MINUTES of the meeting of August 5, 1968, were approved as corrected by motion of Councilman Shaw, seconded by Councilman Courtney and carried. Councilman Shaw's correction was that Councilman Courtney had moved that the assessment hearing. for Sanit.ary Sewer 258 and Watermain 219 b.e contin- ued until August 19, 1968. PUBLIC HE2lRINGS CONDUCTED ON PROPOSED ASSESSMENTS. Affidavits of Notice were presented by Clerk, approved as to form and ordered placed on file. Pursuant to due notice given assessment hearings were conducted and action taken as hereinafter recorded. 1. SANITARY SEWER NO. 258 AND WATERMAIN IMPROVEMENT 80. 219 SPECIAL ASSESS- MENT LEVIED. (Olinger Road from Olinger Blvd. to County Road 8158). Sanit- ary Sewer 258 and Watermain 219 affecting the same property owners, hearings were' conducted simultaneously. continued from the meeting of August 5. He recalled that Sanitary Sewer 258 total construction cost was $31,451.19, proposed to be assessed against 31 connections at cost of $1,014.55 per assessable connection as against estim- ated assessment of $1,450.89. Total construction cost for Watermain 219 was given at $27,149.81, proposed to be assessed against 29 assessable, connections at a cost of $936.20 as against estimated assessment of $993.53 per assessable connection. Mr. Burton Nygaard, representing Mr. and Mrs. Mathew McPherson, stated the objection of the McPhersons to two connection charges proposed to be assessed against. their property at 5816 Olinger Road. there are no plans to subdivide this property and requested a deferment of the assessment until such time as the division might be made. other properties in the area of similar size were,proposed to be assessed for only one connection charge. .He also noted that the McPhersons had been advised by Village officials that only one connection charge would be made against this property. Mr. Nygaard further advised that no special benefit would be received from these connections. ME. Hite stated that the improve- ments were authorized with two connections for this property. Mayor Bredesen noted that two connections on a lot of this size is a special benefit and stated that it b7ould not be fair to other property owners in the assessment, district to haQe to assume the cost of these connections. Mr. Hyde advised that ehis,is the largest parcel in the area and Mr. Hite pointed out that other properties in the area have already been subdivided into lots so that they are not capable of being divided if- the-McPhersons would be willing to place a deed restriction not to divide this property. Mr. Nygaard replied that this would not be practical but I requested a two year deferment of the assessment. Village Attorney Whitlock advised that the Village could assume the cost of the second assessment from General Funds until and when the lot is subdivided. Hoisington presented Ordinance 261-160 for Second Reading, noting that First Reading had been granted on April 15, 1968. With the aid of the view-graph, Mr. Hoisington indicated the zoning changes which would be approved by this ordinance for zoning requests of National Food Stores for Automobile Parking District and R-1 Residential District to C-2 Commercial District, of Pure Oil Company from Automobile Parking District and R-1 Resident5al District to C.-4 Commercial District and of Gisselbeck and Schneider from R-1 Residential Dis- trict to R-4 Multiple Residential District. Mr. Hoisington noted that since First Reading was approved, details have be'en worked out and variances have been granted in all three cases and that Planning Commission and the staff have recommended approval. Mr. Kenneth Mayo representing National Food Stores advised that he would be glad to answer any questions with regard to the re- zoning. Mr. D. P. Poiboisk, 6025 Kaymar Drive, advised that he objects to the proposed zoning. He stated that an attempt is beirig made to purchase five lots on Eden Prairie'Road for construction of single family dwellings. Objections to the proposed zon'ing were also expressed by Mr. Wm. Reich, Jr., 6113 Kaymar Drive, and Mr. R. A. Pfohl, 6101 Kaymar Drive. Mr. Sam Schneider advised that he proposes to construct two buildings on the three existing lots in question and that the buildings would cost approximately $70,000 in addition to the cost of the land. The Village proposal for development in the area calls for a large park and recreational facility to the east and a school- park complex to the south. of Gleason Road and the Crosst6wn and-single family development is occurring to the north and west. Mr. John Crouch, attorney representing Cherokee Sales, advised that the adjacent property is zoned R-1 only so that flexibility of development could be maintained. He pointed out that adjacent property to the south is highway right-of-way and that the school and church are not adjacent to the site in question and that the terrain was not suitable for Single family dwelling construction. Mr. Hite noted that there is ample evidence that single family dwellings have been built on terrain more severe than the land under consideration. Mr. Hite further advised that new homes have been built along the Crosstown as near its interchange and that no evidence has been presented that would suggest lands near the crosstown are not suitabl'e for the uses permitted by R-1 zoning. Mr. Crouch pointed out that it is the cumulative effect that makes this property undesirable for single family dwellings. Oscar Jones of Cherokee Sales, Inc., advised that this apartment complex would be aesthetically desirable and compatible with the neigtiborhood. noted that this complex would be a high rental type of building which would be of value to the Village from a tax producing standpoint. Mr. Hyde advised Council that in reply to the protests of the Village relative to traffic signal participation, Mr. Klostner of the Hennepin County Highway Department had stated that there was a "blind spot" in the traffic .signal participation policy and that they would advise the Village when a decision has been reackd as to a revised policy. COUNTY-WIDE POLICE COMMUNICATION SYSTEM DISCUSSED. Mr. Hyde stated that he had received a letter from Mr. StanL'ey R. Cowle, County Administrator, ex- pressing concern about the cooperative development of a police communications system that would meet the test of today's law enforcement requirements. The Board of Hennepin County Commissioners has indicated their willingness to underwrite a major share of the cost of a County-aide participation com- munication system. This system will allaw two cars in different municipal- ities to talk directly to each other when these cars are in pursuit. It is proposed that the County will sustain the purchase of the central facility dispatching equipment and all mobile radio units. Cost estimates for local -dispatching equipment total $4,482.00 for each jurisdiction after Civil De- fense credits have been applied. The County proposes to buy all of the mobile units and maintain and replace them at $100 per unit. pf Mayor Bredesen as to present costs, Mr. Dalen advised that the Village is currently paying about $135.00 annually per unit and that the balance of the cost of the system will be assessed against the Village mill. rate. Mayor Bredesen advised that he does not object to the system itself, but suggested the possibility of paying on a per capita basis. look into the possibility of this type of financing. UNCLAIMED BICYCLE SALE PROCEDURE TO BE CHANGED FOR ONE TIME ONLY. noted that the system of auctioning unclaimed bicycles to individuals one at a time has become costly and time consuming. He recommended that the sale be conducted on an "all or none basis" which would be participated in by dealers only. Councilman Shaw's motion that the sale be conducted on this basis for one time only to see whether this method of selling the bicycles would be satisfactory was seconded by Councilman Courtney and carried.
