OF THE EDINA CITY COUNCIL HELD AT CITY HALL

The kdina City Council held a closed meeting regarding potential litigation in
connection with the Rolling Green Parkway Addition plat on September 14, 1987 at
6:15 p.m. at Edina City Hall.
Present were Members Kelly, Smith, Turner and Mayor Courtney.
Also in attendance were Assistant Manager Hughes, Planner Larsen, Attorney
Erickson and Clerk Daehn.
Assistant Manager Hughes advised the Council that both the proponent and the
neighbors in Rolling Green have said they intend to file.lawsuits against the City
in connection with the proposed plat of Rolling Green Parkway Addition.
Larsen gave an update on the position of the prop'onent, Charles Luther, and the
objections presented by the neighbors.

Attorney Erickson advised as to the time and manner of decision for the Council.
He said action would be by resolution either for or against plat approval.
recommended that prior to final Council action staff be directed to prepare
Finqings, Decision and Reasons for review by the Council at a date certain in
support of the Council's decision. He then advised the Council as to the City's
legal position in defense of the potential suits.
possibility of imposing larger than normal sideyard setback requirements for the
proposed lots by means of private covenant.
No formal action was taken and no other business was discussed by the.Counci1.
