Manager Hyde asked for formal authorization for execution of a contract with the Hays interests for purchase of 10.65 Acres at the Northwest Corner of Hays farm, which would make the Nest boundary of Hays Park County Road 1/18; purchase to be effected as follows: The price of the property, $24,000 plus 1.21 acres now owned by the Village on the West side of County Road #18, less 29,000 Yds. of fill (more or less) at 10~ per Yd. from surplus material off the streets in LaBuena Vista Addition paving project, making net cash sale price of $21,100. Manager Hyde reported the Park Board had allocated $23,000 for this purchase, that the money is available, and the Park Board approves the transacation, all as discussed in informal budget meeting held September 5. MINUTES OF THE REGULAR MEETING OF THE EDINA VILLAGE COUNCIL, HELD MONDAY, SEPTEMBER 25, 1961, AT 7:OO P.M., AT THE EDINA VILLAGE HALL Members answering Rollcall were Beim, Dickson, Tupa and VanValkenburg. Mayor Pro Tem Dickson presided in Mayor Bredesen's absence. MINUTES of September 11 and September 18, 1961 Meetings were approved as submitted, by motion VanValkenburg, seconded by Tupa and carried. PUBLIC HEARING ON PROPOSED SANITARY SEWER IMPROVEMENT IN WOODDALE AVENUE FROM GARRISON LANE TO 480 FT. NORTH AND IN VALLEY VIEW ROAD FROM THE CENTERLINE OF OAKLAWN AVENUE EXTEDED TO 406 FT. WEST. Affidavit of Publication of "Notice of Public Hearing" in Edina- Morningside Courier September 14 and 21, 1961; and, pursuant to said Notice, Public Hearing was called on the above entitled improvement, which is an alternate proposal worked out with the affected residents, to the Sanitary Sewer route approved by the Council July 10, 1961, as Sanitary Sewer Improvement No, 181. Vu-Graph Slide was shown of proposed new route and area proposed to be assessed, and Manager Hyde reported that the Engineer's Estimate of Cost, before taking bids today, had been $10,139.36, for $1,448.48 per Connection; that the low bid today, which was considerably lower than the other bids received, will raise assessable cost to about $2,025 per connection. Mr. Neal Swant inquired about the legality of connecting a large building, to be built across the back of his two lots, to the 6" hertrice connection through the Tedman property, stating that if there would be some difficulty in this he is willing to pay the difference between the 6" connection and a gt' connection if it does not total more than $1.00 per'foot. inquired as to whether a manhole will be placed at the end of the connection and was informed that the connection will be plugged, now; that no manhole is contemplated; that when he wishes to connect a direct connection ma$:bbezmade without manhole. Captain Gans told Mr. Swant that from a design standpoint he believes the Village has fully satisfied the requirements for service to this area. Mr. Swant inquired about possible connection for a car wash, and was informed that the Village has an ordinance on car wash operations, which provides special regulations for this type of business, including grease traps before water can be sent into the sewer system. favoring improvement, was read. and none had been received prior thereto. the Vooddale Avenue-Valley View Road intersection is bad because of the steep grade of 'Nooddale Avenue running south of Valley View Road, Trustee Tupa suggested that perhaps Wooddale could be partially filled while the sewer work is being done. Mr. Hyde reported that this probably would have to be a major construction job (6f its own, because he felt that fill would have to start from the extreme south end to get a gradual grade. felt it would help if a plateau large enough for one car could be had just at the intersection. Mr. Fred Rogers, Jr. told Council that the dirt moving contractor, Kraft, has assured him this lot will be at the required elevation very shortly. Mr. E. C. Stow asked that the matter be laid over for a month. Mr. Hyde reminded Council that the last formal extension of the bond expired September 16. is of opinion that bond will remain in force until Village gives notice that work is complete. WATERMAIN IMPROVEMENT NO. 163 - Trunk Watermain in W.56th St., Gleason Road, etc. Coburn & Meek being low bidders at $139,926.00; Swanson Excavating Co., second low at $140,111.00; Orfei & Mariani, third-low at $143,020.65; and J.A. Danens & Son, high bidder at $176,104.50. Engineer's Construction Estimate was $160,853.50. Manager zecommended award to low bidder, and VanValkenburg so moved. Tabulation of Bids was presented, Tabulation of bids received Friday whowed receipt of nine bids, Motion seconded by Beim and carried. 2. SANITARY SEWER IMPROVEMENT NO. 178 AND SANITARY SEXJER IMPROVEMENT NO. 181 Tabulation of bids received today on these two projects showed receipt of four bids, Swanson Excavating Co. being low bidder; Northern Contracting Co., second low; Peter Lametti Const. Co., third-low, and Coburn &Meek, high bidder. Manager explained that Sanitary Sewer Improvement No. 179 bids had been taken two ways-- the base bid being on the line in East Service Drive of Hwy.#lOO from Valley View Road to 675 Ft. South; and the alternate going only 595 Ft. South of Valley View; that low bidder had bid $16,251.25 on the base bid; $15,725.25 on the alternate; said bid covering both Sewer No. 179 and Sewer No; 181. Broken down, low bidder's bid was $11,480.00 for Sanitary Sewer No. 181 (as'compared with Engineer's Estimate of $8,230.00); and $4,771.25 for base bid on Sanitary Sewer No. 179, $4,245.25 on alternate. Manager Hyde recommended award to Swanson Excavating Co. ,on the low bid of $16,251.25. Captain Gans explained that the high bids on Sanitary Sewer No. 181 signify that contractoss are afraid of wet digging on Wooddale, and do not appreciate having to work on Valley View Road under condition that traffic must be kept moving on this street. VanValkenburg's motion, awarding contract for Sanitary Sewer Improvements Nos. 179 and 181 to Swanson Excavating Company was seconded by Tupa and carried. AWARD ON SNOW PLOW DELAYED TO OCTOBER 9. Five Bids--Public.Works Equipment Go., $1,090.00; Geo. T. Ryan Co., $1,100.00; Road Machinery & Supplies, $1,118.50; Hayden-Murphy Equipment Co., $1,127.50; and Phillippi Equipment Co., $1,369.00. Council reviewed Planning Commission's recommendation, dated September 13th, favorable to the granting of Mr. Randolf Hippe's request for multiple residence zoning on the above entitled tract. a 4-plex on this tract if his request is approved. Grandview Heights, and Parecels 610 and 620, Section 28, Twp. 117, R. 21. After an explanation by Planning Director Hite, Tupa moved that Public Hearing on this proposed rezoning be scheduled for Monday, October 9, at 7;OO P.M. Motion seconded by Beim and carried. ZAHALKA REQUEST,FOR ONE-FOOT REAR YARD AT 4900 SUNNYSIDE ROAD DENIED. Council reviewed Planning Commission's September 13th recommendation for denial of Dr. H.J. Zahalka's request for permit to construct a tool shed within one foot of his rear lot line at 4900 Sunnyside Road, and Beim moved that Council deny request in accord with Planning Commission's recommendation. Motion seconded by Tupa and carried. ENGELHART ADDITION PRELIMINARY PLATAPPROVED. Mr. Hite presented this plat, calling Council's attention to the Engelhart home, which will have too short a rear yard if the property is platted in this manner. Mr. Hite told Council that there is no other way to plat, and that it is for this reason that the Planning Commission has recommended favorably. Plat be approved was seconded by Beim and carried. Tupa's motion that Preliminary IDYLWOOD FOURTH ADDITION FINAL PLAT APPROVED. Council discussed at some length the Planning Commission's stipulations for approval of this Final Plat. It was noted that one of the stipulations was that Lots 4 and 5, Block 1 are not to be filled or developed in any manner until adequately served by a storm sewer system. Attorney Hasselquist inquired as to what method will be used to place this stipu- lation on record, and it was suggested that either drainage easements be secured for these two.lots, or deed restrictions be filed thereon. Beim's.motion, that Final Plat be approved subject to compliance with stipulations set forth by the Planning Commission, with understanding that the stipulation on Lots 4 and 5, Block 1, be placed in form of either drainage easements or deed restriction, was seconded by Tupa and carried. BORN'S ADDITION FINAL PLAT APPROVED. Mr. Hite presented Final Plat of a two-lot replat of a parcel located adjacent to the Northeast quadrant of the Crosstown Highway and Normandale Road. He reported to Council that this property will now be served by Sanitary Sewer, in accordance with contract awarded this evening, and recommended approval. was seconded by Beim and carried. EDINA TO :JOIN .ST.LOUIS PARK IN REQUEST FOR COOPERATIVE ENGINEERING STUDY ON MINNEHAHA CREEK WATERSHED. Stating that the Village has .now received a copy of the only study made on the problem of the Minnehaha Creek Watershed, for which he asked at a recent meeting called by the rounty Commissioners; that Mr. Hite has reviewed the study; that the Village of Minnetonka has a great many plans for the beautifi- cation of lands which empty into Minnehaha Creek but that no plans have as yet been made to include in a Watershed District.the lands draining into Lake Minnetonka (from which Minnehaha Creek begins); that there are some legal questions as to whether developed areas such as St.Louis Park, Edina and Minneapolis should be considered as part of the problem; and that St.Louis Park has requested that a preliminary engineering survey be conducted prior to the establishment of a district, and has stated its willingness to cooperate in such a survey, Mr. Hyde recommended that Edina join in St.Louis Park's request. Hasselquist stated that 0nce.a 'Watershed District dhas been established, the Council has divorced itself from jurisdiction over this district; that it is possible that Edina could find itself in a position of being taxed for improvements in which it has had no voice. Beim's motion, that Edina jointin St.Louis Park's request for a cooperative preliminary engineering survey prior to establishment of a watershed district, was seconded by %pa and carried. Motion seconded by Tupa and carried. .,.. , r . t.1 *h* . EDINA HIGHLANDS SANITARY SEWER CONNECTION THROUGH "EDINA PARKLANDS" DISCUSSED. CONDEMNATION OF EASEMENTS CANCELLED IN FAVOR OF GISSELBECK'S GRANTING EASEMENTS FOR TEN-YEAR TE& ASSESSMENT. August 28, stating that Mr. Gisselbeck will start to develop Edhna Parklands immediately, according to the old plat which has been approved/tXe Planning Commission; that he understands that sanitary sewer will be installed in this plat on a special assessment basis over a ten-year term; that the village will install storm sewers on a special assessment basis over a ten-year term; and that Gisselbeck will install the watermains. Mr. Hyde told Council that the easements necessary for the sanitary sewer are being condemned, but that the Village does not have the right to go in on this property for 30 days; that the sanitary sewer contract has been awarded; that Mr. Gisselbeck has agreed to let the Village go ahead with work immediately providing Council agrees to the terms of his letter. Mr. Gisselbeck agreed with Mr. Hyde's statement, saying that he does not want to develop the property, at this time, but that because of the necessity for the Village to secure this sanitary sewer connection for Edina Highlands, he has gotten bids and proposes 60 have Northern Contracting Company begin, soon, on the watermain construction; but that he feels that in return for allowing the Village to make the connection (which he did not need and does not even want at this time), his property should be assessed over a ten-year, rather than a three-year term. a ten-year assessment, whereas it has been assessing on a three-year termwith other developments, Mr. Hyde replied that a ten-year assessment is not feasible unless Council recognizes that, here, the Village needs the sewer connection for the Edina Highlands sewer, which is complete and which has already been assessed; that, here, what the Village is doing is granting a ten-year assess- ment for the privilege of going acress his land. accept Mr. Gisselbeck' s letter in toto; that condemnation/$or sanitgry sewer easements be cancelled upon Mr. Gisselbeck's submission of easements for said utility; and that Council agree upon a ten-year sanitary sewe!: assessment for privilege of making sewer connection through Gisselbeck's Edina Parklandsfor Edina Highlands. Captain Gans told Council that the Engineering Department is now at the stage where it should be making plans for next year's construction work, if this work is to proceed in an orderly manner. He asked that Council set a deadline for some time early this fall for submission of petitions for major construction work for 1962. Some discussion was had, and it was agreed that deadline for petitions for 1962 work should be November 15, 1961. COUNCIL HEARS REQUESTS FOR BUDGET APPROPRIATIONS. Council heard Municipal Judge Burris review the operations of the Court in 1961 and request imkreaised -2iRpropri- ations for 1962 to provide for the ever increasing work load. Mr. Larkin McClellan requested salary adjustments for equipment operators. No action taken.
