We have now received and enclose herewith the following
recorded instruments:
1. Quit claim deed dated October 9, 1953, from Dayton
Brothers, a general copartnership, to Village of Edina, covering
part of the SW4 of Section 29, Township 28, Range 24, which deed
was filed in the office of the Register of Deeds on October 28,
1953, and was recorded in Book 1977 of Deeds, page 490, as Docu-
ment No. 2811697,
2. Easement for Utilities dated October 8, 1953, be-
tween J. Frank Ecklund and wife and Parke D. Robinson and wife,
and Village of Edina, covering part of Lot 43, Auditor's Subdivi-
sion Number 172, Hennepin County, Minnesota, which easement was
filed in the office of the Register of Deeds on October 28, 1953,
and was recorded in Book _19.77 -of Deeds., page ..49.2, , as Document No.
2841695. .
The easement from Dayton Brothers to the Village for
watermain from pumping station to Southdale First Addition has been
recorded in Book 1977 of Deeds, page 85, and now will be registered
in the torrens office inasmuch as part of the property is torrens.
An additional part is abstract property which is in the process of
being torrensed, and we want to make certain that the new certifi-
cate issued in that proceeding will show this easement. There will
be no recorded deed to return to your files so your files should
probably be marked accordingly.

EASEMENT FOR UTILITIES
THIS INSTMJMENT, Made this 9th day of October , 19530 t'y and between
Dayton Brothers, a general copartnership consisting of Donald C. Dayton,
Bruce B. Dayton, Wallace C. Dayton, Kenneth X. Dayton and Douglas J. Dayton,
of the County of Hennepin and State of Minnesota, parties of the first part,
and the Village of .Edina, a municipal corporation of the County of Hennepin
and State of Minnesota, party* of the second part;
WITNESSETH, That the said parties of the first part, in consideration
of One and no/144 (1.04) Dollars, to them in hand paid by the said party of the
second part, the receipt whereof is hereby acknowledged, do grant, bargain, sell
and convey to said party of the second part an easement for the purposes herein-
after set forth, in and over the following described property situated in the
Village of Mina, County of Hennepin and State of Minnesota, to wits
A strip of land Twenty (24) feet in width, the centerline
of which begins at a point Six Hundred Fifty -mine and Four
tenths (659.4) feet North (N) and One Hundred Twenty (120)
feet last (E) of the Southwest (STS) corner of Section 290
Township 28, Range 24, running thence West (W) Eighty - seven
(87) feet to the Bast (E) right -of -way line of France Avenue,
continuing Est (W) Two Hundred Fifty (254) feet distant on
said centerline from a point on the West (W) right -of -way
line of France Avenue to an angle point; thence Borth - westerly
(NW) Two Hundred Eighty (283) feet to the Baster]y (E) and of
a line between Lots ll and 12, Block 4, Southdale First Addition.
For Watermain from pump station to Southdale First Addition.
It is the intention and agreement of the parties hereto that the party
of the second part shall in the construction, or maintenance of said utilities,
replace the surface after any excavation in connection with such construction
or maintenance work, in as nearly as possible the same condition as before such
excavation.
The duration of this easement shall.be perpetual.
The parties of the first part hereby covenant and warrant that they
have good title to said real estate and that they will Warrant and Defend the
said easement and the enjoyment in use thereof to the party of the second part;
and the parties of the first part make that warranty for themselv*ss, themselves their heirs
and assigns forever.
