Members answering Rollcall were MacMillan, Rixe, Tupa and VanValkenburg and Bredesen. MINUTES of the Regular Meeting of April 5, 1965, were not completed sufficiently early to allow Council review. TYLER COURT - ARTHUR STREET AREA STORM SEWER TO HAVE NEW HEARING MAY 3, 1965s This Hearing, continued from April 5, 1965, was to consider the alternative of eliminating the ponding area east of Tyler Court by construction of a completely enclosed system. Manager Hyde reported that the several petitions and letters opposing the original proposal had been thoroughly reviewed and a consulting hydraulic engineer had also reviewed the situation. IThe completely enclosed system included pipe diameters from 27 to 42 inches, and included additional catch basins and connecting pipes. The estimated cost of this.adjusted system was given as $49,782639, which would have to be assessed at the rate of $0.0424 per square foot. The Engineering Department did not agree that the substantial increase in cost would be justified by the benefits gained. It was recommended, however, that a modified system which would increase the pipe size connecting the pond east of.Tyler Court to Mirror Lakes be installed. The estimated cost of such a system was $320373.75, to be assessed at the rate of $0.0281 per square foot. This proposed system would allow the pond to drain within three hours after a rain storm occurring once in 50 years. Mr. George Gould, 6615 Waterman Avenue, presented to the Council the opinion that a public .improvement hearing could not increase the cost, but could -,only decrease the cost, as advertised in the Notice of Hearing. Mr. Whitlock, Village Attorney, stated that bond attorneys will accept alterations that are within 33 -1/3 per cent of the advertised estimate of cost.. VanValkenburg then moved that this proposal be tabled, seconded by Tupa and unanimously carried. (See Resolution Providing for Public Hearings later in Minutes.) OLINGER ROAD AREA SANITARY SEWER LIFT STATION AND FORCE MAIN TO HAVE NEW HEARING ON MAY 3, 1965s Engineer Hite presented the estimate of cost as 39,509.26 to be assessed against the number of estimated lots when the area is fully developed at $316.07 per lot. Manager Hyde stated that the per lot assessment would be reduced to $208.00 if the areas along Nine Mile Creek were developed for residential purposes rather than for park purposes. Mr. Hite recommended that if the project appears feasible, a new hearing be scheduled to include all the possible lots in the area, assuming there will be no parkland development in the assessment district, so all affected properties will have a chance to avail themselves of the improvement.. Tupa then moved that the project, as proposed, be tabled, allowing for readvertisement covering the larger area. Motion seconded and unanimously carried. (See Resolution Providing for Public Hearings later in Minutes.) XERXES AVENUE ADDITION ALLEY PERMANENT SURFACING TO BE HEARD 14AY 3. 1965. At the recommendation of Air. Hite, the permanent surfacing of proposed alley in Blocks 1 and 2, Xerxes Avenue Addition, was scheduled for public hearing on May 3, 1965. VanValkenburg offered the following Resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARINGS ON PROPOSED STORM SEWER, LIFT STATION, FORCE MAIN, GRADING, GRAVELING AND ASPHALT CONCRETE SURFACING BE IT RESOLVED by the Village Council of the Village of Edina: 1. The Village Engineer, having submitted to the Council a preliminary report as to the feasibility of the proposed STORM SEWER IMPROVEMENT, described in the form of Notice of Hearings set forth below, and as to the estimated cost of such improvements, said report is hereby approved and directed to be placed on file in the office of the Village Clerk. 2. This Council shall meet on Monday, May 3, 1965, at 7:00 P.M., in Edina Village Hall to consider ink public- hearings the views of all persons interested in said proposed improvement. 3. Clerk presented Affidavits of publication in the Edina - Morningside Courier on April 8 and 15, 1965, and Affidavit of Mailing on April 9, 1965, of Notice of Public Hearing. Affidavits were approved as to form and ordered placed on file, and pursuant to due notice given, Public Hearings were conducted on the following proposed improvements, and action was taken by Council' as hereinafter recorded: A. CONSTRUCTION OF STORM SEWER IMPROVEMENT IN THE FOLLOWING: Vernon Avenue (T.H. 169 -212) from West 53rd Street to 300 feet north of hest 52nd Street. Estimate of Cost was given as $14,803.20, of which the Village would pay an estimated $6,268.16, to be assessed against an estimated 635,481.9 square feet at $0.00986 per square foot. No discussion or comment was offered. (See Resolution Ordering Improvements later in Minutes.) B. CONSTRUCTION OF STORM SEWER IMPROVEMENT:Iii.THE FOLLOWING: Interlachen Boulevard from existing storm sewer between Hankerson Avenue and Summit Avenue to Intersection with Vernon Avenue (T.H. 169 -212). Estimate of Cost was given as $2,973.61 to be assessed against an estimated 69,496 square feet at $0.0428 per square foot. No discussion or comment was offered. CONSTRUCTION OF LATERAL WATERMAIN AND APPURTENANCES IN THE FOLLOWING: West 62nd Street from Tracy Avenue west 1400 feet to Olinger Boulevard extended; thence northwesterly along Olinger Boulevard extended to 125 feet south of the south line of Edina Grove Addition. Estimate of Cost was given as $211246.99 to be assessed against 22 lots at $965.77 per lot. No discussion was heard on this proposal. (See Resolution Ordering Improvements later in Minutes.) D. CONSTRUCTION OF ASPHALT CONCRETE PAVING WITH PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: ' Edina Industrial Boulevard from West 78th Street to Nine Mile Creek; West 76th Street from Bush Lake Road to Metro Boulevard; jiest 74th Street from Bush Lake Road to Metro Boulevard; Bush Lake Road from Edina Industrial Boulevard to West 74th Street; Metro Boulevard from Edina Industrial Boulevard to T.H. 100., Estimate of Cost was given as $236,733.88 to be assessed against an estimated 16,163.81 feet at $14.64 per assessable foot or against 5,936,680 square feet at $0.0399 per square foot. The method of assessment is to be determined at the Assessment Hearing. There was no discussion offered. (See Resolution Ordering Improvement later in Minutes.) E. CONSTRUCTION OF ASPHALT CONCRETE PAVING WITH PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: York Avenue from Heritage Drive south to' cul -de -sac; West 64th Street from Xerxes Avenue to York Avenue. Estimate of Cost was given as $30,744.94 to be assessed against 526,04048 square .feet at $0.058 per square feet. Mr. Hite submitted that the abutting property owner, Mr. Roy Peterson, has requested that the proposed street be extended an additional 100 feet south. This would be done, with the resulting increased cost, Mr. Hite reported. No further discussion was heard on the proposal. (See Resolution Ordering Improvements later in Minutes.) 4A9/65 F. CONSTRUCTION OF GRADING AND GRAVELING, ASPHALT CONCRETE PAVING AND PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: West 70th Street from Cahill Road to 200 feet east of Minneapolis, Northfield and Southern Railroad right -of --way. Estimate of Cost was given as $50,629.220 of which $19,172.96 is to be assessed against 1,574.36 assessable feet. at $12.18 per foot. It was explained that this project would have no effect on Cahill Road or the Cahill Road - West 70th Street intersection. A new bridge across the railway on West 70th Street is also scheduled for construction this year by the County. No further discussion was offered. (See Resolution Ordering Improvements later in Minutes.) G. CONSTRUCTION OF GRADING,. CONCRETE CURB AND GUTTER, BITUMINOUS SURFACING AND TRAFFIC SIGNAL SYSTEM IN THE FOLLOWING: France Avenue from Cross Town Highway to West 66th Street. Estimate of Cost was given as $31,187.01, which was Edina's share of the total project, to be assessed against 104745000 square feet at $0.02116 per square foot. Manager Hyde explained that this project had been engineered by Hennepin County Highway Department, with Edina's share constituting 50$ of the cost of the roadway improvement and 750 of the cost of the signalixation. Hyde explained that the basis of assessment represented an attempt to estimate the traffic contribution- of each of the properties near the intersection. Mr. Kramer of Employers Mutual Insurance Company, 6500 France Avenue South, questioned why the property at the northwest corner of West 66th Street and France Avenue was exempted from the assessment district. It was explained that that property would be unable to use the intersection under consideration unless access was gained through Employers Mutual property. Mr. Tiffany, representing Home Mutual Insurance Company, 4018 West 65th Street, objected to the inclusion of Home Mutual's total property in the assessment district since traffic access to Valley View Road was available to them. Manager Hyde recommended that some adjustment be made, prior to the assessment hearing, to exempt parts- of those L� properties which do.--not enter and egress entirely to France Avenue. No further discussion was offered on the proposal. (See Resolution Ordering Improvements later in Minutes.) •H. CONSTRUCTION OF ASPHALT CONCRETE PAVING AND PORTLAND CEMENT CONCRETE CURB AND GUTTER ON THE FOLLOWING: West 65th Street from France Avenue to Barrie Road; Drew Avenue from West 65th Street south to north line of Lot 2, Block 4, Southdale Acres. Estimate of Cost was given as $39,758.20 to be assessed against an estimated 30120.3 feet at $12.74 per foot. The Village will pay for curb radii amounting to an estimated $1,274.00. No discussion was offered on this proposal. (See Resolution Ordering Improvements later in Minutes.) I. CONSTRUCTION-OF ASPHALT CONCRETE PAVING AND PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: St, Patrick's Lane from Valley View Road south to cul -de -sac. Estimate of Cost was given as $16,753.66 to be-assessed against an estimated 1,764.72 feet at $9.49 per foot. No discussion was heard on this proposal. (See Resolution Ordering Improvements later in Minutes.) J. CONSTRUCTION OF ASPHALT CONCRETE PAVING AND PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: Doncaster Way from Ayrshire Boulevard to cul -de -sac 1300 feet north. Estimate 'of Cost was given as $230967.06,.which represents the amount after payment by the Village for parking lot and curb radius costs, to be assessed against an estimated 2270.97 feet at $10.55 per foot. Mr. Kenneth G. Anderson, 5209 Doncaster Way, questioned whether or not his lot would be assessed for only one -third of the footage on Doncaster Way since he paid full footage on the long side of Croyden Lane. Mr. Wayne H. Williams, 5213 Doncaster Way, also stated that he understood he would be assessed for only one -third of the Doncaster Way improvement. Manager Hyde stated that since the Village could not change the Croyden Lane assessment it would - stand, but the Anderson and Williams properties would be assessed for only one -third frontage of the Doncaster Way improvement. CONSTRUCTION OF ASPHALT CONCRETE PAVING WITH PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: West 53rd Street from U.S. Highway 169 -212 west to the west line of Replat of Part of Grandview Plateau. Estimate of Cost was given as $8,176.36, less $130.00 for curb radius to be paid by the Village, to be assessed against an estimated 567.50 feet at $14.18 per foot. No discussion was heard on the proposal. (See Resolution Ordering Improvements later in Minutes.) L. CONSTRUCTION OF ASPHALT CONCRETE PAVING AND PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: Wilryan Avenue from West 64th Street to the south line of Lot 5, Block 3, Normandale Second Addition. Estimate of Cost was given as $10,669.28 to be assessed against an estimated 1000 feet at $10.67 per foot. Manager Hyde presented two written notes from the audience which stated that Mrs. Alrick, 6337 Wilryan Avenue,..and Mrs. Larson, 6329 Wilryan Avenue, were in favor of the proposed project. No other comment or discussion was offered on the project. (See Resolution Ordering Improvements later in Minutes.) 4/19/65 M. CONSTRUCTION OF ASPHALT CONCRETE PAVING WITH PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: Schey Drive from Dewey Hill Road north to Gleason Road. Estimate of Cost was given as,$17,801.17 to be assessed,against an estimated 2198.21 feet at $8.10 per foot. Mr. Hite explained that all utilities have been installed in this street, No other discussion was offered.' (See ,Resolution Ordering Improvements later in Minutes.) N. CONSTRUCTION OF ASPHALT CONCRETE PAVING AND PORTLAND CEMENT CONCRETE CURB AND GUTTER IN THE FOLLOWING: West 57th Street from Xerxes Avenue to York Avenue. Estimate of Cost was as $6,597.38 to be assessed against an estimated 553.6 feet at $11092 per foot. Manager Hyde explained that this proposal was initiated by the Village in order gain-a decision as to what the status of this street should be.. It has been a platted street, however, it has never been opened•or improved, except for the semblance of an alley. Mr. Hite recommended that since the abutting residents not wish to have the street opened. that it be vacated with the exceation of a n easement John Co given to do alley rrom xorx avenue to the mica- bloeJc alley. ;me abutting property owners, le, Don Winter, A. J. Kelly and John Sanchez stated their opposition to the opening of the street for anything beyond an alley or driveway. easement. VanValkenburg moved that the improvement proposal be tabled and that the Council entertain petitions from the abutting owners to vacate the street. Motion seconded by MacMillan and unanimously carried.. 0. CONSTRUCTION OF PORTLAND CEMENT CONCRETE CURB AND GUTTER IMPROVEMENT IN THE FOLLOWING: Lanham Lane from West 70th Street south and east to the east line of Hondo Addition. Estimate of Cost was given as $,8,315.34 to be assessed against an estimated 1,078.82 feet at $7.71 per foot. It was explained in response to a question by James Coffin, 7015 Lanham Lane, that the estimate presented was higher than normal curb and gutter costs because there were two large lots which had: their short sides on crest 70th Street, and long sides on Lanham Lane, and wouIId be assessed for only one -third of the long side footage, thus reducing the number of . assessable feet and increasing the per -foot cost. Residents of Lanham Lane questioned the amounts of money estimated for driveway replacements and were told that the job would be rechecked before contracts were let. It is possible that up to $1.00 per foot could be saved pending the investigation of driveway replacement. It was also mentioned that the grade adjustment cost at West 70th Street was .previously agreed by a former Village Engineer to be paid for by the Village. Mr. Hite explained that it may be possible to charge that grade adjustment to the West 70th Street paving project, which is where the fault originated. Residents also requested that the Engineer investigate whether or not there is a performance bond by the developer to install street surfacing. No further discussion was offered. (See . Resolution Ordering Improvements later in Minutes.) P. CONSTRUCTION OF GRADING AND GRAVELING IMPROVEMENT IN THE FOLLOWING: Amundson's Terrace from West 70th Street,to Cahill Road. Estimate of Cost was given as $16,602.56 to be assessed against an estimated 1,914.92 feet at $8.67 per foot. A representative of Pure Oil Company requested that his firm be allowed to examine the grade adjustment at the intersection with West 70th Street, where they purchased a filling station site. Mr. Hite agreed. No further discussion was offered. Motion by VanValkenburg to accept recommended low bid.was seconded by MacMillan and unanimously carried. OTTO H. PREUS AND SAM MCGOWAN REQUESTS FOR ADJUSTMENT ON STREET PAVING CONSIDERED. Mr. Hyde explained that letters had been received from Otto Preus, 4500 Dunham Drive and Sam McGowan, 4444 Dunham Drive asking that the one -third side street formula on assessments be applied to their property, even though the work was done prior to the application of the one -third rule. Mr. McGowan stated that there are five corner lots involved and that at least two adjustments have been made already. GABBERTS FURNITURE PLANS APPROVED, Mr. Hite, using the viewgraph, explained that Planning Commission had approved the building plan for the proposed Gabberts warehouse on Cahill Road between We 70th St. and Dewey Hill Road. Mr. Hite stated that the cost sharing agreement with Hennepin County relative to 65th and France Improvement No. BA -71 was in accord with distribution set forth on the estimate. VanValkenburg's motion for approval of the agreement was seconded by Tupa. All voted aye and the motion carried. SURFACE WATER REPORT PRESENTED BY MANAGER HYDE. Mr. Hyde submitted the attached report on results of flooding conditions that existed.in the Village between April 1. and April 15, 1965. PROPOSED ICE FACILITY DISCUSSED, Mr., Gilbert Giebink informed Council -of recommenda- tions of the Park Board relative to a proposed ice facility for which it is felt a very strong need exists. He stated that this ice facility, costing $450,000 to $475,000 would be located in Braemar Park along the western extremity just off County Road 18, with suitable access through a fuiure.cloverleaf to be constructed near the northwestern corner of the park. Cost would be paid from revenues generated' from the use of the ice facility. Financing would have to be worked out by the- Council and fiscal officer of the Village, but a group of citizens in the community are willing to take on sizeable undertakings with respect to a portion of the financing. Mr. Win Stephens corroborated Mr. Giebink's statement concerning the possibility of a group of interested individuals purchasing a good share of the Series B bonds. Mr. Rolland Ring stated that he could produce letters indicating support bf the ice facility for use -for Lake Conference hockey games and practice sessions. Mayor Bredesen stated that he felt that it would be desirable to continue this meeting until April 29 at -7:00 o'clock in order that Council would have additional time to consider the project and to enable interested citizens to have an opportunity-to-attend. CONDEMNATION PROCEEDINGS APPROVED FOR LOTS 6 AND 48, NORMANDALE THIRD ADDITION. Mr. Hyde reported that Elwood Swanson and Wesley Lundquist were firm in their price of $6,240 for Lots 6 and 48, Normandale Third Addition. Cost of right -of- way acquisition of these lots which are needed for Street-Improvement No. C -89 has been estimated by Mr. Kearns and Mr. Hite at $2,150 per lot, a total of $41,250. Meeting of April 19 was continued for purposes of holding Public Hearing on the proposed ice facility to be located at Braemar Park, facing County Road 18. Using the viewgraph, Mr. Gilbert Giebink presented plans developed by the Park Board in cooperation with the Village of Edina Park Department. These plans follow recommendations of Mr. Arthur J. Nickolas, rink consultant, who was employed to study the feasibility of the project. Mr. Giebink told of a growing trend for this type of facility throughout the country. Present plans call for a building 150' x 2651, with an ice area of 85' x 2001. Seating capacity would be 3,300 to 3,500. Ample concessions, restrooms and parking areas have been planned. Mr. Giebink stressed that this ice facility would fill the need of the entire community and was not for the convenience of any particular group. Contemplating a six month per year, 112 hour per week schedule, the following breakdown of use is projected: Figure skating clubs, 9 %; Lake Conference hockey games and practice periods, 14 %; Edina - Morningside Hockey Association (grades 5 through 12), 15 %; Open skating (Monday through Friday, 34 %; Open skating (prime hours), 10 %; Odd hour rentals, 13 %; Central Hockey League, 5 %. Approximate cost of $450,000 would be financed by $300,000 in General Obligation Bonds Series'A and $1501,000 would be financed by General Obligation Series B Bonds with a maximum effective interest rate of not more than 3 %, to be underwritten by a citizen's group. It is contemplated that the ice facility should be self sustaining over a period of years with $770000 the estimated revenue for a normal year. Cost of utilities was estimated at $106000, estimated salaries at $16,000 and miscellaneous operafiing expenses totaling $39,500 for a six month period. Debt service charge would be approximately $36,000. It is hoped that construction could start in early June and be completed by the end of November. Mr. Win Stephens, Chairman of the Citizens Committee, stated that over $75,000 had already been subscribed of the Series B Bonds. Mr. Rollie Ring, Chairman of the Lake Conference, announced that superintendents of eight of the nine Lake Conference schools had written letters of their support for a period of at least five years. A legal agreement should be forthcoming. Mr. William T. Engelking, Figure Skating Club of Minneapolis, advised Council that thirty to forty members of the organization were eager that the arena be built. Mr. Arthur Preusch, Sr. of the National Figure Skating Committee stated that j his group is anxious for a new location to hold their competitions. Mr. Robert Gastler, President of the Edina - Morningside Hockey Association told of the importance of this facility for the group of boys from 5th to 12th grades who play organized hockey. Marilyn Moore expressed her feeling of a need of this type of facility in this area for women skaters. Mr. Kendall Stevens, Park Board Chairman, stated that the open skating use of the arena was of utmost importance. He emphasized that this arena is in a park and that the primary use is not for champions but for recreational use. He stressed the importance of a good balance in the usage between organized groups and community use for open skating. In answer to a question from a gentleman in the audience as to the possibility of year round operation, Mr. Giebink stated that if a real need was evident the period of time that the ice would be available could be extended. He stressed that the plan as presented is still very flexible. There is also a possibility of installing a wood floor over the pipes so that the building could be put to general use during the summer months. In reply to a question from Jerome J. Nagengast, Mr. Giebink stated that Aldrich Arena had a seating capacity of 4,000 but that the ice area was the same size. Mr. Frank Buetel remarked that he would like to see ice in the arena for nine months and also have a summer program. A gentleman in the audience said that he hoped that time would be allotted for the use of speed skaters. Mr. Donald T. Knutson expressed pride in all facilities of the community and praised the Council for its foresight and fine cooperation. Mr. John Klindworth asked about membership fees and was told that these fees were not set but that the approach to the fees would be similar to those at the Municipal Pool and Braemar Golf Course. The arena would be open to outsiders but Edina residents would get first consideration. 4/26/65 Mr. Rixe moved approval of the Ice Facility subject to the following conditions: 1. That construction costs will be in line with present estimates 2. That Lake conference usage is assured 3. That private financing of approximately $150,000 is available as anticipated. Rixe's motion for approval was seconded by Tupa. Mayor Bredesen stated that a new fire station and a library must also be considered in the near future, but that the Ice Facility is being approved at this time because it will be close to, or self sustaining. On Rollcall there were five ayes and no nays and the motion to approve construction of the ice facility was unanimously carried.
