Helen McClelland of the Community Development and Planning Commission. - SOUTIWEST, SOUTH AND WEST EDINA PLAN AMENDMENT CONTINUED TO SEPTEM3ER18, Mr. Hughes presented the Southtrest, South and Western Edina Plan Amendment to Council, recalling that this matter has been continued from May 1, 1978, and recommending that the matter be continued further to September 18, 1978, by motion of Councilman Courtney, seconded by Councilman Shaw. Mr. Hughes recalled Councilman Courtney's motion continuing Ordinance No. 811-All5 as recom- ORDINANCE NO. 811-Al17 GRANTED SECOND READING CONDITIONALLY. Mr. Hughes pre- sellted the request of Edina Baptist Church for R-1 Residential District Zoning, Second Reading for which had been continued from July 7, 1978, so that the mat- ter of drainage from the parking lot could be studied more thoroughly. Sentman, 6500 Parnell Ave,, representing the church, advised that an engineer retained by the church has proposed that the church build a 3 foot berm on the West side of the property which would retain any water caused by a 100 year rain. Sentman assured the Council that the church intends to install landscaping so khat cars in the parking lot will not be visible to neighbors and that they intend to extend the fence across the back of the pumphouse property. He assured Council that the church is not trying to negotiate the purchase of any additional property adjacent to the slte. Xr. David Thatcher, 5309 Halifax Ave. presented a drawing of the site, .advising':that neighbors would like to have trees planted in green areas of the parking lot, rather than having %t.ark blacktop". Mr. Charles Freeburg, 4114 Morningside Road, referred to a peeition signed by neighbors objecting to the plat. Mr. and Nrs. John Morine advised Council that the proposed lot would be identical to Mr. Freeburg's lot. They said that when they purchased the property in 1960 it was a separate lot but that somewhere along the way the property had been combined. that the Westerly 60 foot lot had been created in October, 1967. ALBAN'S ADDITION PLAT APPROVAL CONTINUED TO AUGUST 7, 1978. Notice were presented-by Clerk, approved as to form and ordered placed on file, Affidavits of Nr. Hughes presented St. Alban's Addition for preliminary plat approval, said plat consisting of nine lots located North of Valley View Road and West of Gleason Road and advised that Planning Commission had recommended approval. Nr. Eughes advised of his concern with the intersection of the proposed cul-de- sac with Gleason Road, but pointed out that the existing cul-de-sac located North of the proposed cul-de-sac has similar site distance deficiencies but does not have an unusual accident record. would be accomplished by locating the proposed cul-de-sac intersection at the Southerly extreme of the site. Expressing concern about safety of the proposed intersectian with Gleason Road were Dr. Larry Gold, 6620 Gleason Road, Mr. Jack Debelack, 6701 GleasorL Road and Mr. PeterCorcoran, GG32 Gleason Road. Mr. Douglas Johnson, 6609 Blackfoot Pass, spoke of his concern that more trees would be removed if the nine lot plat is approved, pointing out that the Indian Hills area has already lost many of its trees to Dutch elm disease and oak wilt. Councilman Richards I He suggested that a more desirable subdivision 7/17/78 then moved that the hearing be continued to August 7, 1978, so that the possi- bility of moving the cul-de-sac to the Southerly side of the plat could be cm- sidered, and so that plans for retaining walls could be reviewed by the staff. Neighbors were advised by Mr. Ericlcscn that Ordinance No. 823 calls for protec- tion of trees on the site before a Building Permit can be obtained. EDINA INTERCHANGE CENTER 7TH ADDITION PRELIMINARY PLAT CONTINUED. tfr. Hughes presented Edina Interchange Center 7th Addition for preliminary plat approval, advising that this two lot plat is located West of Ohms Lane and North of W. 73rd Street. He recalled that several months ago, the Council had granted final plat approval for kdina Interchange Center 4th Addition which plat contained six large lots and an outlot and advised that the proponents are now requesting a two lot division of Lot 4, Edina Interchange Center 4th Addition, the size of which would be approximately 3% acres and 2% acres. no subdivision dedication be required inasmuch as a subdivision dedication was made in conjunction with the original platting of the subject property. Hughes presented Dewey Hill Addition Registered Land Survey for pre- liminary approval, advising that this property is generally located North of W. 78th Street, West of Braemar Park and South of Dewey Hill Road. He recalled that approximately two years ago, the City acquired a substantial c-aount of property for the Southwest Edina stormwater ponding syscem, but, because the Indian Meadows plans were dropped, the City no longer requires the property for storm water uses. No objections being heard, Councilman Richards offered the follow- ing resolution and moved its adoption: RESOLUTION BE IT RESOLVED by the Edina City Council that that certain Registered Land Survey, generally located North of W. 78th Street, West of Braemar Park and South of Dewey Hill Road, and presented for preliminary approval at the Edina City Council meeting of July 17, 1978, be and is hereby granted preliminary approval, subject to the following conditions: 1. Final approval should be preceeded by final approval of Dewey Hill Second 0 Addition; 2. A quit claim deed for Tracts A and B of the R.L.S. should be granted to the proponents by the City; 3. A deed for the proposed outlot in Dewey Hill Second Addition should be granted to the City from the proponents; 4. A payment in full of the taxes and installments of special assessments pay- able in 1978, and a transfer of all other special assessments against the outlot in Dewey Hill Second Addition to the remaining property owned by the proponents. Tabulation shoved Akins Fire Equipment Company (the only distributor in Minnesota) bidding $5,394.25, with an additional cost of $122.65 for house connectors. Council was advised that $1,400 was raised for the rescue tool by the Edina Rotary Club, the Junior Federated T?omeas Club and the pancake Breakfast put on by the Edina Masons, Fire Equipment Company was seconded by Councilman Shaw. Ayes: Courtney, Richards, Shaw, Van Valkenburg Ways: None Hotiun carried. FARHERS 6r MECMICS BANK AGREEMENT APPROVED AS EIOIIIFIED. Mr. Rosland presented an agreement drafted by Mr. Erickson relative to conditions of parkingvari- ance and use of the easement area by Farmers Sr Mechanics Bank on lot 4' and part of Lot 3, Block 2, Southdale Officd Park Second Addition. Mr. Howard Groven, attorney representiag Farmers & Mechanics Bank, objected to the stipulation that "the failure of the City ,to give such notice, for any reason or cause, includ- iiig, without limitation, emergencies, shall not negate or detract from any of the rights of the City relative to the Easement Area, nor impose any obligations or liabilities upon the City, nor relieve the Bank from any of its duties and 03ligations ucder this Agreement." In response to Nr. Groven's concern that the above clause completelyunegates any notice that the bank should receive in a non- emergency situation, Councilman Richards pointed out that the agreement assures the good faith of the city. Councilman Richards emphasized that the City cannot guarantee that in future years,when present personnel is no longer with the City, that new employees would not be aware of the agreement. Councilman Richards' motion was seconded by Councilman Shaw that the above clause should remain in the agreement and that the word "emergency" shall be defined and added to the Agreement by the City Attorney. Following discussion, Ayes: Courtney, Richards, Shaw, Van Valkenburg Nays: Hone Motion carried. Mr. Rosland referred to . recent accidents which have occurred on the Crosstown Highway and advised Council that he has requested the TraEfic Safet,y Committee to make recommendations which will alleviate the dangers on the highway. No formal action was taken. MORNINGSIDE SCHOOL USE DISCUSSED. Mr. Rosland recalled Council's meeting with the Park Board regarding the use to which Morningside School is to be Put- AS recommended by the Mayor, Councilman Richards offered the following resolution and moved its adoption: BE IT RESOLVED that the Edina City Council does hereby authorize the Mayor and City Manager to enter into discussion and negotiations for possible acquisition of Morningside Elementary School; and BE IT FURTHER RESOLVED that the staff of the City of Edina be authorized and dir- ected to submit application for LAWCON/LCMR Grant funds and that said results of the discussion, application and attempted acquisition be brought back to the City Council for consideration of further action. Following discussion, Councilman Courtney's motion was seconded by Councilman Richards that residents be notified by articles in the Edina Sun and by newsletter that boule- vard trees are available at no %ost and that they will be distributed by lottery in the manner recommended by the City Manager.
