'' SITE, SOUTH OF HIGm7AY 7% AT CAHILL ROAD. Council met with Planning Commission with regard to possible rezoning of this site from Comercial back to Open Development District. Vilkinson and Gustafson. Matter was discussed at some length, a thorough review of developments since the rezoning of this property for Western Meats, Inc.,being made by both Commission and Council, including review of Commission Meeting of August 18, and Council Meeting of August 22. certain restrictions on plantings, parking, etc., was brought out. the Planning Commission moved that the Commission re-affirm its previous recommendation to the Council--that while the present zoning (Commercial District) may be ill-advised in respect to the best development of the land around it, the Village is morally obligated to grant purchaser (Accessories, Inc.) the property seconded by Gustafson and carried. Dickson then moved for approval of permit for wholesale display and warehouse on this property, subject to compliance of applicant with the following require- ments : Planning Commission members present were Todd, Lewis, Griswold, During discussion the matter of Lewis of rights for which he has paid. I COXDEMNATION OF LANDS AUTHORIZED BY RESOLUTION. Pursuant to recent action taken by the Council in accordance with recommendation by the Village Entineer, Trustee Tupa offered the following Resolution and moved its adoption: RESOLUTION l.JHEREAS, It is necessary, advisable and in the public interest that the Village - of Edina acquire land for public road purposes and for storm sewer purposes; of Edina to acquire perpetual easements across, over and under certain lands, to-wit : WEREAS, In order to accomplish such purpose, it is necessary for the Village A. FOR PUBLIC ROAD PURPOSES: 1. The Best thirty (30) feet of that part of Government Lot Four (4), Section Thirty-three (33), Township One Hundred Seventeen (117), Range Twenty-one (21) described as follows : feet Best of the Southeast corner of said Government Lot 4, thence North and parallel with the East line of said Government Lot 4 a distance of 180.0 feet; thence West and parallel with the South line of said Government Lot 4, a distance of 140.0 feet; thence South parallel to said East line 180.0 feet to the South line of said Govement Lot 4; thence East along said South line of-sald . 140.0 feet to place of beginning, according to the United States Government Survey thereof and situate in Hennepin County,Hinnesota. Addition. t;lHEREAS, The efforts of the Village of Edina to obtain perpetual easements across, over and under such lands have been unsuccessful; and WHEREAS, By reason of the failure of the Village to obtain said perpetual easements across, over and under such lands it has become necessary to procure the,.same by right of eminent domain. procure perpetual easements across, over and under such lands for the purposes hereinbefore set forth under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petition therefor and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the Village or by the Court; that the Village Attorney, the Mayor and the Clerk do all things necessary to be done in the commencement, prosecution and successful termination of such action. i . 2. 3. The Easterly twelve (12) feet of Lot 3, Block 1, Smiley's NOU, THEREFORE, BE IT RESOLVED That the Village of Edina proceed to $1,800,000 IMPROVEMENT BONDS TO BE SOLD SEPTEMBER 26. following Resolution and moved its adoption: Dickson offered the RESOLUTION PROVIDING FOR PUBLIC SALE OF $1,800,000 GENERAL OBLIGATION IMPROVEMENT BONDS BE IT RESOLVED by the Council of the Village of Edina, Minnesota: 1. This Council shall meet at the time and place fixed in the form of notice set forth below for the purpose of opening, receiving and acting upon sealed bids for the purchase of $1,800,000 Improvement Bonds to be issued to finance various improvements heretofore instituted pursuant to Minnesota Statutes, Chapter 429, and to retire temporary improvement bonds heretofore issued for that purpose. The Village Clerk is hereby authorized and directed to cause notice of the time, place and purpose of said meeting to be published forthwith in the Edina-Morningside Courier, the official newspaper.of the Village; and in the Commercial West, a financial newspaper in the City of Minneapolis, Minne- sota, and in The Bond Buyer, at New York City, New York. 2. 3. Said notice shall be in substantially the following form: NOTICE OF SALE $1,800,000 General Obligation VILLAGE OF EDINA, MINNESOTA Minnesota, will meet at the Village Hall in said Village on Monday, September ' 26, 1960, at 7:30 o'clock P.M., Central Standard Time, to open, receive and consider sealed bids for and award the sale of $1,800,000 negotiable coupon general obligation Improvement Bonds to be issued pursuant to Chapter 429, Minnesota Statutes, for the purpose of financing the construction of various water main, sanitary and storm sewer, and street improvements, in anticipa- tion of the collection of special assessments levied and to be levied there- for, and for retiring temporary obligations in the amount of $500,000 hereto- fore issued for that purpose. 1960, will bear interest at a rate or rates designated by the successful bidder, payable semiannually on March 1 and September 1 in each year, and will mature serially in the amount of $200,000 on September 1 in each of the years 1962 through 1970, all without option of prior payment. The motion for the adoption of the foregoing resolution 17as seconded by Trustee I BUDGET REQUESTS J33ARD BY COUNCIL. The Council met with Park Board, and then with Hunicipal Court personnel, to hear budget requests for the year 1961. During meeting 17ith Park Board,. several phases of operations were discussed, including the matter of park maintenance, and also the matter of fees for the recreation program, it being the concensus that the recreation program should be more nearly self sustaining. There being no hrther business to come before this meeting, VanValkenburg moved for adjournment. at 10:30 P.31. Motion seconded by Tupa and carried. Meeting adjourned Village Clerk I ..
