MINUTES of the Regular Meeting of May 6, 1968, were approved as submitted by motion of Councilman Johnson, seconded by Councilman VanValkenburg and carried. .- ". DANIEL STROT RECOGNIZED UPON COMPLETION OF PUBLIC WORKS CONSTRUCTION INSPECTION COURSE. Mayor Bredesen presented a certificate to Mr. Daniel Strot of the Eng- ineering ,Department in recognition of Mr, Strot's completion of a course in Public Works Construction ,Inspection. Mayor Bredesen pointed out that a number of Village employees extend additional efforts to,increase their skill and value of service to the Village. - HUMAN RIGHTS AD HOC COMMITTEE FINAL REPORT PRESENTED. Chairman of theXuman Rights Ad Hoc Committee, presented the Final Report of the Committee, stating that while the Committee did not encounter evidence of overt acts of discrimination within the community, there was unanimous opinion among Committee members that a Human Relations Commission should be established by the Village. guiding and directing the efforts of individual citizens, private groups, and public agencies concerned with the problems of human relations. presented a prepar,ed Memorandum of Agreement which embodies the recommendations of the Committee for the establishment of a Human Relations Commission created jointly by the Village of Edina and Independent School District C273. In recom- mending that the two agencies cooperate under the Joint Powers Act, it is felt that theiCommission would act most effectively in achieving its goal of securing for all individuals of the community,,freedom from discrimination because of race, color, creed, religion, or national origin in connection with employment, housing, public accommodations, public services and education. Mayor Bredesen thanked the Committee for its efforts and advised that in his opinion the Memorandum of Agree- ment presented reflected completely the attitude of this community. thate the appointment of a "high school student" to the Commission be changed to permit appointment of rlany student;" Mayor Bredesen further pointed out that he believes that there are many 'Tdisadvantaged't people, citing epileptics,, diabetics, unmarried mothers, and e*-convicts, whose interests in finding work should also be of concern to this Human Rights Committee. Gus Gaynor suggested that the Mayor was."skir,ting the real issue" and recommended that the Commission be composed with some semblance of representation of propor- tionment for the community as a whole. Webb, 6825 Wooddale Avenue, as to the next step in the matter, Mayor Bredesen advised that after the Village and School District attcrneys have drawn the agree- ment in the form of a resolution, it will, be presented to the School Board and the Council for approval no later than the 17th of June, 1968. as to whether State Statutes permit the Village and the School District to enter into this agreement jointly. General has issued an opinion in a similar situation in St. Louis Park and that he will look into that matter before rendering his opinion. out that the joint agreement is largely a matter of form and that if the Joint Powers Agreement is indefensible, the Council could accept nominations from the School Board. Mayor Bredesen gave his assurance that the fourteenmembers of the Commission would be representative of the residents of the community. Councilman Johnson then moved that Council accept the report and direct. the Village Attorney to examine the agreement and report back to Council no later than June 17, 1968, at which time the agreement will be considered. The motion was seconded by Coun- cilman Courtney. jurisdiction the Commission will have. Mayor Bredesen advised Mrs. Ford that the Commission will draw up its own by-laws and make certain recommendations to the Council and the School Board, and that any problems which might arise would go before the Edina Human Rights Commission before going to the State level. Jeub added that any legal investigations would be handled by the State board. Mr. Roger Heegaard, 5633 Wooddale Avenue, expressed his thanks to the Ad Hoc Committee and to the Mayor and Council and expressed the hope that the positive thinking revealed at tonight's meeting will be continued. Mr. Hoisington pointed out that land use in the area is comprised of C-1 commerical uses to the north and east and R-1 to the south and west. The parcel immediately to the south is owned by the Village and used for storm water storage. stated that this is the third t-ime that plans have been submitted to the staff, for apartments on this site. The first, in November,,l963, was for an 80 unit .structure, seven stories high. was requested. Tlie R-5 zoning request was dropped and it was the intent of the owners to comply instead with the Community Store District requirements. Shortly thereafter, the Community Store designation was changed to the current commercial classifications; and this site .was reclassified C-1, which would not permit multiple dwellings. property was acquired on December 29, 1966, by Mr. Norman Ackerberg, President of Norman Construction Company, subject to the approval of building plans and specific- ations. The building now under consideration is the same proposal which was made at that time. recommended approval of the zoning at its meeting of May 1, 1968. Hr. Pal Vanoss, 6-101 St. Johns Avenue, advised Council that he had purchased his home two years ago, recognizing that. the property in question was zoned C-1 and that while he does not object to C-1 development, he objects strongly to a 63 unit apratment building, in view of the fact that this is a "residential neighborhood near community stores.'' He objected particularly to the actual number of residents and the resultant traffic which would use the apartment driveway adjacent to his back yard. expressed objection to "harassment of the neighborhood" three times in five years with objectionable proposals for this site. Mrs. Dale A. Harris, 6117 St. Johns Avenue, advised that she also had moved into her home depending on the C-1 zoning, but that while she does not object to a smaller apartment on the site, she deplores an apart- ment of the size proposed, She asked to go on record as adking that complete answers be given when a person inquires about a certain parcel at the Village Hall. Bredesen pointed out that people do not generally inquire about zoning, and noted that it is hoped that.al1 records will be in one place in the not-too-distant future. Mr. Hyde reviewed the zoning background of the property, stating that the last formal action was in March, 1964, when the Council authorized the Building Inspector to issue a building permit for a building under the conditions that had been outlined which would meet the requirements of the general apartment-ordinance in effect at' that time. In December, 1966, Mr. Ackerberg brought in the same basic plan as is now being considered, at Which time meetings were held with neighbors to work out screening and the project has lain dormantsince that time, Mayor Bredesen pointed out that he believes that either C-1 or R-4 development would be an improvement to the area and that an apratment building would be less objectionable than C-1 develop- ment, tecture and that because of its design, the overall height is not much more than that of a two story building. ,He agreed to provide screening in the rear which would be suitable to adjacent property owners. The main entrance is on Valley View Road and a 35 foot setback is planned. In reply to a question of Councilman Johnson as to the effect of the building on the ponding area, Mr. Hoisington noted that the Engineering Department.has indicated that it would not interfere with the ponding needs of the Village. Councilman Courtney pointed out that Council must carefully consider the recommendations of the Planning Commission and the staff who are selected for their knowledge of building and zoning problems. In reply to.a question of Mrs. Harris, Mr. Hyde advised that because there is no unaniminity in feeling between neighbors, the Village has no plans for improvement of the pond south of the proposed building. unidentified gentleman who lives on St. Johns Avenue advised that he favors the proposed apartment building. Following considerable discussion, Councilman Courtney offered Ordinance No. 261-162 for First Reading as follows: ORDINANCE NO. 261-162 An AN ORDINANCE AMENDING ORDINANCE NO. 261 (ZONING ORDINANCE) OF THE VILLAGE OF EDINA ESTABLISHING ADDITIONAL R-4 MULTIPLE RESIDENCE DISTRICT , THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS: 'Section 1. 4, (Multiple Residence District) of Ordinance No. 261 of revised ordinances of the Village of Edina, as amended, is hereby further amended by adding the follow- ing subparagraph: District R-4 : "(28) Paragraph l,, Multiple Residence District Boundaries of Section That tract of land situated in Section 19, Township 28N, Range 24W, described as follows: 'Beginning at the Sauth- east Corner of the Southeast 1/4 of the Southwest 1/4; thence West; along the South line thereof 400.0 feet; thence North and parallel to the east line of said South- east 1/4 of Southwest 1/4 411.0 feet to the center of Valley View Road as travelled; thence Southeasterly along the said center line of Valley View Road 422.0 feet to the East line of said Southeast 1/4 of Southwest 1/4; thence South 282.00 feet to the place of beginning."' Section 2, This Ordinance shall be in full force and effect from and after its passage and publication according to law. Motion granting First Reading was seconded by Councilman VanValkenburg, and on rollcall there were three ayes with Councilman Johnson voting "Nay" in view of the fact that the property was. zoned C-1 when it was acquired by Mr. Ackerberg, Mr. Whitlock noted that it is his feeling that this property was reclassified C-1 at the time of the general reclassification without full appreciation of the background. He further pointed out that no provision was made for variance at the ,time of the 19.66 approval because it was considered a non-conforming use under the zoning ordinance and the law on that question is that if somebody ac- quired the property or made improvements to property, in reliance on existing ordinances, any subsequent changes in the zoning ordinances 'are not binding as to that particular property. He noted that he would think that Mr. Ackerberg is entitled to construct the proposed building but that there are a number of fact questions that need to be d.eterqined before he can make a final opinion. Mr. Johnson then noted that if the Village Attorney gives the finds that Council is obligated to grant the zoning, he would have no objection to the zoning change, although he would still question the variances required. ing was then set for June 3, 1968, by motion of Councilman Courtney, seconded by Councilman VanValkenburg and carried. KILLARNEY SHORES ADDITION GRANTED PRELIMINARY PLAT APPROVAL. Affidavits of notice were presented by Clerk, approved as to form and ordered placed on file. Nr. Hoisington presented Killarney Shores Addition for preliminary plat approval, -advising that this tract of land lies in the southeast quadrant of Vernon Avenue and Gleason Road immediately adjacent to the Mud Lake project. Planning Commis- sion has recommended approval, but the County Highway Department has requested modifications in the roadways which will infringe on Outlot F. Thernell, representing the developer, advised that he will come into the Village Hall and review the recommended revisions. Councilman Johnson then offered the following resolution and moved its adoption: RESOLUTION APPROVING PRELIMINARY PLAT OF KILLARNEY SHORES Second read- Mr. Gordon BE IT RESOLVED by the Village Council that that certain plat entitled "Killarney Shores", platted by Evereth G. SOUTHDALE LIQUOR STORE LEASE TO BE RENEWED. that, while the prime area rate for the Southdale Liquor Store has remained the same, the rate on basement storage has gone from $1.20 to $2.00 per square foot per year. Councilman VanValkenburg's motion that the lease be signed until January, 1972, and that consideration be given to a possible alternate site before the lease expires was seconded by Councilman Johnson and carried. -. Councilman Courtney advised Council that he had received complaints of speeding on Dewey Hill Road and that a group of residents would probably be attending the next Council Meeting to request that some action be taken. The Traffic Safety Committee has denied a request for stop signs on the street stating that this is a poor way to control speed. The attorney representing the contract vendee has requested an extension of Council's order until July 1, 1968, to either raze the building or file a reply.
