Members answering Rollcall were MacMillan, Rixe, Tupa and VanValkenburg. MINUTES of the Regular Meeting of March 15, 1965, were approved as amended by motion of Tupa, seconded by MacMillan and carried. Explanation of Rollcall vote on page 56 is changed to read "four ayes" rather than "five ayes.11 to payment of fees for Lake Edina Third and Fourth Additions on page 59 is to read that "the Village will bring further pressures to bear" unless the fees are paid. in full. HEARINGS ON PROPOSED IMPROVEMENTS. - Clerk presented Affidavits of PublicartAon in the Edina-Morningside Courier on Mamh 25 and April 1, 1965, and Affidavit of Mailing on March 26, 1965, of.Notice of Public Hearing. as to form and ordered placed on file, and pursuant to due notice given, Public Hearings were conducted on .the following proposed improvements, and action was taken by Council as hereinaf&er recorded: Affidavits were approved CO~STRUCTION OF LATERAL SANITARY SEWER AND APPURTENANCES IN THE FOLLOWING : On proposed street from Cooper Avenue to 400 feet west in preliminary plat of Section 29, Township 117, Range 21, lying west of Cooper Avenue and on that part of the SE 1/4 of the NE 3/4 between Hilldale and Brum's Subdivision, West on easemen* line to existing sanitary sewer on west line of above property. Estimate of Cost was given as $3,389.26 to be assessed against two lots at $1,694.63 per lot. (See Resolution Ordering Improvement later in Minutes.) Manager Hyde presented a petition opposing the improvement, signed by twelve residents of the affected area. 6233 Virginia Avenue, stated that the existing residents of the area proposed to be served by Village water had substantial investments in private wells, all functioning adequately, and would be helping to subsidize the development of only a few lots not presently having any type of water systems, further discussion was heard on the proposed improvement. Gilbert,.6324 Warren Avenue; Mrs. Harold C. Albrecht, 6312 Warren Avenue; stated that they were opposed to the assessment for the storm sewerr Mayor Pro Tem VanValkenburg advised that their arguments would be appropriate -to the Assessment Hearing and not the Jmprovement Hearing. Mr. R. R. Lundgren, 6337 Holborn Avenue, stated that he was in favor of the project since his home was located at the low point of the drainage area and it was severely threatened by heavy surface drainage. further discussion was heard on the proposed improvement. Catch basins and leads in vicinity of France Avenue and Halifax Avenue. Estimate of Cost was given as $9,723.96, representing 77.34% of the total, estimated cost. The balance of the project cost is to be paid by Hennepin' County. The $9,723.916 is to be assessed against an estimated 3,214,816 square feet at $0.003 per square foot, enlwgement of the existing system to accomodate excessive.drainage flow caused by street improvements and an increase in surface drainage caused by these improvements. 14r. Homer Cornelius, 6225 Chowen Avenue South protested the project on the basis that they had previously been assessed for other storm sewer projects, without apparent benefit to their respective properties. Mr. L. T. Antonson,$ 6101 Beard South, stated that he questioned the drainage area of this project because the grade of Beard Avenue appeared to have been changed with the latest permanent surfacing. south on Beard. Mr. Folke Victorsen, 5605 Ayrshire Blvd., questioned whether a11 of his property adjacent to Indian Hills was correctly located in the drainage area because Hennepin County had requested that part of his property be condemned to control the drainage around the Gleason Road - Crosstown Highway interchange. of the pipe, which appeared to.necessitate very deep excavation. that the drainage assessment area may have to be altered later, and that the proposed route of the pipe was not excessively deep. of the matter was heard. Mr. Harold Roberts, Oscar Roberts Co., 7200 France Avenue South, objected to the necessity of being included in the project since none of the Company's land drains in the direction of the proposed system. the development of the Roberts property, and its inclusion in the drainage area requires the installation of an over-sized pipe. in the developed area to be permanently surfaced. Tupa discussed the possibility of putting the Roberts assessment for the work on a deferred basis. proposed that if the project were approved at this time, the details of financing Robert's assessment could be worked out prior to the assessment hearing. further discussion was held on this proposed project.
