PUBLIC HEARINGS ON PROPOSED IMPROVEMENTS IN EDEN AND ARCADIA AVENUES. Clerk presented
Affidavit of Publication in Edina-Morningside Courier July 13 and 20, 1961, and
Affidavit of Mailing July 14, 1961 , of "Notice of Public Hearings on Grading,
Permanent Street Surfacing, Bituminous Curb, Concrete Curb and Gutter, Concrete
Sidewalk, Storm Sewer, Lift Station, Force Main, Earth Dams, Sanitary Sewer,
Watermain'Service Connections", which Affidavits were approved as to form and
ordered placed on file. Pursuant to said Notice, the following Public Hearings .
were conducted, and action was taken as hereinafter recorded:
PUBLIC HEARINGS FOR EDEN AVENUE AREA IMPROVEMENTS - Manager Hyde ekplained
that the following four improvements have been initiated on the Council's own
motion because of the urgent necessity of surfacing Eden Avenue between Highway
100 and Highway 169--that this street is in bad condition and is receiving ever-
increasing heavy traffic, by School Buses, Village Maintenance Equipment, the
heavy equipment of the area industries, and general traffic using the street as
a cut-off between the two highways; that this improvement has been long delayed,
pending State Highway Department plans for the two major highways, and sufficient
information has now been received from the State to indicate that improvement of
Eden Avenue may now proceed; that because of the heavy traffic carried, here, it
has been recornended that Portland Cement Concrete be used to surface the street,
and that underground improvements must go in before the street is surfaced.

3. CONSTRUCTION OF PROPOSED STORM SEWER, LIFT STATION, FORCE MAIN, EARTH DAMS,
AND APPURTENANCES IN EDEN AVENUE FROM HIGHWAY NO. 169 TO HIGHWAY NO. 100; AND IN
HIGHWAY NO. 100 FROM EDEN AVENUE TO W.50TH ST. A Vu-Graph Slide was shown of the
route of the proposed Storm Sewer Improvement, and the area proposed to be assessed.
Residents had also received a map with Notice of Hearing, setting forth the plans
for this improvement. Manager Hyde reviewed plans as follows:
This proposed improvement is proposed to be completed in three stages.
Stage I--which involves the construction of storm sewer on Eden Avenue from a point
just east of Highway 169 to a point just west of Highway 100, and then into the
ponds on the church (Our Lady of Grace Church) property, and some earth work around
the ponds--is the only portion of the improvement planned for immediate construction.
The areas proposed to be assessed for this work will be Areas 1,2,3,4 and the
M.N.& S. Railroad property, all as shown on map incorporated as part of the Minutes
of this Meeting. Proposed Assessment, at best Estimate, will be $.005 per Sq.Ft.
for Residential Properties in these areas; $.013 for Commercial and Industrial
Properties; and $.016 for State of Minnesota--these Estimates being made on basis
of bids, and slightly lower than Estimates made in mailed Notice.

Stage I1 of this proposed project, which will .be an outfall storm sewer to Minne-
haha Creek, will be assessed against the entire drainage district, including
Areas 5, 6 and 7, State Highway right-o€-way and an area south of Richmond Drive.
It was explained that the costs of this stage cannot be estimated at this time
because complete and finaL plans for reconstruction of Highway 100 are not known.

Stage 111 will extend the storm sewer Northeasterly from Eden Avenue along Highway
169, at a presently-estimated cost of $9,360, proposed' to be assessed at $277 per
acre for Residential Property, and $883 pel: acre for T. H. 169; the assessment for
this stage fo be only against Area 1 and the Highway; This to also be future work,
Mr. Long, Edenmoor St., protested once again, against the improvement of Eden
Avenue, which necessitates the storm sewer. He suggested that traffic be re-
routed, but was informed by Council*that it is considered inadvisable to add more
congestion at the bad Interlachen-Bhokside Ave.-Highway 169 intersection. Mr.
Long then inquired as to the probable cost of the proposed outfall sewer.
Hyde explained that full information on Highway 100 is not yet available, that
until it is received full cost cannot be known; that the cost of a temporary
lift station is $12,000 on today's market. Mr. Frank Cronin, representing Our
Lady of Grace Church, told Council the Church is willing to grant the easements
necessary for the improvement, but only on condition that the Village will agree
to construct the outfall sewer after five years, regardless of the Highway
Department's action (or lack thereof); that Church's easements must be of a
temporary nature only,

to affected property owners, Manager Hyde told audience that, based on the best
bid received, the cost as given in Notice of Hearing will increase to an Estimated
$6.17 per Assessable Front Foot for the property abutting Eden Avenue (which is
proposed to be'assessed for 25% of.the cost of the project on a per-abutting-foot
basis), and $0 $.038 per Sq, Ft. for Areas 2, 3 and 4, the MN&S Railway right-of-
way, and the West 2.5 acres of commercial and industrial property in Area 5 (which
is proposed to be assessed on an area basis, for 75% of the cost).

with a sidewalk on the south side. It was noted that a petition for Blacktopping
Eden Avenue had been signed some time ago by the Danens, Balfanz and MN&S Railroad

reported that this is an alley job which was proposed some years ago and turned
down because property owners believed they could get along with a gravel sump in
the low spot; that sump has notworked, and some lots are now filled during
storms. Mr. S. Reed, 5608 Xerxes Avenue, told Council he is definitely in favor
of the improvement but thinks that something should also be done with entrances
at both ends of the alley because water drains down both streets into the alley;
that he has asked for bums but that nothing has been done. Mr. T.W. McKeown,
5625 York Avenue, told Council that two lots at W.57th St. drain directly into
his garage. Mr. Rennie, 5613 York Avenue, told Council that the'alley is slowly
disappearing; that it is about eight inches lower than it originally was; that he
feels sump*would work if alley is restored to its original elevation. One owner
informed CounciEthat alley has already been worked over on three 'different
occasions; that he feels Village should now go all out and pave it.

that from a design standpoint it is desirable; that from a maintenance standpoint
it is not strictly necessary. Mr. William Duggan, 5037 Bedford Avenue, protested
to being assessed for the proposed project, stating he feels that even the major
project will not solve the drainage problem for'the properties at 5013 Bedford
Avenue and south. Mrs. Smith, 5340 Hollywood Road, stated she is most concerned
because so much silt and trash is carried into her yard at every rain, from blocks
around; and Mr, Anderson, 5332 Hollywood Road, stated that during hard rains there
is two feet of water in the street in addition to the water running down Mrs.
Smith's driveway. Mr. Puelston, 5344 Interlachen Blvd., told Council that the
only people suffering are.Mrs. Smith and Mr. Anderson; that the same condition
existed when they built and that they knew about it then.

feasible plan to get relief to W. 51st Street; and Captain Gans replied that for

recommend that a line be put into Bedford Avenue, then west on Interlachen Blvd.
Mr. Puelston inquired as to whether Highway 169 will be extended north across
Interlachen Blvd. from Hansen Road, and was told that this proposal is considered
to Be about dead, fromwhat information we can get from the state. Mr. Warren
Posthumus; 5405 Interlachen Blvd., told Council there is very little, if any,
drainage from his tract out to Interlachen Blvd; that his land is heavily grass-
covered and almost flat; that it must rain very hard before there is any runoff
at all; also, that he has lived at his present address for sixteen years and has
never seen a flood of more than four inches at the intersection of Interlachen
and Oxford. Mr. Haemig, 5002 Bedford Avenue, suggested that a four-foot square
catch basin be constructed in &ford Avenue north of Interlachen, to take the
water; and Mr. D. W. Long, 5100 William Avenue, asked that project be tabled for
further study by the engineers. @e gentleman, who stated he had lived on Oxford
Avenue for 12 years, inquired as to the capacity of the bond, stating that if the
highway does go through there will be no pond.

HEARING ANNOUNCED ON PROPOSED OUTLET FR& HAWKk LAKe. At the-condlusion of his
reading of these estimates, Mr. Hydesreported to the audience that there will. be
a Public Hearing very shortly on construction of an outlet storm sewer from Hawkes
Lake; that because of work about to be begun on Tracy Avenue it is proposed to
provide this outlet, now; that Engineers are working on estimates, and it is hoped
to have Hearing in August; that the entire area proposed to'be assessed for the
project under consideration-tonight is also proposed to be assessed for this Outlet
Sewer.
Concerning the project now under consideration, Mayor Bredesen asked whether
streets in the area are now surfaced, and was informed that the South half of
Dundee Road is not surfaced;.that, with the minimum project, maintenance will not
be too extensive with curb and gutter, but that without curb and gutter it will be
difficult to maintain.
Inquiry was made as to ownership of Hawkes Lake, and it was explained that at
the time the property around Hawkes Lake was placted the Village acquired water
storage rights in the lake.
Mr. Al Peyer, told audience that when he purchased his home and moved in he
had no knowledge of any drainage problem; that just the melting of snow caused a
great pond in the lot next door; that water level rose to within 10" of his back
door, and his only alternative was to pump water out into Dundee Road; that this,
together with other stormwaters, has caused 100 yards of road to be completely
under water at 5532 Dundee; that this water has stayed for about six hours before
draining out.

One gentleman in the audience told Mr. Peyer that it was the building of
Mr. Peyer's house, which caused the ponding of the waters in this area.
Mr. Walsh, 5509 Highwood Drive, asked if the system is proposed to drain
the water out of the street, and was informed that it will drain only that water
which gets into the street. He then told Council that certain lots on Dundee
Road all drain from east to west, and not to the street.

DISCUSSION was had on the motion when several questions were e&& from
the floor as to the size of the outlet proposed to Hawkes Lake, and its relation
to the blocked culvert in place now$ and others raised questions concerning
recent filling and grading operations in the area proposed to be used for the
outlet. Stating he feels the motion should pass, Trustee Dickson told audience
the engineers will find out if the culvert is blocked and an obstruction has
been made; that if so, he feels that whoever blocked culvert should be made to
pay for re-opening it.

At this time Captain Gans stated that it is not his intent to jeopardize a
project which is already unpopular with the public, but he feels that Council
should be appraised that he and the consulting engineers, Bredow and Magnuson,
are of the opinion that the minimum project which will do a satisfactory job
is the project proposed as Alternate 3 - from the Hawkes Lake Outlet to a point
on Dundee Road opposite Lot 2, Block 1, Mirror Lakes-Meadow Wood 2nd Rddn. to
Edina Highlands, with provision for a stub west about 110 feet to pick up a
natural low area in Block 3; that if the line is carried only to the point now
being considered by the Council, the water being-carried in the street to this
point will need over-sized catchbasins . Mr. Magnuson concurred, stating that
as Dundee Road is paved and the vacant lots are developed the rate and amount of
runoff will increase.
Mrs. Maurice Hessian, 5216 Dundee Road, requested that Mr. GiebinkJs letter
of opposition be publicly read, and this was done.
With regard to Captain Gans' recommendation, there was comment from the
Council that, should the presently-considered improvement prove later to be
below minimum, the line could then be extended up Dundee Road;

represents a complete job of drainage for the assessable area, while the alternate
shown, which would start tit the intersection of Westridge Blvd. and Crescent Drive
and continue Southwesterly on Crescent Drive to within two lots of the intersection
of Hillside Road and Crescent Drive, and then carry water across lots to Whiting
St., then on easements again to the Creek, represents the minimum-which will
alleviate the problem but is not guaranteed to drain off all the water immediately.
The Estimate of Cost on this project was given as $48,395.56, for $.04081 per
assessable square foot. Mr. Hyde told audience that consideration had been given
to running the water through an open ditch south of 64th St., but that this property
is soon to be developed, and it was considered unwise to have an open ditch, here.
Mr. Walter Norde11,6237 Crescent Drive, reported that owners of six homes on
Crescent Drive had petitioned for the improvement, that they still want it, that in
fact they are asking tha it be done as soon as possible.

Mr. Theodore Hanson, 5109 W.59th St., asked that property owners be given a credit

paid per lot for this erroneous work. ,

ment, by the Del-Edge Association; that, in an effort to clarify matters to the
residents, he and Captain Gans had met with a group of the residents last Saturday;
that, on the basis of the preliminary estimate, a vote had been taken at Saturday's
meeting: showing 22 to 5 in favor of Portland Cement Concrete Paving, and 18 to 5
in favor of an assessment basis whereby corner lots will pay 1/3 the cost of their
long sides, and the balance will be spread over the entire assessable area.

in development; that it is simply asking that the 72nd St. portion of this
improvement be deferred for a short period of time.

Estimate; that the low bidder on the three projects, Art Bolier Const. Co., bid

estimate of $10,295.00.

of the island, be abandoned--and that the Council revert to its original require-
ment of having the lots filled to an elevation of 825 feet.
Council he believes Mr. Stow spoke without the authority of the Board of Directors
of the Corporation, when Stow made the proposal; that, at the time, Stow was unaware
of the scope of thti work; that 15 to 20 thousand cubic yards of dirt must be moved,
and that, in addition, there would be a five-foot wide channel directly behind
these lots, without public access, which at times would be filled with water five
feet deep, constituting a death trap, for which the Village would have to accept
responsibility because it is putting storm water into the-lake. Mr. Godward told
Council it cannot hold the present owner responsible for control of the lake after
he has sold off his lots; that at the present time the new owners are not
incorporated, so that they cannot be held responsible.
Mr. Carl Struck, Hibiscus Avenue, speaking for the residents whose back yards
abut the lake, several of whom were present, stated that he did not know just what
to say after hearing this report--that he felt as though he had been "euchered".
Mr. Stsrck told Council he had believed Stow was a representative of the
Corporation at the time Stow made his proposal; that it now turns out Stow is not
a representative of the Corporation unless he gets his way.
