PUBLIC HEARING ON REQUEST FOR PERMIT TO PLAT 76-FOOT DEPTH LOT AT 4617 TO:.JN'S ROAD POSTPONED TO FIRST MZETING IN DECENBER. At the request of Hr. Phillip Neville, Attorney for Petitioner Mary Neland, Council postponed the Public Hearing scheduled €or this evening on the Meland request for permit to plat a 76-foot depth lot at 4617 Town's Road. Before postponement was. effected Mayor Bredesen asked for comments from the audience, and there were no objections to said postponement. 8/22/60 PUBLIC-HEARINGS ON PROPOSED IMPROVEMENTS. 6 Clerkupresentad *Affidavits of Publicati$$g in Edina-Morningside Courier August 11 and 18, 1960, of "Notice of Public Rearing$,., on Concrete Curb and Gutter and Bituminous Surface Treatment", and reported the Mailing of Notice to affected property owners. Affidavits were approved as to form and ordered placed on file; and pursuant to said Notice the following Public Hearings were conducted and action was taken as hereinafter recorded: IN CODE AVENUE FROMT.J.6OTH ST. TO BENTON AVENUE. $8,824.11, proposed to be assessed against 1,155.4 assessable feet, for $7.64 per. assessable foot. Council's own motion, because of the condition of the road; that residents to the South of this stretch have requested the improvement, to eliminate the wash onto their ov7n blacktopped street. Mr. Glenn Carlson, 5908 Code Avenue, presented an opposing petition, signed by owners of 100% of the abutting properties. Opposition was for the reason that the improvement at this time "is premature and incompatible with long range plans, inasmuch as neither sewer nor water is in the street". Mr. Hyde told the audience that while it is the general policy to withhold above-ground improvements until underground improvements have been made, there seems to be little or no sentiment on this particular street for the underground work, and the steep grade cannot continue to be maintained indefinitely. He asked for some opinion from the audience as to how long it will be before they want sewer and water, and Mr. Carlson answered that he believes there is no immediate need. Petitioners maintained that the wash is caused by drainage from streets other than Code Avenue--Benton,W.S9th St., I.J.6Oth St., Tingdale and Josephine Avenues. Mr. Hyde suggested that proposed project be postponed until Spring. of 1960, in order that t7e may see whether sewer and vater are then imminent, and Dickson so moved. carried. IN PORTER LANE FROM W.60TH ST. TO CODE AVENUE. $9,306.43, proposed to be assessed against 1,275.2 assessable feet, for $7.30 per assessable foot. There were no objections registered at the Hearing, and none had been received prior thereto. on a large "Outlot" abutting this street on the southwest; that this Outlot should be obtained for drainage purposes; that the question is whether or not to assess this property. Boll, 6321 St.Johns Avenue, reviewed events leading to his sponsorship of petition for the proposed improvement--anonymous complaints to the office on street conditions, Mr. Hyde's letter to property owners, his own letter to property owners, and the resulting petition. Mr. Narquardt, 6213 Concord Avenue, presented petition opposing the improvement on Concord. Avenue between W.62nd and 17.63rd St. He explained that the street is oiled, that traffic is light,and the oiled surface does very well for property owners. advisable to withdraw this street from the improvement, because wash down Concord enters Rshcroft Lane. Mr. Redesky, 6112 St.Johns, asked to have his name withdrawn from petition. Mr. Roger Moore, 62nd and St.Johns, inquired about proposed storm sewer, to which Mr. Zikan answered that plans have just this week been received from Consulting Engineers, Adolph Meyer and Associates; thaf; plans shov catch basins at the corner of 62nd and St.Johns; also, at St.Johns and Garrison Lane. Messrs. A. L. 14acLean,6232 Concord, and E. Gunderson, 6216 Concord, asked that improvement be postponed until Crosstown has been constructed; one lady, and a gentleman at 6208 Concord suggested that storm sewer be constructed before consideration is given to the improvement. It was explained that construction of the Crosstolqm Highway should cause little additional traffic for these particular streets, and that public hearing 97211 be conducted shortly on the proposed storm sewer and that it is hoped it will be constructed this fall. Mr. Beryl White, 62nd and Concord, stating that 13 of the 19 property owners on Concord Avenue have signed petition against the improvement, asked that Council take action to delete it from the improvement. street should not be deleted, and Engineer Zikan replied tgat there is a drainage Mr. Bolles advised Council that it is not Mr. MacLean asked if there +s an real reason ~7hy this 8/22660 *. .. . ... . problem at corner of Concord Avenue and N.63rd St.; that water from Concord enters 8.63rd St., from the IJest side of Concord; that water from the East side of the street flows on south, toward the Crosstown; that perhaps a burm could be constructed on the Best side of Concord Avenue to route all the water south. Mr. Bolles told Council that this last will be impossible because the people on Concord south of 63rd St. do want the improvement; that they must be protected against having the ~7ash routed onto their street. One gentleman asked that the portion of St.Johns Ave. lying. between Valley View Road and 62nd St. and a lady immediately took issue, stating that this "is the worst stretch of road in the lot1'. present special assessments are paid up. Earlier in the evening a delegation from W.62nd St. had asked to be heard. The delegation was notified that 17.62nd St. had not been included in the petition; that Hearing is being held because it is thought that this project could be included with the balance of the project at a more economical rate for the benefited property owners. At this time, Mr. Stan Carlson, 4605 17.62nd St., presented a petition signed by 100% of the o~'lners of properties abutting 57.62nd St., objecting to the proposed bituminous surface improvement. 3k. Carlson told Council that concrete curb and gutter is in, that the street is oiled and that they have an excepzionally good surface and want no further work done.
