HINUTES of the Regular Neeting of July 18 and of the Board of Review on July 14, 1966, were approved as submitted by motion of Trustee Tupa, seconded by Trustee MacMillan and carried, . No-discussion was offered from the audience. Hite presented tabulation of ten bids for Storm Sewer lmprovement No. 103 which showed Orfie 8 Sons, Inc., low bidder at $166,151.29; 141. E, Kraft Co., Inc., second low bidder at $170,910.90; Peter Lametti Construction Co. third low bidder at $177,390.44; and Randall & Berglin, Inc. , high bidder at $218,446.00. Engineer's estimate was presented at $212,201.50. called from Washington, D.C. and had advised him that, based on his conversations with the Department of Housing and Urban Development, some of this work may be eligible for federal financial assistance. E4r. Hite explained that federal funds might pay 50% of the portion classified as "trunk sewer," which means that approximately $74,000 might be available for this purposer rate of assessment in the area to 2-1/2$ per square foot rather than 4-1/2$ per square foot as estimated at public hearing. BA-97 BIDS REJECTED. reply to his inquiry as to whether or not residents on Beard Court wished to continue with the street improvement in view of the high bids received. recommendation, Trustee MacMillan's motion that the bids be rejected was seconded by Trustee Tupa and carried, SUPER VALU STORES, INC., REQUEST TO =PLACE REDHOOD FENCE. that Super Valu Stores, Inc,, had requested permission to remove the redwood fence along Spruce Road and Second Avenue between Jefferson Ave. and Maloney Aver and to replace it with a cyclone fence which they propose to cover by planting honeysuckle vines. Erection of the redwood fence had been a requirement in granting commercial zoning to Super Valu at the time the building was proposed, in order to provide a barrier between Super Valu and the neighboring residential property. Super Value requests that the cyclone fence be approved because they hare had considerable difficulty with vandalism of the fence, Loss of equipment and damage to vehicles in the parking arear Super Valu further proposes to close of€ its access to Jefferson Avenue by a locked gate except during periods of emergencies. audience stated that during the winter the vines would not be growing and that the trucks which are parked there are unsightly for the residents whose property backs up to Super Valu, between this commercial property and private dwellings. Upon recommendation of Mr. Hitexat a hearing date be set for a proposed storm sewer to serve a portion of Edina near W, 69th and Xerxes Avenue, Trustee MacMillan offered the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON VILLAGE STORM SEWER AND APPURTENANCES 1, the feasibility of the proposed Storm Sewer described in the form of Notice of Hearing set forth below, and as to the estimated cost of such improvements, said report is hereby approved and directed to be placed on file in the office of the Village Clerk. 2. Sec, -10. Failure to Comply; Notice. Any -person ,required by Section 9 hereof to connect the sewage disposal lines with the sanitary sewer shall make such connection within ten days after written notice is given to such person to make such connection, livered by the Village Public Health Sanitarian on order of the Village Manager. Sec. 11. Connection by Village. Whenever any owner or occupant shall fail to comply with such Fitten notice, the Council may by resolutioh direct that a connection be made with the sanitary sewer and that the cost of said installation be paid in the first instance out of the general revenue fund and then assessed against the property benefited. The written notice shall be prepared and mailed by certified mail or de- Sec. 12. Assessmen$.and Collection. After such installation and connection is completed by order of the Council. the Village Clerk shall serve a written notice of the-assessment upon the owner or his representative directing him to pay said assessment within ten days after the service of said notice to the Village Treasurer. If such assessment is not paid within ten days the Village ClerktshaLl certify the amount thereof to the county auditor for collection in the same manner as other special assessments and the same shall become a lien upon said property until paid; provided, the Village Council may by resolution provide that the assessment be spread over a term of three years upon request of the owner of the property or his representa- tive. , .r See. 13. Certain Connection Forbidden; Removal Thereof. No person, owner, lessee b~ occupant of any parcel of land, building or premises situated within the corporate limits of the Village shall discharge, or permit to be discharged, directly or indirectly, into the sanitary sewer system, water from roofs, yards, lawns, streets, or alleys; water or other fluid used for the operation of air cooling and air conditioning equipment, plants or units; nor discharge or permit to be discharged, directly or indirectly, into the sanitary sewer syst$m, any gravel, sand, dirt or any other heavy material or any substance causing any extraordinary, 'obnoxious odors or gases., or any surface or subsurface waters. contractor who have heretofore made or permitted to be made, or shall hereafter make or permit to be made, any connection to the sanitary sewer system for the purpose of discharging into said system the substances described in this section, shall immediately remove such connection. of such violation delivered personally to such person, owner, lessee or occupant, or posted in the premises where such violation may occur, the Council may order the Plumbing Inspector to cause such connection to be removed at the expense of the Village, and the expense of such removal shall be assessed against such premises and certified to the county auditor of Hennepin County for collection in the same manner as other special assessments, and the same shall become a lien on such property until paid. addition be prosecuted for having committed a misdemeanor. Licenses hereunder shall be issued for either of the following classes of work: Class A License, A Class A Gas Fitter's license shall entitle the holder thereof to engage in all branches of the business of installing, altering and repairing gas piping for illuminating or fuel gas and installing, altering, repairing and servicing gas burning devices connected thereto, including gas burners and gas burner equipmentb as herein defined; and for the purpose of this ordinance the temtlgas burner" shall mean: to the combustion zone of a boiler or furnace used in connection with a heating system; (2) a power burner in which either gas or air, or both, are supplied at pressures exceeding, for gas, the house line pressure, and €or air, atmospheric pressure; or (3) an atmospheric burner (other than a gas range or a gas water heater) in which air at atmospheric pressure is injected into the bwner by a jet of gas under pressurer and whose input exceeds 50,000 BTU per hour; and the tem-ltgas burrier equipment" shall include "gas burners" as above defined, and all piping (other than supply piping from meter to appliance shutoff valve, blowers, control devices and accessories, connected to such burners,) thereof to engage in all branches of the-business covered by a Class A license, as above set forth, except the installing, altering, repairing and servicing of Ifgas burnerst1 and "gas burner equipment" as above defined, work for any Class A or Class B licensee hereunder shaI.1 hold a journeyman gas fitter's license hereunder, Sec. 17. License Procedure or Control; Penalties; License Period, The provisions of Ordinance No, 20 of the Village, including the penaxy provisions thereof, shall apply to all licenses required by this ordinance and to the holders of such Licenses, except that licenses and renewals thereof shall be granted or denied by the Plumbing Inspector, and every license hereunder shall expire on the Lst day of January next following, or renewal of license. shall be accompanied by proof that the applicant holds either a master's certificate of competency issued by the Minneapolis Board of Examiners of Plumbers or a gas fitter's license of the same class as that for which the application is made issued by the City of Minneapolis, or the City of Bloomington or the City of St. Louis Park, accompanied by proof that the applicant holds a journeyman gas fitter's license issued by one of the same three cities, application a bond running to the Village in the penal sum of $1,000, conditioned that the licensee, in all material and equipment by him furnished and in all work by him done and performed in installing, altering or repairing gas piping or installing, altering, repairing or servicing gas burner devices OP gas burner equipment, as herein defined, will strictly conform to the provisions of the ordinances of the Village relating thereto, the period from the date of issuance to the date of expiration of the license, Sec, 14, License Required for Gas Fitting- Work, No person except a person (a) (1) a device for the final conveyance of the gas, or a mixture of gas and air, (b) Class B Licenses.
