by County in 1958. COMPLIMENT TO EDINA RESCUE SQUAD READ. Mr. S.F. McGowan, President of South Garden Association, praising the Rescue Squad for its work on behalf 0f.a heart attack case. Letter accepted with the thanks of the Council and ordered referred to Chiefs of Police and Fire Depart- ment s. Clerk read complimentary letter by IMPROVEMENT PETITIONS FILED. to Council, reviewed, and by motion Kohler, seconded by Beim and carried, were referred to the Village Engineer for programming: 1. SANITARY SEWER - Wooddale Ave., Dunberry Lane to 250 Ft. South. 2. BLACKTOPPING - Bernard Place, Benton Ave. to W.6Oth St. 3. The following improvement petitions were submitted BLACKTOPPING - Alley between Xerxes and York Avenues and between W.54th and W.55th Sts. PETITION FOR RETURN OF BUS SERVICE FROM VILLAGE HALL TO SOUTHVIEW LANE, filed at this meeting, was supported by a delegation.asking that they be given some lcind of service in this area. events leading to cancellation of the service; namely the refusal by the High School to allow lay-over and turn-around space on Southview Lane; and the Village's unwillingness to allow the bus to turn left off Nonnandale Road. Delegation asked that the Wooddale line be extended, but Mr. Hyde'said he thought that regulations governing bus Tupa's motion, that petition be referred to the Railroad and Warehouse Commission was seconded by Beim and Carried. Commission to investigate practicability of the loop requested by the delegation, or of connecting runs. Manager Hyde reviewed.for the delegation the would prohibit such extension. Trustee Kohler suggested that Council ask PROTEST REGISTERED AGAINST DRAINAGE CONDITIONS AT 65TH AND WILRYAN. O.N. Coursolle and G.B.Parsons, 6513 and 6509 Wilryan Ave., protested the flood condition of their street, asking that something be done just as soon as possible to relieve this bad condition. Storm sewer proceedings were reviewed for these poople, and Council told them that the street relief must be given on a temporary, pumping basis (which is becoming more and more difficult as surrounding lots build up and it is necessary to drain water farther and farther away); that they can look for little permanent relief until such time as the proposed storm'sewer can be constructed. Messrs. SIGN ORDINANCE AMENDMENT ADOPTED. Ordinance No. 61A-1, as discussed at the last regular meeting; and Beim offered the following Ordinance, moving that Council waive second reading thereof and adopt Ordinance as offered : Council discussed the matter of adoption of ORDINANCE NO. 61A-1 AN ORDINANCE RELATING TO OUT- DOOR SIGNS, AMENDING ORDINANCE NO. 61A THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA,'MINNESOTA, ORDAINS: adding thereto the following section: Section 1. Ordinance No. 61A of the Village of Edina is hereby amended by "Section 3a. Special Restrictions in Regional Shopping District. In addition to all other restrictions, the following restrictions shall apply to signs hereafter-constructed, posted, printed, paint- ed or affixed in the Regional Shopping District: "(a) Not more than one sign shall be permitted nearer to any street line than the established or customary uniform building line upon the street where a structure shall be erected. Such a permitted sign shall not exceed 48 square feet in area and shall be used only for the purpose of stating the name or ad- dress or both of the business or occupant of the lot upon which the sign is placed. offered for sale or a service provided on the premises. Council reviewed at some length the pro- posed ordinance repealing Ordinance No. 52 and establishing ne97 regulations for the moving of buildings, as discussed at the last regular meeting. Hasselquist told the Council his office has done independant research on this pro- posed ordinance, believes it is a valid ordinance. Planning Director Hite told Council that the Planning Commission approves, generally, of this proposed ordinance, but that some members feel there should be provision for public hearing before moving. It was noted that the ordinance does provide for an appeal before the Council upon denial of permit by the Building Inspector; and Tupa offered the following Ordinance, moving for waiver of second reading and adoption of Ordinance as submitted: Village Attorney ORDINANCE NO. 52A AN ORDINANCE REGULATING THE 'EIOVING OF BUILDINGS AND REPEALING ORDINANCE NO. 52 THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA,.MINNESOTA, ORDAINS: Section 1. Permit Required. No person shall move, remove, raise or hold up any building within the limits of the Village of Edina without first obtaining a permit from the Building Inspector. file an application for such permit-with the Building Inspector in writing, upon forms provided by the Building Inspector. information as the Building Inspector shall find necessary to a determination of whether a permit should be issued. A permit fee of $50 and the following papers shall be filed with the application: Section 2. App lication. Awritten statement or bill of sale or other sufficient written evidence that the applicant is entitled to move the building. Written evidence of arrangements with all public utility companies whose wires, lamps or poles are required to be removed, for the removal thereof by the Company, A liability insurance policy or certificate of such insurance,' issued by an insurance company authorized to do business in the State of Minnesota. The policy shall insure the applicant, and the Village of Edina as an insured in the sum of at least $25,000 for injury to one person, and $50,000 for one accident, and at least $25,000 property damage, and the policy shall be kept in effect until after the building has been moved. A cash deposit in the sum of $500.00 as an indemnity for any damage which the Village may sustain by reason of damage or injury to any highway, street or alley, sidewalk, fire-hydrant or other property of the Village, which may be caused by or be kncidental to the removal of any building over, along or across any street in the Village, and for any expense incurred by the Village under subdivision (b) of Section 5. A bond executed by a corporate surety company authorized to Bo business in the State of Minnesota, in the amount of $3,000, con- ditioned upon the compliance by the applicant with this and other applicable ordinances and laws, and payment to the Village of all fees, fines, and penalties required by said ordinances. I Section 3. Duties of the Building Inspector. (a) Inspection. The Building Inspector shall inspect the building and the applicant s equipment to determine whether the following standards for issuance of a permit are met. if he finds that: (1) insurance requirement has not bee complied with: (2) or property in the Village; He shall refuse to issue a pede any application requirement or any fee or deposit bond, or The building is too large to move without endangering persons M 39 3/28/60 (3) the building is inisuch a state of deterioration or disrepair or is otherwise so structurally unsafe that it could not be moved without endangering persons and property (4) purpose fov which moved, if the location to which the building is to be moved is in the Village; (5) the applicant's equipment is unsafe and persons and property would be endangered by its use; (6) zoning, building code or other ordinances would be violated by the building in its new location if such location is. in the Village; (7) for any other reason, persons or property in the Village would be endangered by the moving of the building; or (8) that the building is in substantial variance with either the established or the expected pattern of building development within the neighborhood to which the building is to be moved. The findings of a comparative study of age, bulk, architectural style and quality of construction of both the building to be moved and the buildings either existing or expected in the neighborhood shall be the criteria by which the Building Inspector shall determine the degree of variance. in the Village; L the building isestructurally unsafe or unfit for the Fees and Deposits. (a) Return upon non-issuance. Upon denying a permit, the Building Inspector shall direct the Village Treasurer to return to the applicant all deposits, bonds and insurance policies. The permit fee filed with the application shall not be returned. :(b) Return upon allowance for expense. After the building has been moved, the Building Inspector shall furnish the Village Manager with a writfen statement of all expenses incurred and of all damage caused to or inflicted upon ,property belonging to the Village by reason of the move. The Village Manager shall authorize the Village Treasurer to return to the applicant all deposits after deducting a sum sufficient to pay for all of the costs and expenses and for all damage done to property of the Village. The permit fee deposited with the application shall not be returned. Designate Streets for Removal, The Building Inspector shall procure from the Department of Public Works a list of designated streets over which the building may be moved. Inspector shall have the list approved by the Chief of Police and shall reproduce the list upon the permit in writing. making their determinations the Department of Public Works and the Chief of Police shall act to assure maximum safety to persons and property in the Village and to minimize congestion and traffic hazards on public streets. The Building In Section 4. Duties of Permittee. (a) Use Designated Streets. for such use in the written permit. (b) Notify of Revised Moving Time. of a desired change in moving date and hours as proposed in the application. Every permittee under this ordinance shall: Move a building only over streets designated Notify the Building Inspector in writing (c) a11 damage done to property belonging to the Village or any public utility Notify of Damage. Notify the Building Inspector in writing of any and within 24 hours after the damage or injury has accurred. (d) time on every side of the building, while standing on a street, in such manner as to warn the public of the obstruction., and shall at all times erect and maintain barricades across the streets in such manner as to protect the public from damage or injury by reason of the removal of the building. Warning lights with open flames shall not be used. (d) Street Occupancy Period. Remove the building from the Village Streets after two days of such occupancy, unless an extension is granted by the Building Inspector. (f) Comply with Governing Law. Comply with the Building Code, the Fire Zone, the Zoning Ordinance and all other applicable ordinances and laws upon relocating the building in the Village. (g) Pay Expense of Officer. ordered by the Village Manager to accompany the movement of the building to protect the public from injury. (h) Clear Old Premises. excavations to existing grade at the original building site, if within the Village, so that the premises are left in a safe and sanitary condition. All foundation structures are to be removed to a depth of 18 inches below the finished grade of a lot. (i) Display Lights. If the building is relocated in the Village, complete within 90 days after removal, all remodeling, additions or repairs as shown on the plans accompanying the application. Section 5. Attorney Hosmer Brown was present to ask that a certain storm sewer, granted without Council knowledge, be released to property owners. Some discussion was had on the matter of the easement's being recorded without Village acceptance, but no one present could ascertain why or how this had happened. Tupa offered the following Resolution and moved its adoption: Engineer Zikan tbld Council that the Village does not need the easement. THAT that easement for the construction, repair and maintenance of a storm "The West 45' of that part of Lot 36, Auditor's Subdivision No. 172, lying north of West 49% Street and extended north from West 49% Street 126.15' in the Village of Edina, County of Hennepin, State of Minnesota, according to the plat thereof", as recorded on Page 280, etc., Book of Deeds 2213, Document 3179970, was granted to the Village of Edina by Dr. Arkthur F. Bratrud and Harriet G. Bratrud, husband and wife, without the knowledge or acceptance of said Village Council. THAT said easement is not needed by the Village of Edina. 2. 3. BEER AND LIQUOR LICENSE RENEWALS APPROVED. Applications for Renewal of some Eighteen Off-sale Beer, Nine On-sale Beer, and Two Club-Liquor On-sale Licenses were received; and licenses 1.7ere granted for the year April 1, 1960 to April 1, 1961, by motion Tupa, seconded by Beim and carried. Manager Hyde reported that repairs. to Well No. 4 have been started; that the well concern now feels that the screen ( is actually broken; that, because of the urgent need of the well's being in, service he has taken the liberty of advertising for repair bids to be taken on April 4. consider the award of said bids. in this emergency, and agreed to meet on April 4, as requested. He asked that Council meet at 5:OO P.M., on Monday, April 4, to Council complimented Manager on his action COUNCIL ADOPTS ORDINANCE PROHIBITING THE SETTING OF FIRES. reporting that despite the wet condition of the ground the Fire Department has already had to answer two grass fire calls, asked for an ordinance for the banning of grass fires at certain times. grass fire calls answered last Spring,.stating that as the Village becomes more. and more built up grass fires become increasingly hazardous. Hasselquist found no fault with the ordinance recommended by Mr. Hyde, and I Beim offered the following Ordinance, moving that the Council dispense with the second reading thereof and adopt Ordinance as read: Manager Hyde, He reviewed forXounci1 the number of Village Attorney ORDINANCE .NO. 114-1 AN ORDINANCE AMENDING ORDINANCE NO. 114 OF THE VILLAGE OF EUINA, MINNESOTA, PROHIBITING THE SETTING OF FIRES AT CERTAIN TIMES TJE VILLAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS AS FOLLOW: Ordinance No. 114 of the Village of Edina, entitled !'An Ordinance Regulating and Prohibiting the Setting of Fires," is hereby amended by adding thereto the following section: "Section 5. The Chief of the Fire Department may prohibit, for such periods of times as are necessary for the protection of property, the setting of any and all bonfires, grass fires, and.outdoor rubbish fires when weather con- ditions are such that the setting of such fires is hazardous. shall be approved by the Village Manager, and notice of it given by legal publication as soon as possible after its promulgation and by advising radio, television, press and other media of public information. The Village Council shall be formally informed of such prohibition at its next regular meeting following the imposition." Section 1. Citing drainage problems recurring throughout the southeastern part of the Village, resulting in completely impassable roads, Manager Hyde told Council that it is absolutely imperative that Council proceed with construction of the trunk main this summer; and that two small lateral mains are ready to be bid, also, at this time. Manager Hyde discussed with Council the plans for this summer's improvements. Reporting the difficulties being experienced in maintaining blacktopped streets, Hr. Hyde recommended that Blacktop Specifications on streets where curb and gutter is not required for drainage purposes be strengthened from the present "6" base compacted to 4"" to a 9'' base compacted to 6"", plus the 2" mat. He also said that the seal coat could be better; that Hennepin CounCy is now using Dresser Junction Traprock; that it is more expensive than our present specifications but provides a more generally satisfactory and durable surface. He told Council that the ne17 specificatioqs, as outlined$ should cost about an average of $4.65 per front foot; that blacktop, under specifications now being used, and standard concrete curb and gutter should cost about $6.85 per front foot, recpmmendations for the strengthening of blacktop specifications were accepted by common consent of Council, without formal action, but without dissenting connncnt.
