and Tupa acting 'as Canvassing'Buard for Village Election for this date, Tuesday,

Officials; and, later, canvassed the returns of Blection Officials in the two
Paper Ballot Voting Districts; and it was then moved, seconded and carried that
Canvassing Board finds the returns made by election officials to have been

Consulting Engineers an opportunity to study an alternate proposal suggested by $k.
Howard Lindow at the 24th Public Hearing. Ilanager Hyde reported that an alternate
estimate prepared by the Engineers has shown the cost of Mr. Lindow's proposal to be
some $400 =ore than the original estimate; that lfr. Lindow has been appraised of this
estimate and has offered no objection to continuing with the original planned route,
Manager Hyde recommended, however, that a new Public Hearing on the project be
held, and that the assessable district be increased .Po include certain properties
between Kaymar Drive and Old Eden Prairie Road.

December 31, 1961.
The owner of any property assessed for the above improvement may pay the whole of the
assessment without interest to the Village Treasurer on or before December 15, 1960,
or make payment with accrued interest to the County Treasurer.

Assessment shows Assessable Cost, for all properties abutting the streets listed
in the Notice to be $.16 per assessable foot. Blanager Hyde reported the written
objection of Nr. E. Sterling Kuhlmey, 6801 Hillside Lane, made on the grounds thate
the street ~7as not oiled in 1960. He explained that the work v7as done in 1959, too
late to be assessed; that it falls in the "Assessment Year 1960". A llr. Anderson,
also of I.T.68th Street, inquired about the scope
work done on Antrim Road, and it 17as explained that Antrim Road has had County
surfacing, while the work done on 3.68th Street is merely an oil dust coat.

BE IT RESOLVED by the Village Council of the Village of Edina, Flinnesota, as fo~~ows:

with the provisions of Elinnesota Statutes Section 412.441; that notice has been' duly..
published, as required by law, that this Councili7OUId meet to hear and pass upon
all objections, if any, to amend said proposed assessments as might be necessary, and
to adopt the same by resolution; that said proposed assessments have at all times
since their filing been open for public inspectioq, and opportun+ty has been given
to all interested persons to present their objections; and that each of the lots,

petition had been denied because of objections registered by owners of neighboring

Conrinission's November 2nd recommendation in favor of approval of this Preliminary;
Nr. Hite presented plat, informing Council that St,Patrick's Church has indicated
willingness to share dedication of the propdsgd road between the properties, and
that Village is asking for an utilities easement betGeen Lots 10 and 11 of plat,
Tupa's mtion for approval of Preliminary in accordance with Commission's
reconmendation was seconded by Beim and carried. This is the 11-lot plat of the
property lying between Chapel Hill and the site of the proposed St.Patriclc's Church.

"HEDGES ADDITIOW PRELIMINARY PLAT TO BE RE-SUBNITTED TO PLANNING COl.BlISSION.
Preliminary Plaf was presented by Mr. Hite, carrying Planning Commission's recommend-
ation €or approval of a plat of six lots on the 4-acre tract just north of the ~e17
70th St. water reservoir. 3lr. Hite explained that the original plat submitted had
been for seven lots, two of which were under area requirements for a plat without
sewer and water; that the larger lots had been platted ih order that sewer need not
be constructed. Council asked that sewer and water be required, and Beim then
moved approving plat with understanding that sewer and water be installed therein.
Hotion seconded by Tupa and carried. Later in meeting, Mr. and Mrs. Hedges asked
that plat be approved without sewer and water, stating that sewer installation,
especially, will be too costly; that builders will tend to set their homes closer
to the street to save connection charges, thus spoiling the appearance of the lots.
Oa Council's insistence that utilities be installed, developers asked permission to
re-submit the plat to the Planning Commission, and motion and second thereto, made
earlier in the meeting, were withdrawn by Beim and Tupa, in order that plat might
be resubmitted.

of utilities easements$ that at the last session she flatly refused to grant
easements on the gltounds that she must know just exactly what is going in on
the propertg directly to the west of her tract. At an inquiry from the Council,
Engineer Zilcan reported that the sanitary sewer can physically be routed down
T.J.66th Street, but that it will be prohibitively costly to those properties to
bz served. Trustee Tupa told Council that Miss Pearce had told him she has
no objection to granting the easement but that she cannot secure sufficient
information from the Village to know how the development to the west of her
tract will affect her property. Messrs. Ilyde and Hite, and Mr. Robert Crabb
of Southdale Management Corp., reported that both PSr. Godward and Niss Pearce
have been given all the information available; and Mr. Beim moved that Trustee
Tupa be appointed as a committee of one to see that Miss Pearce has all the

IRON MMOVAL PLANTS BIDS REJECTED. Manager Hyde reported that the equipment
suppliers, H. M. Flueller Co., have refused to honor a clause in contract which
ail1 hold Village harmless from a suit for patent infringement; that Mueller
has supplied Village Consulting Engineer Banister with plans for a type of
plant which Mr. Banister cannot recommend as meeting the specifications under
which bids were taken. Mr. Ilyde recommmded that Village reject all bids,
and re-advertise, under the amended specifications now prepared by Mr.

Department's proposal of $15,000 for purchase of 5.62 Acres of the Hayes Farm
Park for use as right-of-tray for County Road No. 18, together v7ith Slope Permit,
Waste Pit Permit, Ditch-Permit, and Stockpile Lease, Bir. Hyde's report ~7as in
some detail, comparing this offer with offers to the Hayes interests for adjoining
land; and recommended acceptance of the offer by the Village. T4r. French of the
Park Department told Council he has discussed the dtter with Messrs. Hill and
Stephens of the Park Board, and that they concur v7ith Mr. Hyde's recomendation.
After some considerable discussion Beim moved for sale by the Village to Hennepin
County of the following described property:
"That part of the following described tract: - The West 1/2 of the Southwest
1/4 excepting the West 550 feet thereof, in Section 7, Tovmship 116 North, Range
21 West, being registered land as evidenced by Certificate of Title No. 267482,
lying within a distance of 112.5 feet on each saide of the following described
