Gentlemen:
On December 3, 1953, under Document No. 2848659, we
filed in the office of the Register of Deeds, Hennepin County,
Minnesota, a quit claim deed running from Village of Edina to
Glacier Sand and Gravel Company, Inc., covering a 20 foot strip
of land over the NW-31 of Section 32, Township 28, Range 24,
Hennepin County. The deed as recorded merely conveyed back to
Glacier the easement which the Village had theretofore acquired
from Glacier as recorded in Book 1976 of Deeds, page 574, Docu-
ment No. 2840330. The next day, December 4, 1953, under Document
No. 2849084, we filed in the office of the Register of Deeds.,
Hennepin County, an easement for utilities running from Glacier
to the Village covering a 20 foot strip of land for sanitary trunk
sewer purposes over a somewhat different portion of the same
NWi of the same Section 32.
Part of the property over which the easement runs is
Torrens property (registered), but there is no indication or
evidence in the office of the Registrar of Titles, Hennepin County,
Minnesota, that Glacier Sand and Gravel Company, Inc., holds title
to such property, The reason is that Glacier by mistake filed the
deed by which it acquired such property in the office of the
Register of Deeds instead of in the office of the Registrar. of
Titles. It is necessary, therefore, that Glacier now get its
deed to such property recorded in the office of the Registrar of
Titles so that the 20 foot easement of the Village may be entered
on the certificate of title as a memorial. This should be done
before January 1, 19532 since after that date taxes once more
become due, and no transfers of interests in property may be

filed until stamped by the treasurer and auditor of Hennepin County
to the effect that taxes are paid. Therefore-,.we suggest that steps
be taken by the Village as soon as possible to see that Glacier pro-
ceeds or is proceeding to get its deed recorded in the proper office.

do not hesitate to call either Mr. Virgil Hill of this office or
the writer of this letter.

It is the intention and agreement of the Parties hereto that the party of the
