An easement in and over a strip of land ten (10) feet in width, five
(5) feet on each side of a line extending ten (10) feet westerly
from and parallel to the easterly line of Lot Twelve (12), Block
Eleven (11), Browndale Park, said line extending from the front of
said lot to a point ten (10) feet along said line southerly from the
northerly line of said lot and thence northeasterly to the northeast
corner of said lot, according to the plat thereof on file and of
record in the office of the Register of Deeds of said Hennepin
County, Yinnesota, said easement being more particularly described
as the free right to enter upon said premises, excavate the soil and
construct and install therein a storm sewer, to replace the excavated
soil and maintain said sevier forever, with sufficient soil above the
same to prevent the freezing of liquids therein, for the passage and
drainage of storm and surface water, including the right to enter upon
said premises at all reasonable times for the purpose of repairing,
cleaning and maintaining the said sewer, including also the right to
construct manholes as shown on plans and specifications for said
sewer on file in the office of the Engineer of said Village.
It is understood that party of the second part will restore the
surface of the soil where excavated as nearly as possible to its
condition before such excavation promptly after the work is completed.
