Present also were Mmes. Betty Carver of the Human Relations Commission, Helen McClelland of the Community Development and Planning Commission and Alison Fuhr of the Traffic Safety Committee. MINUTES of July 21, 1980, were approved as submitted by motion of Councilman Courtney, seconded by Councilman Bredesen. I Ayes: Nays: None Motion carried. Bredesen, Courtney, Richards, Van Valkenburg EDINA MASONIC LODGE NO. 343 CONTRIBUTION MADE. Presentation of a check in the amount of $1,000 was presented to the Mayor by the Edina &sonic Lodge No. 343. Council was advised that these funds had been raised by the endeavors of members of the Lodge and was to be put into the fund for the Edina Rescue Squad. Nayor expressed the appreciation of the entire City for this generous gift. The above public improvements affecting the same properties, hearings were con- ducted concurrently. Mr. Rosland presented total estimated construction cost of $41,310.55, proposed to be assessed at a rate of $.175 per square foot. estimated construction cost for Watermain Improvement No. P-IJM-340 at $43,281.02, proposed to be assessed at- $.192 per square foat. Total estimated construction cost of Grading, Graveling and Drainage Improvement $102,988.82, and proposed to be assessed at $.457 per assessable square foot. Estimate3 construction cost for P-BA-245 was given at' $51,481.'14 and proposed to be assessed against benefitted properties at the rate of $.228 per squzre foot. Mr. Hoffman reviewed the history of the property, recalling that a portion of the road is proposed to be constructed on County right-of-way and that, following discussion with the Minnesota Department of Transportation, the original price of $2.00 per square foot has been reduced to $1.65 per square foot. He recalled that these hearings had been continued from the Council Meeting of Jxly 21, 1980 and that a narrow strip of property on the North and East side of the Citizens State Bank is owned by a fourth individual with whom negotiations will probably be necessary. byCMr. Robert Hanson and the Masonic Lodge, but not by any of the other property owners. Mr. Robert Schuffelbein, representing Viking Hills Homeowners Associ- ation, properties and that there would be two cul-de-sacs, rather than one street go- ing straight thru the entire stretch of property. Mr. John Hedberg, represent- ing the Masonic Lodge, expressed support €or the projects, and said that the Lodge is concerned about the extraordinary high cost of the development but questioned what eventual use the land could be put to which would support these costs. He suggested that if the cost is too high, the improvements should be dropped until the futureiland use is known, Mr. Robert Hanson, owner of property adjacent to the Masonic Lodge, said that he favored the project as presented. He said thac he had been advised by Caldwell Banker that the only way these improve- ments could be financially feasible would be for development of 50 to 60 dwelling units on the site. He said that at one point it had been proposed to construct an office building on the site, along with twelve dwelling units per acre. Nr. Hanson emphasized that he was not making any reservations in his support of the improvements. stand on its own regardless of cost and that no representation should be made'to any potential buyer that the land could be developed with a higher density than twelve units per acre. Councilman Courtney thereupon offered the following resolution and moved its adoption as recommended by the Mayor: RESOLUTION ORDERING IMPROVENENTS The Mayor recommended that the improvements NOS. Nays: None Resolution adopted. LOT 7, MIRROR LAKES MEADOW WOOD SECOND ADDITION EDINA HIGHLANDS VARIANCES UPHELD. Mr. Hughcs recalled that the appeal from the Board of Appeals and Adjustments Decision for a lot depth variance and a front yard setback for Lot 7, Mirror Lakes Meadow Wood Second Addition Edina Highlands had been continued from the Council Meeting of July 18, 198U, so that the staff could prepare Findings, Decisions and Reasons relative to the variances for .review and decision by the Council, a copy of which is attached hereto and made a part of these Minutes. Ms. Dorothy McIntyre, 5540 Duiidee Rd. , reiterated her objections which she made at the Council Meeting of July 18, 1980. She referred to item 9, Page 4, .of the Findings, Decisions and Reasons and said that is "where our case begins and ends" and that the City is still using the wrong map after nine years. Ms. McIntyre was reminded by the Council that the lot in question had been declared a buildable lot in 1971 and that denial of the variance would con- I28 * - stitute an undue hardship which was not self imposed an&' that 'the front yard setback was influenced by the unusual setback to the West. then moved that the Council deny the appeal and affirm the decision of the Board of Appeals and Adjustments in approving the variances, including the following conditions to the variance: 1. The variance is limited to the plans presented; . 2. 3. The developer provides documentation of the required utility easement to Councilman Richards I A landscaping plan for the berm is approved by the Planning staff prior to the issuance of a building permit; allow connection to sewer and water in Dundee Road; I 4. The sewer and water connection charges are paid prior to issuance of a building permit. Motion was seconded by Councilman Courtney. Mr. Hughes presented Lots 2 and 3, Block 1, Indian Hills Thompson Replat, for lot division as recommended by the Community Development and Planning Commission and by the staff. No objections being heard, Councilman Courtney offered the following reso- lution and moved its adoption: WHEREAS, the following described tracts of land are now separate parcels: WHEREAS, the owners of the above tracts of land desire to subdivide said tracts into the following described new and separate parcels (herein called "Parcels"): RESOLUTION Lots 2 and 3, Block 1, Indian Hills Thompson Replat; and . Mr. and Mrs. E. Meszarus, 6005 Killarney Lane, objected that the City would have to hire addi- tional help to keep the parking lot clean and that people like the-park just as it is. They suggested that Edina residents could use other parks that already have adequate parking. Mr. Rosland explained that it is intended that the park would appeal to people who are interested in nature and that the parking lot would keep cars off the street. Councilman Courtney pointed out that this is a park for all residents of Edina, rather than for residents who could walk or bike to the park and said that he thought that it should be improved to a point where all interested residents would come. Mr. Keven Curry, GO64 Olinger Circle, read a statement favoring the improvements generally, but said that he is not convinced that the parking lot will not have an adverse affect on wild life. Mr. Douglas Hart, 6012. Olinger Blvd., Mrs. Robert Henry, 5841 Jeff Place, and Mr. Charles Loeper, 6008 Olinger Blvd., all expressed concern about the speed and amount of traffic already existing on Olinger Blvd. and also about the use of Olinger Blvd. by emergency vehicles. Police Chief Swanson said that he concurred with Mr Hughes that it is safer to park cars in a parking lot than on the street. Mr. Rosland said that he had asked that this matter be placed on the August 12, 1980 Traffic Safety Committee agenda for its recommendations. An unidentified lady in the audience asked that the paths by the townhouses be raised so that the paths would drain. Mr. Rosland advised an unidentified lady in the audience that the path through the park will be resurfaced where necessary as soon as weather permits. Mr. Wayne Sweet, 6356 Pheasant Court, said that he favored the entire plan, but asked that the City look at the possibility of widening Olinger Blvd. adjacent to the park entrance for parallel parking. Lane, Mr. Rosland explained that Bredesen Park would have asphalt trails only near the entrance and that the park would not be actively programmed as is the Wood Lake Nature Center. Mayor Van Valkenburg said that he thinks that the plan has a lot of merit and is of benefit to the people living in the area as well as to all Edina residents. He agreed that the parking lot on the Gleason Road side should be eliminated but expressed confidence that recommendations to alleviate potential traffic problems would be made by the Traffic Safety Committee. man Courtney then moved that the plan be approved as recommended by the Mayor, with the elimination of the parking lot on Gleason Road, and with the understand- ing that the Traffic Safety Committee make recommendations on the parking lot and on whether Olinger Blvd. should be widened to allow for parallel parking. PAUL REQUEST FOR CABLE TELEVISION FRANCHISE MORATORIUM NOTED, receiat of a resolution adopted by the City of St. Paul requesting a moratorium The Mayor noted . on cable communication franchising, along with a letter asking for support of the City. No action was taken. COUNCILMAN RICHARDS' POSITION ON CABLE TELEVISION ACTION NOTED. The Mayor called Council's attention to a letter from Councilman Richards formalizing his position of non-participation in any proceedings dealing with cable television in the City of Edina because his law firm represents one of the companies seeking the grant of franchise for the Southwest Area Cable District and/or the City of Edina. Councilman Richards' letter emphasized that, except for serving as a member of the Edina Cable TV Advisory Commission preparing and submitting the needs assess- ment to the City Council, he has not intthe past and will not in the future, participate in any discussions of, or cast any votes in any manner when this matter comes before the Edina City Council, The Clerk was instructed to reflect this letter in the record. No formal action was taken. Mr. Rosland advised Council that the City of Richfield has requested that the City of Edina construct a sidewalk on the South side of W. 66th Street as a continuation of the sidewalk in Richfield to Southdale. . Councilman Courtney thereupon offered the following resolution and moved its adoption: RESOLUTION BE IT RESOLVED that the Edina City Council does hereby concur with the City Council of the City of Richfield that a sidewalk is highly desirable on W. 66th Street between Xerxes Avenue and York Avenue; and BE IT FURTHER RESOLVED that the City of Edina will include the construction of sidewalks on the South side of W. 66th Street between Xerxes Avenue and York Avenue in its Master Sidewalk Plan.
