A Village Clerk MINUTES OF THE REGULAR MEETING OF THE EDINA VILLAGE COUNCIL, HELD MONDAY, MAY 4, 1964, AT 7:OO P.M.9 AT THE EDINA VILLAGE HALL Members answering Rollcall were MacMillan, Rixe, Tupa, VanValkenburg and Bredesen. COUNCIL RECOGNIZES MR. RAYMOND C. DRAKE, REGISTERED PROFESSIONAL ENGINEER. Mayor Bredesen publicly recognized the achievement of Mr. Raymond C. Drake, of the Village Engineering Staff, who has now become a Registered Professional Engineer. MINUTES of the Regular Meeting of April 20, 1964, were approved as submitted, by motion VanValkenburg, seconded by MacNillan and carried. COUNCIL HONORS DEVCO PETITION FOR REZONING, SUBJECT TO AGREENENTS ON WATER SERVICE, AND APPROVAL BY AIRPORTS COMMISSION AS TO HEIGHTS. Public Hearing Mas conducted on the amended Petition for Rezoning from R-4 Multiple Residence District to R-5 Multiple Residence District and for setback Variances from the requirements of R-5 Multiple Residence District, to permit the construction of two seventeen-story apartment buildings on "Parts of Lots 1 and 2, Block 2, SOUTHDALE ACRES", all as set forth in the Meeting of April 20, 1964 Minutes (Page 97, This Book).' presented Affidavits of Publication and Posting of "Notice of Hearing", which affidavits were approved as to form and ordered placed on file. Neville, representing the petitioners, Devco, Incorporated of Columbus, Ohio, produced a visual aid and explained the character of the surrounding property. He reported that of the 22 acres involved in the Devco development, only 3.8 acres, in the center of the property, will be used for the twin seventeen-story apartment towers. only a development corporation, but keeps and operates what it develops; that it has developments in several large cities; that Dayton Development Company has sold to Devco with the restriction that Dayton has right of approval or veto of arthitectural plans, and Eirst right to re-purchase, should Devco ever wish to withdraw. the request for the two towers, Mr. Neville told Council he is well aware that the Council had, on February 17th of this year, postponed action on Devco's request for rezoning until such time as the two towers were nearer the point of construction-- and that Devco still does not intend to start its development with the construction of the two towers; but that because the density has been reduced in the periphery, on the grounds that the dengity could be varied in the over-all development as originally approved by the Planning Commission, it is now necessary to know that the apartments can be built, in order to obtain financing for the development; that it is essential that developers know what is going to be done. twenty-five years, who told the Council, in answer to questions by Mr. Neville, that in his appsaisal work, not only in the Minneapolis-St.Pau1 metropolitan area, but also in several other cities--Seattle, Houston, Toronto, etc., he has found that where park areas are developed around high-rises, or where buffers are planned, there is no affect--either adverse or favorable--on adjacent residential buildings. He added that while this proposal is in line with current proposals aro country, generally, 740 River Drive and Calhoun Towers are the only two/ Ag -rises seeming to have the same general characteristics as are proposed, here; that he had talked with residents in the immediate area of 740 River Drive, one of whom had felt the apartment had no effect on residential values, another of whom believed the apartment added interest to the area. He stated he had also talked with a resident in Sunset Gables, who felt Calhoun Towers had no effect on valuation. Shenehon said, too, that he had interviewed residents in the Southdale residential area, relative to the "Golf Ball1' water tower; that Mrs. Sally Schaper, 6905 Dawson Lane, Mr, C. L. Timmerman, 6817 Southdale Road, and the real estate agent selling the property at 6917 Southdale Road all felt that the construction of this water tower had no adverse effect on the valuation of their properties. Mr. Benjamin Bermel, was next introduced by Mr. Neville, and stated that as a real estate broker for about eighteen years he is familiar with the area and was asked to take a look at this proposal and study it and (at question from Mr, Neville) that he feels the high-rises will have no effect on the values of the properties north of the Crosstown Highway;.that the high-rises will complement the area. statements as to sale by Dayton Development Company to Devco and the restrictions placed upon this sale. the Southdale development showed the area north of 66th Street as an apartment development (this was in 1952-3); that later, in 1955, the Company came in with a refined plan, which showed high rises in the area; that the matter of high-rises in the location is no immediate surprise to the neighborhood or the Council. Asked by I4r. Neville what he thinks about the effect high' rises will have on the valuations of single family properties, 1-5r. Mr. Ireland said that R-4 Zoning would be disastrous, here; that developers are attempting to make some- thing more pleasant by striking a balance of densities; that they cannot do a good job of renting the periphery apartments without the community facilities planned for the center of the project; that he believes the towers will be a tremendous asset to the area. Hyde reported the Natertower had been approved, subject to its having a light; and, as regards the booster pumps, Mr. Hite replied that the building code does provide that adequate water supplies must be furnished to each dwelling unit--which would demand installation of booster pumps. Mr. Hite suggested an Alternate for these two proposals, being a single pipe starting at 64th St. and York, thence Southeasterly along W.65th Street and across France Avenue to the pond lying between W.-65th St., France Avenue and Valley View Road, the total square footage represented by the assessment areas for the two foregoing ESTIMATE OF COST FOR THIS PROPOSAL was $75,00O,proposed to be assessed against \ proposals, for an EstimateqPer Square Foot Cost of $.05. Mr. Hite's recommendation was for approval of the first two projects, rather than for the Alternate, because of the difference in cost. As to Storm Sewer Proposal No. 1, Mr. Hite told Council that approximately 21,000 square feet in the Northeast corner of the proposed assessment' district formerly drained to Heritage Drive-Barrie Road, and was thus assessed for Stom Sewer Improvement No. 68, whereas almost a like number of square feet on the west side of Barrie Road was not assessed for Storm Sewer No. 68, but now drains to it. He recommendedthat some $1,600 in Assessments for Storm Sewer Improvement No. 68, levied against the Peterson Tract, be cancelled and assessed against the &her areas which do drain to this system and are not assessed for it; that this would eliminate the possibility of assessment to the Northeast corner twice, and make the Devdo Assessment more equitable, . Mr. Roy Peterson told Council that Proposal No. 1 is routed through'his land in a way which would stop him from using the property as he wants to. Sehlin, whose residence is at 5921 Walnut Drive, told Council his neighbors had had a meeting after receiving Notice of Hearing; had decided that because*of=the cost and the fact that most wells in area are comparatively new, they do not want the water now. He asked how the people to the North of Walnut Drive would receive water when they wanted it, and Mr, Hite told him the North area would be served from Sehlin's area-- but that this property has already been assessed for a trunk main; that the only possibility for assessment would be against the Krahl property to the south--but that a preliminary plat on file shows lots backing to Hwy.#169, which would preclude this assessment. Question was raised as to why assessment for watermain improvement is "so much higher" in Edina than in other suburba. suburbs provide from their Water Fund for part of the cost of mains; and that while their assessments might be lower, their water rates are corresponaingly higher. Mr, Sehlin informed Council that Walnut Drive property owners had received notices from the Village AssessorP's office, raising valuations some $2,000 to $3,000 apiece--and tha-t this notice has helped them to make up their minds not to take the watermain improvement at this time. in this improvement without Walnut Drive, and Mr. Hite answered that it is possible, but that then the "abnormal" costs about which Mr. Sehlin complains will all be on the Gleason First Addition area. Drive in the assessment area would not make as much difference in the assessable cost as estimated; and another inquired as to how Walnut Drive will benefit from the main in Gleason First Addition which serves one tier of lots. Mr. Bredesen answered the latter quedtion by saying that this one tier of lots helps to pay for the dead run down #169 and at Church. Some discussion was had relative to the high cost of the Creek Crossing, with someone from the audience advocating assessing a papt of this cost against the property to the North of the proposed improvement. Mr. Hite answered that at such time as the North property secures water there must be another Creek Crossing, to loop the line. that this property, too, is owned by Sime Construction Co., and is about the same as Walnut Drive it--Gleason Addition; and that pemaining area be assessed for only its portion of the Creek Crossing and dead run--that the Walnut Drive portion be eliminated. Hite suggested that Council authorize improvement in that portion of Walnut Drive North of W.59th Street, saying there are a number of unimproved lots in this street which will need the main. He said there are also two or three residences, here, which already have wells; that he would recommend that assessment on the lateral main be deferred until such time as there is a connection to the lateral, at which time a connection charge would be paid in cash, equal to amount of total principal assessment; the unimproved lots to be assessed on completion of project with balance of the district. There were no further objections from the audience, and Rixe'moved that Watermain Improvement be approved as presented except for the Watermain in Walnut Drive from Highway No. 169 to W.59th Street, and the Watermain in Highway #169 between proposed Tamarac Avenue and Walnut Drive; that Council recognize Mr. He said he feels that part of this line should be considered a sub-trunk.
