Members answering rollcall were Councilmen Courtney, Johnson, Shaw and Mayor Bredesen. OATH OF OFFICE was administered by the Clerk to Mayor Arthur C. Bredesen, Jr., whose new term of office runs to January 1, 1972. KESLER-LILJA ADDITION GRANTED PRELIMINARY AND FINAL PLAT APPROVAL. of Notice were presented by Clerk, approved as to form and ordered placed on file. Mr. Hoisington presented Kesler-Lilja Addition for approval as recom- mended by the Planning Commission, noting that developers had requested both preliminary and final approval before the end of 1969. heard, Councilman Shaw offered the following resolution and moved its adopt ion : Affidavits No objections being RESOLUTION APPROVING PRELIMINARY AND FINAL PLAT OF KESLER-LIMA ADDITION BE IT RESOLVED by the Edina Village Council that that certain plat entitled "Kesler-Lilja Additionit, platted by Gale T. Kesler and Lillie N. Kesler, husband and wife, and by TJallace 0. Lilja and Maren H. Lilja, husband and wife, and presented at the Special Mee:ing of the Edina Village Council held on December 29, 1969, be and is hereby granted preliminary and final approval. ATTEST : Mayor Village Clerk HAM RADIO TOWER ORDINANCE TO BE PREPARED; ORDERED. Mr. Hyde recalled that at the Council Meeting of December 15, 1969, the Village Attorney had been instructed to determine whether the Village could legally ponk?bl:-the height of radio and television antennas. Mr. Whitlock advised that our present zoning ordinance is not explicit, stating only that a "structure" cannot exceed thirty feet in height, He said that there is a possibility that a court would go along with the Village if such an amend- ment was adopted, inasmuch as it is not clear whether radio and television towers are "structures". motion that notice be served on the owner of a ham radio tower at 5754 Wood- dale that his tower is considered a violation of Village ordinances and that a new ordinance be worked out by the Village Attorney which would cover future cases, was seconded by Councilman Courtney and carried. Johnson for five feet of Lot 5, Block 5, Edina Highlands to be added to Lot 6, Block 5, Edina Highlands in order that he could geC marketable title for his property. As recommended by Mr, Hoisington, Councilman Shaw offered the following resolution and moved its adoption: RESOLUTION WHEREAS, Gilman C. Johnson and Hulda Johnson, .husband and wife, are $he; owners of certain parcels of land in the Village of Edina described as follows : Lot 6, Block 5, Edina Hihglands, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Hennepin County, Minnesota; and 2-,$ . I 12/29/69 That part of Lot 5, Block 5, Edina Highlands, lying Southeasterly of a line drawn parallel with the Southeasterly line of said Lot 5 and distant 5 feet Northwesterly measured at right angles from said Southeasterly line of said Lot 5, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Hennepin County, Minnesota; and WREAS, said owners have requested approval of the Village of Edina of the two above described parcels of land as one parcel; and WHEREAS, it has been determined that compliance with the Subdivision and Zoning Regulations of the Village of Edina will create an unnecessary hard- ship and said tracts of land as a single parcel does not interfere with the purpose of the Subdivision and Zoning Regulations as contained in the-Village of Edina Ordinance Numbers 261 and 263-A; NOW, THEREFORE, it is hereby resolved hy the Village Council of the Village of Edina that the conveyance and ownership if the above described tract of land as a single parcel is hereby approved and the requirements and provisions of Ordinance Nos. 261 and 263-A are hereby waived as to said division and conveyance, subject, however, to the provision that no further subdivision be made of the above described tracts of land unless made in compliance with the pertinent ordinances of the Village of Edina or with the prior approval of this Council as may be provided for by these ordinances, . Mr. Hyde presented a check in the amount of $200 which was donated by Clancy Drug Company, Edina Pure Oil Service, First Edina National Bank and Lunds, Inc. for the Police Educational Training Fund. Councilman Johnson thereupon offered the followingaresolution of thanks and moved its adoption: WHEREAS, Clancy Drug Company, Edina Pure Oil Service, First Edina National Bank and Lunds, Inc. have presented a check in the amount of $200 to the Village of Edina to be used for the Police Educational Fund; and WHEREAS, this generous gift is deeply appreciated by all Edina officials as well as by the Edina Police Department; NOW, THEREFORE, BE IT RESOLVED that the Village Council of the Village of Edina express its sincere thanks to Clancy Drug Company, Edina Pure Oil Service, First Edina National Bank and Lunds, Inc., for their thoughtfulness in making this generous presentation. Mr. Dunn noted that the City of Hopkins is taking action for relief af their sanitary sewer problems and that Richfield is studying their metering problems and recommended that the Apartment Moratorium be lifted. Following some discussion,, Councilman John- son's motion that the moratorium not be lifted until bids had been let for Hopkins' sanitary sewer relief lines and that the moratorium be continued to March 2, 1970, was seconded by Councilman Shaw and carried. SUBURBAN PUBLIC HEAT;TH NURkING SERVICE REPORT was revgewed by Mr. Hyde and ordered placed on file by motion of Councilman Shaw, seconded by Councilman Courtney and carried. FATHER RICHARD JEUB RESIGNS FROM HIMAN RIGHTS COI.IISSION, advised Council of the resignation of Father Richard Jeub from the Human Rights Commission because he has been transferred out of the Village. man Shawls motion approving nomination of Mr. James Rutherford to replace Father Jeub on the Commission, if Mr. Rutherford will accept, was seconded by Councilman Johnson and carried. Mayor Bredesen Council- BIALICK LAND ACQUISITION DISCUSSED. offered $22,000 to Nr. Councilman Johnson offered the following resolution and moved its adoption: BE IT RESOLVED by the Edina Village Council that the salary of the Village Manager be set at $28,600 for the year 1970 in line with the ten percent raises granted other Village employees.
