SEPTEMBER ,15, 1969 Members answering rollcall were Councilmen Courtney, Shaw and Mayor Bredesen. - PUBLIC HEARING CONDUCTED ON SPECIAL ASSESSMENT FOR BA-119. that the public hearing for the special assessment for Street Improvement BA-119 had been continued from meeting of September 8, 1969, in order that the Engineering Department could check complaints about the czown in the street and the grade of driveways. J. H. Rush, 5801 Olinger Road had been repaired and that the driveway of Mr. Robert Hagen, 5721 Olinger Road would be completed shortly. that her driveway was still not satisfactory since her car scxapes if more thari two people are in the car and that she will have no control of her car in the winter. She also complained because she now has a "blind driveway". Mrs, Rush was agreeable to Mr. Hyde's suggestion that the Engineering Department continue to work with Mrs. Rush and that the assessment be levied as proposed. Council- man Courtney thereupon offered the following resolution and moved its adoption with the observation that the Village do everything in its power to correct the situation, within reason: Mr. Hyde recalled Mr. .Hyde advised that the driveway of Mrs. I Hrs. Rush said RESOLUTION -ORDERING SPECIAL ASSESSMENT OF STREET IMPROVEMENT BA-119 BE-IT RESOLVED by the Village Council of the Village of Edina, Minnesota, as follows : 1. assessment roll for the improvement hereinafter referred to, and at such hearing held on September 15, 1969, has considered all oral and written object- ions presented against the levy of such assessment. 2. Councilman Shaw's BA-109 REASSESSMENT REQUEST DENIED. Mr. Hyde advised Council that a petition was received, after Street Improvement BA-109 had been authorized, in which the residents of Iroquois Circle requested that their assessment be made on a per lot basis. Discussion ensued during which it was noted that there be nothing basically wrong with granting the request but that a precident would be set which would be undesirable. It was noted also that it would be very confusing to assess different areas in the same improvement in a different manner, and since the same owners are still living in the houses as at the time the petition was signed, Mayor Bredesen suggested the possibility of the neighbors working out a per. lot division on a.voluntary basis among themselves. man Courtney's motion that the assessment of BA-109 stand as approved was seconded by Councilman Shaw and carried. Council- OLD LIBRARY SITE DISCUSSION CONTINUED TO OCTOBER 20, 1969. Mayor Bredesen recalled that some time ago the.Counci1 had indicated that the old.Library property would be returned to the donors unless there was approval by the residents of Maple Road on the Village'proposal to sell the Library property. He noted that the total area, including the 50 foot buffer, running from W. 49th Street to TJ. 50th Street, was a part of the donation and should the Library site be returned to the donors, that 50 foot strip would be included in the return of this property. Mayor Bredesen suggested that this could be a very serious matter in the event the donors wished to make an effort to open the land for a street or for some other purpose. Council had indicated that it would turn the property back to Lund-Kruse as of September 15, 1969, unless Maple Road property owners waived the site restrictions.which limit its useto a park or library facility. property must either be returned or else the matter must be continued to a later date. Nrs. 1.Jilliam Ruppert, 4905 Maple Road, asked why this land could not be made into a small park. Approval has not been received and the 9/15/69 Mayor Bredesen said that this would be bf no value to people in the Village and would be only an expense. In response to the question of Nr. Ruppert as to whether the Library building.could be used for School or Village offices, Mr. Hyde advised that when the building was being used as a Library, the Fire Marshall would not permit use of the second floor without a considerable amount of expenditure for additional exits. lir. Hyde contradicted the state- ment of Nr. Roy Mehrkens, 4912 Maple Road, who s-aid that residents were told that the 50 foot buffer would always remain. Mr, Hyde said that residents were told that the strip would remain only if Village plans were followed. In answer to a question regarding the bank's expansion plans; Mr. Hoisington noted that the bank has a number of ideas for expansion but hag not solidified them. Hyde reviewed the background of the T.H-. 100% - Benton Avenue Interchange, recalling that in 1965 the Council approved a plan for a complete diamond at Benton Avenue and T.H. 100. The State Highway Department and the Village then worked together and the State Highway Department presented statistics to the Referral Committee, prov- ing that if there were no access at Benton Avenue to the upgraded T.H. 100, that there would be more ramps needed, and larger remps, at Eden Avenue and 50th Street. which provides for movement between Benton Avenue and T.H. 100 to and from the North only. Mr. Hyde added that as a result of a meeting af-the Referral Committee which Village pepresentatives attended last week, the Referral Com- mittee advised Mayor Bredesen and members of the staff that it would appreci- ate it if the representative of the Council would be present to ''reflect the views of the Council on the proposal or to report on any more formal action which might be taken between now and September 18". Following considerable discussion, Councilman Courtney offered the following . resolution and moved its adoption: This summer the Metropolitan Council Referral I The Referral Committee then recommended a half diamond plan The Police and Fire Mr. Hyde said that he has asged for a formal Mayor Bredesen suggested that a resolu- He noted the Metropolitan Council 9/15/69 f RESOLUTION CONCERNING TRUNK HIGHWAY 100 AND BENTON AVENUE INTERSECTION tIHEREAS, the Village of Ediha, through its Village Council and staff, has worked with the Minnesota State Highway Department since 1957 in developing plans for increasing the traffic capacity of Trunk Highway 100 through the Village; and WHEREAS, on August 16, 1965, after thorough study and several public hearings, the Village Council approved State Highway'Department pldns for a full diamond interchange at Trunk Highway 100 and Benton Avenue because such plans accom- modated not only the through highway trafgic, but also provided reasonable access and egress for the Edina school complex which consists of a senior high, a junior high and a grade school, as well as for a large church in the immediate vicinity of the intersection; and WHEREAS, Edina's local streets in this area serve residential districts and were designed to facilitate the niovement of purely neighborhood traffic to and from Trunk Highway 100; and WHEREAS, the Metropolitan Council Referral Committee and its staff now looks with disfavor on the full interchange because'such a design does not meet recently adopted standards for future highway c'onstruction which standards do not consider the needs of existing developments; and WHEREAS, the Metropolitan Council Referral Committee has requested the views of the Edina Village Council; NOW, THEREFORE, BE IT RESOLVED BY THE EDINA VILLAGE COUNCIL that the Edina Board of Education advise the Metropolitan Council Referral Committee as to its access and egress problems and recommend which design. it prefers, and BE IT FURTHER RESOLVED BY THE EDINA VILLAGE COUNCIL that in view of the needs of local traffic in a fully developed area which has to depend upon the availability of a long-existing thoroughfare, Trunk Highway 100, and to obviate the forcing of through traffic on to narrow, residential streets which would result if full access to and from Trunk Highway 100 is not available, the Metropolitan Council Referral Cornittee be advised that the Village of Edina re-affirms its approval of an interchange at Benton Avenue and Trunk Highway 100 as basically approved in 1965 which would allow north and south access to the highway. Boblett, 5404 Larada Lane, which noted the fact that Edina Police Officers made such a fine appearance and were so well prepared for their appearances before the Grand Jury. Mr. Boblett added that it reflected great credit on the Edina Police Department and on the Village government, as.a whole. - SOUTHEAST EDINA PLANS DISCUSSED. Mr. Hyde presented Ordinance5No. 241-5 which provides for payment of connection charges by properties in lieu of special assessments.
