Dickson presided in the absence of Mayor Bredesen. Mayor Pro Tern MINUTES of the Regular Meeting of February 27, 1961, were approved as submitted, by motion Tupa, seconded by VanValkenburg and carried. TRACTOR-LOADER CONTRACT AWARDED TO H.C, OHMES CONSTRUCTION EQUIPElENT COMPANY. Review was made of bids taken February 27, on a Tractor-Loader, as recorded on page No. 273 of this MXnute Book. for award of contract is to award to Road Machinery and Supplies Company, at a net, with trade-in, of $10,545, on a Michigan 85A; this recommendation being made in preference to awarq to low bidder, Ormes Equipment Company, on a Trojan Q164 at net of $10,498,/~&&~e of availability of parts for the Michigan. Council that there is no dissatisfaction with tk 320.j~; that both are excellent machines for the work they will be doing for the Village. that he definitely feels that the Case W-9, which was bid by Eagle Equipment Company at a net of $7,998 does not meet specifications because of its capacity (1-318 yd. bucket as against 1% yd. specified), horsepower (70, as against 90 specified) and cylinders (4, as against 6 specified); that, while this machine could serve village needs some 75% of the time, it could not do the heavy snow work required, and the $2,500 saving effected in its purchase could be used up in one year for rental of a heavy machine. Manager Hyde told Council that service months for the Trojan. Mr. Harry Ormes, representing low bidder, told Council that while tie is willing to agree that the Michigan.is a fine machine, he lieels that he should be awarded the contract because the Trojan more than meets.speci- fications and is low bid. He stated that he, too, is willing to guarantee parts and service for 18 monthsl Tupa then moved that award be made to Ormes Construction Equipment Company, low bidder, on a Trojan No. 164 Tractor-Loader, at Net Bid of $10,498.00, with stipulation thah 18-month guarantee be furnished for parts and service. A representative for the Case W-9 spoke for this machine; with Manager Hyde making the points set forth above as to deficiencies in specifications. Tupa's motion for award to Ormes was seconded by VanValkenburg and carried. V. Terry Excavating Company at $15,991.05. recommendation was for award of contract to low bidder, and Tupa so moved. Motion seconded by VanValkenburg and carried. Tabulation of Bids was presented, showing receipt of eleven Manager's EMPLOYEES' BONDS AWARDED TO BRANDT INSURANCE AGENCY. Finance Director Dalen presented Tabulation of Bids taken today, in response to Advertisement for Bids published in Edina-Morningside Courier, showing receipt of six bids; low bid for Plan 2 being Brandt Agency, at total of $2,144.44 for three-year period. Plan 2 covers $5,000 Honesty Blanket Position Bond for Police Personnel Only, $50,000 Faithful Performance of Duty Blanket Bond for all employees except Clerk-Treasurer and Police personnel; $50,000 Individual Bond for Clerk-Treasurer; and Individual Bonds for Assessor and two Deputies, and for Clerk of Court, in amounts of $500 for assessors and $1,000 for Court Clerk. Aetna Casualty Bonds, and third-low was C. A. Hayes, bidding Travelers, at $2,311.61 and $2,327.47 respectively. Agency, and Van Valkenburg moved for award in accordance with Mr. Dalen's recommendation. Second-low was Ed Arnold Co., bidding Mr. Dalen recommended award to low bidder, Brandt Motion seconded by Tupa and carried. DMPROVEMENT PETITIONS ACCEPTED. PETITION FORWATERMAIN IMPROVEMENT FOR HEATHER LANE from Highway $169 to Cul- de-sac was filed, with request that it be considered with the former petition for Sanitary Sewer in the same street. Manager Hyde told Council that because this is such a small project he believes it can be considered as requested, even though this present petition is filed after deadline for 1961 work. Tupa's motion accepting petition and referring to Village Engineer for programming with Sanitary Sewer was seconded by VanValkenburg and carried. PETITION FOR SANITARY SEWER AND WATERMAIN FOR HANKERSON AVENUE from Interlachen Blvd. to W.5lst St. was filed; and Council heard the plea of Mr. Robert W. Gislason 85024, who explained there are evidences of water pollution, that one new home is about to be constructed on the street. to Village Engineer for programming, looking to Public Hearing at the earliest possible date, was seconded by VanValkenburg and carried. accepted and rererred to Engineer tor programming, by motion Tupa, seconded by VanValkenburg and carried. LOTS FILLED TO PROPER GRADE. and that he is afraid-soqe.damages may be suffered by low lots should there be heavy rains in the early spring; that the Village has not yet received an Engineer's Certificate showing that lots in Lake Edina 2nd Addition have been filled to required grade, Planning Director Hite asked that the Village proceed under the bond to have this work done. Council was in general agreement that proceedings under bond are correct; it was noted, however, that considerable work has been done in the area, and that it would be very difficult, if not impossible, for an engineer to certify at this time that lots are at correct elevation; that, in fairness to developers, Village should not require such a certificate until frost is out of ground. By comn consent of Council, Mr. Hite was instructed to write the Estow Corp., and Mr. William Boyer that unless Engineer's Certificate showing lots are to correct elevation is received by the Village by May 1, the Village will proceed under the bond to have the required work done; letter to be written at Mr, ate's earliest convenience. Stating that the Village Storm Sewer is now hooked up, COUNCIL FORMALLY AUTHORIZES CONDEMNATION FOR STORM SEWER. Pursuani to Mr. Zikan's report given at last regular meeting, and further information received that it has as yet been impossible to negotiate certain easement for Storm Sewer No. 58, VanValkenburg offered the following Resolution and moved its adoption: , STORM SEWER EASEMENT RESOLUTION AUTHORIZING CONDEMNATION FOR WHERF;AS, It is necessary, advisable and in the public interest that the Village of Edina acquire land for storm sewer purposes; WHEREAS, In order to accomplish such purpose, it is necessary for the Village of Edina to acquire perpetual easements across, over and under certain land, to-wit: The Northeasterly Ten (10) feet, front and rear, of Lot Two (2), and the Southwesterly Five (5) feet, front and rear, of Lot Three (3), Block Two (2), Valley Park, according to the map or plat thereof-on file and of record in the office of the Registrar of Titles in and for Hennepin County, Minnesota. WHEREAS, me efforts of the Village of Edina to obtain perpetual easements across, over and under such lands have been unsuccessful; and WHEREAS, By reason of the failure of the Village to obtain said perpetual easements across, over and under such lands it has become necessary to procure the same by right of eminent domain. NOW , 1 perpetual TEIEREFORE, BE IT RESOLVED That the Village of Edina easements across, over and under such lands for the proceed to procure purposes herein- ' before set forth under its right of eminent domain, and that the Village Attorney be instructed and directed to file the necessary petition therefor and to prosecute such action to a successful conclusioh or until it is abandoned, dismissed or terminated by the Village or by the Court; that the Village Attorney, the Mayor and the Clerk do all things necessary to be done in the commencement, prosecution and successful termination of such action. RESOLUTION ADOPTEb. Mr. Hyde told Council that the matter of revision in P.E.R.A. status will be considered by the Legislature this next week. He recommended that the Council give its legislators evidence of its thinking on the matter; and VanValkenburg offered the following Resolution and moved its adopt ion : RESOLUTION RELATING TO P.E.R.A.-O.A.S.I. COVERAGE FORVILLAGE EMPLOYEES WHEREAS, A proposal is pending in the Minnesota State Legislature to permit municipal employees to elect to remain under P.E.R.A. or, in the alternative to have a combination of O.A.S.I. and P.E.R.A. coverage; and WHEREAS, This proposal will permit each individual employee of the Village of Edina to elect that form of retirement benefits which would be most beneficial to him; and WHEREAS, The use of combined O.A.S.I. and P.E.R.A. coverage,for Village Employees will not be likely to increase the cost of retirement benefits paid by the Village, over what such cost would be if P.E.R.A. coverage alone were continued: d NOW, THEREFORE, BE IT RESOLVED By the Village Council of the Village of Edina ad follows: (1) the Village employees of this Village combined P.E.R.A.-O.A.S.I. coverage. Legislature, introduced by Edina, for financing of State Aid Street Construction in anticipation of future years' gasoline tax receipts; that final determination has not been had by Committee; that Council should inform legislators of the Council's opinion on this bill. Tupa offered the following Resolution and moved its adoption: Mr. Hyde reported that a hearing has been held on the bill before the RESOLUTION RELATIVE TO FINANCING OF "UNICIPAL STATE AID STREETS WHEREAS, there is an urgent need to do at least $500,000 of permanent street mrrfacing on various streets i'n Edina included in the local State Aid System, on which gasoline tax moneys may be used to reduce the cost to property owners and the Village as a whole; and cipation of future years' gasoline tax receipts; and use moneys on hand in other funds to purchase bonds issued in anticipation of gasoline tax revenues: NOM, THEREFORE, BE IT RESOLVED By the Village Council of the Village of Edina, Minnesota, that, in order to provide satisfactory streets as early as possible, the State Legislature be requested to amend present laws so that the Village may finance immediately an urgently needed improvement program on local State Aid Streets by selling bonds which may be redeemed by future years' gasoline tax receipts and purchased by other funds of the Village. BHEREAS, present state laws limit the amount which may be borrowed in anti- WHEREAS, there is no provision in present state laws for municipalities to 3/13/61 R. ;*: 19 Motion for adoption of Resolution was seconded by VanVal there were three ayes and no nays, as follows: Tupa, ay and Dickson, aye; and the Resolution was adopt , and on Rollcall 'Magor Pro Tem COUNCIL REQUESTS FIRST CLASS POST OFFICE. ask Congress that Edina be given a First Class Post Office, rather than continue on its present basis of service from two different Minneapolis branches and the Hopkins Post Office. adoption: Manager Hyde asked that the Council Tupa offered the following Resolution and moved its RESOLUTION REQUESTING ESTABLISHMENT OF FIRST CLASS POST OFFICE IN EDINA, MINNESOTA WHEREAS, Edina has been incorporated as a Village since 1888, and WHEREAS, The official 1960 Census of the United States reveals the WHEREAS, There are in excess of 145 commercial establishments and 13 WHEREAS, The whole Minneapolis-St.Pau1 metropolitan area has been population of Edina to be 28,501; and industrial establishments within the Village limits of Edina; and divided by the Post Office into districts, with no relation whatsoever to municipality boundary lines; and WHEREAS, The Minneapolis and Hopkins Post Offices serve various parts of Edina; and WHEREAS, It is difficult and inconvenient for official village mailing purposes to have to divide official mail between Minneapolis and Hopkins Post Offices; and WHEREAS, It Ls desirous that Edina have a Post Office of the First Class so that it may enjoy the consequent improvement of mail services: NOW, THEREFORE, BE IT RESOLVED By the Village Council of the Village of Edina, County of Hennepin, State of Minnesota, in regular meeting assembled, that the Postmaster-General of the United States be, and he hereby is, petitioned and entreated to create and establish a Post Office of the First Class in and for the Village of Edina. BE IT FURTHER RESOLVED That copies of this Resolution be forwarded to the Honorable J. Edward Day, Postmaster General, the Honorable Clark MacGregor, United States Representative, the Honorable Hubert H. Humphrey, United States Senator and the Honorable Eugene McCarthy, United States Senator. Manager reported briefly to Council on plans for expansion of the Metropolitan Sewage System, stating he ,believes that, because of mess the metropolitan area is now in, this expansion must come eventually; that, should Minneapolis and St.Pau1 require re-payment of their portions of the plant cost, Edina will also fight for re-payment of its share of this cost. "OVERHEAD" TRAFFIC LIGHT FOR 54TH AND FRANCE TO BE INVESTIGATED. Stating that he had been observing the "overheadft stop and go lights recently installed in Minneapolis; that he believes the cost of such lights should be less than that of the corner signals, Trustee Tupa asked that investigation be made on cost of such light for the corner of 54th and France. believes there is some regulation against this type of signal on "combination" streets; and it-was determined that investigation be made as to both legality and cost of installation. Manager Hyde told Council he CLAIMS PAID.
