MIIJUTES of the Regular Meeting of January 17, 1966, Vere corrected to read that Mr, Johnson voted "nay" on the motion authorizing the Library Committee to proceed with the preparations of the preliminary library building plans as outlined, Tupals motion for approval of the Minutes as corrected was seconded by Trustee MacMillan and carried, Trustee PUBLIC HEARINGS CONDUCTED ON VARIOUS IMPROVEMENTS, Affidavits of Publication in the =-Morningside Courier on January 28 and February 3, and of Mailing on January 28 were submitted by Clerk, approved as to fomn and ordered placed on €ilea due notice given, Public Hearings were conducted on the following proposed improvements and action was taken by Council as hereinafter recorded: Pursuant to A, CONSTRUCTION OF LATERAL SANITARY SEWER AND APPURTENANCES IN THE FOLLOWING; Rolling. Green Parkway from existing manhole on Annaway Drive to 950 feet south. Crescent Terrace from Rolling Green Parkway to 328 feet, plus or minus, west, . Estimate of cost was given at $40,639,23 to be assessed against ten lots at $4,063*92 per Lot, this time because of the difficulty with the disposal system of Richard Petty, 5801 Crescent Terrace, at his request last August, the Engineering Department had checked the elevation of his property to ascertain whether it would be feasible for him to connect to the gravity system in Interlachen Boulevard, of this survey and requested that the most economical connection be used for his propertyb Mr, Hite stated that the elevation would again be checked, but that in the event Mr. Price was connected to the gravity system, he would have to be assessed €or his share of that system as well as the road surfacing, Mr, Hyde stated that Mr, C, L; Horn, owner of Lot 23 had telephoned to say that he was not opposed to the htprovement,' Mr, Roscoe Furber indicated that inasmuch as there apparently was a real need for the improvement, he was withdrawing his previous objection. An attorney representing Mr. Petty spoke of the existing need. CONSTRUCTION OF LATERAL SANITARY SEWER AND APPURTENANCES IN THE FOLLOWING : 'Bansen Road from T,H. #l69 to Minneapolis, Northfield E Southern Railroad. Existing manhole on T,HI #l69 and Ayrshire Boulevard to Hansen Road, Estimate of cost was given at $14,573.22 to be assessed against eight lots at $1,821.65 per lot, Mrs, Stephen P. Sweeney, 5525 Hansen Road, questioned the fact that this estimate is so much higher than the price of the sanitary sewer constructed on Hansen Road to the south, Mrb Hyde informed Mrs* Sweeney that labor rates have gone up for private contractors and that the estimate includes some street resurfacing which was not included in the price of the improvement to the south. was heard on the proposed improvement, in Minutes, ) No further discussion (See Resolution Ordering Improvement later C, CONSTRUCTION OF LATERAL SANITARY SEWER AND APPURTENANCES IN THE FOLLOWING: County Road #18. from existing trunk sewer to Indian Hills Roadb Indian Hills Road from County Road #l8 to 385 feet east of Margaret's Lane. Margaret's Lane, Easement line from Margaret's Lane to Post Lane, Post Lane , t Estimate of cost was given. at $63,839,69 to' be assessed against 31 lots at an estimated cost of $2,059.34 per lot, estimated at $13,000 , plus $3,000 €or electrical service, advised by Mr, Hyde that estimates of construction costs have exceeded actuaL costs in 90% of the cases. Mr, McCauley was further assured that sanitary sewer would be available for his home, Mr, Leland Karr, 6808 Margaret's Lane, stated that he lis highly in favor of the improvement, necessity of the lift station and was told that the design using the lift station was the least expensive method of constructing the sanitary sewer, No further discussion was heard. Mr, Hyde stated that this cost involves a lift station 14r, Thomas McCauley was Mr, Robert Naas, 6320 Post Lane, questioned the (See Resolution Ordering Improvement later in Minutes,) 24' j 2/7/66 D . CONSTRUCTION OF SANITARY SEWER AND APPURTENANCES IN THE FOLLOWNG : Easement line along Minneapolis , Northf ield-and Southern Spur line track from Eden Avenue south to the center line of Downing Street extended; thence west along the center line of Downing Street extended a distance of 240 feet. Estimated cost was given at $9,447.49 to be assessed against two lots at an estimated cost of $4,723.74 per lot, Addition, stated that he and 14r. Swendseen were both in favor of the improvement, but that they felt that the Minneapolis, Northfield and Southem Railroad should also be assessed for property owned by them. Trustee VanValkehburg's motion was seconded by 'bustee Tupa and carried that the Hearing be continued two weeks and that notice be sent to the railroad. E . Kenneth Harvey, owner of Lot 2, Block 1, Wanner I Estimated cost was given at $13,579.92 to be assessed against six lots at an estimated cost per lot of $2,263.32. (See Resolution Ordering Improvement later F, CONSTRUCTION OF LATERAL NATERMAIN AND APPURTENANCES IN THE FOLLOWING: East Service Road of T.H. #LOO from Payton Court to 275 feet north, presented estimated cost of $903.00 to be assessed against two lots at $451.50 per lot. Nr. Hyde Mr. Hite stated that he would recommend deferral of this project because of the anticipated construction for Highway #loo. Mr. VanValkenburg's motion to table approval of the watermain was seconded by Mr, MacMillan and carried. G. I Estimated cost of construction was given ats$6,983.20 to be assessed against nine connections at an estimated cost of $775.91 per connection. from the floor. Estimated cost of construction was given at $9,514.61 to be assessed against Lot 1, Block 1, Southdale Acres. There-were no objections from the ,floor and non had been received prior thereto. Hite recalled to Council that a request made on November 1, 1965, to the Hennepin County Department of Highways €or increase of speed limits on Interlachen Boulevard between Bywood West and Blake Road from 30 to 35 miles an hour had been denied because of the short distance in question, At that time, it was recommended that'a complete speed survey of Interlachen Boulevard and Blake Road from T.H, 169 to Excelsior Boulevapd be requested, then offered the following resolution and moved its adoption: Trustee VanValkenburg RESOLUTION REQUESTING HENNEPIN COUNTY HIGHWAY DEPARTMENT TO INCREASE SPEED LIMITS ON INTERLACHEN BOULEVARD BETWEEN T,Ho 169 AND EXCELSIOR BOULEVARD WHEREAS, Interlachen-Boulevard has a speed limit of 30 miles per hour at the - present time, and WHEREAS, the amount of cross traffic on this road is minimal, NOW, THEREFORE, BE IT RESOLVED that the Village Council of the Village of Edina request that the Hennepin County Highway Department conduct a survey to determine the desirability of increasing the speed limit on Interlachen Boulevard and Blake Road between T,H, 169 and Excelsior Boulevard from 30 to 35 miles per hour. Motion for adoption of the resolution was seconded ATTEST: SOUTHDALE MEDICAL BUILDING ADDITION APPROVED, Development Company has inquired regarding the application of the new provision in the Regional Medical District Ordinance which restricts the maximum height of buildings in the Regional PIedical District to three stories. for the Medical Building had contemplated a third wing and that the height of the two existing wings exceed the height restrictions of the new ordinance. ordinance makes no provisions for special permits and since a variance would not seem to be appropriate relief in the matter, Trustee VanValkenburg offered the following resolution and moved its adoption: Mr, Hyde informed Council that Dayton He pointed out that the original plans Since the new RES 0 LU T I ON WHEREAS, Dayton Development Company has erected two wings of its building En the Regional Medical District under the provisions of the former Medical District Chapter of the Edina Zoning Ordinance Number 261, Section 7 of which permitted the erection of buildings to a height greater than 40 feet under certain conditions and the height of said wings is in excess of 40 feet; and WHEREAS, the Medical District Chapter of said zoning ordinance has recently been revised so as to restrict the height of buildings in the Regional EIedical District to three stories or 40 feet above the average surrounding ground level, whichever is the lesser; and WHEREAS , Dayton Deveioprnent Company has called to the Council's attention that it has been the intention of Dayton Development Company to add to said building a third wing of the same height as the other two existing wings and that the present ordinance fails to take into account this intention which was known to the Council and has asked the Council to adopt a resolution confirming such mutual understanding; &?g f 2/7/66 I ROW, THEREFORE, BE IT RESOLVED, that the present Council of the Village of Edina acknowledges that it has been aware that the intention of Dayton Development Company was to add to its building at France Avenue and 66th Street in the Village of Edina at some future time a third wing of equal height to the present two wings and that such plans were generally known and acceded to bp %he Council and be it further resolved that,in the absence of a substantial change in’circumstances and to prevent undue hardship the Dayton Development Company should be granted a vmiance to allow it to complete a third piing on its said building in the Regional Hedical District of the same height as the presently existing two wings, I DOHATIOH.
