PUBLIC HEARINGS CONDUCTED ON VARIOUS IMPROVEMENTS.
that Storm Sewer Improvement P4ST.S; -124, Street Improvement P-B-78 and Street
Improvement P-BA-171 had been continued from meeting of June 15, 1970, since
only three Councilmen had been present2 at the time vote was taken on these
improvements. Action was then taken as hereinafter recorded:
A. STORM SEWER IMPROVEMENT NO. P-ST.S. 124 IN THE FOLLOWING:

Mr. Dunn recalled total estimated cost for the trunk portion of this improvement
was $242,'454:56, proposed to be assessed agaidst the entire drainage area at an
estimated cost of $20.26 per 1,000 square feet for residential property. Total
estimated cost of the lateral portion of the system was given at $30,993.71,
proposed to be assessed over the area benefitting from lateral service at $7.56
per 1,000 square feet.

some adjustment could be made on the assessment and was told by Mayor Bredesen
that he would not approve paying for any part of the storm sever from General

property would not receive any benefit;,khat the assessment will be excessive
and that their property will be depreciated by the upgrading *of the highway.

have to be done, whether or not the highway was improved, to offer relief to

man Shaw and carried. Councilman Shaw made the additional comment that the
trunk sewer was necessary because of the fact that some of the lateral storm
sewers in the area would have to dead-end 'and become useless without the trunk
sewer.

Recalling that this project had been contin\ed from June 15, 1970, Hr. Dunn
presented total estimated cost. of the project, including bridge widening, at
$170,676.39. Of this estimated amount, $85,338.20 is expected to be paid from
State Municipal Turn Back funds, $77,050.15 from.Municipa1 State Aid funds and
it is proposed to assess $8,288.04 against abutting property at $12.00 per
assessable foot. No objections were heard, whereupon Councilman VanValkenburg
offered the following resolution and moved its adoption:

DRIVERS' LICENSE ISSUANCE CONTINUED TO SEPTEMBER 21, 1970. Mr. Dalen noted
the request of the Clerk of District Court of Hennepin County for the Village
to ac0iipt the responsibility of issuing drivers' licenses along with the
issuance of motor vehicle licenses which will commence on July 1, 1970. As
recommended by Mr, Dalen, Councilman VanValkenburg's motion continuing the
dkcision on the matter to September 21, 1970, was seconded by Councilman Shaw
and carried.

P.E .R.A. CONTRIBUTIONS BY VILLAGE FOR RETIRED PERSONNEL CLARIFIED. Mr. Dalen
'advised that at the time Council agreed to make retroactive contributions for
P.E.R.A. on June 15, 1970, there had been no discussipn of the participation
of the Village Manager. Mr. Dalen added that Chief' Bennett, Captain Merfeld
and Mr. Hyde would be the only employees who would be considering buying back
into P.E.R.A.

S.IHEREAS, the Commissioner of Highways has prepared plans, special provisions
and specifications for the improvement of a part of Trunk Highway Number 130
and 5 renumbered as Trunk Highway Number 100 within the corporate limits of
the Village of Edina from Willson Road to the North Corporate Limits; and

, and incorporate the plans and special provisions in the foregoing recitals
particularly identified and described;

and special provisions be and they are hereby approved and consent is hereby

ance with said plans and special provisions.

AGENCY AND RELOCATION AGREEXENT AUTHORIZED F0R;T.H. 100 IMPROVEMENTS. As recom-
mended by Nr. Dunn, Councilman VanValkenburg's motion authorizing the Mayor and
Clerk to enter into agreement to relocate sewer and water utilities in T.H.
100 from Nillson Road to North Village Limits was seconded by Councilman Shaw
and carried.
COST SHARING RESOLUTION APPROVED FOR T.H.. 100 IMPROVEMENTS. As recommended
by;-Blr. Dunn, Councilman VanValkenburg offered the following resolution and
moved its adoption:
WHEREAS, the State of Minnesota, Department of Highways, proposes to make
certain improvements on a portion of Trunk Highiiay No. 100 located in the
Village of Edina in Hennepin County, from North Village of Edina limits to
Willson Road; and
TJHEREAS, such improvements include the following items which affect the Vill-
age: Curb and Gutter (abutting non-Highway Department property) on frontage
roads; Sanitary Sewer in West Frontage Road fromll. 44th Street to 615 feet
North; Sanitary Sewer. and appurtenances relocation; Watermain and appurtenances
relocation; Storm Sewer construction;
BE IT RESOLVED that following approval by the Minnesota Department of Highways
of plans and specifications for said improvements of said trunk highway and
before a contract is awarded for the construction of said improvements, the
Village shall enter into an agreement with the .State which shall provide that
the Village shall pay its share of the cost of the improvements as determined
by the State in keeping with its latest edition of Minnesota Highway Department
Directive - Basic Policies and Procedures Cooperative Construction Projects
with Municipalities (a copy of which has been received from the Minnesota High-
way Department's District Engineer) and, that if the State lets the construction
contract, the municipality will deposit with the State upon demand, after the
execution of the agreement and before the start of construction, a sum equal to
an estimate of the Village share as prepared by the Minnesota Department of
Highways.

COOPERATIVE CONSTRUCTION AGREEMENT APPROVED FOR T,H. 100. As recommended by Mr.
Dunn, Councilman VanValkenburg offered the following resolution and moved its
adoption, noting that while the State Highway Department had requested this
particular resolution form, the section of Laura Avenue between Moore Avenue and
cascade Lane was deleted from the project:

BE IT RESOLVED that the Village enter into an agreement with the State of Minne-

'to provide for payment by the Village of Edina to the State of part of the cost
of constructing integrant curb, concrete curb and gutter, concrete driveway
pavement and concrete walk upon and along the West Frontage Road, Eden Avenue,
Grange Road, Vest 50th Street, Willson Road, Arcadia Avenue and Laura Avenue
and the storm sewer construction in connection with Trunk Highway No. 100
within the corporate Village limits and also including the storm sewer con-
struction extending northerly into the City of St. Louis Park to be done and
performed by the State in accordance with State plans designated as State '
Projects No. 2733-39 (T.H. 1004-130) and No. 2734-18 (T.H. 100=5); and
BE IT FURTHER RESOLVED that the Mayor, Village Manager and Village Clerk be

T.H. 100 ENCROACHMENT RESOLUTION APPROVED. As recommended by Mr. Dunn,
Councilman SlanTlallenburg offered the following encroachment resolution and moved
its adoption:
WHEREAS, the Village of Edina has approved the plans and specifications for
the improvement of that part 0% Trunk Highway Number 130 and 5, renumbered
as Trunk Highway Number 100, within the corporate limits of the Village of
Edina from Willson Road to the North Corporate Limits; and
WHEREAS, in order to obtain Federal Aid in the construction of said Trunk
Highway Number 130 and 5, renumbere-d as Trunk Highway Number 100, the Bureau
of Public Roads requires the assurance that the Village of Edina will not
suffer any encroachment of any nature or kind whatsoever on the right of way
of said Trunk Highway Number 130 and 5, reymbered as Trunk Highway Number
100, within the corporate limits of the said Village of Edina; and
WHEREAS, the Commissioner of Highways desires in the interest of public safety
that all parking of vehicles on said trunk highway be parallel with the curb
and at least 20 feet from any crosswalk;
NOW, THEN, BE IT RESOLVED that said Village of Edina does hereby agree and
covenant that it will never hermit 03.' suffer, within its corporate limits,
any encroachment of any kind whatsoever, including curb gas pumps and gas
stations, billboards or other structures of any kind whatsoever, upon the
right of way of Trunk Highway 130 and 5, renumbered as Trunk Highway Number
100, and to the above end said Village of Edina hereby agrees that it will
never issue any license, permit, or graht, or give any leave or liberty or
any other consent bf whatever form for the construction or maintenance of any
encroachment whatsoever,-including curb gas pumps and gas stations, billboards
or other structures of any kind whatsoever, upon said right of way; and that
