FRIDAY, JULY 24, 1970
Continued Meeting of the Regular Meeting of July 20, 1970, was convened at
4:30 p.m. immediately following the 3:30 Board of Appeals Meeting.
Members andwering rollcall were Councilmen Courtney, Shaw, VanValkenburg and
Mayor Bredesen.
ORDINANCE NO. 261-206 GRANTED SECOND READING. Mr. Hoisington recalled that
Ordinance No. 261-206 had been continued from the meeting of JuJy 20, 1970, so
that Council would have an opportunity to read the ordinance, whereupon
Councilman VanValkenburg offered Ordinance 261-206 for Second Reading and
moved its adoption as follows:

AN ORDINANCE AMENDING ORDINANCE NO. 261
(ZONING ORDINANCE) OF THE VILLAGE OF EDINA
ADDING CHILD CARE CENTERS TO THE LIST OF PERMITTED
USES IN THE R-3 MULTIPLE RESIDENCE DISTRICT
THE VILLAGE COUNCIL OF THE VILLAGE OF EDINA, MINNESOTA, ORDAINS:
2 of Section 4 (Multiple Residence District) of Ordinance 261 of the Village
of Edina is hereby amended to read as follows:
Section 1. Subparagraph (a) (Principal Uses, District R-3) of Paragraph
(a) Principal Uses
District R- 3 :
(1)
(2) Child Day Care Centers
Residences containing not less than three nor more than twelve
dwelling units
Section 2. Paragraph 7 (Parking) of Section 4 (Multiple Residence District)
of Ordinance 261 of the Village of Edina is hereby amended by adding the follow-
ing subparagraph.:
$'In addition to the above requirements, Child Day Care Centers shall have
one on-site parking space for each employee and teacher."

''Child Day Care Centersd" - Any facility that regularly provides care for
six or more children for all or part of a day including nursery schools
and day nurseries.
Section 4. This ordinance shall be in full force and effect from and

Councilman Shaw's motion confirming the appointment of Mr. Gordon V. Johnson
to succeed Mr. George Nugent to the Planning Commission was seconded by Council-
man VanValkenburg and carried.

BOARD OF APPEALS MEMBER TO BE NOMINATED BY PLANNING COMMISSION. Councilman
VanValkenburg's motion that the Elanning Commission nominate one of its members
to replace Mr. George Nugent on the Board of Appeals was seconded by Councilman
Shaw and carried.

P.E.R.A. "BUY-BACK" STATUS REPORT was made by Mr. Hyde who advised that only
Mr. Woehler and Captain :He$feld *. had decided to participate.
TREE REMOVAL AT .INTERSECTION OF T.H. 100 AND I?. 50TH STREET DISCUSSED. Mr.
Hyde noted the removal of trees on the Southeast corner of T.H. 100 and 14.

50th Street for the new interchange, pointing out that although the removal
is unfortunate, it t7as approved in plans authorized by Council in 1964, 1968
and 1969.
* questioned, inasmuch as the price of the land has not been settled, but Elk::
Hyde said that it had been determined that they probably did have the right
to remove the trees.
The question of whether the State had the right to come in was
ORDINANCE CODIFICATION BIDS CONTINUED. Mr. Hyde presented tabulation of bids
from Poucher.Printing & Lithographing Co. and from Paul Foss Printing and
Lithography, Inc., for printing the ordinance codification. Tabulation showed
bid of Paul Foss Printing & Lithography, Inc., at $7,728.25, with no charge
for making typesetting alterations. Poucher Printing & Lithographing Company
bid was given at $7,600 with a charge of cost plus 10% for any changes or
additions from the original copies. As recommended by Mr. Hyde, Councilman
Courtney's motion contfnuing the matter to August 3, 1970, so that Mr. Hyde
dould-check with llr. Spencer was seconded by Councilman Shaw and carried.
LOT 1, BLOCK 2, EJELDhIM SECOND ADDITION EASEBENT AGREEMENT APPROVED. Mr.
Hyde advised Council of the request of Mr. Jerry D. Kelley to build a garage
over a storm sewer easement located on Lot 1, Block 2, Fjeldheim Second
Addition, whereupon Councilman VanValkenburg offered the following resolution
and moved its adoption:
BE IT RESOLVED by the Edina Village Council that the Village Manager be
authorized to enter into agreement whereby a garage may be built over the
storm sewer easement existing in Lot 1, Block 2, Fjeldheim Second Addition.
Motion for adoption of the resolution was seconded by Councilman Shaw and
carriod.by rollcall vote of four ayes and no nays.

ORDINANCE NO. 181B-2 ADOPTED. Nr. Hyde presented Ordinance No. 181B-2 which
amends the Peddlers ' and Solicitors ' Ordinance, whereupon Coun&lman VanValken-
burg offered the following ordinance for First Reading wich waiwer of Second
Reading and moved its adoption as follows:
