HomeMy WebLinkAbout19700518_regularMINUTES OF THE REGULAR MEETING OF THE EDINA VILLAGE COUNCIL HELD AT VILLAGE .HALL ON MONDAY, MAY 18,,1970 Members answering rollcall were Councilmen Courtney, Johnson, Shaw, VanValkenburg and Mayor Bredesen. MINUTES of May 4, 1970, were approved as corrected,by motion-of Councilman Shaw, seconded by Councilman Johnson,and carried. Councilman Shaw's correction was that the old Library site property would be returned to rather than by the orig- inal owners unless releases are received from property owners by June 1, 1970. PUBLIC HEARING CONDUCTED ON GRADING AND GRAVELING IMPROVEMENT C -102. Mr. Dunn recalled that Grading and Graveling Improvement P -C -102 had originally been brought to hearing on May 19, 1969, and had been continued many times since that date. Affidavits of Notice had been placed on file at,the meeting of May 19, 1969. Pursuant to due notice given, public hearing was conducted and action taken as hereinafter recorded. CONSTRUCTION OF.GRADING AND GRAVELING IMPROVEMENT NO. P -C -102 in the following: West 76th Street from France Avenue to Xerxes Avenue Mr. Dunn presented revised total estimated project cost at $59,325.00, proposed to be assessed against 4,824.01 estimated feet at an estimated cost of $12.30 per assessable foot. Mr. Dunn said that details had been worked out whereby property owners would mine their own materials and that, while all agreements 00 have not been signed, they are now being considered by the owners. Mr. Ernest 2fJ Beckman, 7520 Xerxes Avenue, was told that his property is one of the lots that is considered to be residential and would not, therefore be assessed for the cost of the improvement. No objections being heard, Councilman VanValkenburg offered the following resolution and moved its adoption: RESOLUTION APPROVING GRADING AND GRAVELING IMPROVEMENT NO. C -102 BE IT RESOLVED.by the Council of the Village of Edina, Minnesota, that this Council heretofore caused notice of hearing to be duly published and mailed to owners of each parcel within the area proposed to be assessed on the following proposed improvement: CONSTRUCTION OF GRADING AND GRAVELING IN THE FOLLOWING: West 76th Street from France Avenue to Xerxes Avenue and at the hearing held at the time and place specified in said notice, the Council has duly considered the views of all persons interested, and being fully advised of the pertinent facts does hereby determine to proceed with the construction of said improvement including all proceedings which may be necessary in eminent domain for the acquisition of necessary easements and rights for construction and maintenance of such improvement; that said improvement is hereby designated and shall be referred to in all subsequent proceedings as GRADING AND GRAVELING IMPROVEMENT NO. C -102; and the area to be specially assessed therefor shall include ' Parcel Nes. 2100, 2800, 3200, 3600,.4800,-5450, 6000, 6400, 6800, 7400, 8000, 8800 and 9200, all in Sec. 32, T..28, R. 24. Motion for adoption of the resolution was seconded by Councilman Courtney and on rollcall there were five ayes and no nays and the resolution was adopted. ORDINANCE NO. 261 -201 GRANTED FIRST�READING. Affidavits of Notice were pre- sented by Clerk, approved as to form and ordered placed on file. Pursuant to due notice given,'public hearing was conducted and action taken as hereinafter recorded. Mr. Hoisington recalled that in 1967 these lots were considered for R -2 zoning along with other lots in the area. At that time Planning Commission had recommended approval of R -2 zoning for all of the lots and included in the recommendation that when the lots in between were platted, those also should be double bungalow lots. Planning Commission and the staff have now recommended approval of the rezoning of these lots on McCauley Circle and Mr. Hoisington noted that this zoning would be in keeping with the established Western Edina Plan and that the lots are all larger than required R -2 lots. Following some discussion, Councilman VanValkenburg offered Ordinance No. 261- 201,for First Reading asi'folloas: ORDINANCE NO. 261 -201 AN ORDINANCE AMENDING ORDINANCE NO. 261 (ZONING ORDINANCE) OF THE VILLAGE OF EDINA ESTABLISHING AN ADDITIONAL R -2 MULTIPLE RESIDENCE DISTRICT THE VILLAGE COUNCIL_OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS: Section'1. Paragraph.J.. Multiple Residence District Boundaries of Section 4 (Multiple Residence District) of Ordinance No. 261 of revised ordinances of the Village of Edina is hereby amended by adding the following sub - paragraph: District R -2: "(52) Lots One (1), Two (2) and Three (3), Block One (1), McCauley Heights;Third Addition Section 2. This ordinance shall be in full force and effect from and after its publication and passage according to law. P 5/x.8/70 LOTS 10 AND 11, BLOCK 2, VALLEY ESTATES DIVISION DENIED. Affidavits of Notice, were presented by Clerk, approved as.to form and ordered placed on file. Mr. Hoisington presented the request of Mr.,Richard L. Mills to divide 40 feet from Lot ":10 and with land divided from Lot 11, create one additional lot between the two existing lots. Mr. Hoisington. noted that the plat had originally been planned for three lots, but had only platted two because of serious soil condi- tions. Planning Commissions recommendation for denial of the request was not based on the soil conditions. An unidentified gentleman in the audience spoke in opposition to the division and presented two petitions, one in opposition of the division signed by owners of fourteen properties, and another signed by owners of six properties requesting that their names be removed from a petition previously signed. He protested the division on the grounds that the house would have-to be built closex_to the street than other houses in the area be- cause the lot is smaller than- adjacent lots, that it is of aesthetic value to leave the existing open space and that owners of adjacent properties should be able to rely on the plat. He also noted that the house would cause a blind corner which would be unsafe for traffic. Mr. Richard L. Mills.said that the house would not be built in such a manner as to block vision of drivers and that the aesthetic value would be greatly enhanced with a dwelling on the pro- perty. Mr. Shaw noted that the Village map shows such a division and was told by Mr. Hoisington that this is what had lead him to believe that the original plat-had come in with the three lots. Mr. Hoisington'added that the soil condi- tions could be overcome. Following some discussion, Councilman Shaw's motion denying the lot division on the grounds that property owners should be able to rely on a plat was seconded by Councilman Johnson and carried. LOT 3. BLOCK 18, NORMANDALE ADDITION DIVISION APPROVED. Affidavits of Notice* were presented by Clerk, approved as to form and ordered placed on file. Mr. Hoisington presented the request of Mr. Kenneth J. Rerich for dn-Ea.§vtWest division of Lot.3,_ B1ock'18, Normandale Addition, in conformance with -dbher lots in,the area and noted that Planning Commission had recommended approval. Council- man VanValkenburg offered the following resolution and moved its adoption, subject to the provisions that no concessions be given on any special assessments against the property; RESOLUTION WHEREAS, Kenneth J. Rerich and Dorothy M. Rerich,'husband and wife, are the owners o_f a certain parcel of land in the Village of Edina described as follows:. The East 123 Feet of Lot 3, Block.18, Normandale Addition; and WHEREAS, said owners have requested approval of the Village of Edina of the conveyance and ownership of the above described land as a separate parcel; and jsTiiEREAS, it has been determined that compliance with the Subdivision and Zoning Regulations of the Village of Edina will create an unnecessary hardship and said tract of land as a separate parcel does not interfere with the purpose of the Subdivision and Zoning Regulations as contained in the Village of Edina Ordinance Numbers 261 and 263 -A; NUI, THEREFORE, it is hereby resolved by-the Village Council of the Village of Edina that the conveyance and ownership of the above described tract of land - as a separate parcel is hereby approved and the requirements and provisions of Ordinance Nos. 261 and 263 -A are hereby waived to allow said division and conveyance, but are not waived for ank other purposes or as to any.,other pro- vision thereof,.and subject, however, to the provision that no further subdivi- sion be made of the above described tract of'land made in compliance with the pertinent ordinances of the Village of Edina or -with the prior approval of this Council as may be provided for by those ordinances. Motion for adoption of the resolution was seconded by Councilman Shaw and on rollcall there were five 'ayes and no nays and,the resolution was adopted. STREET LIGHTING IMPROVEMENT L -8 AWARD OF BIDS CONTINUED. Mr. Hyde presented tabulation of six bidd- ,received in response to Advertisement for Bids in the Edina Sun on April-30 and-in the Construction Bulletin on April 30 and May 7,' 1970. Tabulation showed Premier Electrical Construction Company low bidder at $46,267.00, Hoffman Electric Company of Minneapolis at $47,876.00, Lee Electric at $49,800 and Egan McKay Electrical Contractors high bidder at $59,978.00. Engineer's estimate was given at-$62,I00'. As recommended by Mr. Hyde, Councilman Courtney's motion continuing award of bid so that the low bidder could be checked out was seconded by Councilman•Shaw and carried. He noted that the area which lies South of Southdale is the subject of an economic analysis at this time by the Metropolitan Council and a traffic study may be undertaken in the near future. Mr. Hoisington advised that Industrial, Regional Commercial, Highway Commercial and high density multiple residence zoning are anticipated and that the plan ties in with the general plans of Bloomington and Richfield for their adjoining areas. Discussion ensued as to the possibility of getting this area•in the Edina School.District, which possibility was cbnsidered highly unlikely.. Following considerable discussion, Councilman Johnson!s motion granting preliminary approval to the conceptual plan for Southeast Edina. as attached to these Minutes was seconded by Councilman VanValkenburg and carried. Mayor Bredesen thereafter noted the reservation with which the Council had granted approval: FIRE STATION COSTS TO BE FURTHER INVESTIGATED. Mr. Hoisington recalled that the Western Edina Plan calls for one central fire station to be located generally in the Northwest quadrant.of the Crosstown Highway and Tracy Avenue. He referred to a report from'Chief McNellis on a study made in conjunction with the Fire Underwriter's Inspection Bureau, in which Chief McNellis recommended and fire station in the center of the Village at this time. Mr. Hoisin� ton said that the Park Board had been asked to consider the possibility of constructing the building in Countryside Park and had taken a rather nega- tive attitude toward this site. Citizens attending the Planning Commission Meeting of May 6, 1970, had also expressed opposition to use of the park site. Mr. Hoisington presented total estimated cost of the fire. station, not includ- 00 ing land acquisition, at $386,000 for 10,000 square feet of building area, plus 1fJ an additional 1,200 square feet of area for a repair shop. He further noted. that the site South of the park was recommended by the Planning Commission and is owned by Pemtom, Inc., who has indicated that it would be willing to' sell it to the Village on the basis of its per acre buying cost for the entire site. This cost is estimated to be in the neighborhood of $12,000 p "er acre for the one or two acres needed, bringing the total estimated cost, should the station be built on the Pemtom property to $410,100. Mr. Hoisington requested permission to build the new fire station, to hire an architect as soon as•possible and to either negotiate for the Eemtom property•or to get advice from Brauer & Associates as to how to redesign the park if that site should be used. Mayor Bredesen said.that he believes that the cost estimates are 25 to 30 percent too high and that one acre of land should be sufficient. This would bring the estimated total cost to $330,000 rather than the suggested $410,000., Mr. Hyde suggested that a site be decided upon and requested authority to negotiate for a building site.` In response to a question about one versus two fire stations by an unidentified gentleman in the audience, Mayor Bredesen explained that the fire station would be moved from the Village Hall because the Village needs additional office space and also because the Village Hall is no longer in the center of the Village. Mr. Hyde noted that most of Edina is in Class 6 fbr fire insurance rates and that there would be no further reduction in residential rates. Mr. John Telfer urged that the fire'.station not be built in the park. Mr. John Yarger said that perhaps Pemtom would be willing to donate land to the Village in exhhange for zoning consideration as it had done in Burnsville. Mayor Bredesen said that a donation would certainly be acceptable, but that he would not want to make such a donation a consideration of any rezoning. He emphasized that as far as he was concerned, absolutely no concessions had been made by the Village relative to the Olsen property rezoning and that'he feels exactly the same way about the fire station site. Mr. Erickson pointed out that the Planned Residential District Ordinance authorizes the Village to acquire land for park purposes as a condition of-rezoning, but that this is not going�to be a park.. Considerable discussion ensued, whereupon Councilman VanValkenburg's motion was seconded by Councilman Johnson and carried authorizing the staff to obtain more realistic cost figures on the proposed building and to negotiate for land from Pemtom. NL44 LIBRARY DISCUSSION CONTINUED TO JULY 20, 1970. Mr. Hyde recalled that discussion of the recommendations of the Friends of the Library as to the sale of the new Library building to Hennepin County had been continued from May 4, 1970. He noted that the Old Library Committee had recommended that the Village sell the new Library to the County and start looking for a site for another library which could be financed by proceeds from the sale of the present Library building. Mayor Bredesen took issue with the report, stating that he does not know why the Village should sell the Library and wondering on what professional advice the Committee determined that the rental of $3.58 per square foot was too high. It was noted that the County was willing to pay only $2.75 per square foot. Mayor Bredesen said that if the Village sells the present site, he would see no reason at all to buy another library- -site. Mayor Bredesen added that if Hennepin County is going to take over, they should buy their own site and operate the library. Mr. Erickson said that he 1; U,. 5/18/70 had researched the Statutes and Attorney General's opinions and had concluded that once the Village made its own tax levy or taxed its own properties for the maintenance of the Village Public Library, there would no longer be any taxable power in--the County for operation and maintenance, although a continu- ing power would exist for bonds previously issued for construction of the Library. Mr. Erickson added that he had just discovered another Attorney General's opinion which was just to the contrary of the other opinions. This second opinion, made in 1967, stated that once the Village has been taxed, as the Village has now been taxed, that taxing power of the County continues even though the Village thereafter establishes its own Public Library and taxes its own properties for the establishment and maintenance. Mr. Erickson said that he believes that his original conclusions were correct but that he will have to check further into the matter. It was noted that, if it so desired, the Village could run a.very good Library with funds now expended in the present system. Following some discussion, Councilman Shaw's motion that the Village Attorney obtain another ruling from the Attorney General was . seconded by Councilman Johnson-and carried. Mrs. Thomas Dale, of the Friends of the Library, asked why Edina wants to operate the Library. Mayor Bredesen explained that it is a matter of economics inasmuch as the Village is now pay- ing for other libraries in Hennepin County. He added that he is sure that Hennepin County feels that Edina and some of the other suburbs can better afford to pay for this service and that they, therefore, pay a larger share per capita than some other municipalities. Mrs. E. J. Diefenbach, Chairman of Friends of the Edina Library, noted that the Friends had never felt that another library should be built in view of the possibility that a Regional Library may be built in- Edina. Councilman Shaw said that if the County would not comprom- ise on the per foot cost,-that Edina could, if desired, buy a Minneapolis Library card for everyone in the Village who wished to use one and still come out better financially for the residents of the Village. Mr. Erickson noted that at the present time the City of Columbia Heights has made an arrangement for payment of a blanket fee for use of the Minneapolis Public Library System. Mr. Hyde added that he understands that arrangements have been completed for a metropolitan wide exchange of cards between St. Paul, Minneapo- lis and several other suburbs. Mr. Dalen added that at the present time, - Edina is paying Hennepin County approximately two mills (amounting to approxi -. mately $120,000) plus operating costs, or a total of nearly $500,000 yearly for bonds and interest and land acquisition and that this cannot be avoided. Following considerable discussion, Councilman Johnson's motion continuing the matter for two months so that the Village Attorney can obtain another Attorney General's opinion was then.seconded by Councilman Shaw and - carried. GARBAGE AND TRASH COLLECTION DISCUSSION CONTINUED to meeting of June 1, 1970, by motion of Councilman Shaw, seconded by Councilman Courtney and carried in order that the:Mayor_ and •FZilldge staff members could meet with licensed garbage haulers. HUMAN RIGHTS COMMISSION RESOLUTION REFERRED BACK TO COIDUSSION. Mr. Hyde noted a resolution adopted by the Edina Human Rights Commission at its meeting of May 13, 1970 as follows: "The Edina Human Rights Commission feels the present Minnesota law forbidding public employees to strike and the penalties imposed upon them in case of a strike are a denial of their human and civil rights." The concensus of opinion of the Council was that the Legislature should re- examine the existing law in an effort to find some means of resolving disputes short of a strike, should legitimate grievances exist. Following some discus- sion, Councilman Johnson's motion that the Human Rights Commission re- word'its resolution to more clearly reflect the discussion of the meeting at which the resolution was adopted was seconded by Councilman VanValkenburg and carried. T.H. 100 AGREEMENT WITH MINNESOTA HIGHWAY DEPARTMENT CONTINUED TO JUNE 1, 1970. Mr. Hyde referred to the cost sharing resolution with the,Minnesota State Highway Department for T.H. 100 from North Village Limits to Willson Road which had been revised by Mr. Dunn and note4 that most of the utilities had been installed in highway property under permits from the Highway Department with the stipulation that they would be moved at the time of the highway improvements were made at the expense of the Village. Cost of any improvements necessary can be assessed against property owners if the Council so wishes. Mr. Dunn explained that this resolution should have come to Council about a year ago and added that a cost sharing agreement must be approved by the Village Council before - contracts can be awarded after bids are taken on June 26, 1970. Mr. Dunn also said that the curb and gutter on frontage roads which abut private property and the relocation of watermains and sanitary sewer facilities are the entire responsibility of the Village and that the storm sewer which will be involved will be paid in part by the State Highway Department and partially by the Vill- age. Councilman Johnson noted that the proposed resolution is very specific 5/18/70 9 -fe AMATEUR RADIO TRANSMITTING TOWER ORDINANCE DISCUSSED. Mr. Hyde noted receipt of a letter from Mr. L. L. Miller, 5720 Wooddale Avenue, complaining that the Council had failed to act toward removal of the amateur radio transmitting tower located at 5754 Wooddale Avenue. Mr. Erickson noted that the Radio Relay.League of America had still not answered Mr. Whitlock's letter. Discus- sion ensued as to a proposed ordinance which might deal with the problem as a private, rather than a public nuisance. Following some discussion, Council- man VanValkenburg's motion that the Village Attorney draw up an-.ordinance with- out waiting any longer to hear from the Radio Relay League was seconded by - Councilman Shaw and carried. Mr. Miller was not present at the meeting. STREET IMPROVEMENT BA -96 TO BE REASSESSED. Mr. Hyde advised Council that at the last meeting he reported that the Village had von a case relative to the BA -96 assessment. However, the next day he received a signed statement in which the last sentence indicated that the case had not been won completely, and that the project must be reassessed on the basis that the corner property that was assessed 1/3 was not a single lot. Mr. Erickson noted that the Court had not overturned the theory of the assessment of 1/3 on the long side, but that the trouble with this approach was that it appears to apply irrespective of the size of a corner lot. He added that-some rational must be developed in the assessment policy as to when this policy should be applied. As.recom- mended by Mr. Erickson, Councilman VanValkenburg's motion that the matter of reassessment'be continued until Mr. Tupa's attorney could be contacted was seconded by Councilman Shaw and carried. LABOR RELATIONS SERVICE OF LEAGUE OF MINNESOTA MUNICIPALITIES APPROVED FOR ONE YEAR. Mr. Hyde advised Council that-for the past two years the Metro Section of the Minnesota League of.Municipalities had worked on a federal grant and during the last year they had been of particuldr service to the Village in working with the union. He noted that this grant had run out and that the League is now proposing that they will continue a basic service as a part of the dues cost to the State League and the Metropolitan Section with the Inter - County Council for a total of approximately $11,000. If any municipality wants and wondered how the Village could avoid any cost sharing agreement proposed by the State if it signs the proposed resolution. Mayor Bredesen added that in signing the resolution, the Village would be signing a blank check. Mr. Dunn said that the estimated cost would be known by June 15, 1970. Follow- ing considerable discussion, Councilman Shaw's motion continuing the matter to June 1, 1970, so that the proposed resolution could be reworded to eliminate the words "as determined by the State" and so that the feasibility report could he studied after estimated costs are received from the State was seconded by Councilman Johnson and carried. HAM LAKE SITE OPPOSED FOR NEW AIRPORT. Mr. Hyde advised that a resident of the Village and the owner of a substantial amount of commercial property had requested that the Council take a stand on the proposed new site of the airport. Discus- sion ensued as to the number of Edina residents working at the Airport and as to flight patterns over the Village., whereupon Councilman Johnson offered the following resolution and moved its adoption: RESOLUTION WHEREAS, many of the Village of Edina's 45,000 residents are emplayed at or use the facilities of the present Minneapolis -St. Paul International Airport; and WHEREAS, a large number of businesses have established offices in Edina at least partially because of the proximity to the present Airport; and WHEREAS, many residents of Edina frequently use the airlines serving this metropolitan area for business and pleasure travel; CN NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Edina 00 that the Metropolitan Airports Commission and the Metropolitan Council be advised that the Village Council of Edina is strongly opposed to the possi- bility of a new airport at the proposed Ham Lake site which would supplant Q the present facilities, because of the distance residents of Edina would be required to travel to an airport at that location and because an airport North of the metropolitan area would result.in more North and South flights over Edina. Motion for adoption of the resolution was seconded by Councilman VanValkenburg and on rollcall there were five ayes.and no nays and the resolution was adopted. NORMANDALE BRANCH POST OFFICE REFUSAL TO PAY LICENSE FEE NOTED. Mr. Hyde advised Council that the Normandale Branch Post Office had denied liability to pay $5,00 for a permit for storage -and handling of flammable liquids as required by the Fire Prevention Code and recommended that, rather than incur attorneys' fees, the matter be dropped. Councilman Courtney's motion that payment of the permit fee not be pressed was seconded by Councilman VanValkenburg and carried. AMATEUR RADIO TRANSMITTING TOWER ORDINANCE DISCUSSED. Mr. Hyde noted receipt of a letter from Mr. L. L. Miller, 5720 Wooddale Avenue, complaining that the Council had failed to act toward removal of the amateur radio transmitting tower located at 5754 Wooddale Avenue. Mr. Erickson noted that the Radio Relay.League of America had still not answered Mr. Whitlock's letter. Discus- sion ensued as to a proposed ordinance which might deal with the problem as a private, rather than a public nuisance. Following some discussion, Council- man VanValkenburg's motion that the Village Attorney draw up an-.ordinance with- out waiting any longer to hear from the Radio Relay League was seconded by - Councilman Shaw and carried. Mr. Miller was not present at the meeting. STREET IMPROVEMENT BA -96 TO BE REASSESSED. Mr. Hyde advised Council that at the last meeting he reported that the Village had von a case relative to the BA -96 assessment. However, the next day he received a signed statement in which the last sentence indicated that the case had not been won completely, and that the project must be reassessed on the basis that the corner property that was assessed 1/3 was not a single lot. Mr. Erickson noted that the Court had not overturned the theory of the assessment of 1/3 on the long side, but that the trouble with this approach was that it appears to apply irrespective of the size of a corner lot. He added that-some rational must be developed in the assessment policy as to when this policy should be applied. As.recom- mended by Mr. Erickson, Councilman VanValkenburg's motion that the matter of reassessment'be continued until Mr. Tupa's attorney could be contacted was seconded by Councilman Shaw and carried. LABOR RELATIONS SERVICE OF LEAGUE OF MINNESOTA MUNICIPALITIES APPROVED FOR ONE YEAR. Chief McNellis said that his office has received numerous requests for a ban on outside burning but recommended that the adoption of the ordinance be withheld until the amendments adopted by the Pollution Control Agency become effective, sometime in June, so that a' complete ordinance can be adopted. Mayor Bredesen expressed concern about what will be -done with dead leaves. Following considerable discussion, Councilman Shaw's motion was,seconded by Councilman John- son and carried•continuing the discussion on the proposed ordinance until the Pollution Control Agency amendments are effective. Mr. Hyde presented Ordinance No. 196 which is desirable in order to enforce removal.of corner vision impediments and noted that this ordinance has.been worked out by the Traffic Safety Com- mittee. Following some discussion, Councilman Shaw offered Ordinance No. 196• for First Reading as follows: ORDINANCE NO. 196 AN ORDINANCE RROHIBITING PLANTINGS, STRUCTURES AND ALL OTHER CONSTRUCTIONS TO CLEAR VIEW AT INTERSECTIONS AND OTHER PLACES, AND PROVIDING A PENALTY THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS: Section 1. Clear View at Street Intersections. On any property which is located at a street intersection, it shall be unlawful for the owner or occupant of such property to install, set out, maintain, or permit the installation or maintenance of any sign, fence, hedge, tree, shrub, natural growth, building or other obstruction to a clear view having a height greater than three feet above the level of the center of the adjacent intersection, within the triangular area formed by connecting the following three points: the point of. intersection of the adjacent curb lines extended, and a point on each adjacent curb line 30 feet from such point of intersection. If there are no curbs, the edge of the travelled portion of the street or road shall be used instead of the curb line. Sec. 2. Exceptions. This ordinance does not apply to the following: CN (a) Any building, sign, fence, growth or other obstruction in exist- 00 ance on the effective date of this ordinance. (b) Trees with trunks less than 12 inches in diameter and trimmed to tYa a height not less than eight feet above the level of the adjacent intersection. (c) Official warning signs or signals. (d) Signs mounted ten feet or more above the ground and none of whose supporting members are greater than 12 inches in diameter or width. Sec. 3. Plants Extending over Road. No person owning or controlling any plantings along public streets or roadways shall permit such - plantings to extend over the travelled portion of such street or roadway unless trimmed to a minimum height of 16 feet. Sec. 4. Plants, etc., on Roadway. No plant, fence, construction or any other obstruction shall be placed on the boulevard or public right -of -way without permission of the Village'Manager. Sec. 5. Penalty. Any person found to have violated any provision of this ordinance shall be guilty of a misdemeanor, and shall be fined a sum not to exceed $300, or shall be imprisoned for not'to exceed 90 days, or both, and costs of prosecution may be added in either case. Sec. 6. This ordinance shall be in full force and effect upon its pass- age and publication. TONKA KENNELS STRIKE NOTED. In answer to Mr. Shaw's question as to the status of the stike of dog catchers at Tonka Kennels, Mr. Dalen said that Tonka Kennels is hiring new.men to work for them. 5325 BENTON AVENUE LANDSCAPING APPROVED. As recommended by Mr. Dunn, Councilman Shaw's motion authorizing expenditure of $1,130.40 to repair damage done during construction of BA -146 was seconded by Councilman Johnson and carried. Cost of the landscaping will be charged against the improver;ent. SWEEPER BROOM FOR PARKING RAMP APPROVED. As recommended by Mr. Dalen, Council- man Courtney's motion was seconded by Councilman Johnson and carried approving expenditure of $1,195.00 for a sweeper broom to'clean the Parking Ramp. Cost of the broom is included in -the budget. CLAIMS PAID. Councilman Johnson's motion was seconded by Councilman Shaw and carried for payment of the following claims as per pre -list: General Fund, $46,480.19; Construction Fund, $27,210.44; Park, Park Const., Swimming,Arena, Park Sinking, $38,334.80; Water Fund, $12,255.90; Liquor_Fund, $85,636.76; Sewer -Fund, $1,533.44; Improvements, $163,371.94; Total, $374,823.47.
