NOTICE OF PUBLIC HEARING ON VACATION OF PUBLIC
RIGHT-OF-WAY EASEMENT IN THE CITY OF EDINA
HENNEPIN COUNTY MINNESOTA
NOTICE IS HEREBY GIVEN
that the City Council of the City of
Edina, Minnesota will hold a public
hearing on, Tuesday, May 7, 2019
at 7:00 p.m. in the Council Cham-
bers at 4801 West 50th Street to
consider the requested vacation
of the following public right-of-way
easement:
PROPOSED DESCRIPTION
That part of the 15-foot wide
Drainage and Utility easement
which lies over, under and across
that part of Lots 1 and 2, Block
1, LINCOLN DRIVE RESIDENC-
ES, according to the recorded plat
thereof, Hennepin County, Minne-
sota, described as follows:
Commencing at the most east-
erly corner of said Lot 1; thence
North 50 degrees 53 minutes 21
seconds West, assumed bearing
along the northeast line of said Lot
1, a distance of 253.20 feet; thence
South 39 degrees 06 minutes 38
seconds West, a distance of 6.00
feet to the northeasterly line of said
Drainage and Utility easement and
the point of beginning of the tract
to be described; thence North 08
degrees 55 minutes 22 seconds
East along a northeasterly line of
said easement, a distance of 72.95
feet to an angle point in said north-
easterly line; thence North 38 de-
grees 09 minutes 59 seconds West,
continuing along said northeasterly
line, a distance of 229.60 feet to
the northwesterly line of said Lot 2;
thence southwesterly a distance of
15.01 feet along the northwesterly
line of said Lot 2, being a non-tan-
gential curve concave to the north-
west, having a radius of 333.00
feet, central angle of 2 degrees 34
minutes 57 seconds, and chord
which bears South 49 degrees 56
minutes 47 seconds West, to the
southwesterly line of said Drainage
and Utility easement; thence South
38 degrees 09 minutes 59 seconds
East, along said southwesterly line,
a distance of 222.57 feet to an an-
gle point in said southwesterly line;
thence South 08 degrees 55 min-
utes 22 seconds West, continuing
along said southwesterly line, a
distance of 75.04 feet to an angle
point in said southwesterly line;
thence South 50 degrees 53 min-
utes 22 seconds East, continuing
along said southwesterly line, a
distance of 8.63 feet; thence North
39 degrees 06 minutes 38 seconds
East, a distance of 15.00 feet to the
point of beginning.
All persons who desire to be
heard with respect to the question
of whether the above proposed
street right of way and utility and
drainage vacation is in the public
interest and should be made shall
be heard at said time and place.
The Council shall consider the
extent to which such proposed
street vacation affects existing
easements within the area of the
proposed vacation and the extent
to which the vacation affects the
authority of any person, corpora-
tion, or municipality owning or con-
trolling electric, telephone or cable
television poles and lines, gas and
sewer lines, or water pipes, mains,
and hydrants on or under the area
of the proposed vacation, to con-
tinue maintaining the same or to
enter upon such easement area or
portion thereof vacated to maintain,
repair, replace, remove, or other-
wise attend thereto, for the purpose
of specifying, in any such vacation
resolution, the extent to which any
or all of such easement, and such
authority to maintain, and to enter
upon the area of the proposed va-
cation, shall continue.
