STORM SEVER IMPROVEMENT NO. 52 (MAIN NO. 2) CONTEUCT AIWRDED. Manager Hyde presented Engineer's Tabulation of Bids taken today, showing receipt of eleven bids, ranging from $84,940.25 to $129,310.85. Swanson Excavating Company was low bidder, with $84,940.25; Lametti and Sons, Inc., second low, with $90,970.60; Phelps-Drake Co., Inc., third low, with $93,231.93; and Johnson Bros. Highway and Heavy Constructors, Inc., high bid with $129,310.85. Manager Hyde told Council that construction of this improvement had been delayed for definite plans on Highway No. 100 improvement. bidder, and Beim moved for award to Swanson Excavating Company. by Tupa and carried. He recommended award of contract to low Motion seconded ORDINANCE NO. 262-A ADOPTED AFTER PUBLIC HXARING. Publication in Edina-Morningside Courier, and of Posting, of "Notice of Public Hearing on Proposed Ordinance No. 262-2"; publication having been made June 29 and July 6; and posting, June 29, 1961. She explained that the words "No. 262-2" should have read "No. 262-Af'--and, with this correction Affidavits were approved and ordered placed on file. called Public Hearing on the proposed ordinance. speaking on behalf of the Oscar Roberts Company, told Council Mr. Harold Roberts is out of the city and that Mr. Thomsen has not been able to confer with his client since receiving notice of hearing; that he (Mr. Thomsen) feels this is a rather sweeping piece of enactment by the Village Council, and would like additional time to study it; that he does not wish to be in the position of opposing the ordinance at this time, but that it does contain some very strong language, particularly as to businesses which have been in the Village for a number of years. He told Council he has talked with Mr. Don Erickson of Glacier Sand and Gravel Company, who would also like more time to study the ordinance, and recommended that the Council delay action until gravel pit people have had an opportunity to study ordinance with the Village staff. was present, representing Stow Development Corp. He told Council he thinks the ordinance is an excellent piece of draftmanship; he feels it gives dirt movers all the rights to which they are entitled under the law; he is concerned about this because his client has to live with it; that he hhas decided the ordinance is fair and reasonable and that his client can live with it; that a delay by the Clerk presented Affidavits of Pursuant to said Notice, Mayor Pro Tem Dickson Attorney Helge Thomsen, Mr. Josiah Brill in ordinance Will be harmful to the contractor, under contract 7/10/61 vith his client. Hr. Dickson asked Mr. Brill if, in Mr. Brill's opinion the Ordinance as drafted will Ixurt anybody who is now doiag business; wd Mr. Brill replied, "Not in the least.)' Mr. Thomsen asked if the gravel pit companies must abide by the samz rules as land developers under this new Ordinance, and Mr. Hite replied that anyone mining, stripping, extracting or excavating is subject to this ordinance. Village Attorney Hasselquist informed Mr. Thomsen that the ordinance is an attempt to more clearly define regulations; that there is no attempt to enact more rigid enforcement procedures against the gravel companies.LMr. Hite told Council that Planning Commission recommends adoption of the Ordinance. Mr. Thomsen asked once again for delay in action; but Mayor Pro Tem Dickson, stating that Council and Planning Commission have both considered, and re-considered proposed ordin,ance, over a matter of months, recommended action; and VanValkenburg offered the following Ordinance, moving that Council dispense with the second reading thereof and adopt Ordinance as submitted: I ORDINANCE NO. 262-A AN ORDINANCE REGULATING THE USE OF LAND IN .THE VILLAGE FOR MINING, STRIPPING,'EXTRACTION AND EXCAVATION PURPOSES, I AND REPEALING ORDINANCE NO. 262 THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS: Section 1. Purpose. Commercial mining, stripping, extracting and excavating activities are now being and for some time have been conducted in certain places in the Village, in order to remove from the ground black dirt, sand, gravel and other minerals or substances existing on, in or under such place. Such acts are inherently accompanieik by noise and dust, often create hazardous conditions, and usually xesult in lasting disfigurement of the places where they.are carried on, and thus tend to interfere with the exisging lapd uses in nearby areas, and to discourage further permanent developmmt of the surrounding properties, and to impair adequate planning for municipal develop- ment, and to diminish the public health, safety and general welfare. It is therefore desirable to regulate both existing operations and any further extension of such mining, stripping, extraction and excavation operations in the Village, all by means of power granted to the Village Council in Minnesota Statutes, Sec. 412.221, Subdivisions 23, 24, 29 and 32, to regulate by ordinance public nuisances, noise or other disorder and uses of land in the Village for various purposes, and to provide for the good order of the Village and the general welfare of the public. otherwise extract or remove black dirt, sand, gravel or other minerals or substances existing on, in or pnder any lands in the Village, except in those areas hereinafter designated as 'PTemp~rary Excavation Districts", and subject to the conditions and requirements hereinafter prescribed. Areas designated as Temporary Excavation Districts pursuant to the provisions of paragraph (b) of this Section may be expressly designated as such for a certain term or period of time, after which time the area shall cease henceforth to be so designated, without further action or proceedings. Termination of Activities. Whenever activi’sies such as described in Section 2 of this ordinance have not been continuously conducted in an area designated as a Temporary Excavation District for a period of not less than two years, such area shall cease henceforth to be so desig- nated, unless such suspension of activities was caused by an Act of God, labor dispute, or war emergency. Any person performing any of the acts described in Section 2 of this ordinance shall make application for and obtain from the Village Council, a permit for performing any of the acts described in Section 2. Application. Application for such permit shall be made in such form, and the applicant shall furnish such information,as shall be required by the Council, and among other things shall include: (1) The true name and address of the applicant; (2) The period of time for which the permit is requested; (3) (a) A description of the Temporary Excavation District in which the applicant intends to conduct the activities for which the permit is requested, or if such activities are intended for less than the entire area of a Temporary Excavation District, a full description of such area; (4) The estimated quantity of materials to be mined, stripped, excavated or otherwise extracted or removed from the area for which the permit is requested; The current plans of the applicant for the present and future development of the area for which the permit is requested; The locations of public road access and egress to and from the excavation district and the anticipated primary routing of all vehicles hauling extracted material within one-half mile of the district. A land survey of the existing topography in thhe area for which the proposed permit applies, and an additional land sur- vey of the proposed finished topography of such area after the completion of activities to be conducted pursuant to the re- quested permit. The required land surveys shall be prepared by a registered land surveyor or engineer, shall be drawn to a scale of not more than one hQndred feet to an inch, and shall be drawn with contour intervals of not more than ten feet. application. (b) Review by Council. The Council may approve the proposed finished topography survey, or may reject the proposed survey and establish, on recommendation of the Village Manager, the grades, elevations and topography that are necessary and desirable in thhe surveyed area, in view of general health, welfare and safety conditions, drainage requirements, and eventual land use of such place. When any Temporary Excavation District includes natural slopes with more than a five foot vertical rise for each one hundred feet of horizontal measure, in no case shall a permit be granted or proposed finished topography survey approved, which would result in diminishing the grade of such slopes below said rise of five vertical feet for each one hundred feet of horizontal measure, except that Council may modify this slope in those instances where land now or hereafter is zoned for uses other than residential. Such- fee shall be non-refundable. Section 5. Duties of Permittee. Every permittee under this ordinance shall : Finished Topography. Maintain grades and elevations fully consistent with the finished topography survey submitted with an application for a permit pursuant to Section 4 of this ordinance, and as approved by the Village Council, except that variance in the finished topography shall be permitted if no more than two feet over or under elevations established by the approved finished topography survey, and occurring in no more than twenty-five per cent of the area of the Temporary Excavation District in which the activities are conducted. Maximum Depth. lower than five feet below the grades and elevations established in the approved finished topography survey, nor perform any acts that disturb or displace the ground below such levels. Sloped Banks. any mine or excavation in such condition as not to be dangerous from caving or sliding banks. Drainage. Properly drain, fill in or level any mine or escavation, after it has been created, so as to make the same safe and healthful as the Council shall determine. Crushing Activities. Conduct no activities of crushing gravel, rocks or any other materials or substances without first receiving the expressed consent of the Village Council. Fences. Properly fence any mine or excavation. , Transportation of Naterials. access and egress and primary hauling routes within a half-mile of the Temporary Excavation District as approved by the Village Council. Progress Surveys. Prepare and submit prozress surveys of current ground elevations, upon the request of the Council pursuant to the Council's determination that the conditions within a Temporary Excavation District require a survey of the progress of extraction activities therein. Inspection. At all reasonable times permit the Village Manager or any assistant of the Village Manager to enter upon any premises where acts described in Section 2 of this ordinance are being performed, for the purpose of making inspection to enforce this ordinance. Bond. When required by the Council, post a bond, executed by a corporate surety company authorized to do business in the State of Minnesota, in such form and sum as the Council shall determine, and conditioned upon raising grades, elevations and topography of a Temporary Excavation District to the levels established in the finished topography survey submitted and approved pursuant to Section 4 of this ordinance, and upon payment to the Village of all fees, fines and penalties required by this ordinance. Liability Insurance. File with the Village Manager a liability insurance policy or certificate of such insurance, issued by an insurance company authorized to do business in the State of Minne- sota. in Section 2 of this ordinance and the Village of Edina as an insured, in the sum of at least $25,000 for injury to one person, and $50,000 for one accident, and at least $25,000 property damage or in such other amounts as the Council shall determine. kept in effect until the termination of a permit granted pursuant to this ordinance, or such time as the area ceases to be designated as a Temporary Excavation District, whichever shall occur first. Pursuant to the request by Mr. Jack Haverly, developer of Cherokee Hills--present at this meeting with a recent purchaser of one of his lots--and a written request by Mr. Dick Anderson, for sanitary sewer and watermain service for the Cherokee Hills subdivisions and Heather Lane, respectively, Manager Hyde explained in some detail the difficulties involved in attempting to provide such service, in view of recent platting developme'nts Cn these areas. in urgent need of at least sanitary sewer service for h&ii development because of the new health rules concerning private sewer systems; that he has six or seven homes with private sewer systems, and four or five homes ready for hook-up to the Village sewer. Mr. Haverly asked that thhese projects be expedited, stating that his petitions had been in for a long time; that he had experienced many delays in attempting to get sewer to his property. a recently proposed plat of 130 lots, just Vest of the Overholt property, has prompted a change in preliminary plans for water; that this is a complicated project even though it seems relatively simple on the surface. Godward, C.E.), togeth'er with the Planning Commission's Resolution dated July 5, 1961, recommending issuance of excavation permit to Stow Development Corporation under Ordinance 262-A, subject to conditions set forth in Resolution as "a,b,c,d, and e". Mr. Josiah Brill, representing the Stow Development Corporation, complimented the Planning Commission on its thorough study of the problem, telling the Council that only one problem remains to be resolved--that of the amount of the bond required, insuring that grades will be left as per the approved "finished topography survey". bond should be in a nominal amount because it is actually to the economic interests of his clients to comply with the survey; and, too, there are provisions in the Ordinance which are tremendously coersive in seeing that the grades are so left-- that Council can refuse to plat; refuse to issue building permit if Ordinance is violated.
