PUBLIC HEARING ON PROPOSED REZONING FROM "OPEN DEVELOPMENT DISTRICT" TO "TEMPORARY EXCAVATION DISTRICT" A PORTION OF THAT PROPERTY COMMONLY KNOWN AS NELSON FARM, LOCATED AT APPROXIMATELY COUNTY ROAD #18 AND HIGHWAY #5. Clerk presented Affidavit of Publication in Edina-Morningside Courier Juae 30 and July 7, 1960 of "Notice of Hearing on Amendment to Ordinance No. 262", which was approved as to form and ordered placed on file; and pursuant to said notice' Council called public hearing on request of Mr. Edward C. Stow for rezoning from ?Open Development District" to "Temporary Excavation District" that portion of the "Nelson Farm" outlined in faid Notice. The Council reviewed and discussed at length the July 6th recommendations of the Planning Commission with regard to this matter. Attorney Hosmer Brown rppresented Mr. E. C. Stow at the meeting, and Mr. Stow also attended. Messrs. Brown and Stow made no objections to the stipulations required by the Planning Commission; and in addition, Manager Hyde that the village ordinance pertaining to hours of operation of noisy machines be observed. This, too, was agreeable to applicants. Stating that with the understanding that the following stipulations will be observed by the applicants : 1. 2. This ordinance shall be in effect immediately upon its passage and publication, DISCUSSION followed submission of Ordinance, during which it was pointed out that the area proposed in the ordinance for rezoning is only a part of the area set forth in the notice of hearing but that it covered an area satisfactory to both applicants and village; also, Mr. Brown told Council he would have performance bond in in the morning to guarantee compliance with requirements. Mr. Tom Lee asked for reviewal of objecting petition, and upon receiving it requested that the 5800 Block be deleted from the improvement; but Engineer Zikan told Council that only a very small portion of the street, near Benton Avenue, could be relieved of curb and gutter if the drainage problem is to be remedied. Pursuant to"Advertisement for Bids-Concrete Curb and Gutter, Bituminous Surface Treatment, Grading and Graveling, Watermain, and Sanitary Sewer" published in Edina-Morningside Courier and Construction Bulletin June 30 and July 7, 1960, Manager Hyde presented Tabulations of Bids taken today on several approved improvements, and action was taken as follows: 1. STREET IMPROVEMENTS NOS. A-148, BA-23,24,25,26 AND 27. Tabulation showed receipt of four bids: BaJck Top Service Company, $36,262.19; Bury & Carlson, Inc., $40,627.18; Riegger Roadways, Inc., $41,601.45; Northwest Bituminous Co., Inc., $51,117.73. Manager's recommendation was for award of contract to low bidder, Black Top Service Company, at $36,262.19, and Tupa so moved. Mr. Hite told Council that at its meeting of June 8, 1960, the Planning Commission had gone on record as approving double bungalows for those portions of Lots 8 and 9, Block 1, Peacedale proposed to be platted facing the Crosstown Highway, providing such buildings are constructed in conformity with Ordinance No. 261-50; that Mr. Hoppe is anxious to complete his plat but does not wish to do so without Council assurance that he can build double bungalows on lots facing Crosstown. Beim's motion for accept- ance by Council of Commission's recommendation and for like assurance to Mr. Hoppe, was seconded by Dickson and carried. Olmstead, 5804 Olinger Road, led a delegation asserting that in the platting of "Edina Highlands Lakeside Addition" being developed by the Spring Company (formerly the Rosendahl Hawkes Lake plat), storm water has been diverted from its natural channels to Olinger Road. a list of questions, were presented by Mr. Olmstead; and after considerable discussion, the delegation was asked to consult with Messrs. Zikan, Hite and Hyde for the purpose of working out their problems. Council fhat Olinger Road will require a storm sewer in the future. A topography of the area, and Engineer Zikan told VILLAGE COUNCIL TO IMPROVE OTJN WATER SYSTEM BY IRON RENOVAL TREATPENT INSTEAD OF PURCHASIXG WATER FRO21 IIINNEAPOLIS. Association, dated June 30, 1960, recommending "the continuance of the present system with additional wells as needed, including the installation of iron removal plants and consideration given to adding zeolite softening plants after two years if there is. sufficient demand for this service", was reviewed, together with the Banister Report and Eir. Dalen's supplementary . figures, presented at the last meeting. the report of the South Garden Association, dated June 23, and advocating continuance with the original plan for Edina's own municipal water system. Council once more discussed this matter at some length, and Beim moved that Edina go ahead with its original program of iron removal and new wells. Motion seconded by Dickson and carried. Report of Edina Civic and Improvement Also presented and reviewed was IMPROVEMENT BONDS TO BE SOLD SEPTEMBER 26. of the Improvements already approved, reporting that Improvement Bonds must be sold, shortly, to finance. He recommended September 26 as date of sale, and was authorized to proceed with preparations for sale of $1,800,000 Improvement Bonds on September 26. Mr. Dalen suggested that, if Council approves, he and Mr. Hyde once again visit Chicago bond houses to advertise this bond sale; which suggestion was approved by the Council. Mr. Dalen presented a summary GARBAGE COLLECTION RATE INCREASE TO BE NEGOTIATED. Pursuant to the recent announced Phange in rates by Garbage Collectors, from $18.00 per year to $25.00 per year, which is causing considerable unfavorable comment by residents, EIr. Locke presented a report on reasons presented by collectors for this increase. residents, and distance between homes, were advanced as three reasons, beside expected increase in labor and equipment costs. ' It was reported that some residents have three and four garbage cans and expect collectors to take all kinds of rubbish not ordinarily collected. Manager Hyde reported that under present ordinance Village cannot dictate prices charged. authorized and directed to negotiate for a minimum $18.00 per year charge for two garbage cans, plus additional rate for additional service.
