HomeMy WebLinkAbout19800609_edina_board_of_reviewMINUTES OF THE MEETING OF THE EDINA BOARD OF REVIEW HELD MONDAY, JUNE 9, 1980 AT 4:OO P.M., AT EDINA CITY HALL Answering rollcall were members Bredesen, Schmidt and Mayor Van Valkenburg who served as Board of Review, which meeting convened pursuant to Board of Review Meeting" published in the Edina Sun on April 23, 1980, and posted on City Bulletin Boards on April 18, 1980. The Mayor explained that the purpose of this meeting was to give persons who considered themselves aggrieved by their property valuation, or those who wishdto complain that the property of another is assessed too low, an opportunity to show cause for having the assessment corrected. Mr. Johnson, City Assessor, explained that almost 100% of the residential property values had been increased 15% and that the real decision comes down to the market value of the property. The Mayor advised that the decision of the Board of Review could be appealed to the County Board of Review and could then be appealed to the State Board of Review. "Notice of ---. Mr. Earl Nelson, owner of a commercial building at 4100 W. 76th Street, objected that he has no objection to the assessment for the building, but that he consid- ered $2.99 per square foot too high for the land value. 4401 W. 76th Street which, he said, was $2.00 per square foot and to 4175 W. 75th Street which he said was appraised at $2.90 per square foot and said that he believed that all should be assessed at $2.50 per square foot. He also re- ferred to a building on Parklawn Ave. which was sold in 1979 for $355,000, which building was smaller than Mr. Nelson's building but on a larger lot. property is presently assessed ;it $431,000. Ms. Helen Letson, 4505 Garrison Lane, objected to the increased assessment for her home from $78,200 in 1979 to the present value of $89,900, stating that she believed that the value should be $80,000. street from her house had recently sold between $95,000 and $110,000. Mr. Kenneth Dragseth, 6904 Antrim Road, objected to his estimated market value 11 of $89,300, stating that because of heavey traffic and speed on Antrim Road, his value should not be as high as if the house.:was on a les's travelred street. Mr. Dragseth said that his market value had been increased to $89,300 from last year's value of $77,700 and that houses valued up to $125,000 had lower taxes than his property. He also objected that residents on the West side of Antrim. Road have no sidewalks and have'trouble crossing the street to reach the park. Mr. Johnson advised that the location of a11 properties have been considered in arriving at values. Mr. W. A. Spanton, 4816 Roycar Road, objected to his market value of $108,700. Sunnyslope Rd., complained again the general percentage increase for his property and advised that his assessed valuation was $211,000. Mr. Ray Johnson said that he hoped that his valuation would not continue to in- . crease next year. Mr. John McDonald, 5116 Tifton Drive, said that he, too, had wondered whether his 1981 assessed valuation would be increased. . &. Richard Cheng, 6405 Nordic Circle, objected that houses at 6204 Creek Valley Road and 6413 Nordic Circle had more square footage than his home and yet were valued at a lower rate. The property will be reviewed. Mr. Paul Scully, 6024 Leslie Lane, objected to his assessed valuation of $110,000 In response to Mr. Scully's question as to how the assessor arrives at his values, Mr. Johnson said that he cannot always keep pace with property sales in all areas and must . make some assumptions. The pr.operty will be reviewed. . He asked that a more equitable assessment be made. . stating that he believed his property to be worth only $100,000. Mr. Zwack said that Lake West paid $240,000 in November, 1977, with the intent of con- structing Section 8 housing on the site, but that H.U.D. had refused financing. He said that by the time 1/4 acre is not usable and a 50 foot strip of land along the entire East side of the property was dedicated as a buffer between their building and the adjacent single family property, they have only between 3 and 4 acres of usable ground. He objected also that they were only allowed to build a three story building, rather than the four story building requested. Mr. Zwack said that he believed that $260,000 would be an equitable valuation; based on the purchase price and also based on the fact that it is customary to 95 0 0 7) Q: U get a ratio of somewhere between 10 and 15% ratio 'of :building to land in value for an office building site and that they would have to build approximately a $7,000,000 building to meet that criteria. Mr. Zwack Mr. C. Edward Belanger, 4708 Annaway Drive, objected to the estimated market value for his property of $149,200, advising that in 1978 his limited market i: value was $116,000.. Mr. Johnson advised that the Legislature had eliminated ' the limited market value and that.for that reason, this year's tax statements did not reflect a large increase. He explained that the percentages of arriv- ing at assessed value has been lowered and that the homestead credit has also been increased which results in lower taxes. Mr. Del Johnson said that he had told Mr. Ralph Johnson that he would get an independent appraisal. Mr. Ralph Johnsoa explained ex- plained that there are no comparable buildings in Edina, but that he had found three sales outside the City and would give this information to Mr. De1,Johnson over the phone. He emphasized that the underlying value must be the economic valuation. Ms. Kathryn Kjellsen, 4453 Ellsworth Dr., objected to the estimated market value .. of $88,200 on her home, stating that her uncle is on the Board of Equilization in Minnetonka and that he said the property is worth between $82,000 and $84,000. She said that she had a two car, rather than a three ,.car 'garage,. that .the :houde'J is in poor condition as is the pool in the back yard. Mr. Johnson said that the City had not been aware of the pool. The property vi11 be reviewed. Mr. Eaurice Lava, objected that the estimated market value has increased 56% in the four years that he has owned it, and that since the apartment does not have a laundry room or air conditioning, he believes that the market value should be $65,000, rather than the Assessor's estimated market value of $75,300. that he would "just let that go", but complained more specifically about the estimated market.value of $5250 W. 73th St. of $825,000, saying that he believes that the value should be no more than $725,000 insamuch as he has nothing but problems since he purchased the building. He clarified that he is in a low spot with adjacent buildings being 5 to 6 feet higher than his property. Mr. Lava said that the building was completed in February, 1979, and was not able to rent it because "people could not get to it". He said that today the building is surrounded only by mud. Mr. Rosland confirmed that there is a problem on the site and that it all goes back to ine Mile Creek Watershed District setting the level when the building was constructed. He recommended that Mr. Luniesky visit the property with Mr. Hoffman so that the Engineer can say whether he thinks that the level of the building has a reflection on the market value. Mr. John- son said that they would be looking to see whether the conditions of the site affect either the rents or the quality of long term tenants. Mr.,Lava expressed concern that conditions are so bad that when existing leases are up, the tenants may move. He said . Mrs. S. V. Christenson, 6409 Glacier Place, objected to his estimated market value, saying that shebelieves that the property value should be no more than $125,000, Mrs. Christenson said that they purchased the property four years ago for $87,200, which price included approximately $6,000 in personal property and objected that noise from traff-ic on Gleason Road has hindered the sale of lots in the area. 6/ 9/ 80 .. 96 Mr, Ivan S. Kerr, 5704 DeVille Dr., objected to his estimated market value of $185,400, saying that the market value should be between $165,000 and $170,000. He recalled that he bought this house in 1973 or 1974 for $52,500, including personal property and said that the estimated market value established by the Assessor is not fair or equitable. Dr. Robert Jeub, 4810-12 Hilltop Lane, objected to the estimated market values on his property of $128,000 and $59,400. he obtained permission from the Council to build a two-car garage with living quarters above it, provided he agreed not to rent the living quarters to anyone other than a member of his family. Dr. Jeub said that he subsequently divided the two properties and that the space over the garage is used only for storage. He asked what action he might take to reduce taxes on the two properties. Mr. Johnson said that he had been aware of the-situation and would make a personal inspection so as to review the matter.. Mr. Ricnard Simmons, 4800 Dunberry Rd., objected to the estimated market value of $108,600, stating that the market value has increased $14,100 this year. objected that noise from T.H. 100 has decreased the value of properties in the area. He asked that noise levels be taken and that these levels be considered . in arriving at a reduced market value for his property. 1. The property ail1 be reviewed. L- A- h, City Clerk MINUTES OF THE CONTINUED MEETING OF THE EDINA BOARD OF REVIEW HELD THURSDAY, JUNE 26, 1980, AT 4:OO P.M. Answering rollcall for the continued meeting of the Board of Review were members Bredesen , Courtney, Richards , .Schmidt and Mayor Van Valkenburg. Mr. Johnson presented the objection of Bernard E. Johnsrud to the estimated market value of $88,400 on his house at 6309 Tingdale Ave., based on the fact that he has been unable to sell the house at a price near the Assessor's valu-': ation. The appeal of Mr. Leon Tichy, 7685 Parklawn Ave., was noted by the Board. Mr.. Tichy objected to the Assessor's estimated market value of $436,700, stating that he believed the market value should be $355,000, based on a July 9, 1979, sale and on an appraisal of the property showing an estimated value of $400,000. Mr. Edward Harter, 5237 Meadow Ridge, advised the Board that he would be satis- fied with the Assessor's revised estimated market value of his house at $74,000. Councilwoman Schmidt's motion was then seconded by Councilman Bredesen, authoriz- ing homesteads for Apartment Nos. 112, 212, 312, 120, 220 and 320, Edina West Homesteads, because property otjners could not live in their homes on January l., 1980, due to a December fire io the building. Councilman Richards ' motion was seconded by Councilman Courtney, accepting the Assessor's recommendation for the reduction of the estimated market value for the house at 4212 Scott Terrace, owned by Boyd Aldrich, from $81,600 to $71,000, based on the reduction of estimated market value of .a similar house at 4023 Kip- ling Ave. '!
