Gentlemen:
In your letter of April 18, 1952, you enclosed a storm
sewer easement covering part of Lot Five (5), Block Nine (9),
Golf Terrace Heights,, signed by Ann Porter Smith. We have checked
the courthouse records and find that Ann Porter Smith is married
to one Gerald M. Smith, who should join in the grant of this ease-
ment* We return herewith the aforesaid easement for completion.

EASEMENT
ViEREAS, The undersigned, Ann Porter Smith and Gerald M. Smith,
husband and wife, are the owners of the premises hereinafter described,
situated in the Village of Edina, County of Hennepin, State of Minnesota;
and
WHEREAS, Said premises are within what is known as "Colonial Grove
Golf Terrace, Storm Sewer District No. 1911, heretofore created in said
Village and with others, the undersigned are desirous of having said
sewer line constructed and thereafter maintained for the service of their

NOK, THEREFORE, In consideration of the premises and of the sum of
One Dollar ($1.00), to them in hand paid, the receipt whereof is hereby
acknowledged,(the undersigned hereby give and grant unto the Village of
Edina, a municipal corporation organized and existing under the laws of
the State of Minnesota, a perpetual easement five (5) feet in width and
of the necessary depth for the construction, installation, operation,
maintenance and repair of a storm sewer in, under and upon the following
described premises:
A perpetual easement across the Southwesterly 5 feet, front and
rear, of all that part of Lot Five (5), Block Nine (9), Golf
Terrace Heights, lying Northeasterly of a line drawn parallel
with and 40 feet distant Northeasterly- measured at right angles
to the Southwesterly line of said Lot Five (5), according to the
map or plat thereof on file and of record in the office of the
Register of Deeds in and for Hennepin County, Minnesota, and of
the necessary depth for the construction, installation, operation,
maintenance and repair of a storm sewer in, under and upon the
above described 5 foot strip.
It is understood that said sewer will be constructed and thereafter
maintained within the easement limits as above described, and that the
surface of the area will be replaced in the condition that existed before
said sewer was constructed, maintained, or repaired, including any necessary
grading, landscaping, sodding or other repairs made necessary by the installa-
tion and operation of the storm sewer.
