Trustee NO HEARING TONIGHT ON "PLANNED INDUSTRIAL DISTRICT" ORDINANCE! announced to the audience, that contrary to notices circulated privately by Mayor Bredesen various citizens' groups, Hearing would not be conducted this evening on a proposed "Planned Industrial District" ordinance ; that the Plannini Commission was not yet ready with its formal recommendation to the Council; that there would certainly be publicity before any official public hearing is held. MINUTES of Regular Meeting of February 26, 1962, were approved as submitted, by motion VanValkenburg, seconded by MacMillan and carried . SANITARY TRUNK SEWER IMPROVEMENT NO. C-2 TABLED AFTER PUBLIC HEARING, This being a blizzardy evening, after a day of heavy snow, Mayor Bredesen asked those in the audience if they felt there were some persons who were kept away from this official hearing because of the weather. been unable to leave their homes, but inasmuch as there were over a hundred present, Council decided to go ahead with the Hearing, of Publication in Edina-Morningside Courier March 1 and 8, 1962 of "Notice of Public Heaking on Trunk and Lateral Sanitary Sewer and Lift Station", which affidavit was approved as to form and drdered placed on file, as was affidavit of mailing of Notice of Hearing to owners of affected properties. reviewed for Council and audience% the Estimated Cost of the proposed pr'oject (the route and assessment district for which was set forth in detail in the Notice of Hearing), the Estimated Cost and proposed assessment therefor being as follows : Some present felt their neighbors had Clerk-presented Affidavit Manager Hyde Construction Cost $664,116.00 Engineering and Clerical 53,129.28 Capitalized Interest 71,724.53 Share of Cost of C-1 140,568.57 $929,538.38 Assessments - Trunk Charge - Per acre, for unplatted land - $770.95 Trunk Charge - Per front foot - fot platted lots - $3.75 - (Maximum of 150' to be assessed against any one lot, if lots of greater footage cannot be subdivided into smaller Lots) Lateral Charge - For properties abutting the route of the trunk sewer, which can connect directly to the trunk, without additional lateral sewer construction - $6.50 per front foot. Mr. Hyde reported this is the second Hearing held on this proposed project; that it was first heard along with the "Nine-Mile Creeks1 Sanitary Sewer; that, at that time it was decided to over-size the C-1 sewer in. order to accommodate that area which would have to tie into it in the future, proposed to be served by Trunk Sewer No, C-2 is in large homesteads; that there are some original farms which are ripe for development; that the Village cannot guarantee any private sewer installation for any length of time; that the Village has strengthened its ordinance governing private sewer installations , and now requires percolation tests before such private systems can be installed; that out of 32 such tests taken, 16 have been found to be unsatisfactory; that some of the soil in this area will support private systems, and some will not; that the sewer is being proposed again at this time because some of the farms in the area have been sold and are being held by people who intend to develop them, and because the building of the Junior High School and'the opening of the Catholic School will intensify development; also, that what the Village is trying to do is to decide whether to put the trunk sewer in now, or nhether to wait until the area is developed. He added that the pDOpOSed Trunk Sewer has not been petitioned for. the improvement, signed by some 130 property owners. construction of the im@vement at this time will put an artificial pressure on land owners to do something with their properties, and that Edina would be better off to develop more slowly, Mr. Shuster asked that he be allowed to voice a very strong objection. that there are hundreds of acres in the area which land owners want to keep; that he could not sell his land unless he "gave it away"; that he'believes the Council does not want to impose a hardship on owners, and that while Manager and Council have done an excellent job of planning, this project is coming too early. stated that Mr, Ralph Overholt, owner of several acres, had called from Florida by phone, voicing his objection. Stating that a part of the area Mr, Gordon Shuster, 5809 Dewey Hill Road, presented petition in objection to Stating he feels that Mr, Me1 Jensen, 6939 Valley View Road, told Council this project is premature; He *- 3/12/62 Mr, and Mrs. Carl Eiken, 7200 Normandale Road, objected to the route of the proposed sewer, stating it will ruin their land, running between their house and the-ir outbuildings. It was noted that the Highway Department proposes to take this tract as part of Highway No, 100 reconstruction; and the Eikens asked that they be notified before construction as to which unit of government would pay for the sewer easement, A Mr. Holland, who stated he is owner of six or seven acres, said he was very much opposed to the sewer construction at this time, as did Mr, Tom McCauley, 6817 Highway No, 169. lots in this area are large, the homes are new, and he believes a sewer is not needed. high per-acre assessment on unplatted property, and it was explained that this has been figured to equal an assessment on two to 2 or two and one-half lots- which is the type of platting we are now getting on acreage. During the discussion, the Council had requests from Mr. Warren Reynolds, 6401 Indian Hills Road, Rev. Paul F, Keller, 6412 Indian Hills Road, Mr. Donald Buck, 6509 Indian Hills Road, two others, for estimates on the cost of laterals for Prospect Hills Hills Additions, in order that property owners might determine whether it is economically feasible to install public sanitary sewer in these areas. Reynolds told Council that unless laterals can be installed on a practical economic basis he feels it is unfair and probably illegal to levy a trunk sewer assessment on them. so that laterals for the areas under discussion can flow into it by gravity; that engineering for laterals is not done until petitions for them are received. A question was raised dts to the proposed assessment to be levied against the Hays Farm property; add it was explained that this had not been figured, for two reasons: 1. It is not yet known what facilities will be needed on the Hays Park; and 2, Because this park is not to be developed residentially, its full sewer capacity will not berneeded by Edina and could be made available to Eden Prairie, which has asked to be allowed to use some of this capacity--which is tentatizgl proposed to be assessed on the basis of a capacity for some 500 to BOO ce%ie&eas; that this matter has yet to be worked out, and that the proposed estimated assessment will be decreased in accordance with any agreement which is worked out with Eden Prairie, Mr. Donald K. Nelson, 6709 Indian Hills Road, told Council he believes Eden Prairie will be commercial from Valley View Road to the North, asking what this will mean to a sewer agreement, him it is tentatively proposed to assess on a Itpopulation equivalent" basis. The only person in the audience who spoke for the improvement was Mr, E. C. Stow, who told the Council that Captain Gans has informed him that the old B,B. Nelson Farm just west of Highway No. 100 (which Mr. Stow expects to develop) can be served by a tie to Trunk Sewer No. C-1; but that this will be a temporary expedient and that the C-2 sewer would have to be constructed later, anyway. Telling the audience that the developers are willing to provide the line necessary for service to their property, Mr, Stow asked those present if they would be willing to assume the small cost for the over-sizing of the line, now, in order that they might save the installation of an entire line at a later date. met with a resounding general NO from those in the audience, no one speaking in favor of Mr. Stow's proposition, promotion fof! it at this time is far ahead of development; that after studies of this area and the Eden Prairie request perhaps something equitable can be worked out for installation at a later date; requested that such study include estimates of costs of laterals in Indian Hills and Prospect Hills. Captain Gans had stated, earlier in discussion, that studies on laterals are almost impossible to run until the Village knows how property is to be platted, but these geitlemen felt that since both Indian Hills and Prospect Hills are immediately,off the main line the Captain's objection would not apply to these subdivisions, the sewer the matter be tabled for at least six months for further ingestigation as to costs relative to both the request of the Town of Eden Prairie for capacity in.Edina's sewer and proportionate cost therefor, and studies on costs of construction of lateral sewers, including estimates of residence hookups, in the areas in which these studies have been requested. and carried. Reynolds, Keller and Robb Trpstee Dickson moved that in view of the preponderance of opinion against Motion seconded by VanValkenburg "VALLEY VISTA" SANITARY SEWER AND WATERMAIN IMPROVEMENTS ABANDONED . was conducted on the following improvements pursuant to "Notice of Public Hearing" published in Edina-Morningside Courier March 1 and 8, 1962, Affidavit of which publication.was approved as to form and ordered placed on file. were shown of areas proposed to be assessed, as well as routes of proposed improvements, and costs as estimated were read by Manager Hyde as follows: SANITARY SEWER - On an easement line between Lots 6 and 7, and between Lots 13 and 14, Block 1, Valley Vista Addition from Gleason Road to Rosemary Lane; Rosemary Lane from Valley View Road to Cul-de-sac, - Estimated Cost, $15,517,37, proposed to Public Hearing Vu-Graph Slides 1 45 3/12/62 be assessed against thirteen lots, for $1,193,64 per Lot , WATERMAIN - In Rosemary Lane from Valley View Road to Cul-de-sac; On easement line between Lots 2 and 3, Block 1, Valley Vista Addition from Rosemary Lane to 97 feet North - Estimated Cost, $7,3!?0,11, proposed to be assessed against eleven Lots, for $668, 19 per Lot , Manager Hyde told Council the major question before the Council at this Hearing is whether Mr, Brenner (developer of the plat of Valley Vista) wishes to sign the agreement with the Village for the Village's shore term financing of these improvements, or whether he wishes to pay for these improvements himself, developer Brenner, told the Council Mr, Brenner does not wish to sign the agreement. be abandoned, and it was so ordered, by motion Dickson, seconded by MacMillan and carried, Mr, Bernard M, Herroun, an attorney representing Manager Hyde then recommended that the proposed improvements STREET SURFACING AND CURBING APPROVED FOR "SCOTLAND HEIGHTS CIRCLE" ON VALLEY VIEW ROAD, Hearing", published in Edina-Morningside Courier March 1 and 8, 1962. Affidavit was approved as to form 'and ordered placed on file; and, pursuant to Notice, Public Hearing was conducted on proposed street improvement consisting of Asphalt Concrete Paving and Concrete Curb and Gutter €or the Scotland Heights Circle abutting Valley View Road. Estimate of Cost was given as $3,238.08, proposed to be assessed against 286.59 feet, for $11.30 per assessable foot, told Council he speaks for himself and all his neighbors in asking the Council to go ahead with the improvement; also, if it is possible to do so, property owners would like the "island" curbed all the way around. explained that Hennepin County's permission must be had before this is done, but it is expected that the County will be cooperative, 6.724 Valley View Road, added his request for Council to expedite work and, if possible, to include llall-around't curbing of the island to facilitate its beautification, adopt ion : Clerk presented Affidavit of Publication of llNotice of Mr. Jerry Streeter, 6732 Valley View Road, It was Trustee MacMillan, Dickson offered the following Resolution and moved its RESOLUTION ORDERING IMPROVEMENT STREET IMPROVEMENT NO, BA-38 BE IT RESOLVED by the Council of the Village of Edina, Minnesota, that this Council heretofore caused notice of hearing to be duly ,published on the following proposed improvement: CONSTRUCTION OF PERMANENT STREET SURFACING AND CURBING IN SCOTLAND HEIGHTS CIRCLE ON VALLEY VIEW ROAD and at the hearing held at the time and'place specified in said notice the Council has duly considered the views of all persons interested, and being fully advised of the pertinent <acts does hereby determine to proceed with the construction of said improvement by CONSTRUCTION OF ASHPALT CONCRETE PAVING AND PORTLAND CEMENT CONCRETE CURBING therein; that said improvement is hereby designated and shall be referred to in all. subsequent proceedings as STREET IMPROVEMENT NO, BA-38; and the area to be specially assessed therefor shall include all lots and tracts of land abutting the proposed improvement, BE IT FUBTHER RESOLVED that if permission is received from Hennepin County so to do, the island abutting both Scotland Heights Cirele and Valley View Road be curbed for its entire circumference, with Portland Cement Concrete Curbing, as part of this improvement, Motion for adoption of Resolution was there were four ayes and no nays, as VanValkenburg, aye; and Bredesen, a PUBLIC HEARING ON STREET SURFACING AND CURB FOR Wa49TH ST. Council approved and ordered placed on file of "Notice of Hearing" on proposed Street SuFfacing and Curbing in the ibove I street; and, pursuant thereto, Public Hearing was conducted. Estimate of Cost for Asphalt Concrete Paving and Concrete Curb and Gutter was given as $10,503.25, proposed to be assessed against 1,072.0 feet, for $9.80 per assessable foot. Mrs, J.A. Anderson,4840 Westbrook Lane, presented petition signed by owners of six tracts, objecting to the improvement, Manager Hyde explained that part of the hight cost of this project results from the lldeadll unassessahle footage along the Highway; that if the Village takes all this cost, estimate would be $9.19 per foot for balance of property; if Village takes half , estimate would total $9.59. intersection of W.5Oth St. and Highway No. 100. has been in touch with the Highiay Department; that there is optimism that: this job will be approved and funded this summer. Mr. Robert Soelberg inquired about contemplated changes in the Captain Gans answered that he Mr. Jarnberg, who has signed the 53z12 fG2 4' petition for the improvement Qn behalf of the Biltmore Apartments' three lots, spoke in favor of doing the work, now, breakdown between third of cost is for curb; that curb is needed for drainage. had completed its construction on this leg of the intersection, if possible; and Captain Gans added that the Highway Department hopes to do the work this summer* property insofar as assessment for the work is concerned, stating Lot 12, Block 1, Tingdale Brothers Brookside, is being assessed on estimate for 135 feet of side footage on I.1.49th St.; that this may not be consistent with new policy on assessing side footage; that it is also a problem to kn~w how to assess the MNGS Railroad tract. he-tablea-until thbZStafe Highway work is done, and Dickson so moved, Elr. VanValkenburg seconded Dickson's motion, and it carried, Mayor Bredesen told audience improvement has been tabled indefinitely, and that they will get new notice when it is to be considered again. Morningside Courier March 1 and 8, 1962, of Wotice of Hearing" on Proposed Permanent Street Surfacing and Curbing in \?,62nd Street from ConcordlLvenue to Virginia Avenue, ordering said Affidavit placed on file. Pursuant to notfce given, Public Hearing was conducted on this proposed improvement. Estimates of Cost were given as follows: For Asphalt Concrete Paving and Concrete Curb and Gutter - $5,081.22, proposed to be assessed against 500,15 assessable feet, for $10.16 per assess- able foot. Council approved Affidavit of Publication in Edina- 1, 2. For Portland Cement Concrete Paving and Integral Curb - $5,393.12, . proposed to be assessed against 500 15 assessable feet, for $10 , 78 per assess- able foot. It was reported that the area is predominently asphalt concrete paving; that it is difficult to estimate cost of either type of surfacing because the project is alone in the area and a small job; that it would be proper to take bids for both AsbJalt and Portland Cement Paving, raised at the meeting, and none had been received by the Clerk prior thereto, Dickson offered the following Resolution and moved its adoption: There were no objections RESOLUTION ORDERING IMPROVEMENT STREET IMPROVEMENT NO, BA-39 BE IT RESOLVED by the Council of the Village of Edina, Ninnesota, that this Council heretofore caused notice of hearing to be duly published on the following proposed improvement: FRO13 CONCORD AVENUE TO VIRGINIA AVENUE and at the hearing held at the time and place specified in said notice the Council has duly considered the views of all persons interested, and being fully advised of the pertinent facts does hereby determine to proceed with the construction of said improvement; that said improvement is hereby designated and shall be referred to in all subsequent proceedings as STREET IMPROVElENT NO, BA-39; and the area to be specially assessed therefor shall include all lots and tracts of land abutting that portion of the street proposed to be improved. BE IT FURTHER RESOLVED that the Director of Public Works be authorized and directed to take bids for this improvement on construction of Asphalt Concrete Paving and Concrete Curb and Gutter, with alternate bids on construction of Portland Cement Concrete Paving with Integral Curb, in order that Council may then determine which type of Permanent Surfacing shall be constructed in said street. CONSTRUCTION OF PERMANENT STREET SURFACING AND CLRBING IN T.1.62ND STREET Eiotion for adoption of Resolution was there were Sour ayes and no nays, as VanValkenburg, aye; and Bredesen, Mayor "LAKE EDINA 2ND ADDITION" STREETS TO BE SURFACED AND CURBED BY ESTOW CORP., DEVELOPERS. Courier March 1 and 18, 1962, of "Notice of Public Hearing" on proposed Clerk presented Affidavit of Publication in Edina-Morningside -- Construction of Permanent Street Surfacing and, Curbing in-Hibiscus Ave , , Trillium Lane, Nonardo Lane and Phlox Lane, a11 in Lake Edina 2nd Addition. Affidavit was approved as to form and ordered placed on file; and, pursuant to notice given, Public Hearing was called on this proposed improvement. Manager Hyde reported that this Hearing is being held pursuant to action 3/12/62 4 2. taken by the Council lastAugust , at which time the Council, at the request of the developer, agreed t'o postpone the street surfacing deadline under bond to September 1, 1962, subject to. immediate oiling of the streets, Estimate is the same as that presented at the-Hearing last year--$899,42 per lot, He recalled for the Council the developer's agreement with the Village whereby developer agrees to pay for the improvement, saping $600 per lot estimate of cost was made some time ago, and Village has been collecting this amount as the Lots were sold, holding it in escrow pending the surfacing of the streets. Mr. Hyde told Council and audience that word has been received from Mr, E. C, Stow of Estow Corporation that the Corporation intends to proceed to have the streets blacktopped by September 1; and Mr. Stow concurred in this statement, saying, 'We agreed to put the improvement in, and the people who live there are going to pay for it," Mr, Helge Thomsen,%PO5 Hibiscus Ave,, told Council that residents are all in favor of the street improvement and are anxious to have it as soon a5 weather will permit, He inquired about a notation on the agenda for this evening's meeting, concerning Lot 26, Block 3. explained that the side footage of this lot abuts on West Shore Drive, which has been paved with Portland Cement Concrete; that the new owner is concerned about the method of assessment for it, taken, Hasselquist, reading from the agreement between the Village and Estow Corporation, told the Council that the only time a public hearing is necessary is if the improvement is going to be assessed. Corporation is not asking for any financing on this; that they are going to do the work as soon as it is practica1;that they have the job out on bids, now1 Mr, Hyde reported that the Hearing is being held to determine, first, whether the job is going to be done this year, and, second, how it is going to be paid for; that he feels the Village has neither the right nor the moral obligation to handle this improvement as a regular assessment project because assessment, now, would fall on some forty or fifty property owners, some of whom, at least, believe they have paid €or the improvement as part of the purchase price of their lots, Mr, Hasselquist replied that if the Village gets into the position of calling a special assessment hearing it will be obligated for paying for the project, Mr, Stow replied, *'Thkt is what we told you,' We have a letter to that effect." Reading from Mr, Stow's letter of March 6, addressed to the Council, Mr, Bredesen quoted, "As stated in our letter of February 22nd, it is still our inten- tion to accomplish this work by September 1, 1962, the property owners will impede our progress," Lane, told Council he is somewhat confused; that when he purchased the property he understood $600 was to pay for the street surfacing; that, now, he receives an estimate of $900; that he wants to know if he is going to have to pay the difference in cost. Mr, Stow replied that when he gets bids in he will call neighbors together to figure things out; that he had an agreement with every contractor he ever sold to, and he is sure that these contractors passid at along to purchasers, that if costs of street surfacing are more than estimated, neighbors are to pay it--if less, they will get a refund, Mr, K, E. Reichwald, 7224 Monardo Lane, told Council he doesn't quite understand this and would like to know whether property owners are going to have a road in the area this year; and, if some property owner objects, what will happen then, force the developer to put in the street, Estow Corporation is under bond to the Village to have the street completed by September 1, 1962, by VanValkenburg and carried, four-ton axle load, and Captain Gans replied that these particular streets, along with some fifteen others, will be posted this next week, i . Motion seconded Mr. Stow asked that the streets be posted to a CONTRACT AWARDED FOR GRADING OF PEDESTRIAN AND BICYCLE PATH IN WOODDALE AVENUE FROM NANCY LANE TO CROSS TOWN HIGHWXY, today pursuant to Advertisement for Bids published March 1 and 8 in Edina- Morningside Courier and Construction Bulletin, was presented, showing M,E. Kraft Excavating and Grading CO,, Inc., to be low bidder at $3,194.30; J.A. Danens E Son, Inc,, second low at $3,362.30, and Black Top Service to be high bid at $5,114.08 , compared with Engineer1 s Estimate of $2,858.00 , Gans reported that although a letter has been received from the County Engineer, stating the County Highway Department might not get to the matter of the bridge this year, he has since talked to Mr. McKay of the Department, who has promised to copplete the design; that the Captain hopes for a call from the County Engineer this week, saying the work can be done yet this summer, recommended award of contract to low bidder even th'ough it is above estimate. Dickson's motion, that contract be awarded to low bidder, M.E. Kraft, was seconded by VanValkenburg and carried. Tabulation of the five bids received Captain Manager Hyde .. 3/12/62 SUBURBAlP YE'LLOM CAB COMPANY ANSWERS COMPLAINTS : PROMISES BETTER SERVICE , Maurice A. Hessian, Jr, and Mr, Jack Daly, Jr,, representatives of Suburban Mr . Yellow Cab Company, were present at the Council's request, to discuss with Council complaints received on fares and service for Edina residents, Mr, Hessian explained that the Company has put more cabs into service to alleviate problems experienced because of bad weather.. Telling officials the Council is aware that some of its problems stem from this winter's exceptionally bad weather, Mayor Bredesen stated he believes complaints began well before the cold weather, He cited his own experience in being unable to make a ''time" cail in the evening for a cab to the airport the next morning-ithis being the complaint of many of the residents; also asked if the Company's disagreement with theiAhport has any bearing on the reluctance of its drivers to go out to Wold Chamerlain, Hr. Daly replied that the Company is happy with its present arrangement at the Airport; that, as to time calls, the Company will take time calls during normal weather; cannot do so in inclement weather.
