MAYOR ANNOUNCES CONTINUANCE OF PUBLIC HEARING ON PROPOSED STORM SEWER IN BARRIE ROAD,
ETC. , TO MONDAY , MAY 4.
decision to re-study the proposed Storm Sewer in Barrie Road from proposed W.65th St.,
Mayor Bredesen announced that because of an administrative
northerly and then east, etc., that Public Hearing on this project, scheduled for
this meeting, would be continued to Monday, May 4, without discussion this evening.

MINUTES OF APRIL 6TH MEETING AMENDED.
April 6th Regular Meeting of Council be amended by-adding to the second paragraph,
Page 74, Book 27, after the words "and that the costs of this accounting must be added
to regular engineering and overhead costs;" the words, "that total cost could possibly
run as high as 12% of this project",(this .refers to matter of Village-incurred costs
relative to contract for Street Surfacing, Lake Edina Third and Fourth Additions), and
that said amended Minutes of April 6th Regular Meeting be approved.

Council conducted Continuation of Public Hearings of March 16 and 30, 1964, on the
Petition of Metro4.S. Construction Company, for Rezoning to R-4 Multiple Residence
District, Office Building District, and Planned Industrial District of certain portions
of the Nelson Farm--all as described in "Notice of Public Hearing", published in Edina-
Morningside Courier March 5 and 12, 1964, posted and mailed to owners of affected
properties; also conducting Public Hearing on new proposal, as recommended by Edina
Planning Commission after the Public Hearing of March 16, to rezone to Planned Industrial
District that portion of the Nelson Farm originally petitioned by Metro-U.S. for rezoning
to R-4 Multiple Residence District.

Mr, Ray Jones, 5232 W.7Oth Street, told Council he feels now, and tried to make
his opinion clear at the last Hearing, that there is a.definite need €or "pre-zoning" -
in the entire area; that he wants to request that Council ask Planning Commission to
make a study of the entire area, come up with recommendations to the Council--and that
the Council then pass commission's considered recommendations into Ordinance, so that
residents may have some idea what they can expect.

later be deeded to the corporation which is composed of the property otmers in the
Lake Edina area--Lake Edina, Inc. Letter of intent, dated April 20, 1964, addressed
to Lake Edina, Inc., and signed by Antonio Bernardi, President of Edina Plaza Corporation,
reads as follows:

PETITION GRANTED FOR SIDE YARD VARIANCE AT 5136 TIFTON DRIVE. Mr. Hite showed
to the Council copy of the survey of Lot at 5136 Tifton Drive, together with
the proposed location of house on this lot, explaining that while Ordinance
requires a ten-foot setback from side yard line for llliving" side and five-foot
setback for "garage" side, Mr. A. L, Teasley, petitioner, proposes to have a
corner of the "living" side within five feet of lot line--and average side yard
setback of eight feet. He added that Mr. Teasley does have written approval of
both of adjacent owners. Mayor Bredesen asked for dpinions from the audience,
this being the Public Hearing on matter of request for variance from Zoning
Ordinance requirements, in response to mailed "Notice of Public Hearing".
There were no objections filed from the f&oor, and none had been received prior
to the Hearing. Tupa's motion, that request for variance from side-yard
requirements of Zoning Ordinance be granted, was seconded by MacMillan and carried.

the sanitary sewer problem does not exist--and that if he must have the sewer he
would wish to be served by gravity-that this does not mean he is voting in favor of
the system, however.

water. She explained that their home received Sanitary Sewer from the Hilldale
system, but that water connection would have to be from the Rolling Green main.

that it is necessary from a public health standpoint to put Sanitary Sewer in
Rolling Green Parkway.

Mr. Hite explained that the main reason water is being proposed, now, is that several
large trees in the boulevards willsuffer, and may have to be removed, if boulevard
construction is used.

Watermain' Improvement should be eliminated, and the Sanitary Sewer Improvements
should be ordered in, with the exceptions that the mains in Rolling Green- Parkway
and Crescent Tecrace be eliminated

show evidence of pollution, that noone knows just where this pollution is coming
from, and that he believes Rolling Green Parkway and Crescent Terrace should be
included in the improvement, and thus must vote ..no; on the proposal as stated.
Rixe, Tupa, VanValkenburg and Bredesen all voted aye on the proposal, and
VanValkenburg's motion carried.

Nanager Hyde reminded Council that Public Hearings had been continued for further
study by the Engineering Department as to alternate routes for the Sanitary
Sewer,

be served, and Nr. Hite explained the several reasons the Engineering Department
is not recommendhg them.

Mr. George Hardisty, 4717 Meadow Road, told Council he has discussed the

Street and that without exception they are opposed to sanitary sewer at this time;
that they feel there may be a problem at some future time but that today no one has
a problem. He added that cost will be some $4,000 rather than the $2,700 proposed
assessment, because of the cost of connecting,

here who would object to the sanitary sewer if he felt it was necessary to prevent
typhoid fever; that with this present system of deep cesspools water anywhere can
become contaminated.

STREET SURFACING IN LAKE EDINA THIRD AND FOURTH ADDITION STREETS AWAITS SUBMISSION
OF BOND. Relative to Public Hearings held about Street Surfacing and Concrete Curb
and Gutter in all streets in Lake Edina Third and Fourth Additions and Council's
granting of Estow Corp.'s request for permission to do this work at its own expense
under contract to Viktor Carlson E Sons, Inc., Messrs. Brill and Stow advised the
Council that the bonding company had refused to amend bond to cover the obligation
of Estow Corporation under the proposed agreement which would allow Estow.Corporation
to install permanent street surfacing and concrete curb and gutter at its own expense.
Mr, Brill explained that the bonding company would not change the bond as long as
there is any question about default of Estow Corporation under existing bond by
reason of its failure to pay special assessments for sewer and water facilities. I
Mr. Brill stated that under the Village's contention such assessments become
due when the Estow Corporation conveys title, and that upon any default the Village
would have the right to accelerate all special assessments. Mr. Whitlock confirmed
that this was the situation and that as of the end of 1963 there was some $80,000
in assessments unpaid, but that this had been paid down since the first of the year.
IVIr. Brill reiterated his position, that the intention of the parties when they
signed the agreement relating to Lake Edina 3rd and 4th Additions was that special
assessments would not be owing until title to property was conveyed to person
actually intending to live in house--as was the case with the contract pertaining
to Lake Edina Second Addition.

but that this is at his own risk since the Village cannot reimburse him if there is no
contract; however, that if the rquired bond running to the Village is not furnished the
contractor will be required to cease work on the job.

Petitioner Eike and Mr. W. J. McGrath, owner of the other lot proposed to be
assessed, were both at the Hearing. Mr. McGrath protested his lot's being
included in the assessment, saying he has an adequate system and drainfield,
installed just two years ago. He added he does not understand the amount of
the estimates, inasmuch as he received an estimate in amount of $2,400 for
a complete hookup a couple of years ago, and that the Village Engineers'
estimates donot include the connection to the house

and 16, 1964, whoed receipt of two bids--that of Minnesota Toro, Inc. at $2,307..00,

resident in Sunset Gables, who felt Calhoun Towers had no effect on valuation.
Shenehon said, too, that he had interviewed residents in the Southdale
residential area, relative to the "Golf Ball1' water tower; that Mrs. Sally Schaper,
6905 Dawson Lane, Mr, C. L. Timmerman, 6817 Southdale Road, and the real estate
agent selling the property at 6917 Southdale Road all felt that the construction
of this water tower had no adverse effect on the valuation of their properties.
