1. Quit Claim Deed, Document No. 2890981
filed for Record August 13, 1954 at 11 :10 A.M.
in Book 2008 of Deeds, page 507 etc., dated
August 4, 1954, between George W. Frey, Jr. and
Nancy Frey, husband and wife, grantors, and
Village of Ldina, grantee, covering the Southeast
corner of Lot 1, Block 2, Edina Park Addition;
thence Northeast to a point on the North line
of Lot 1, said point being 246.4 feet East of
the Northwest corner of said Lot 1; thence South
at right angles to the North line of Lot 1, to
intersect the curve which forms the East line
of said Lot 1; thence in a southwesterly direc-
tion along the East line of said lot to the
point of beginning.
2. Warranty Deed, Document No. 2890979
filed for record August 13, 1954, at 11 :10 A.M.
in Book 2008 of Deeds, page 506 etc., dated
July 23, 1954, between Victor Hugo Adams and
Florence May Adams, husband and wife, grantors,
and Village of Edina, grantee, covering an easement
for the construction, repair and maintenance of a
storm sewer over and upon the West 5 feet of the
following described tract of land, to wit: The
East 172 feet of the North 1/2 of Lot 36, Auditorts
Subdivision 172, Hennepin County, Minnesota.

On condition that the grantee herein, by the acceptance
and use of said easement, shall thereby be deemed to
covenant to the drantors, their heirs, representatives
and assigns, that it will indemnify the grantors or their
successors in interest for any loss or damage resulting
to any portion of the above described tract of land,
other than the portion covered by this easement, or to
any buildings or structures on said tract of land,
other than the portion covered by this easement, arising
out of theuse by grantee of said easement, and the Grantee
herein further covenants that it shall in the construction,
maintenance and repair of said storm sewer, replace the
surface of the ground to as nearly as possible the same
condition as existed prior to such construction, maintenance or

second part shall, in the maintenance and repair of said sewer, agd
in case of excavation for such maintenance and repair, replace the
surface after such excavation, repair and maintenance work wa:said

The parties of the first part hereby covenant and warrant that
- they have good title to said real estate and that they will warrant
and defend the said easement and the enjoyment in use thereof to the
party of the second part; and the parties of the first part make
that warranty for themselves, their heirs and assigns forever.
