MINUTES OF SPECIAL MEETING

OCTOBER 15, 1979

Meeting of; the Edina City Council was called to order at 8:30 p.m.,
with the following Council members present :
Schmidt and Mayor Van Valkenburg.
Manager, Thomas Erickson, City Attorney, and Jerry Dalen, Fran Hoffman, Robert
Kojetin and Mark Bernhardson. The purpose of the meeting was to discuss three
issues that could potentially result, or are currently in litigation, and there-
fore a closed meeting was held.

ORIN JOHNSTON CONDEMNATION DISCUSSED. The City Manager outlined the provisions
of the proposed condemnation settlement. He indicated that a possible buyer of
the excess land would be providing schematics of the development of adjoining
and the excess land prior to any sale of the excess land.

School Board and members of the City and school staff was scheduled for 4:30 p.m.,
Tuesday, October 16, 1979, at Southview Junior High School, to become better
informed on the issue. Following discussion concemirrg enforcement and liability,
the matter was concluded with EO formal action being tzkcii.
Mr. Rosland reviewed the history of the .-
GARDEN VS. EDINA SOCCER ASSOCIATION SUIT DISCUSSED. After reviewing the issue,
Mr. Rosland indicated that the Association and Mr. Garden were willing to drop
the law suit without prejudice and the Association had requested coverage under
the City's general liability insurance for legal fees incurred in the suit.
After Nr. Rosland's recommendation and discussion on the issue, a motion was
made by Bredesen and seconded by Courtney, that 1) because of the significant
and beneficial public purpose served by the Association's program; 2) because
of the need of the Association for mora and financial support at this time; and
3) because if such support is not now given.the Association, it nay not continue
operations, thereby imposing a very substantial finmcial burden on the City
to carry on the Association's soccer program; the City loan the Edina Soccer
Association $7,000.00 for ilriprovement of the soccer program znd other expenses
of tha asscclatfzn tz 32 rspaic! over tea years at no btercst.
