CONTINUATION OF JULY 2STH PUBLIC HEARINGS ON PROPOSED ASSESSMENTS FOR DLPROVENENTS.
Manager Hyde reported that Mr. Halcolm McDermid, 5116 Mirror Lakes Drive, who had
objected at the last regular meeting that Mirror Lakes Drive is receiving a double
“blacktop replacement” assessment on Sanitary Sewer and Watermain Improvements, is
now satisfied that the amended assessments, as reported in Enutes of the Meeting
of July 25, and whi h include $2.31 per front blacktop replacement for the sewer
and $.43 per front/ 8Btthe watermain, are fair and equitable. Mr. 14cDermid con-
curred in 14r. Hyde’s report. There were no objections registered against the
proposed assessments, and Pir. Hyde recommended that assessments be levied as
follows :

BE IT RESOLVED by the Village Council of the Village of Edina, Minnesota, as fo~~ows:
1. It is hereby found: determined and declared that the proposed assessments for
NO. 141, and each of them, have been properly calculated in accordance with the pro-
visions of Minnesota Statutes Sections 429.051 and 429.061;that notice has been duly
published, as required by law, that this Council would meet to hear and pass upon all
objections, if any, to amend said proposed assessments as might be necessary, and to
adopt the same by resolution; that said proposed assessments have at all times since
their filing been open for public inspection, and opportunity has been given to all
interested persons to present their objections; that it is hereby determined to amend

said amended assessments are hereby adopted and confirmed as the proper special
assessments for said improvements, respectively.
3. The assessments for SANITARY LATERAL IMPROVEMENTS NOS. 157 AND 158,
together with the interest accruing on the full amount thereof from time to time
unpaid, at the rate of five percent per annum from the date of this resolution,
shall be a lien concurrent with general taxes apon the property described therein
and all thereof. The total amount of each such assessment shall be payable in
equal annual installments extending over a period of ten years, the first of said
installments, together with interest on the entire assessment from the date hereof
to December 31, 1961, to be payable with the general taxes for the year 1960, and
one of the remaining installments, with one year's interest on that and all
subsequent installments, to be payable with general taxes for the years 1961
through 1969, 'collectible in the respective ensuing years.
4. The assessments for 'WATERMAIN IMPROVEMENT NO. l&I> together with the
interest accruing on the full amount thereof from time to time unpaid, at the
rate of five percent per annum from the date of this resolution, shall be a lien
concurrent with general taxes upon the property described therein and all thereof.

PROPOSAL FOR PURCHASE OF PARK LANDS REFERRED TO PARK BOARD. Mr. M.J. Lauib, 6813
Cornelia Drive, told Council he would be willing to purchase Lots 1 and 2, Block 1,
Lake Cornelia Park Addition, for $4,500, to keep houses which would depreciate his
own dwelling from coming into the community. Mr. Hyde reported that the Park Board
has felt $3,500 to be a fair price for Lot 1, Block 1; but has had no bidders on the
property. At a question from the Mayor, Mr. Laub stated that while he would not be
willing to put a "forever" restriction against buildings on these properties, he is
willing to restrict them against buildings for the next five years--kthat he does

Some considerable discussion was had on the condition of Kellogg
STCE@i SEWER IB@ROVEMENT SO. 53 WORK TO BE NEGOTIATED, IF LEGAL. Messrs. Hyde and
Rite told Council that no one had even inquired as to plans for this small project
in response to “Advertisements for Bids” appearing in the two official publications
this past two weeks; that the work needs to be done just as soon as possible; that
there are storm sewer contractors in the immediate area who might do the work on
a negotiated basis. Beim‘s motion, that contract be negotiated if such action is
legal according to Village Attorney; that Village re-advertise of negotiation is
not legal, was seconded by DicIcson and carried.

HEARIEG SCHEDULED FOR SEPTEMBER 12 ON REZONING PETITION--H.T. Ogdahl, for Rezoning
from Open Development District to Multiple Residence District. Nr. Hite reported
the Planning Commission still is of the opinion that this property would be a good
"Multiple Residence" district; that Council denied .the petition at one time after
hearing objections of the residents to the north of the proposed Crosstown Highway.
Dickson's motion that new public hearing on petition be scheduled for September 12
17as seconded by Tupa and carried.
NEWSPAPER DROPS TO BE LICENSED? Trustee Tupa complained that several of the news-
paper drops are in a most disreputable conditipon, with torn papers, string and wire
widely scattered. Stating that he finds this matter to be a real nuisance because
both circulation people and newsboys change so often, Manager Hyde suggested that
perhaps newspaper drops could be licensed for a small fee, which y0Uld enable- the
Village to employ a trash collector to make regular collecfions at these points.
Council agreed that the suggestion is good, and direcked Manager to make further
investigation into the matter; also, if possible, to install trash barrels for use
of the newsboys.
REZONING OF PROPERTY SOUTH OF HIGHWAY NO. 5 AT CAHILL ROAD AGAIN CONSIDERED BY
COUNCIL. Council reviewed Planning Commission Minutes of August 3, with regard
to use of this property for a wholesale warehouse. (Property was recently rezoned
from Open Developmznt to Commercial District at request of Western Bleat, Inc.,
which subsequently sold it).

PARKING RESTRICTIONS ESTABLISHED FOR WOODDALE AVENUE AND FOR SOUTHVIEl-7 LANE.
Pursuant to advice by Engineer Zikan that the State will require formal action
by the Council to the effect that parking be restricted, Dickson offered the
following Resolution and moved its adoption:
RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BETWEEN
THE VILLAGE OF EDINA AND COMMISSIONER OF HIGHWAYS,
STATE OF MINNESOTA
WHEREAS; the Commissioner of Highways of the State of Minnesota has submitted
to the Village Council for execution, an agreement relating to restriction of
parking on those streets and avenues wherein Municipal 'State Aid funds are used
in improving said streets and avenues,

and on behalf of and in the name of the Village of Edina an agreement between
the Village and the Commissioner of Highways wherein the Village agrees to
restrict parking to one side of each of the following streets:
NOH, BE IT RESOLVED; By the Village Council of the Village of Edina, that

VOODDALE AVENUE between W. 50th Street and Tower Street;
SOUTH VIEW LANE between State Highway No. 100 and Concord Avenue.
Motion for adoption of the Resolution was seconded by VanValkenburg, and on

status of this place, Mr. Hite reported that owner Anderson has been informed
that use of the home as a double dwelling is illegal and one family must be
vacated; that matter is in hands of Village Attorney for his action.

Review; the August 3rd Adjourned Portion of the July 14th Meeting having been
postponed to this date.

to be as follows:
