MINUTES of the Regular Meeting of July 10, 1961, were approved as submitted, by motion Bredesen, seconded by Tupa and carried. PUBLIC HEARING ON PROPOSED LATERAL SANITARY SEWER, LIFT STATION, ium APPURTENANCES IN BELMORE LANE FROM EXTENDED CENTERLINE OF GROVE PLACE 425 FT. E., AND IN ALLEY JUST EAST OF GROVE PLACE FROM BELMORE LANE 400 FT. NORTH. Affidavits of Publication in Edina-Morningside Courier August 3 and 10, 1961, and of Mailing to affected property owners, of "Notice of Public Hearing" were submitted, approved as to form 'and ordered placed on file; and, pursuant to said notice, Public Hearing was conducted and action taken as hereinafter recorded. partially as a continuation of the July 24, 1961 public hearing, at which Mr. James DeKiep requested that provision be made for additional lots neighboring Belmore Lane, which would be left without provision for sewer should the originally, planned construction take place. Edina has now met with Hopkins; that Hopkins will allow connection to its Sanitary Sewer at Maple Hill Road; that Estimates of Cost have been worked out, showing that it will be considerably more economical to go into Hopkins than to serve the six properties needing sewer with a lift station in Edina, Estimates being $21,179.31 for the lift station sewer, as against $16,881.00 for the Hopkins sewer. connection basis, which will be an approximate $1,380 per connection--based on the price of Sanitary Sewer No. 120 at a per front foot assessment of $8.53, plus a 29% increase in construction cost since 1957; that the balance of cost will be assumed by thb2Village; that when the larger lots are split and additional connections needed, charges will be made on these new connections on the same basis as though now proposed to be assessed. Both Messrs. Wilhoit and DeKiep expressed their satisfaction with this arrangement; and there were no objections made. Motion for adoption of the Resolution was s PUBLIC HEARING ON PROPOSED CONSTRUCTION OF PORTLAND CEMENT CONCRETE PAVING WITH INTEGRAL CURB IN W.70TH ST. FROM TRUNK HIGWAY NO. 100, EAST TO FRANCE AVENUE, Clerk presented Affidavits of Publication in Edina-Morningside Courier August 3 and 10, 1961, and of Mailing to affected property owners of "Notice of Hearing", which affidavits were approved as to form and ordered placed on file. Pursuant to said Notice, Hearing was conducted on this proposed improvement, and action . taken as hereinafter recorded. to cost $196,000, the greater portion of which will be financed from gasoline tax funds under the %Municipal State Aid Street" plan; that it is proposed to assess approximately $5.00 per Assessable Foot to properties abutting the street, over a ten-year period, with those corner lots having their long sides on W.7Oth St. paying 1/3 their abutting footages; that the street will be 40 feet wide, withh parking limited to the North side; that there will be no parking on south side because of platting pattern; that it is proposed to pave between France and West Shore Drive in 1961; West Shore to Highway 100 in 1962, to allsw compaction after storm sewer construction. There were no objections registered at the Hearing, and Manager Hyde reported the improvement is estimated no written objections had been received Resolution and moved its adoption: RE SOLUTION 8/14/61 . prior thereto. FROM TRUNK HIGHWAY NO. 100, EASX TO FRANCE A?"UE and at the hearing held at thh time and place specified in said notice the Council has duly conslidered the views of all persons interested, and being fully advised of the pertinent facts does hereby determine to proceed with the construction of said improvement; that said improvement is hereby designated and shall be referred to in all subsequent proceedings as STREET IMPROVEMENT NO. E-14, and the area to be specially assessed therefor shall include all lots and tracts of land abutting the street to be improved. PUBLIC HEARING ON EIAWKE'S LAKE OUTLET STORM SEWER, AND TRACY AVENUE AND RELATED LATERAL STORM SEWERS. Manager Hyde asked Planning Director Hite to explain to the audience the main features of this large proposed project, a part of which is necessary before Tracy Avenue can be paved. Publication in Edina-Morningside Courier August 3 and 10, 1961, and of Mailing to affected property owners, of "Notice of Hearing", which affidavits were approved as to form and ordered placed on file. Public Hearing was conducted, and action taken as hereinafter recorded. Hite reported that the proposed improvement consists of several integrated parts, as follows: Clerk presented Affidavits of Pursuant to said Notice, Mr. 1. Provision for an outlet for stormwater overflow from Hawkes Zake by installation of a pumping station on the west side-of the lake to pump the overflow to the top of the hill immediately to the southwest, and a line from there to the Nine Mile Creek flood plan -- the cost of which is estimated to be $26,700, and is proposed to be assessed against the entire area contributing water to Hawke's Lake (either by surface flow or storm'sewer pipe) at an estimated cost of $,0045 per assessable square foot. Warden Avenue from Hawkes Lake easterly to Johnson Drive; (this pipe to be Tracy Avenue from Hawke's Terrace southerly to Grove Street; Johnson Drive from a point approximately 400 feet north of Warden Avenue Grove Street from Johnson Drive to approximately 260 feet easterly. The cost of this proposed project is proposed to be assessed against all properties within the outlet area (No.1) drained by said laterals, and against an additional area within the outlet area which now drain to the park pond-at Hansen Road--this latter area to be assessed for the oversizing of the Warden Avenue lateral, only. An addition to the above-cited laterals, easterly ahag Johnson Avenue along a road in the proposed Edina Parklands subdivision to the west side of an enlarged pond in Village park property, and an overflow outlet for the park pond. 2. With the aid of a map, showing the areas proposed to be assessed (copy of which map had been included with mailed notice of hearing), Mr. Hite reported that if all the proposed laterals and the outlet for thhe park pond are constructed, the Estimated Cost woul e $80,600, of which $9,400 will be paid as part of the Municipal State/ hi gram, leaving $71,200 proposed to be assessed. Of this amount, $8,450 is directly attributable to the park pond outlet, and would be assessed against the area now draining to the pond (area C on map) at an estimated $.0044 per-square .foot. The balance of $62,750 would be assessable to areas drained by proposed laterals (A&B on map) at an estimated $.0302 per assessable foot. the assessment against area C is low because this area has no direct inlet or catch basin service for streets within the area; that should such fauilities be needed at a later date, additional assessment would be made for them, to area C. I It was emphasized that Mr. John I). Danielson, 5714 Benton Avenue, reported that the Benton Avenue pond does not drain; that outlet from pond is plugged. Mr. Downes, Hawke's Drive, inquired as to what effect this plan will have on the level of Hawke's Lake, and Mr. Lindsey, consulting engineer, reported that present level will remain-that I53 8/114/61 surplus water will be pumped out. inquired about his assessment..' It was explained that his area is now being assessed for lateral service--that the only additional assessment he would receive would be for the Wawlce's Lake Outlet portion of the improvement. Mr. Charles Blake, 5716 Benton Avenue, asked if this improvement includes plans for a small pond near his residence. it is believed the owner is working with the Church people to get this re- opened. Mr. Wyman, Benton Avenue, told Council he couldn't begin to pay the assessments proposed for his property--and that with these proposed assessments he couldn't give his lots away. He asked that the assessment be levied over 20 years. project is completed, at which the term of the assessment can be considered; although it has been the policy to levy over a ten-year term because of the better rating received on short term bonds. Mr. Brooks Nielsen, 5521 Benton Avenue, asked concerning plans for the beautification of the Benton Avenue pond, and was informed tlhat plans are in specifications for contract. Mr. Nielson then reported that the back yards in the 5500 block between Benton and Countryside Road are too low to be served by the proposed improvement; and Mr. Rollie Danielson corroborated this statement, saying there are 19 lots which contribute water to this area; that water is trapped, here. Manager Hyde and Captain Gans recommended that a stub drain of about 150 feet be installed . Mr. Steele, 5516 Benton Ave., inquired as to why assessment should be made for storm sewer if there is no pipe put into the street. It was explained that for reasons of economy storm sewers are planned to take all water possible by gravity; that the water from Benton Avenue is picked up in catch basins below Benton and then carried underground. Council he has never had drainage problems; that the proposed improvement is . doing his 45,000 square feet absolutely no good, and that he objects to paying for the improvement. The owner at 5705 Olinger Road informed Council that his property is hemmed in by nine acres which the owner proposes not to sell for some time, and that he objects to paying for storm sewer unless he can realize some benefit from development of his property. inquired as to wheter it is proposed to levy different assesments for improved, as compared with mnimprovedproperty, and was told rate of assessment will be the same. PUBLIC HEARING ON PROPOSED ASSESSMENT FOR TREE TRIMMING IMPROVEMENT NO. E-2. Pursuant to "Notice of Assessment Hearing on Tree Trimming Improvement No. T-2", published in Edina-Morningside Courier August 3 and 10, 1961, affidavit of which publication was presented by Clerk, approved as to form and ordered placed on file, Public Hearing was called on proposed assessment for the above entitled improvement. proposed to be assessed on a "per-lot" basis against the lots abutting the streets on which trees were trimmed, whether or not the particular lot has a tree, against 1,003 Lots, for $15.40 per Lot. There were no objections to the proposed assessment registered at the Public Hearing, and no written objections had been received prior thereto. Dickson's motion, that Assessment be approvedsas presented, was seconded by VanValkenburg and unanimously carried. (See Resolution of later in Meeting, Adopting and Confirming Assessment). Tabulation was read at Total Assessable Cost of $15,446.20, PUBLIC HEARING ON PROPOSED'ASSESSMENT FOR STREET IMPROVEMENT NO. ~~-18, IN CHANTREY ROAD FROM AYRSHIRE BLVD. TO HIGHWAY NO. 169. Clerk presented Affidavit of Publi- cation of "Notice of Assessment Hearing" in Edina-Morningside Courier August 3 and 10, 1961; and, pursuant to said Notice, Public Hearing was called. Tabulation was read at Total Assessable Cost of $16,722.09, proposed to be assessed against 20 lots at $7.98 per front foot, as compared with Improvement Hearing Estimate of $6.79 per Front Foot. Manager Hyde explained that increase in cost is due to two reasons; that the major reason is an under-estimate by the engineers on excavation and gravel; that the other reason is the widening of the entry way to Highway No. 169. Mr. Walter Lindley, 5525 Chawey, told Council he feels estimate should have been closer; also, that property owners were informed the'night of the improvement hearing that engineer's estimate is usually high. Asking what type of bid is obtained, he was informed that bids are on unit prices. He asked if perhaps manpower hours were figured including driveways rather than on street work alone, and was told that bids are not taken on manpower hours, but,rather, on unit prices of excavation, bituminous surface, etc. Mr. Tom Grady, 5505 Chantrey, inquired if it is not the policy to accept fixed-price contracts, and on receiving the answer that this is not the policy, inquired as to what safeguard the taxpayer has that he will be assessed an amount comparable to the estimate given. Manager explained that estimates are made up from the best available information; that soil borings are taken beforehand and that it is from the results of these tests that quantities are figured. Captain Gans told group that matter of taking core borings from the street is a matter of engineering judgment; that, in this particular case, worse soil conditions were encountered than were anticipated from test results. Mrs. Meinhofer, who stated she was responsible for the petition for this work, asked if the Village will not assume a share of the cost of widening the Highway No. 169 entryway; and Mr, Lindley told Council he feels there is a real question as to whether this entryway should be assessed against Chantrey Road at all--that it serves several other streets in addition to Chantrey; that the street was widened only for the purpose of contributing to the safety of the persons in the area.
